SUBJECT: A Resolution Specifying Employee Positions Receiving the Floating Holiday Pursuant to the Memorandum of Understanding and Subsequent Side Letter Agreement by and Between the City of Kerman and the Kerman Miscellaneous Employees Association (JJ) RECOMMENDATION: Council adopt a resolution specifying Kerman Miscellaneous Employees Association (KMEA) positions receiving the Floating Holiday pursuant to the Memorandum of Understanding and subsequent Side Letter Agreement by and between the City of Kerman and the Kerman Miscellaneous Employee Association.
DISCUSSION:
Following the conversion of the Ceaser Chavez birthday holiday to a “floating holiday” by City Council approving a Side Letter Agreement by Resolution 26-73 on September 9, 2026, there remains the need to specify the KMEA employees, by position, who are eligible for the floating holiday negotiated by KMEA and approved by the City.
The proposed resolution, Attachment ‘A’, includes Exhibit ‘A’, which is a listing of the positions eligible for this benefit. The position titles shown with an asterisk denote an authorized position that is currently unbudgeted or unfilled. Approval of the resolution will resolve any ambiguity of eligibility for this benefit with the use of the word “member”.
FISCAL IMPACT:
This recommendation requires no new expense. This holiday for KMEA was approved by Council in 2024 and has been budgeted annually.

STAFF REPORT
MEETING DATE: October 14, 2026
PRESENTER: Jesus A. Gonzalez, City Engineer
SUBJECT: Offers of Dedication and Deeds from Kerman Unified School District (KUSD) to the City of Kerman, Relating to the KUSD Harvest Elementary School Project (JG) RECOMMENDATION: Council adopt a resolution:
1. Accepting Irrevocable Offers of Dedication for public utilities and street right-of-way purposes pertaining to Assessor’s Parcel Number (APN) 020-120-26ST, 020-120-27ST, 020- 120-28S and 020-120-32ST;
2. Approving and accepting Easement deeds for Well 18 and water meter access purposes pertaining to APNS 020-120-26ST and 020-120-27ST;
3. Approving and accepting Grant deed for Basin C expansion purposes pertaining to APN 020-120-26ST; and
4. Authorizing execution, acceptance, and recordation.
EXECUTIVE SUMMARY:
KUSD constructed Harvest Elementary School, which opened at the start of the 2024–25 school year. As part of the project, KUSD was required to construct improvements to be dedicated to the City for public use.
In late 2024, the improvements remained incomplete, including electrical service to the streetlights and sewer lift station. In order to schedule the electrical work, Pacific Gas and Electric Company (PG&E) required the City to accept from KUSD the land rights where its infrastructure would be located. However, City policy required the improvements to be operational before acceptance of the dedications.
City staff coordinated with KUSD and PG&E to resolve the issue through Irrevocable Offers of Dedication (Offers of Dedication). KUSD agreed to issue Offers of Dedication and the City adopted Resolution No. 25-14 approving their acceptance on February 26, 2025, contingent upon completion of the improvements.
The improvements have now been verified as complete and operational. Formal acceptance of the Offers of Dedication is therefore needed for public utilities and street right-of-way over portions of APN 020-120-26ST, 020-120-27ST, 020-120-28S and 020-120-32ST. 29 Section 5, Item F.
Additional dedications associated with the completed improvements also require acceptance.
These include access easements over portions of APNs 020-120-26ST and 020-120-27ST for accessing Well 18 and a water meter. Acceptance of these easements will provide the City with access rights to operate and maintain these facilities.
Lastly, acceptance of a grant deed for a portion of APN 020-120-26ST will transfer ownership to the City land where KUSD constructed additional storm drainage storage capacity to serve the school. Acceptance of the grant deed will provide the City ownership to operate and maintain this facility.
The proposed resolution formally authorizes the acceptance of the Irrevocable Offers of Dedication, Easement Deeds, and Grant Deeds outlined above.
FISCAL IMPACT:
The acceptance of dedications does not result in an expense to the City.

STAFF REPORT
MEETING DATE: October 14, 2026
PRESENTER: Theresa Johnson, CPRP Community Services Director SUBJECT: Renaming Northwest Park to Virsa Park in Recognition of the Punjabi Community’s Significant Contributions to the City of Kerman (TJ)
RECOMMENDATION: Council, by motion, adopt a resolution to rename Northwest Park to Virsa Park in recognition of the Punjabi community's significant contributions to Kerman.
EXECUTIVE SUMMARY:
On April 16, 2026, staff received a request from Mayor Maria Pacheco to consider renaming Northwest Park to Virsa Park to reflect the surrounding area's cultural heritage and honor the legacy, identity, and continued impact of the Punjabi community in Kerman. For the Punjabi community, the term “Virsa“ loosely translates as culture or heritage; it is not a sentiment. It is a standard of living.
Heritage carries the weight of responsibility: a charge to work honestly, give back generously, and ensure that what the generation before built, is strengthened by Punjabi hands. When the first Punjabi families migrated to the Central Valley in the 1960s and chose Kerman as their home, they did not come to pass through. They came to belong, and for over six decades, they have proven it in ways the City can measure.
Staff has reviewed the request to rename Northwest Park as Virsa Park and determined that it fully complies with the City of Kerman Parks and Facilities Naming Policy. Specifically, the proposal satisfies the following criteria:
“Section V. Qualifying Name
D. A commonly recognized historical event, group, organization, or individual (living or deceased) F. Outstanding accomplishments by an individual for the good of the community. Quality of the contribution should be considered along with the length of service by the individual – this to be fully substantiated by the person making the recommendation.” To provide examples of the Punjabi community's contributions, Mayor Pacheco met with members of the Punjabi community. Their contributions are reflected in agriculture, business and commerce, education, the medical profession, transportation, non-profit organizations, Gurdwara Anandgarh Sahib, and philanthropy. This list is a testament to the meaning of Virsa, the cultural inheritance that every generation is given and is responsible for passing forward.
1. Sidhu, Randhawa, Singh, Sran, Gill, Aulakh, Dhaliwal, Bains, and Sapraj families represent generations of stewardship over Kerman's productive agricultural land. 84 Section 7, Item A.
2. Rakkar, Dhaliwal, Brar, Grewal, and Badhesha families own and manage businesses like Deli Delicious, Subway, Punjabi Plate, Baskin Robbins, Sourdough & Co., Fast-Trip, Chevron, Valero, Gill Chevrolet, Fertilizer Depot, and mechanic shops.
3. Over 75 Kerman High School valedictorians carry Punjabi heritage.
4. Over 50 Punjabi medical professionals including doctors, dentists, nurse practitioners, registered nurses, CNAs, and LVNs serve the health of Kerman and the surrounding region.
5. Over 100 Punjabi individuals sustain Kerman's transportation industry as trucking company owners, drivers, and truck yard operators.
6. The Jakara Movement, Punjabi American Growers Group, and the American Punjabi Sikh Community of Kerman give structure and sustained voice to the values this community lives by organizing, advocating, and serving across every season.
7. Since 2006, Gurdwara Anandgarh Sahib in Kerman has served as a place for all, serving free meals to all who walk through its doors, every single week, without condition. In Punjabi and Sikh culture, this practice known as langar is an act of seva, selfless service as a spiritual discipline. For nearly two decades, this institution has fed Kerman: neighbors, strangers, and those in need, without application, qualification, or expectation of anything in return. The Gurdwara alone speaks volumes about what the Punjabi community means to this city and what culture, when lived faithfully, looks like in practice.
8. Kerman High School offers a Punjabi language course that stands among the most unique language programs in the nation.
9. Kerman Public Library houses a Punjabi language section: the only one of its kind in the nation.
Among thousands of public libraries across the United States, Kerman stands alone in offering this resource.
10. Contributing to scholarship funds, community events and facility donations for disaster relief.
Naming this park Virsa Park is more than symbolic; it accurately reflects our history. For over sixty years, the Punjabi-Sikh community has built, served, educated, healed, fed, and invested in Kerman, not as visitors, but as people who put down roots and treated this city as a home to be passed down through generations. In a city where "Community Comes First," this park in northwest Kerman is a fitting tribute to a group that has profoundly shaped Kerman into the safe, clean, and successful community it is today.
On Tuesday, September 15, 2026, the Parks, Recreation and Community Services Commission reviewed and commented on the renaming of Northwest Park to Virsa Park. The Commission unanimously voted to recommend approving the proposed name change to the City Council.
FISCAL IMPACT:
The fiscal impact is the cost of the permanent park sign: $4,342.65.

STAFF REPORT
MEETING DATE: October 14, 2026
PRESENTER: Jesus A. Gonzalez, City Engineer
SUBJECT: Introduction and First Reading of an Ordinance Establishing Speed Limits for Designated City Streets (JG)
RECOMMENDATION: Council introduce an Uncodified Ordinance Establishing Speed Limits for Designated City Streets.
EXECUTIVE SUMMARY:
The California Vehicle Code (CVC) sets speed laws and prima facie speed limits for highways and local roads. To vary speed limits from those established by the CVC, a local agency must conduct an Engineering and Traffic Survey (E&TS). The City Engineer has conducted a new E&TS as justification for speed limits on designated streets. The proposed speed limits are provided as Exhibit ‘1’ to the ordinance (Attachment ‘A’), as well as a map showing the proposed speed limits as Attachment ‘B’. To be enforced, the E&TS must be filed with the local Court, and new speed limit signs must be posted, as necessary.
The City last conducted an E&TS in 2019. As such, the Police Department directed the City Engineer to prepare a new E&TS to ensure all speeding citations are enforceable. Under State law, cities previously had to set speed limits based solely on the speed at which most drivers were traveling. Enacted in 2022, AB 43 now gives cities the flexibility to consider criteria such as crash history and adjacent land use when setting speed limits. In accordance with Section 627 of the CVC, data was collected for prevailing speeds on applicable street segments in each direction of travel. The speed data collection was conducted between July and August of 2026.
In addition to speed data, information was also collected on accident history, street width and alignment, pedestrian activity and traffic flow characteristics, land use and proximity to schools, etc., as these factors may be considered in the establishment of speed limits per CVC Section 627.
Under CVC Section 21400(b), speed limits shall be set to the nearest 5 MPH increment of the 85th percentile speed of free-flowing traffic. Federal Highway Administration (FHWA) studies demonstrate that limits set near this speed are safer and produce less variation in vehicle speeds. Limits set too high or too low can increase collisions. The 85th percentile therefore establishes the upper limit of operating speeds considered reasonable and prudent. Arbitrarily low limits can make violators of a disproportionate number of drivers, impede orderly traffic movement, and require constant enforcement.
89 Section 7, Item B.
CVC Section 21400(b) allows the speed limit to be set at the 5 MPH increment below the 85th percentile speed, even when mathematical rounding would require the higher increment, but no further reduction is then allowed. Under certain circumstances, the limit may instead be reduced by 5 MPH from the nearest 5 MPH increment. Such a reduction must comply with CVC Sections 22358 and 627, and the E&TS must document the conditions and justification and be approved by a registered Civil or Traffic Engineer.
The E&TS proposes the speed limit changes shown below based on segments having new limits where none were previously posted, increased limits, or decreased limits.
Street From To Posted Proposed
Siskiyou Ave Northern City Limits Whitesbridge Rd N/A 30 Siskiyou Ave Whitesbridge Rd Kearney Blvd 35 40
First St Kearney Blvd California Ave 30 25
E&TS are typically valid for a period of five years. However, CVC Section 40802(c) allows for E&TS to be valid for a period of seven years when the following conditions are met:
1. Officers have successfully completed a radar operator course of not less than 24 hours on the use of police traffic radar and the course was certified by the Commission on Peace Officer Standards and Training; and
2. The radar equipment used to measure the speed of the vehicle meets the minimal operational standards of the National Traffic Highway Safety Administration and has been calibrated within three years.
The Kerman Police Department meets both conditions. The officers who use the radar guns and issue radar based speeding citations have completed the Peace Officer Standards and Training 24-hour radar school. In addition, the Departments radar guns are serviced and calibrated annually. As such, the E&TS will be valid for a period of seven years, as long as officer training and equipment calibration is continued as required.
FISCAL IMPACT:
Following adoption of the speed limits, Public Works Staff will verify any new speed limit signs required. A budget amendment will be presented at a later date for the cost of new signage, if necessary.

ORDINANCE NO. 26-____
AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF KERMAN
ESTABLISHING SPEED LIMITS FOR DESIGNATED CITY STREETS IN THE CITY OF KERMAN WHEREAS, California Vehicle Code Section 22352 establishes prima facie speed limits for streets; and
WHEREAS, California Vehicle Code Section 22357 provides that whenever a local authority determines upon the basis of an engineering and traffic survey that a speed greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street other than a state highway otherwise subject to prima facie limit of 25 miles per hour, the local authority may by ordinance determine and declare a speed limit of 30, 35, 40, 45, 50, 55, or 60 miles per hour or a maximum speed limit of 65 miles per hour, whichever is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and
WHEREAS, according to California Vehicle Code (CVC) Section 40802, a “speed trap” is defined as a section of highway or street with a prima facie speed limit that is not justified by an engineering and traffic survey conducted within the time periods specified and the enforcement of the speed limit involves the use of radar or any other electronic device that measures the speed of moving objects; and
WHEREAS, the evidence of a speeding violation based on the maintenance or use of a speed trap is inadmissible in court per CVC Section 40803; and WHEREAS, in order to establish speed limits and ensure a speed trap is not created, engineering and traffic surveys must be conducted in accordance with CVC Section 627 and the California Manual on Uniform Traffic Control Devices (MUTCD); and WHEREAS, the City prepared an engineering and traffic survey (2026 E&TS) for designated City streets from July 2026 thru August 2026 and the proposed speed limit for each street as established by the 2026 E&TS is provided as Exhibit ‘1’; and WHEREAS, CVC Section 40802(c) allows for engineering and traffic surveys to be valid for a period of seven years if the conditions specified in Section 40802(c), pertaining to officer training and equipment standards, are met; and
WHEREAS, the City has reviewed CVC Section 40802(c) and determined that the Kerman Police Officers using radar equipment for determination of speed have been properly trained and the radar equipment used meets the required standards and is properly maintained and calibrated.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KERMAN ORDAINS AS FOLLOWS:
91 Section 7, Item B.
1. The 2026 E&TS is hereby approved and incorporated herein by reference.
2. A speed limit in excess of 25 miles per hour as set forth in Exhibit ‘1’ is hereby established for the City streets identified in Exhibit ‘1’. The Council finds, upon the basis of the 2026 E&TS, that these speed limits would facilitate the orderly movement of vehicular traffic and would be reasonable and safe.
3. The 2026 E&TS must be filed with the local Court, and new speed limit signs must be posted, as necessary. Speed limits shall be effective when appropriate signs giving notice thereof are erected upon a street. The Director of Public Works is hereby authorized and directed to erect and maintain on such streets appropriate signs to give notice of the declared speed limit and for purposes of enforcement. All such signs shall conform to the requirements of the California Vehicle Code as to placement and design.
4. The speed limits do not apply to any 25 mile per hour prima facie limit which is applicable when passing a school building or the grounds thereof or when passing a senior center or other facility primarily used by senior citizens.
5. The speed limits shall also be subject to limitations of Vehicle Code Section 22352 or any other subsequently enacted limitation.
6. The speed limits shall be as provided in Exhibit ‘1’.
7. Unless a different speed limit is set forth in this Ordinance, the prima facie speed limit on any local street shall be 25 miles per hour or as otherwise specified in the Vehicle Code.
8. The 2026 E&TS shall be effective for a term of seven (7) years from the date of adoption of this Ordinance, unless extended under the provisions of the Vehicle Code.
9. The City Clerk shall maintain this Ordinance with other City Ordinances and shall retain a certified copy as the Official List of Special Speed Zones, which copy shall be made available for inspection upon inquiry by a member of the public.
10. If any section, subsection, paragraph, sentence, clause or phrase in this Ordinance, or its application to any person or circumstance is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, paragraphs, sentences, clauses or phrases of this Ordinance.
11. This Ordinance shall become effective thirty (30) days after its adoption.
12. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published and/or posted in accordance with applicable law. 92 Section 7, Item B.
