STAFF REPORT
MEETING DATE: June 26, 2024
PRESENTER: Josefina Alvarez, Finance Director
SUBJECT: Approval of Project List for Fiscal Year 2024/2025 Funded by SB-1-The Road Repair and Accountability Act of 2017 (JA)
RECOMMENDATION: Council by motion adopt resolution approving project list for Fiscal Year 2024/2025 funded by SB1-The Road Repair and Accountability Act of 2017.

EXECUTIVE SUMMARY:

Senate Bill 1 (SB1), known as the Road Repair and Accountability Act of 2017, was signed into law by the Governor in April 2017 to address basic road maintenance, rehabilitation and critical safety needs on both the state highway, local streets and road systems.

To receive funding from the Road Maintenance and Rehabilitation Act (RMRA), the City is required to submit to the California Transportation Commission (CTC) a list of projects proposed to be funded with these funds pursuant to an adopted resolution by the City Council at a regular public meeting.

Based on Maintenance of Effort (MOE) established in Streets and Highways Code Section 2036, an annual match of $20,200 (minimum) from the City's discretionary spending is required. The purchase and installation of the Solar Light Poles Project on the East side has been designated for the use of the MOE for Fiscal Year (FY) 2019/2020, FY 2020/2021, FY 2021/2022, FY 2022/2023, FY 2023/2024 and installation of these lights will be done in FY 2024/2025.

The Street Rehabilitation Project will continue into FY 2024/2025. The total project cost for this FY is $1,301,629. Funds from both SB1 and Article VIII will be used to fund this project.

Annually in December, the City must submit a completed and an in-progress project report. If this report is not submitted, the RMRA funds will be forfeited.

FISCAL IMPACT:

The City of Kerman projects to receive a total of $433,918 from SB1 RMRA Funds in Fiscal Year 2024/2025, according to the State Department of Finance statewide revenue projection. Fund reserves or Local Transportation Funds (LTF) will fund this project, if needed.

1 Policy
The City of Kerman is committed to providing a work environment that is free of disruptive, threatening, or violent behavior involving any employee, appointed or elected official, volunteer, contractor, client, and/or visitor. Our policy is to establish, implement, and maintain an effective plan as required by SB 533. That legislation requires us to establish, implement, and maintain, at all times in all our facilities, a workplace violence prevention plan for purposes of protecting employees and other personnel from aggressive and violent behavior at the workplace.

Our Workplace Violence Prevention (WVPP) is available to our employees, their representatives, and the Chief of Cal/OSHA or his or her designee.

Prohibited Acts
The City of Kerman will not ignore, condone, or tolerate threats of violence or workplace violence by any employee, appointed or elected official, volunteer, contractor, client, or visitor.  Threats of violence include both verbal and non-verbal conduct that causes a person to fear for his or her safety because there is a reasonable possibility he or she might be physically injured and that serves no legitimate work-related purpose.  Workplace violence means any act of violence or threat of violence that occurs at the work site. The term workplace violence shall not include lawful acts of self-defense or defense of others. Workplace violence includes the following:
– The threat or use of physical force against an employee that results in, or has a high likelihood of resulting in, injury, psychological trauma, or stress, regardless of whether the employee sustains an injury
– An incident involving the threat or use of a firearm or other dangerous weapon, including the use of common objects as weapons, regardless of whether or not the employee sustains an injury
Workplace violence can be categorized into four types:

Type 1: Workplace violence committed by a person who has no legitimate business at the work site - includes violent acts by anyone who enters the workplace with the intent to commit a crime
Type 2: Workplace violence directed at employees by customers, clients, patients, students, inmates, or visitors
Type 3: Workplace violence against an employee by a present or former employee, supervisor, or manager
Type 4: Workplace violence committed in the workplace by someone who does not work there but has or is known to have had a personal relationship with an employee 46 Section 7, Item A.
2 In addition, The City of Kerman prohibits all dangerous weapons not used for fire suppression, accident and incident response, emergency medical services, the service of law enforcement, or security duties on all The City of Kerman property. Any employee or appointed or elected official in possession of prohibited dangerous weapons on The City of Kerman property is in violation of this policy and may be subject to disciplinary action up to and including dismissal. Any volunteer, contractor, client, or visitor in possession of prohibited dangerous weapons will be banned from the premises. Dangerous weapons include any instrument capable of inflicting death or serious bodily injury.
