MEETING DATE: June 28, 2023
PRESENTER: Josefina Alvarez, Finance Director
SUBJECT: Approval of Project List for Fiscal Year 2023/2024 Funded by SB-1-The Road Repair and Accountability Act of 2017 (JA)
RECOMMENDATION: Council by motion adopt resolution approving project list for Fiscal Year 2023/2024 funded by SB1-The Road Repair and Accountability Act of 2017.
EXECUTIVE SUMMARY:
Senate Bill 1 (SB1), known as the Road Repair and Accountability Act of 2017, was signed into law by the Governor in April 2017 to address basic road maintenance, rehabilitation and critical safety needs on both the state highway, local streets and road systems.
To receive funding from the Road Maintenance and Rehabilitation Act (RMRA), the City is required to submit to the California Transportation Commission (CTC) a list of projects proposed to be funded with these funds pursuant to an adopted resolution by the City Council at a regular public meeting.
Based on Maintenance of Effort (MOE) established in Streets and Highways Code Section 2036, an annual match of $20,200 (minimum) from the City's discretionary spending is required. The purchase and installation of the Solar Light Poles Project on the East side has been designated for the use of the MOE for Fiscal Year 2019/2020, Fiscal Year 2020/2021, Fiscal Year 2021/2022, Fiscal Year 2022/2023 and for Fiscal Year 2023/2024.
The Street Rehabilitation Project FY 21/22 and 22/23 will continue into Fiscal Year 2023/2024.
The total project cost for this fiscal year is $1,420,871. Funds from both SB1 and Article VIII will be used to fund this project.
Annually in December, the City must submit a completed and an in-progress project report. If this report is not submitted, the RMRA funds will be forfeited.
FISCAL IMPACT:
The City of Kerman projects to receive a total of $411,320 from SB1 RMRA Funds in Fiscal Year 2023/2024, according to the State Department of Finance statewide revenue projection. Fund reserves or Local Transportation Funds (LTF) will fund this project, if needed.

2. The Building Official shall implement an administrative review process to expedite approval of electric vehicle charging stations. Review of a complete permit application shall be limited to the Building Official's review of whether it meets all health and safety requirements of local, state and federal law. Local law requirements shall be limited to those standards and regulations necessary to ensure there is no specific, adverse impact on public health or safety by the proposed installation.
3. A permit application that satisfies the information requirements in the City’s adopted checklist shall be deemed complete and be promptly processed. Upon confirmation by the Building Official that the permit application and supporting documents meets the requirements of the City adopted checklist and is consistent with all applicable laws and health and safety standards, the Building Official shall, consistent with Government Code Section 65850.7 and 65850.71, approve the application and issue all necessary permits.
Such approval does not authorize an applicant to energize or utilize the electric vehicle charging station until approval is granted by the City. If the Building Official determines that the permit application is incomplete, he or she shall issue a written correction notice 37 Section 5, Item E.
to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance.
4. Consistent with Government Code Section 65850.7, the Building Official shall allow for electronic submittal of permit applications covered by this chapter and associated supporting documentation. In accepting such permit applications, the building official shall also accept electronic signatures on all forms, applications and other documentation in lieu of a wet signature by any applicant.
C. Technical Review
1. The permitting requirements in this chapter do not supersede the building official’s authority to address higher priority life-safety situations. The building official may deny an application to install an electric vehicle charging station only if the building official makes written findings based upon substantial evidence in the record that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact. The findings shall include the basis for the rejection of potential feasible alternatives of preventing the adverse impact. The decision of the building official to deny an application to install an electric vehicle charging station may be appealed to the planning commission.
2. The city shall not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association.
D. Electrical Vehicle Charging Station Installation Requirements
1. Electric vehicle charging station equipment shall meet the requirements of the California Electrical Code, the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing laboratories such as Underwriters Laboratories, and rules of the Public Utilities Commission or a municipal electric utility company regarding safety and reliability.
2. Installation of electric vehicle charging stations and associated wiring, bonding disconnecting means and overcurrent protective devices shall meet the requirements of Article 625 and all applicable provisions of the California Electrical Code.
3. Installation of electric vehicle charging stations shall be incorporated into the load calculations of all new or existing electrical services and shall meet the requirements of the California Electrical Code. Electric vehicle charging equipment shall be considered a continuous load.
4. Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations shall meet the requirements of the California Building or Residential Code as applicable 38 Section 5, Item E.
per occupancy, and the provisions of the manufacturer’s installation instructions. Mounting of charging stations shall not adversely affect building elements.
5. All electric vehicle charging stations shall meet all applicable health and safety standards and requirements, including but not limited to any requirements imposed by the state and the City, local fire department and utility director, the California Building Code, City of Kerman Municipal Code, and Federal laws including the Americans with Disabilities Act.
6. It is the intent of this Ordinance to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations so long as the action does not supersede the Building Official’s authority to address higher priority life-safety situations. If the Building Official makes a finding based on substantial evidence that the electric vehicle charging station could have a specific adverse impact upon the public health or safety, as defined in this Chapter, the City may require the applicant to apply for a use permit.
7. In the technical review of a charging station, consistent with Government Code Sections 65850.7 and 65850.71, the Building Official shall not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association, as that term is defined by Civil Code Section 4080.

SUBJECT: Updated Residential Water Service – Reconnection Fee/Service Fee for Non-Payment of Water Service (JA)
RECOMMENDATION: Council by motion approve resolution adopting reconnection fee/service fee for non-payment of water service effective July 1, 2023.
EXECUTIVE SUMMARY
The City maintains a Water Shutoff Policy for Non-Payment of Residential Water Service. However, in compliance with an Executive Order of the State of California, the City of Kerman enacted a moratorium on the termination of residential water service for non-payment during the COVID-19 pandemic. As water shutoffs for non-payment resume, staff recommends adopting an updated reconnection/service fee for non-payment of water service. If adopted, the updated fee will be effective July 1, 2023, and incorporated into the City’s Schedule of User and Regulatory Fees.
A public hearing notice has been published in the Kerman News and on our City website.
BACKGROUND
The fee is intended to maintain compliance with regulations imposed by the State of California relating to the termination of water utility services adopted via Senate Bill 998 (2017- 2018 Session), amending provisions of the California Health and Safety Code Sections 116900 through 116926, entitled the Water Shutoff Protection Act.
Additionally, the proposed fee is intended to comply with applicable federal, state and local laws including providing confirmation that the proposed fee/charge is not a tax as defined in Article 13C of the California Constitution and that the proposed fee/charge is no more than necessary to cover the reasonable costs of the City’s activities and services addressed in the fee. Additionally, the manner in which the costs are allocated to a payor bear a fair and reasonable relationship to the payor’s burdens on, or benefits received from the activities and services provided by the City.
Current and Proposed Fee
The City’s current Reconnection/Service Fee for Non-Payment of Residential Water Service is $15. This is significantly less than the City’s cost of service. The proposed Reconnection/Service Fee for fee Non-Payment of Residential Water Service is:
o For Reconnection/Service Provided During Regular Business Hours: $50 o For Reconnection/Service Provided During Non-Business Hours: $150 57 Section 6, Item A.

FISCAL IMPACT:
Additional revenues expected from any fee collections are intended to offset the cost of providing existing services associated with those fee-related regulatory functions. Additional fee revenue is not intended to fund new services. Fairly allocating costs to the services provided and recovering some, or all, of these costs from service recipients creates value and predictability for City customers and reimburses the City for services provided to a single party, as compared to the public at large.

STAFF REPORT
MEETING DATE: June 28, 2023
PRESENTER: Jerry Jones, City Engineer
SUBJECT: Resolution of Intention to Levy and Collect the Annual Assessments for Landscape and Lighting District No. 1 (JJ)
RECOMMENDATION: Council by motion adopt resolution of intention to levy and collect the annual assessments for Landscape and Lighting District No. 1 and set the date for the required public hearing for July 26, 2023.
EXECUTIVE SUMMARY:
The Landscape and Lighting District (LLD) No. 1 maintains public landscaping in median islands and landscape strips along major streets. The revenue from the district also pays for street lighting costs for areas within the LLD. All new developments are annexed into the LLD and charged an annual assessment that is collected with property taxes. There are currently 13 subareas within the LLD. No new annexations took place this past year.
This is the second of three actions by Council required by State law for the levy of the annual assessments. Council previously initiated proceedings for the annual levy of assessments at the April 26, 2023 Council Meeting. The City Engineer has prepared a preliminary report labeled Engineer’s Report of the City of Kerman Landscaping and Lighting District No. 1 (LLD), dated June 2023, and filed the report with the City Clerk. The report includes descriptions of the improvements maintained, boundaries of the district and sub-areas, and proposed assessments per parcel. The final report will be submitted for approval at the time of the public hearing. The next, and final, action required by Council will be to conduct the required public hearing, receive any testimony, and confirm the annual assessments. The assessment roll is then submitted to the County Assessor for inclusion on the property owner’s tax bill.
FISCAL IMPACT:
The annual assessments from Landscape and Lighting District No. 1 are used for maintenance of public landscaping and street lighting. The assessments for Sub-areas 1 through 5 were established prior to the passage of Proposition 218 and therefore cannot be raised without a vote of the property owners. The assessments for Sub-areas 6 through 12 are adjusted annually by the change in the Consumer Price Index (CPI). For 2022, there was an increase in the CPI of
8.0%. The estimated total assessments for FY 23-24 are $380,801.76. The exact amount of total assessments will be known once the City receives the property roll from the Fresno County Assessor’s Office.
