Item No. 5(A)
REPORT TO THE CITY COUNCIL
DATE: OCTOBER 27, 2023
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: DOREEN LIBERTO, AICP, COMMUNITY DEVELOPMENT
DIRECTOR
SUBJECT: CONSIDERATION OF A REGIONAL EARLY ACTION PLANNING (“REAP”) 2.0 GRANT
RECOMMENDATION:
It is recommended the City Council adopt the attached Resolution approving participation of the City in the Regional Early Action Planning (“REAP”) Grant 2.0 Program and authorizing the City Manager to execute a Memorandum of Understanding (“MOU”) with the Association of Monterey Bay Area Governments (“AMBAG”) and any other required documents for receipt of the REAP 2.0 Grant.
BACKGROUND:
The California Department of Housing and Community Development (HCD) is authorized to provide up to $510,000,000 to Metropolitan Planning Organizations and Councils of Government listed in Health and Safety Code Section 50515.08, subdivisions (a)(1)-(6) under the Regional Early Action Planning Grants Program (REAP 2.0). The State of California Department of Housing and Community Development (HCD) issued a Notice of Funding Availability on July 26, 2022 for REAP 2.0 grants available to Metropolitan Planning Organizations and Councils of Government. AMBAG will be implementing the requirements and administering the REAP 2.0 Program.
DISCUSSION
In August 2023 City submitted an application for REAP 2.0 for the cost of the environmental review that will be needed to approve the Development Code update currently under way. The Development Code update project consists of the comprehensive review and amendments to Title 17 Zoning and Title 16 Subdivision into a single regulatory document.

The Development Code update will also include focus on facilitating implementation of the 6
th Cycle Housing Element, including allowing for affordable housing near key job center areas. The Development Code will focus on Opportunity Zone areas centered in the downtown area. The project will utilize the Infill Housing Toolkit to facilitate additional housing units called out in the 6 th Cycle Housing Element,
including higher density types of housing found in the tool kit and encouraging development densities beyond single family housing zoning.
COST ANALYSIS:
There is no General Fund impact associated with this agenda item. REAP does not require a local financial commitment or “match” from local jurisdictions requesting grant funds.
ENVIRONMENTAL REVIEW:
The City of King has determined that the proposed action for this agreement is not a project as defined by the California Environmental Quality Act (“CEQA”) per Guidelines Section 15378. CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.
ALTERNATIVES:
1. Adopt the attached Resolution.
2. Do not adopt the attached Resolution and take no action.
3. Direct staff to amend the Resolution.
