PRESENTER: John Jansons, City Manager
Akayla Cheema, Human Resources Officer
Theresa Johnson, Community Services Director
SUBJECT: Reorganization of Positions in the Community Services Department (JJ), (AC), (TJ) RECOMMENDATION: Council by motion adopt resolution approving new position of Lead Supervisor in the Parks, Recreation, and Community Services Department and related job description and deleting position of Building and Facilities Supervisor position.

EXECUTIVE SUMMARY:

In April of 2025, Gilbert Garcia was temporarily reclassified to a Lead Supervisor position to assist with supervising maintenance staff in the Parks, Recreation, and Community Services department. As he settled into the position, it created a structure in the park maintenance division that was previously lacking. Management determined to make this reclassification permanent by creating a position of Community Services Lead Supervisor. The template for the Public Works Lead Supervisor job description has been used to reflect the duties of a Community Services Lead Supervisor – Parks and Facilities. This position will remain an hourly position and be part of the KMEA bargaining unit.

With the passing of the 2025-2026 fiscal year budget, the position of Assistant Director was approved. This position will assume the mid-management level responsibilities previously listed in the Building and Facilities Supervisor job description, as well as other administrative tasks, thereby eliminating the Building and Facilities Supervisor position.

The proposed resolution includes the job description for the new position as Exhibit ‘A’.

FISCAL IMPACT:

The proposed Lead Supervisor position is on a lower pay scale than the Building and Facilities Supervisor pay scale, resulting in some budget savings.

STAFF REPORT
MEETING DATE: July 23, 2025
PRESENTER: Jesus A. Gonzalez, City Engineer
SUBJECT: Public Hearing and Approval of Resolution Confirming Diagram and Assessments for the Annual Levy, 2025-2026, for Landscaping and Lighting District No. 1 (JG) RECOMMENDATION: Council conduct a public hearing, receive public testimony, and adopt resolution confirming the diagram and assessments for Landscaping and Lighting District No. 1 for the 2025-2026 annual levy in the amounts specified and authorize the City Clerk to record the diagram and assessment with the Fresno County Auditor-Controller.

EXECUTIVE SUMMARY:

The Landscape and Lighting District No. 1 (LLD) serves to maintain public landscaping in median islands and landscape strips along major streets as well as pay for street lighting costs. All new developments are annexed into the LLD and charged an annual assessment that is collected with property taxes. There are currently 14 sub-areas, with a total of 2,246 properties, within the LLD.

The Landscape and Lighting Act of 1972 requires that certain actions be completed by Council prior to levying assessments upon properties within Kerman’s LLD. Council has previously adopted resolutions for initiation of proceedings and intention to levy and collect assessments.

The final action required of Council is to conduct a public hearing to consider protests to the proposed assessments and to confirm the diagram and assessments. The Engineer’s Report, dated July 2025, for the LLD is on file with the City Clerk and contains descriptions of the improvements maintained, boundaries of the district and sub-areas, and proposed assessments per parcel. A map showing the boundaries of the assessment areas is included as Exhibit A within the accompanying resolution.

FISCAL IMPACT:

The annual assessments from the LLD are used for maintenance of public landscaping and street lighting. The assessments for Sub-areas 1 through 5 were established prior to the passage of Proposition 218 and therefore cannot be raised without a vote of the property owners. The assessments for Sub-areas 6 through 14 are adjusted annually by the change in the Consumer Price Index (CPI). For 2025, there was an increase in the CPI of 2.9%. The assessment for each property within the LLD for FY 25-26 are included in the Engineer’s Report on file with the City Clerk.

STAFF REPORT
MEETING DATE: July 23, 2025
PRESENTER: Michael Barajas, Public Works Director
SUBJECT: Ratification of Well No. 14 Emergency Water Well Repair (MB) RECOMMENDATION: Council by motion adopt resolution ratifying emergency repairs to Well No. 14 and the procurement of services for the repairs from Zim Industries, Inc. in the amount of $176,443.58.

EXECUTIVE SUMMARY:

City Staff determined the need to immediately proceed with emergency repairs to Well No. 14 to maintain the city water systems. As a result, staff contracted emergency work with Zim Industries in the amount of $176,443.58 to address the immediate needs of the City. The proposed Resolution (Attachment A) will ratify the award of the contract for emergency work to restore the City’s water system to full function and bring the expenditure into compliance with the City’s Purchasing Regulations regarding emergency work.

DISCUSSION:

During a routine inspection on Friday, March 31, 2024, City staff noticed a concerning noise vibration emitting from Water Well No. 14 (Well 14) and immediately shut down Well No. 14.

To properly diagnose the situation, staff contacted Zim Industries, Inc., and was informed that the pump bowl assembly, bearings, needed to be replaced. Also, the line shaft had to be repaired. Due to the well failure, staff submitted a written request to the City Manager/Purchasing Officer for authorization and approval of the required emergency repairs.

Well 14 is located on the northeast quadrant of the City near Vineland and Whitesbridge. Well No. 14 is a high capacity well-constructed in 1998 and is integral in contributing to the City’s water supply. With the City’s system being a looped system, maintaining adequate water supply and quality the system is interdependent on the function of multiple wells operating on any given day. The repairs necessary for Well 14 were deemed to be “emergency” because while the system remained functional and adequate during the repair of Well 14, any chance of a cascading failures or “domino” effect of shutdowns of the other supporting wells during the repair to Well 14 would have been catastrophic to the system and the community.

In discussing this matter with the City Attorney, while there was an emergency, there was likely time to go to Council first. Staff will be more diligent in determining when to proceed without Council authorization before the fact and obtain proper documentation. 99 Section 7, Item A.

FISCAL IMPACT:

The total estimated cost of the repairs for Well 14 is $ 176,443.58 and is available in the Water Enterprise Fund.

RESOLUTION NO. 25-___

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KERMAN

WHEREAS, the repairs necessary for Well 14 were deemed to be “emergency” because while the system remained functional and adequate during the repair of Well 14, any chance of a cascading failures or “domino” effect of shutdowns of the other supporting wells during the repair to Well 14 would have been catastrophic to the system and the community; and WHEREAS, staff deemed it necessary for the City to enter into an emergency repair contract without the time delay of competitive bidding to maintain adequate water supply; and WHEREAS, the City contracted with Zim Industries, Inc. to perform the necessary emergency repairs to Water Well No. 14; and
WHEREAS, City Purchasing Regulations allow for immediate emergency contracting when needed and require follow-up approval (ratification) by the City Council.
