PRESENTER: Chief John Golden
SUBJECT: Annual Agreement with Madera Police Department for use of Kerman Police Department’s Firearms Range Facility (JG)
RECOMMENDATION: Council by motion adopt resolution approving agreement with Madera Police Department for use of Kerman Police Department’s Firearms Range Facility.
EXECUTIVE SUMMARY:
The Kerman Police Department has a firearms range facility which is located to the rear of 15485 W. Church Avenue, Kerman. This facility is used monthly by the Kerman Police Department to train officers in the use of handguns, shotguns, and rifles. Historically, the Kerman Police Department has allowed other law enforcement agencies to use the facility when needed. Madera Police Department previously asked for, and permission was granted to use the range facility and Chief Golden has requested that we approve this year’s agreement between the two entities.
DISCUSSION:
Madera Police Department has used the Kerman PD range facility for many years for their normal firing range needs.
Historically, several different agencies including Madera Police Department and the Fresno Sheriff’s Office have used the Kerman Police Department’s range facility for firearms training on an as-needed basis. In the past, there have not been any formal agreements between the Kerman Police Department and other agencies using the range.
Madera PD regularly uses the range facility and this agreement defines the roles and responsibilities for the City of Madera. Madera Police Department will provide their own supplies and materials needed for their training. Madera Police Department will clean the range area of any debris, trash, or materials when they complete their training. Madera Police Department will coordinate all training dates and times with the Kerman Police Department.
The Madera Police Department will annually provide proof to the City of Kerman of their liability insurance. The Kerman City Attorney has drafted the proposed agreement. The Resolution authorizes the City Manager to execute the Agreement and extend it annually at the pleasure of the City upon recommendation by Chief of Police 28 Section 5, Item F.

EXECUTIVE SUMMARY:
The City of Kerman completed a Water and Wastewater study in 2018 with rate schedules through December 31, 2023.

STAFF REPORT
MEETING DATE: June 14, 2023
PRESENTER: Jesus R. Orozco, Community Development Director SUBJECT: Public Hearing Ordinances Relating to Expedited Permit Process for Electrical Vehicle Charging Stations, Repeal of Current Ordinance and Consideration of New Ordinance (JRO)
RECOMMENDATIONS:
1. City Council conduct a public hearing, waive full reading, and introduce Ordinance Text Amendment 2023-01 repealing Chapter 17.98 related to expedited permit process for electrical vehicle charging stations from Title 17 of the Kerman Municipal Code; and
2. City Council conduct a public hearing, waive full reading, and introduce Ordinance Text Amendment 2023-02 adding Chapter 15.22 to Title 15 of the Kerman Municipal Code relating to Expedited Permit Process for Electrical Vehicle Charging Stations EXECUTIVE SUMMARY:
The proposed ordinance text amendments (OTA 2023-01 & OTA 2023-02) attached are Cityinitiated amendments. OTA 2023-01 will repeal Chapter 17.98 from Title 17 which was adopted in 2017 by Ordinance No 17-04, to ensure compliance with Government Code Section 65850.7 as part of Assembly Bill 1236. Chapter 17.98 is specific to the expedited permit processing of electrical vehicle charging stations wherein the Building Official is the implementing officer.
Though Chapter 17.98 is being repealed, existing language will be updated and transitioned appropriately into Title 15, the Buildings and Construction Code as part of OTA 2023-02.
Repealing Chapter 17.98 will not result in conflict with any other ordinance, chapter, or section of the Kerman Municipal Code (KMC). The Planning Commission held a public hearing on May 8, 2023 to consider OTA 2023-01 and approved the attached (Attachment 3) resolution consistent with 17.26.040 of the KMC. This will allow existing language to be transitioned into Chapter 15.22 alongside required updates consistent with Cal. Gov't Code § 65850.7 and § 65850.71. OTA 2023-02 includes language for the application and reviewing process, definitions clearly defining new electric vehicle terms, and electric vehicle parking requirements.
ANALYSIS:
Background
Assembly Bill 1236 amended Government Code Section 65850.7 to require jurisdictions with a population less than 200,000 residents to establish procedures for expedited, streamlined processes for permitting of electric vehicle charging stations. Additionally, Assembly Bill 970, requires local agencies, including charter cities, to deem an application complete and approved 54 Section 6, Item A.
within a certain timeframe if all requirements are met. The amendments to Section 65850.7 include the requirement for a jurisdiction to adopt an ordinance for the expedited, streamlined process. The ordinance requires that a jurisdiction adopt a checklist of requirements with which a permit application for an electric vehicle charging station will be eligible for expedited review.
Said checklist (Attachment 4) has been prepared by the Building Official and will be updated as deemed necessary.
General Plan Consistency
The City of Kerman’s 2040 General Plan Conservation, Open Space, Parks and Recreation Element guides the city’s long-range growth and development policy; it establishes citywide standards, goals, and policies, implemented through the City’s municipal code and other pertinent programs. OTA 2023-02 is consistent with General Plan Goal COS-5, which encourages minimizing “energy consumption and reducing greenhouse gas emission as part of the statewide effort to combat climate change”. Furthermore, OTA 2023-02 will directly and indirectly address Policy COS-5.3 (Sustainable Building Practice), COS-5.4 (Renewable Energy Features in New Projects), and COS-5.6 (Electric Vehicle Charging). The OTA will not create any inconsistencies with the General Plan.
Zoning Ordinance Consistency
As previously noted in this report, the ordinance related to Expedited Permit Process for Electrical Vehicle Charging Stations, consistent with Government Code § 65850.7, was originally adopted under Chapter 17.98, Title 17 (Zoning Code). However, “since review of the application to install an electric vehicle charging station shall be limited to the building official's review…”, staff has recommended existing language in concurrence with updated language as required by Government Code § 65850.71 be transitioned into Title 15 (Building and Construction Code) of the Kerman Municipal Code via OTA 2023-02. Procedurally, OTA 2023-01 will prevent inconsistencies with the Zoning Ordinance.
ENVIRONMENTAL REVIEW:
A preliminary environmental assessment has been performed for this project pursuant to the California Environmental and Quality Act (CEQA). There are findings to determine with certainty that, pursuant to CEQA Guidelines Section 15061(b)(3), there is no possibility that this project may have a significant, adverse, impact on the environment. This is because this project involves purely procedural policies with no impacts on the environment. Therefore, this project is not subject to CEQA.
FISCAL IMPACT:
None.

Consistent with Government Code Section 65850.7 and Section 65850.71, the building official shall implement an expedited, streamlined permitting process for electric vehicle charging stations and adopt a checklist of all requirements which electric vehicle charging stations shall comply with in order to be eligible for expedited review. The expedited, streamlined permitting process and checklist may refer to the recommendations contained in the most current version of the "PlugIn Electric Vehicle Infrastructure Permitting Checklist" of the "Zero Emission Vehicles in California: Community Readiness Guidebook" as published by the Governor’s Office of Planning and Research. The city’s adopted checklist shall be published on the city’s website.
B. Permit Application Processing
1. Prior to submitting an application for processing, the applicant shall verify that the installation of an electric vehicle charging station will not have specific, adverse impacts to public health and safety and building occupants. Verification by the applicant includes but is not limited to: electrical system capacity and loads; electrical system wiring, bonding and overcurrent protection; building infrastructure affected by charging station equipment and associated conduits; areas of charging station equipment; and vehicle parking.
2. The Building Official shall implement an administrative review process to expedite approval of electric vehicle charging stations. Review of a complete permit application shall be limited to the Building Official's review of whether it meets all health and safety requirements of local, state and federal law. Local law requirements shall be limited to those standards and regulations necessary to ensure there is no specific, adverse impact on public health or safety by the proposed installation.
3. A permit application that satisfies the information requirements in the City’s adopted checklist shall be deemed complete and be promptly processed. Upon confirmation by the Building Official that the permit application and supporting documents meets the requirements of the City adopted checklist and is consistent with all applicable laws and health and safety standards, the Building Official shall, consistent with Government Code Section 65850.7 and 65850.71, approve the application and issue all necessary permits.
Such approval does not authorize an applicant to energize or utilize the electric vehicle charging station until approval is granted by the City. If the Building Official determines that the permit application is incomplete, he or she shall issue a written correction notice 59 Section 6, Item A.
to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance.
4. Consistent with Government Code Section 65850.7, the Building Official shall allow for electronic submittal of permit applications covered by this chapter and associated supporting documentation. In accepting such permit applications, the building official shall also accept electronic signatures on all forms, applications and other documentation in lieu of a wet signature by any applicant.
C. Technical Review
1. The permitting requirements in this chapter do not supersede the building official’s authority to address higher priority life-safety situations. The building official may deny an application to install an electric vehicle charging station only if the building official makes written findings based upon substantial evidence in the record that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact. The findings shall include the basis for the rejection of potential feasible alternatives of preventing the adverse impact. The decision of the building official to deny an application to install an electric vehicle charging station may be appealed to the planning commission.
2. The city shall not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association.
D. Electrical Vehicle Charging Station Installation Requirements
1. Electric vehicle charging station equipment shall meet the requirements of the California Electrical Code, the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing laboratories such as Underwriters Laboratories, and rules of the Public Utilities Commission or a municipal electric utility company regarding safety and reliability.
2. Installation of electric vehicle charging stations and associated wiring, bonding disconnecting means and overcurrent protective devices shall meet the requirements of Article 625 and all applicable provisions of the California Electrical Code.
3. Installation of electric vehicle charging stations shall be incorporated into the load calculations of all new or existing electrical services and shall meet the requirements of the California Electrical Code. Electric vehicle charging equipment shall be considered a continuous load.
4. Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations shall meet the requirements of the California Building or Residential Code as applicable 60 Section 6, Item A.
per occupancy, and the provisions of the manufacturer’s installation instructions. Mounting of charging stations shall not adversely affect building elements.
5. All electric vehicle charging stations shall meet all applicable health and safety standards and requirements, including but not limited to any requirements imposed by the state and the City, local fire department and utility director, the California Building Code, City of Kerman Municipal Code, and Federal laws including the Americans with Disabilities Act.
6. It is the intent of this Ordinance to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations so long as the action does not supersede the Building Official’s authority to address higher priority life-safety situations. If the Building Official makes a finding based on substantial evidence that the electric vehicle charging station could have a specific adverse impact upon the public health or safety, as defined in this Chapter, the City may require the applicant to apply for a use permit.
7. In the technical review of a charging station, consistent with Government Code Sections 65850.7 and 65850.71, the Building Official shall not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association, as that term is defined by Civil Code Section 4080.
