STAFF REPORT
MEETING DATE: July 26, 2023
PRESENTER: Jerry Jones, City Engineer
SUBJECT: Award of Contract for the Hart Ranch Community Park Phase II Orchard Removal to JFS Enterprises, Inc.
RECOMMENDATION: Council by motion adopt the resolution awarding the contract for the Hart Ranch Community Park Phase II Orchard Removal to JFS Enterprises, Inc. in the amount of $45,000.00 and authorize the City Manager to sign the contract.
EXECUTIVE SUMMARY:
Hart Ranch Community Park, formerly referred to as Eastside Community Park, will be located at the northeast corner of Goldenrod Avenue and California Avenue. The first phase of the development of the Park will consist of the westerly 15 acres. This area has been cleared of the plum orchard that previously occupied it. The City has also purchased an additional 10 acres adjacent to, and immediately east of the first 15 acres. The subject 10 acres currently is occupied by a plum orchard that has been farmed in prior years by the previous property owner, through a lease with the City. The City would like to clear the plum orchard to provide for easier upkeep of the property. The City requested bids for the orchard removal in January 2023 in accordance with the City’s Purchasing System. Bids were received from six contractors and they are as follows:
Contractor Base Bid
Integrity Arborist & Ecoscape, Inc. $25,000.00
JFS Enterprises, Inc. $45,000.00*
Marco A. Gonzalez Engineering Inc. $45,000.00
GCB1 Inc. $48,750.00
HD Matthews $49,745.00
Bowen Engineering & Environmental $71,000.00
*See Fiscal Impact Section
Upon reviewing the bids received, Staff was concerned with the low bid submitted from Integrity Arborist & Ecoscape being so much lower than the others. Staff reached out to Integrity Arborist to confirm that they had a clear understanding of the scope of work to be performed, which they said they did, and to request references to confirm their familiarty with this type of work. Once received, Staff was able to make contact with two of the three references provided. Both references stated that Integrity Arborist provides tree trimming and 43 Section 5, Item E.
removal, as well as landscape maintenance for commercial and residential (multi-family) properties that they manage. Although Integrity Arborist does provide tree removal, it appears that it is only for individual trees of an urban nature (i.e. shade trees, street trees, decorative trees, etc.). The type of work they provide, per their references, is quite a bit different than the required orchard removal scope of work, and Staff was not provided with any further references to show that they have performed orchard removal or similar work in the past.
In accordance with the California Public Contract Code, projects of $60,000 or less may be performed by City employees by force account, by negotiated contract, or by purchase order.
Although no informal or formal bidding process is required under the Public Contract Code, the City’s Purchasing System (specifically KMC Section 3.20.050-060) requires that an informal bidding process be used for projects of $30,001 or higher, except that the City is not required to award to the lowest bidder as other factors may be considered, including cost, experience/ability, and quality of past performance. Based on this, Staff is recommending award of the contract to the second lowest bidder, JFS Enterprises, due to the following:
1. Integrity Arborist & Ecoscape has not provided any information to document experience with the type of work required by this Project; and
2. The City has no past experience with Integrity Arborist & Ecoscape and thus no first hand knowledge of their ability to perform, or quality of work; and
3. JFS Enterprises performed the orchard clearing for the 15 acres (to be developed as initial phase of Hart Ranch Park) immediately adjacent to the subject 10 acres, and the City is satisfied with their performance.
FISCAL IMPACT:
JFS Enterprises’ submitted bid was in the amount of $42,000. Since some time has went by since bids were submitted, Staff contacted JFS to see if they were still interested in performing the work. They indicated that the are still interested, but need to increase their quoted amount by $3,000, for a total of $45,000 due to rising costs. The orchard removal will be funded with Measure M funds.

MEETING DATE: July 26, 2023
PRESENTER: Jerry Jones, City Engineer
SUBJECT: Public Hearing and Approval of Resolution Confirming Diagram and Assessments for the Annual Levy, 2023-2024, for Landscaping and Lighting District No. 1 (JJ) RECOMMENDATION: Council conduct a public hearing, receive public testimony, and adopt resolution confirming the diagram and assessments for Landscaping and Lighting District No. 1 for the 2023-2024 annual levy in the amounts specified.
EXECUTIVE SUMMARY:
The Landscape and Lighting District (LLD) No. 1 maintains public landscaping in median islands and landscape strips along major streets. The revenue from the district also pays for street lighting costs for areas within the LLD. All new developments are annexed into the LLD and charged an annual assessment that is collected with property taxes. There are currently 13 sub-areas, with a total of 2,157 properties, within the LLD. No new annexations took place this past year.
The Landscape and Lighting Act of 1972 requires that certain actions be completed by Council prior to levying assessments upon properties within Kerman's Landscaping and Lighting District No. 1 (LLD). Council has previously adopted resolutions for initiation of proceedings and intention to levy and collect assessments. The final action required of Council is to conduct a public hearing to consider protests to the proposed assessments and to confirm the diagram and assessments. The Engineer’s Report, dated June 2023, for the LLD is on file with the City Clerk and contains descriptions of the improvements maintained, boundaries of the district and sub-areas, and proposed assessments per parcel. A map showing the boundaries of the assessment areas is included as Attachment ‘B’.
FISCAL IMPACT:
The annual assessments from Landscape and Lighting District No. 1 are used for maintenance of public landscaping and street lighting. The assessments for Sub-areas 1 through 5 were established prior to the passage of Proposition 218 and therefore cannot be raised without a vote of the property owners. The assessments for Sub-areas 6 through 12 are adjusted annually by the change in the Consumer Price Index (CPI). For 2022, there was an increase in the CPI of 8.0%. The assessment for each property within the LLD for FY 23-24 are included in the Engineer’s Report on file with the City Clerk. The proposed total assessments for FY 23-24 are $380,801.76.

4. The Council hereby orders the levy of the assessments described in said Resolution of Intention and the Engineer's Report.
5. The assessment diagram showing the assessment district referred to in said Resolution of Intention and also the subdivisions of land within the District, as contained in said Engineer's Report, is the diagram of the properties that are to be assessed to pay the District costs.
49 Section 6, Item A.
6. The City Clerk shall file the diagram and assessment, as confirmed, or a certified copy thereof, with the Recorder of the County of Fresno and all assessment information required by the County Auditor to the Auditor's office no later than August 10, 2023, or as otherwise directed by the County Auditor.
BE IT FURTHER RESOLVED THEREFORE, that the City Council of the City of Kerman finds as follows:
1. That the assessment imposed hereby is an assessment imposed exclusively to finance the costs of maintenance and operation of public street landscaping and street lighting and integral portions of each of the above-described facilities;
2. Tract No. 6293 Railroad
Crossing Improvements
Update
BACKGROUND
Planning Commission approved Tract
6293 in December 2020
Located at southeast corner of Siskiyou
Avenue and California Avenue
As a Condition of Approval, the
Developer (Joseph Crown Construction
& Development) must improve the
railroad crossing at Siskiyou Avenue,
south of California Avenue
The California Avenue Pedestrian Trail
runs along the south side of Tract 6293
The Trail crosses Siskiyou just north of
the railroad tracks due to lack of
sidewalk on east side of Siskiyou;
Intended to be temporary until sidewalk
is constructed on east side

Crossing Improvements
Update
CURRENT SITUATION A Field Diagnostic Meeting was held with City Staff, Developer’s
Representatives, Railroad Staff &
Consultants, and California Public
Utilities Commission Staff (jurisdiction
over at-grade railroad crossings)
Required first step in process of getting
approvals/permits for improvements
Discussion was had, and direction
given, that the existing pedestrian
crossing of Siskiyou Avenue, north of
the railroad tracks, is too close and
must be relocated further north
Location for new crossing would have
to be determined by a traffic (queuing)
analysis

Update
PROPOSED SOLUTION In-lieu of relocating the pedestrian crossing, which was planned to be
temporary, Staff have developed an
alternative solution to provide a path of
travel from the end of the trail to the
intersection of Siskiyou and California
Avenues
Pedestrians will be routed along a
temporary asphalt sidewalk along the
east side of Siskiyou, adjacent to the
two existing residential properties
Temporary sidewalk will connect to the
permanent sidewalk, to be constructed
with Tract 6293, north of said
residential properties, up to California
Avenue
From this point, pedestrians have safe
routes to travel in the north, east, and
west directions
