City Manager Adams had nothing to report tonight.

City Attorney Santos stated that the Sixth District Court of Appeals issued a decision ruling in the City’s favor on all grounds in Grocery Outlet litigation. Among others, the Court made clear that it found “no merit” in the contentions that environmental regulations were not followed and went so far as to award costs to Best Development and the City. 11. REGULAR BUSINESS
A. Consideration: Project Update on the San Antonio Drive/Broadway Street Bike Path and Safe Routes to Schools Improvements Project
City Manager Adams introduced this item.

City Engineer Hurtado further introduced this item.

Molly Tremblay and Sean Houck Kimley-Horn further introduced this item with a PowerPoint presentation.

Council Member DeLeon asked for clarification on trucks and buses being able to move through the roundabouts. It has been evaluated and it seems to work. He is also concerned about sidewalk improvements. City Engineer Hurtado stated that we have additional funding to do curbs and gutters and sidewalks along Broadway.

Council Member Cullen wanted to make sure we were accommodating the cemetery. Ms. Tremblay stated yes. He would like to see the stakeholder group Chamber of Commerce involved and the high school students when outreach is done. He would also like to see time calculations around 5p.m.

Council Member DeLeon would like to see the High School reached out to as they have plans in place that directly affect Franciscan Way and Mildred Ave.

Page 3 of 4 ends

Mayor LeBarre suggested that when the outreach meeting have something for children to do, food and drink and provide in English and Spanish.

Debbie Norman has been a resident since 1976. Her experience is that high school students are unique creatures. She suggested strongly spending a week at the King City High School during peak times of going and coming from school. They will walk right out without looking to see if a car is present sometimes on their cell phone.

Lei Gallegos worked at the High School, and she is concerned about the times going to school, lunchtime, and going home. She is representing King City in Bloom, and they have concerns about this.

A gentleman from 412 Windsor St. is concerned about speeding traffic which is close to the high school.

Council Member DeLeon suggested that the crossing lights on Broadway at Canal be relocated to the two places on Mildred where High School wanted to put them. City Engineer Hurtado stated that lights will go in on Pearl, Ellis/Mildred and 1st Street going to Jayne.

Mayor LeBarre was concerned about MST buses and large motor homes as we want people to be able to get to the downtown. Simulations make sense he would like to see real time drone footage with the 3D simulation. He feels a stop light at Mildred would cause an issue. He would like to see another terminology for road diet because he doesn’t feel if translates well.

Council Member Cullen stated that Mondays are bad for meeting dates so he feels that the Wednesday date would be good.

Ms. Tremblay stated that they have an online survey that will be in English and Spanish that can be done prior to the meeting date.

City Engineer Hurtado stated that they are looking at using the Police Departments drone for footage.

Action: Motion to direct staff to proceed with public outreach and agendize consideration of approval of the environmental review and preliminary design of the project at the November 26, 2024, City Council meeting; and 2 D view, 3 D view and everything that City Council and community members spoke on tonight be considered by Cullen seconded by Avalos.

Item No. 9 (D)

REPORT TO THE CITY COUNCIL
DATE: NOVEMBER 12, 2024
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF AGREEMENT WITH THE COUNTY OF

MONTEREY FOR AWARD OF ENCAMPMENT RESOLUTION

FUNDING (ERF) FOR THE TEMPORARY HOMELESS SHELTER

AND HOMELESS RENTAL ASSISTANCE PROGRAMS
RECOMMENDATION:

It is recommended the City Council: approve and authorize the City Manager to execute an agreement with the County of Monterey for $561,000 in Encampment Resolution Funding (ERF) for the temporary homeless shelter and homeless rental assistance programs. and 2) authorize the City Manager to make nonsubstantive changes to the agreement as necessary in a form approved by the City Attorney.

BACKGROUND:

The City has experienced an ongoing significant level of homelessness. A substantial number of homeless individuals formerly resided in encampments in the Salinas Riverbed area, which created a number of issues regarding unsafe living conditions, environmental damage, public safety concerns, and fire hazards. The City has undertaken a number of efforts to do its part in addressing homelessness in a proactive manner. The most significant step was the application and approval of a Homekey project, which is proposed to be a permanent supportive housing facility. The former Days Inn hotel was acquired, but the City has experienced significant delays due to serious financial problems, fraud and mismanagement of the project by the developer (Shangra-La Industries, LLC).

Due to the ongoing delays, the City and a number of partners developed an interim plan to shelter a large number of homeless living in the riverbed at the Monarch Inn hotel. The City Council approved an overall Interim Riverbed

Homeless Strategy at the June 13, 2023 meeting. Implementation began in July 2023, which has been successful and operated within the budget approved by City Council.

The original agreement was established for 18 rooms with the motel owner through the end of October 2023. The Homekey project experienced further problems, eventually leading to foreclosure of the former Days Inn property.

Staff and partnering agencies developed a new funding plan to extend the interim homeless shelter program. The purpose was to maintain the participants in shelter while strategies to address the Homekey project problems were pursued.

Continuing issues with the Days Inn have required several additional extensions and expansion to 20 rooms. The City and its partnering agencies have been successful in securing additional grants to fund the extensions. Most recently, at the October 8th meeting, the City Council approved an extension of the Monarch Inn lease to August 12, 2025.

Families with multiple children who had been relocated from the riverbed encampments will not qualify for the permanent supportive housing facility.

Therefore, at the November 14, 2023 meeting, the City Council also approved a rental assistance program to help the families find other permanent solutions.

DISCUSSION:

The County of Monterey and Housing Authority for the County of Monterey submitted an application and were awarded an Encampment Resolution Funding (ERF) grant primarily for the purpose of funding the acquisition and development of the permanent supportive housing project. However, it also included funding for the temporary shelter and temporary rental assistance programs. It was the primary funding source to extend the programs beginning July 1, 2024.

The State authorized expenditures to begin on July 1, 2024 while the agreement with the County was being processed. The County has now drafted an agreement to allocate the funds for the temporary shelter and temporary rental assistance programs to the City. The permanent supportive housing project funds will be allocated under an agreement to the Housing Authority for the County of Monterey.

COST ANALYSIS:

The total amount that will be provided to the City that the County has obtained from the grant will be $561,000. Of this amount, $465,000 is for the Monarch Inn

RE: CONSIDERATION OF AGREEMENT WITH STEP UP ON

SECOND STREET FOR HOMELESS RENTAL ASSISTANCE

PROGRAM
RECOMMENDATION:

It is recommended the City Council approve and authorize the City Manager to execute a contract services agreement with Step Up on Second Street to administer a housing rental assistance program to families previously homeless and residing in the Salinas Riverbed encampment; and 2) authorize the City Manager to make non-substantive changes to the agreement as necessary in a form approved by the City Attorney.

BACKGROUND:

The City has experienced an ongoing significant level of homelessness, which has become a major issue facing many jurisdictions. A substantial number of homeless individuals previously resided in encampments in the Salinas Riverbed area.

As a result, the City undertook a number of proactive efforts to address this problem. The most significant action has been development and approval of the homekey permanent supportive housing project at the former Days Inn site and a temporary shelter program at the Monarch Inn.

Families with multiple children who had been relocated from the riverbed encampments will not qualify for the permanent supportive housing facility.

Therefore, at the November 14, 2023 meeting, the City Council also approved a rental assistance program to help the families find other permanent solutions.

CITY COUNCIL

CONSIDERATION OF AGREEMENT WITH STEP UP ON SECOND STREET

FOR HOMELESS RENTAL ASSISTANCE PROGRAM
NOVEMBER 12, 2024
It began as a short-term program, but additional funding has been secured to extend the benefits. It is now proposed to contract with Step Up on Second Street to help administer and expand the program assistance.

DISCUSSION:

The application submitted by the County of Monterey for an Encampment Resolution Funding (ERF) grant was approved primarily to fund the acquisition and development of the permanent supportive housing project, but it also included funding for the temporary rental assistance program. This was an important component of the project since the grant is specifically awarded for the purpose of addressing homelessness of individuals who formerly resided in the riverbed encampment and to prevent the encampment from being reestablished.

This has enabled the City to extend the program for two families who have been able to secure permanent housing. The City was authorized by the State to begin expenditures covered under the grant in July 2024, but the City has had limited staff and expertise available to administer the program since funding expired for the Community Assistance Coordinator position. The City Manager has been overseeing the program and issuing the payments, but staff does not have the ability to provide other supportive services.

As a result, staff is proposing to contract with Step Up on Second Street to assume administration of the program. They will have the ability to coordinate the program with other supportive services with the ultimate goal of achieving independent housing sustainability of the participants in the future.

COST ANALYSIS:

The grant obtained by the County of Monterey includes $96,000 for the rental assistance services. Of this amount, $27,107.54 has already been expended, which leaves $68,892.46 remaining. Services of Step Up on Second Street are funded through other grant programs. Therefore, there is no cost to the City for the contract services provided. All the funds provided under the agreement will go to pay for the rental assistance payments.

ENVIRONMENTAL REVIEW:

The services under the agreement are not a “project” for the purposes of the California Environmental Quality Act (CEQA) as they do not have the potential for resulting in either a direct physical change to the environment or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.

RE: CONSIDERATION OF CLOSE OUT OF COMMUNITY
DEVELOPMENT BLOCK GRANT AGREEMENTS 20-CDBG-CV2-
3-00005 and 20-CDBG-CV2-3-00014 WITH THE STATE OF

CALIFORNIA
RECOMMENDATION:

It is recommended the City Council: 1) review the past use of funds and program performance for the City of King Community Development Block Grant (CDBG) contracts 20-CDBG-CV2-3-00005 and 20-CDBG-CV2-3-00014; 2) open the public hearing, receive public input regarding the outcome and accomplishments of the funding received under the contract, and close the public hearing; and 3) direct staff to submit the required close out documents per the program requirements.

BACKGROUND:

Per the requirements of the CDBG contract, the City is required to hold a public hearing to review the past use of funds and program/project performance for the City of King CDBG contracts. This agreement with the State of California Department of Housing and Community Development also requires the City to solicit citizen input regarding the outcome and accomplishments of the funding received under these contracts.

DISCUSSION:

The City of King was awarded funds from the Department of Housing and Community Development under the American Reinvestment and Recovery Act under contract numbers 20-CDBG-CV2-3-00005 and 20-CDBG-CV2-3-00014. The purpose of these funds was to provide grants for small and microbusinesses to

The majority of the businesses served were of Hispanic/Latino origin, reflecting the City’s commitment to supporting diverse communities.

COST ANALYSIS:

There was no direct cost impact to the City for the work completed under this contract. All costs were covered by the grant funding as follows:

The grant funding under this contract was $83,212.00 described as follows:

REPORT TO THE CITY COUNCIL
DATE: NOVEMBER 12, 2024
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: MIKE HOWARD, FINANCE DIRECTOR
RE: CONSIDERATION OF PURCHASE OF THE TYLER

TECHNOLOGIES UTILITY BILLING MODULE
RECOMMENDATION:

It is recommended that the City Council: 1) adopt a Resolution approving the purchase of the Tyler Technologies utility billing module and authorizing the City Manager to execute an agreement for the system acquisition, services, and licensing in the amount of $57,965; and 2) approve a budget amendment of $57,965 to The Sewer Enterprise Fund.

BACKGROUND:

The City has used the Tyler Technologies financial reporting system for decades.

Tyler Technologies is the leading provider of Financial Reporting System software to governmental entities such as cities, counties and school districts.

On October 25, 2022, the City Council approved the migration from the Tyler Technologies Fund Balance system to the Tyler Technologies ERP Pro 10 system. The City has now been live on five of the seven modules scheduled for migration to ERP Pro 10. The remaining two modules will be completed by January 2025.

The City has never processed its own sewer bills, instead has contracted with California Water Service (“Cal Water”) to bill and collect the City sewer charges with the monthly water bills. Recently, Cal Water notified the City that they will no longer include the City sewer fees with their monthly water billings. The City is now faced with doing it’s own billing for sewer fees.

CITY COUNCIL

CONSIDERATION OF PURCHASE OF THE TYLER TECHNOLOGIES UTILITY

BILLING MODULE
NOVEMBER 12, 2024
DISCUSSION:

For years the City has contracted with Cal Water to include the sewer fees with their water bills. Therefore, the City has never had the need for a Utility Billing Module as part of the financial suite of products.

Recently Cal Water notified the City that effective June 30, 2025, Cal Water will no longer include the City sewer fees as part of the monthly water bills. For the first time, the City is now faced with producing utility bills for sewer services. In order to accomplish this, the City has obtained a quote from Tyler Technologies for the inclusion of the Utility Billing Module as part of our financial suite of products. It is necessary to move quickly in order for the City to start the process and ensure we are able to begin billing in July 2025.

With City Council’s approval of the Utility Billing Module, staff plans to implement additional processes to not impact customer traffic or workload at City Hall. Staff will implement an online payment system where customers can pay by check or credit card. Staff intend to work with a local vendor to take cash payments like the City of Soledad has done. Additionally, staff will establish a Lockbox system for the processing of payments made by check via the US Postal Service. With these measures, it is believed the City will not need to add staff for the processing of utility bills at this time.

There are some benefits to the City from controlling the sewer billing. The City will have visibility to delinquent accounts and be able to attempt to collect them.

Currently, when an account is delinquent, it is up to Cal Water to collect. If a customer makes a partial payment, it is applied first to the water charges and not to sewer charges until the water debt is fully paid. Therefore, in many cases where there is a delinquent account, the City does not get paid. It is recommended that the City establish a property tax special assessment process for sewer delinquent accounts similar to the one recently developed for refuse and recycling payments. Staff will present those recommendations at a later time after the billing system has been developed.

The downside to this change is that the residents of King City will now receive an additional utility bill for sewer services instead of one monthly bill for water and sewer services which can lead to some confusion. The City will engage in sufficient public outreach during the project to advise the residents of the upcoming change.
