RECOMMENDATION: Council by motion adopt resolution approving amendment to Fiscal Year 2023/2024 Position Allocation List to add position of Administrative Assistant and amending Salary Schedule to Add Administrative Assistant and delete part-time Assistant to City Clerk.
EXECUTIVE SUMMARY:
As a result of refining duties in the Administration Department, it is recommended to amend the Authorized Positions List to add the full-time position of Administrative Assistant. The Authorized Positions List does not include part-time positions. However, the budget contemplated a part-time Assistant to City Clerk. That position is reflected in the Salary Schedule.
The new full-time Administrative Assistant position will allow for support to Administration Department (City Manager, City Clerk and Human Resources). The City Manager will develop a new job description for the new position before the position is filled.
FISCAL IMPACT:
The recommended action will have no impact on the Fiscal Year 2023/2024 budget as there are salary savings from the unfilled part-time Assistant to City Clerk position which had been budgeted for a full year versus the actual cost of the remaining months of the current fiscal year at the following Miscellaneous Employees range of $3,193 - $4,279 per month.

PRESENTER: Michael Barajas, Public Works Director
SUBJECT: Resolution Authorizing the City Mananger to Complete and Sign Applications and Administer the Zero-Emission Landscaping Equipment (ZELE) Voucher Program through San Joaquin Valley Air Pollution Control District
RECOMMENDATION: Council by motion adopt resolution authorizing City Manager to complete and sign applications and administer the zero-emission landscaping equipment (ZELE) voucher program through San Joaquin Valley Air Pollution Control District EXECUTIVE SUMMARY:
The San Joaquin Valley Air Pollution Control District launched the new Zero-Emission Landscaping Equipment (ZELE) Voucher Program to assist landscape maintenance professionals in replacing their existing gas or diesel – powered equipment with new electric zero-emission alternatives. This program is open to commercial landscape maintenance professionals, school districts, cities, counties, special districts and other businesses and commercial entities willing to replace gas-powered equipment with zero-emission electric options.
This program requires a resolution from City Council authorizing the application or other documentation signed by a duly authorized official with authority to make financial decisions, authorizing the submittal of the application and identifying the individual authorized to implement the new zero-emission landscaping equipment (ZELE) voucher program is required.
In past years, the City has been fortunate to have been awarded cleaner air vehicles including compressed natural gas (CNG), gas-electric hybrids and all electric vehicles. In support of cleaner air in the San Joaquin Valley, it is beneficial for the community and the City to make a positive impact on the Valley’s air quality. With further transitioning to a zero-emission landscaping equipment fleet that results in less CO2 emissions.
FISCAL IMPACT:
If successful, cost savings to the City could be up to $700 - $15,000 per equipment.

STAFF REPORT
MEETING DATE: January 24, 2024
PRESENTER: Steve Wilkins, Chief of Police
SUBJECT: Curb Markings for No Parking or Limited Parking Zones RECOMMENDATION: Council by motion adopt resolution approving No Parking Zones and authorizing Curb Markings along Commerce Way, Church Avenue, Industrial Way and Vineland Avenue to address imminent public safety and convenience concerns as identified by the Chief of Police in several locations within the City limits.
DISCUSSION:
Several locations have been reported and identified as requiring “No Parking” signage and markings to improve vehicular, bicycle and pedestrian safety.
Pursuant to Kerman Municipal Code Chapter 10.12, “at such times as the Chief of Police finds that the public safety and convenience require the establishment of no parking or limited parking zones for motor vehicles on the public streets in the city, he shall report this fact to the City Council at a meeting of that body.”
Accordingly, Staff seeks Council adoption of a resolution to authorize the installation of curb markings to address unsafe and illegal parking in several areas.
Additionally, Assembly Bill 413 was signed in to law, which prohibits drivers from parking “within 20 feet of the vehicle approach side of any unmarked or marked crosswalk.” The bill also bans parking 15 feet from a crosswalk with a curb extension.
Local jurisdictions may choose a different prohibited distance on a case-by-case or citywide basis, as that distance is clearly marked with paint or signage, and gets approved through an ordinance process that incorporates traffic safety standards. The new law will not be enforced until 2025, unless a violation occurs within an area that is already “marked using paint or a sign.” The City of Kerman intends to implement AB 413 as determined to preserve public safety.
Exhibit ‘A’ is a map depicting the priority areas where installation of signage and paint markings are recommended to improve the safety, access, and line of sight associated with parking on City streets.
As indicated in Exhibit ‘A’, several problem areas are along West Church Avenue, Commerce Way, Industrial Way and Vineland primarily attributed to large vehicles, trailers and large truck 33 Section 5, Item G.
parking. Other areas recommended for new controls include red curbs along street facing fire hydrants.
COORDINATION AND REVIEW
The recommendation of the Chief of Police has been reviewed by, and is supported by, the Traffic Committee, City Manager, Public Works Director and City Engineer.
FISCAL IMPACT:
It is estimated that the expense for time and materials to install immediate parking safety controls is less than $2,500 from the Streets Maintenance Fund for this first phase of improvements. The cost to phase the implementation of AB 413 as needed, has not been estimated at this time, but will be considered on an as needed basis in future budget allocations.

STAFF REPORT
MEETING DATE: January 24, 2024
PRESENTER: Jesus Gonzalez, City Engineer
SUBJECT: Approval of Contract Change Order No. 1 for the Lions Park Recharge Project RECOMMENDATION: Council by motion adopt the resolution:
1. Approving contract change order no. 1 for the Lions Park Recharge Project to DG Construction Inc. in the amount of $128,521.62 and;
2. Authorizing an additional construction contingency in the amount of $22,200.00 (10% of original construction contract) and;
3. Authorizing the City Manager to sign the change order and subsequent change orders, up to the additional contingency amount on behalf of the City.
EXECUTIVE SUMMARY:
In 2014, the State of California passed the Sustainable Groundwater Management Act (SGMA) requiring local agencies’ groundwater consumption not exceed water quantities put back into the underground aquifer (recharge). In 2022, the City entered into an agreement with Fresno Irrigation District (FID) to receive an annual allocation of surface water for increasing its groundwater recharge efforts.
On September 13, 2023, following a competitive bid process, DG Construction was awarded a construction contract in the amount of $222,770.00 for the installation of an actuated valve, water meter, and associated piping at FID’s existing structure located on the west side of Siskiyou Avenue at the Middleton Avenue alignment. The improvements will allow for FID supplied water to be released into the Lions Park drainage basin, where it will percolate into the ground thereby recharging the underground aquifer.
On December 11, 2023, a construction Notice to Proceed was issued to DG Construction. Upon start of construction activities, partially collapsed high-density polyethylene (HPDPE) corrugated pipe was discovered in place of anticipated concrete pipe. The HDPE being inadequate for the use and reducing flow capacity of received FID water, must be replaced with a 24-inch concrete pipe over an approximate length of thirty eight (38) linear feet in a new alignment. Additionally, a gate valve requiring replacement was confirmed to be sixteen (16) inches in diameter rather than the anticipated twelve (12) inches. The additional cost for the installation of the concrete pipe, inclusive of necessary traffic control implementation, HDPE pipe abandonment, and surface restoration and upsizing to the 16-inch replacement gate valve is in the amount of $128,521.62.
38 Section 7, Item A.
FISCAL IMPACT:
The total estimated Project cost is $477,300.00, including design, construction management, inspection, change order no. 1 and the additional 10% contingency. The City has received a Proposition 1 Grant from the California Department of Water Resources in the amount of $207,515.00 for the Project. The construction contract award approved the original $118,985.00, in excess of Grant award, to be funded from the Water Operations Reserves. Staff recommends the additional $150,521.62 in costs resulting from change order no. 1 and the request for additional 10% contingency be further funded from Water Operations Reserves, or another source upon Council’s direction, bringing the total excess costs to $269,506.62. If the Project does not move forward at this time, the City will be unable to meet the grant timeline and will be at risk of losing the grant funding.
