Item No. 9 (C)

REPORT TO THE CITY COUNCIL
DATE: AUGUST 27, 2024
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF AN ORDINANCE ESTABLISHING
CHAPTER 7.72 OF TITLE 7 OF THE KING CITY MUNICIPAL

CODE PERTAINING TO SHOPPING CART REGULATIONS
RECOMMENDATION:

It is recommended the City Council waive the second reading by title only and adopt an ordinance establishing Chapter 7.72 of Title 7 of the King City Municipal Code pertaining to shopping cart regulations.

BACKGROUND:

The City has experienced an increasing problem with abandoned shopping carts in the community. They cause blight, create significant pedestrian and vehicle obstacles, and damage the City’s beautification efforts. It has resulted in a significant amount of staff time by the Public Works Department staff to respond to abandoned carts, which involves notifying the business owners and then manually removing and returning the carts if the business does not respond in a timely manner.

As a result, staff proposed a new ordinance to establish regulations on businesses that provide shopping carts. Stores in King City with shopping carts were notified of the proposed ordinance. The City Council approved introduction of the ordinance at the August 13th meeting.

DISCUSSION:

Shopping cart regulations are restricted by the California Business and Professions Code. The proposed ordinance would create the following requirements consistent with State law:
• Removal and abandonment of shopping carts from a business without permission of the owner is prohibited.

CITY COUNCIL
CONSIDERATION OF AN ORDINANCE ESTABLISHING CHAPTER 7.72 OF TITLE 7 OF THE KING CITY MUNICIPAL CODE PERTAINING TO SHOPPING

CART REGULATIONS
AUGUST 27, 2024
• Every shopping cart is required to identify the owner and owner’s contact information.
• Businesses with shopping carts shall include a sign notifying the public that removal of shopping carts is prohibited.
• Shopping carts are required to be locked after business hours. • The City shall impound carts that are found abandoned. • Retrieval of carts by the owner is required within 3 business days. After 3 business days, a fee set by City Council resolution to recover City costs will be charged.
• If over 3 carts are not retrieved within the required 3 business days within a 6-month period, a fine of $50 will also be charged to release the cart. • Abandoned shopping carts can be disposed of after 30 days.

If approved, City staff will notify each business in the City utilizing shopping carts of the new regulations. A public education effort will also be implemented.

COST ANALYSIS:

The intent of the ordinance is to reduce staff time involved in retrieving shopping carts.

ENVIRONMENTAL REVIEW:

The proposed regulations are not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it does not have the potential for resulting in either a direct physical change to the environment, or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA.

ALTERNATIVES:

The following alternatives are provided for Council consideration:

1. Adopt the proposed ordinance;

2. Direct staff to modify the ordinance to only charge the fine or to make other changes and then re-introduce it;

ORDINANCE NO. 2024-830

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF KING ESTABLISHING CHAPTER 7.72 OF TITLE 7 OF THE KING CITY MUNICIPAL CODE PERTAINING

TO SHOPPING CART REGULATIONS
WHEREAS, California Business and Professions Code §§22435 through 22435.8 regulated shopping and laundry cart retrieval services and authorizes a city to retrieve off-premises shopping and laundry carts and fine the shopping cart owner up to $50 if four or more shopping or laundry carts are not retrieved in any six month period; and WHEREAS, Subdivision (d) of Business and Professions Code §22435.7 authorizes cities which impound shopping carts to recover the actual cost of the recovery service; and WHEREAS, the City Council desires to protect the appearance, integrity and character of the community and safeguard property within the community; and WHEREAS, the City Council finds that abandoned shopping carts create blight, serious pedestrian and vehicle safety hazards, and increased costs to the City for abatement services; and WHEREAS, this Ordinance is intended to regulate use of shopping carts provided by commercial businesses in order to reduce the number of shopping carts that are removed from the business site and left abandoned in other public and/or private property locations; and NOW THEREFORE, the City Council of the City of King does hereby ordain as follows:

SECTION 1. The above recitals are all true and correct and are hereby adopted as findings..

SECTION 2. The Ordinance is exempt from the California Environmental Quality Act (“CEQA”) because it can be seen with certainty that there is no possibility that it will have a significant effect on the environment. (CEQA Guidelines § 15061(b)(3).) Further, the adoption and implementation of this Ordinance is not a project, as defined in CEQA Guidelines section 15378, because it has no potential for resulting in physical change to the environment, either directly or indirectly, and is therefore not subject to environmental review under CEQA pursuant to CEQA Guidelines section 15060(c)(3).

Item No. 9(D)

REPORT TO THE CITY COUNCIL
DATE: AUGUST 27, 2024
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
BY: ERICA SONNE, CITY CLERK
RE: CONSIDERATION OF 2024 LOCAL AGENCY BIENNIAL NOTICE

ON CONFLICT OF INTEREST CODE
RECOMMENDATION:

It is recommended the City Council adopt a resolution making changes to position titles in exhibit A and receive and file the 2024 Local Agency Biennial Notice.

BACKGROUND:

The Political Reform Act requires each city to review its Conflict of Interest Code biennially and notify the City Council as to whether or not the Code needs to be amended. The completed biennial notice must be submitted to the City Council no later than October 1, 2024. The Code was last amended in 2022.

DISCUSSION:

Statements are required in all jurisdictions to be submitted by Council Members, Planning Commission Members, the City Manager, the City Attorney, and the City Treasurer/Finance Director. The designation of other employees and officers is discretionary. Traditionally, the City of King has limited their requirements to the minimal positions established by State law. In 2016 the list was expanded to include all positions that potentially influence decisions that may impact financial interests. This year some positions have been reclassified or have changed, so the City needs to send a revised list. There are five criteria questions in the instructions for the Biennial Notice for amending the Conflict of Interest Code, and the City answered yes to a couple of them, so amendments to the current Conflict of Interest Code are necessary.

The Fair Political Practices Commission has adopted a regulation (2 Cal. Code of Regulations, Section 18730) which contains the terms of a standard conflict of interest code, and which can be incorporated by reference in an agency's code. Item No. 9 (E)

REPORT TO THE CITY COUNCIL
DATE: AUGUST 27, 2024
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF AMENDMENT TO MASTER FEE

SCHEDULE
RECOMMENDATION:

It is recommended the City Council adopt a Resolution amending the Master Fee Schedule to add fees for the Alcohol Beverage Control (ABC) Public Convenience or Necessity Letters and shopping cart retrieval.

BACKGROUND:

The City maintains a Master Fee Schedule of all user fees. Fees are based upon the cost to provide each service. Staff recommends the Master Fee Schedule be amended at this time in order to add two proposed fees and adjust recreation fees. The new recommended fee amounts were determined through an analysis of actual average costs to the City for each item.

DISCUSSION:

When a census tract has an overconcentration of alcohol licenses as determined by ABC or is considered a high crime area, ABC will not process a new alcohol business permit without a Public Convenience or Necessity Letter from the local jurisdiction. The purpose of the letter is to determine whether the license will serve a public convenience or necessity. A public hearing before the Planning Commission and City Council is necessary, which results in staff and noticing costs. Currently, the City does not have a fee to reimburse the City for these costs. Therefore, a new fee for such applications is proposed.

Staff have also proposed a new ordinance to establish fees and penalties related to abandoned shopping carts. The purpose of the ordinance and fee is to reimburse the City for staff costs involved in retrieving shopping carts, to encourage businesses to better prevent shopping cart theft, and to encourage

WHEREAS, the City Council desires to establish new fees for ABC Public Convenience or Necessity Letters and Shopping Cart Retrieval; and
WHEREAS, the City Council desires to implement minor inflationary adjustments to recreation program fees; and
WHEREAS, an analysis of actual costs has been prepared to determine the necessary fee amount.

NOW, THEREFORE, BE IT HEREBY RESOLVED that the City Council of the City of King hereby approves the Master Fee Schedule attached and included herein as Exhibit A.

Item No. 10(A)

REPORT TO THE CITY COUNCIL
DATE: AUGUST 27, 2024
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: DOREEN LIBERTO, AICP, COMMUNITY DEVELOPMENT

DIRECTOR
RE: CONSIDERATION OF AN ORDINANCE AMENDING MUNICIPAL
CODE CHAPTER 17.26 (HIGHWAY SERVICE ZONING DISTRICT)

TO EXCLUDE RESIDENTIAL DEVELOPMENT, CHANGE

LANDSCAPING REQUIREMENTS AND OTHER MINOR

CHANGES
RECOMMENDATION:

It is recommended that the City Council open the public hearing, consider public testimony, introduce, conduct the first reading of the attached Ordinance, by title only, and set the second reading and adoption for the next regularly scheduled Council meeting on September 10, 2024.

BACKGROUND:

The City is diligently working on several communitywide programs, including economic development to improve the local economy, updating the General Plan Land Use Element, and updating the Subdivision and Zoning Ordinances. A primary objective is to maintain and expand existing businesses and attract new businesses. Therefore, it is important to include enough commercially designated areas to accommodate business growth. The H-S Zoning District allows residential development, which may detract from commercial development. Staff is recommending that all residential uses be prohibited in the H-S Zoning District to ensure there is sufficient land for commercial development. The Planning Commission considered this item on August 20, 2024 and recommended the City Council adopt the Ordinance with a minor amendment regarding the use of canopy trees.

CITY COUNCIL
CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER 17.26
(HIGHWAY COMMERCIAL ZONING DISTRICT)
AUGUST 27, 2024
DISCUSSION:

The City has been actively working on economic projects to assist in business retention and expansion and attracting new businesses. The goal is to assist in creating jobs, providing goods and services, and facilitating new commerce. The South Monterey cities are working with the Monterey County Business Council (MCBC) to identify retail and hotel sites. MCBC has contracted with Kosmont Companies to prepare a Retail/Hotel Market Analysis. The sites being considered as part of the analysis are in the H-S Zoning District. The existing H-S Zoning District permits residential uses (trailers and mobile home developments).

Allowing residential uses in the H-S Zoning District reduces available land for commercial development.

The H-S Zoning District does not typically provide an appropriate location for residential housing. The proximity to the highway creates air quality and noise impacts. In addition, locating housing next to commercial uses creates inconsistent land uses, often resulting in complaints involving noise from late night operations, traffic, trash, and other concerns. Staff is recommending the H-S Zoning District be strictly for commercial. The proposed Ordinance states residential development is not permitted.

The Ordinance also provides new landscaping standards to minimize the creation of “heat islands and to make it more feasible for commercial developers to address the City’s landscaping requirements.” Heat islands are areas that create higher temperatures due to infrastructure (e.g., parking lots) that absorb and re-emit the sun’s heat more than natural landscaping. trees and vegetation (e.g., bushes, shrubs, and tall grasses) lower surface and air temperatures by providing shade and cooling through evaporation and transpiration, also called evapotranspiration. There is also minor clean up language in the Ordinance.

Given the lack of available large commercial properties and high costs of development, it is difficult for developers to address parking requirements with the amount of landscaping also required. The proposed change measures the amount of landscaping by the tree canopy size rather than the surface area of the landscaping. This change will both assist developers to comply while at the same time providing an incentive to plant shade trees rather than shrubs and small trees.

The changes also now allow bumper overhand areas to be landscaped instead of paved to provide another option to meet the minimum landscaping required.

On August 20, 2024, the Planning Commission considered the Ordinance and recommended the City Council adopt the Ordinance with the following change:

01222.0001/979923.1 1
ORDINANCE NO. 2024-831

WHEREAS, the City of King (“the City”) has the authority, under its police power, to enact regulations for the public peace, morals, and welfare of the City, California Constitution Article XI, section 7; and
WHEREAS, it is the intent of the City to amend the Highway Service Zoning District; and

RECOMMENDATION:

It is recommended City Council introduce to be read by title only an Ordinance amending provisions of Chapter 17.50 of Title 17 of the King City Municipal Code and establishing Municipal Code Sections 17.50.070 through 17.50.077 pertaining to architectural control and entitled historic downtown area design and colors, open the hearing, allow for public testimony, close the hearing, waive first reading of the Ordinance, and approve the introduction of the Ordinance.

BACKGROUND:

In response to concerns and direction provided by the City Council regarding color of buildings in the downtown area, staff are recommending an ordinance to establish architectural standards on building design and colors within the Historic Downtown Area. The ordinance includes preferred standards from the Historic Corridor Revitalization Plan (HCRP) which underwent an extensive community outreach process and was adopted by the City Council on January 11, 2011. The purpose is to preserve and protect the historic character of the City’s downtown area.

On August 6, 2024, the Planning Commission held a public hearing, received public comment, and passed Planning Commission Resolution No. 2024-336 recommending City Council adopt the Ordinance amending Chapter 17.50 Architectural Control.

standards to protect the historic character of the City’s downtown area. Some of the City’s most distinguishing historic resources are in the City’s downtown area.

Many structures have undergone façade improvements, specifically the structures located within the three-hundred block of Broadway Street. The City has been working together with properties owners in the Historic Downtown Area to restore the buildings to their original condition and preserve the architectural designs. These buildings add tremendous value to the community and the purpose of this ordinance is to take part in the historic restoration and preservation of these historic buildings and to establish standards for any future development in the Historic Downtown Area.

Per City Council direction, the proposed ordinance sets forth non-standard colors. The ordinance does not prohibit non-standard colors in order to provide flexibility and unique designs, but it will require administrative architectural review for changes in building colors to non-standard colors. To prevent creating a disincentive to improving buildings, no architectural review is required for painting when only standard colors are used.

COST ANALYSIS:

There are no costs associated with this action.

ENVIRONMENTAL REVIEW:

Staff has performed a preliminary environmental assessment of this project and has found that the Ordinance is exempt from the California Environmental Quality Act (“CEQA”) because it can be seen with certainty that there is no possibility that it will have a significant effect on the environment.

ALTERNATIVES:

The following alternatives are provided for Council consideration:

1. Introduce the proposed Ordinance;

2. Modify the Ordinance;

3. Do not introduce the proposed Ordinance;
