Item No. 9 (E)

REPORT TO THE CITY COUNCIL
DATE: JULY 8, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF CONTRACTUAL SERVICES

AGREEMENT WITH LEW EDWARDS GROUP FOR

PROFESSIONAL CONSULTANT SERVICES
RECOMMENDATION:

It is recommended the City Council: 1) approve a contract services agreement with Lew Edwards Group for tax measure consultant services; and 2) approve an appropriation of $32,000 in the FY 2025-26 budget and $56,500 in the FY 2026- 27 budget.

BACKGROUND:

The City has made tremendous progress in addressing its financial crisis. It recently achieved a positive General Fund balance for the first time in almost 20 years and has now established a General Fund reserve However, there are still major priority needs in the community that remain unfunded, and the City continues to experience serious financial constraints in a very challenging environment for local cities throughout California due to policy changes at the federal level and the current environment. These constraints and funding needs may start to reverse the progress made if not addressed.

As one approach to expand a reliable source of locally-controlled funding, the City had previously considered local sales tax ballot measures in 2022 and 2024.

King City is only one of just three cities in Monterey and San Luis Obispo counties with a local sales tax under 1.5%.

The next opportunity to consider another local funding measure will be the next 2026 Municipal Election. Staff recommend the City contract for professional services to assist the City in better identifying and assessing community priorities, engaging the public to get input, sharing Best Practices of what other cities our size are successfully doing with community support to address longterm fiscal sustainability with local funding approaches, and potentially supporting staff and the City Council through this process. The City Council adopted the FY

2025-26/FY 2026-27 Biennial Budget, which included funding recommended by staff for consultant services to support revenue generation strategies. After a thorough analysis of potential options, staff recommend the City Council approve a contract with Lew Edwards Group to provide these services.

DISCUSSION:

Staff solicited recommendations from other jurisdictions for sales tax measure consultants throughout California. The results were used to prepare a distribution list for a Request for Proposal (RFP), which was released but later suspended. Staff now recommend awarding a sole source contract to Lew Edwards Group. Staff concluded that Lew Edwards Group is the leading firm providing these specialized services based on the results of a discussion and information received from the consultant, information obtained through statewide outreach to other cities, and references from the City’s new legal firm. Staff also believe it is critical for the City’s future to obtain the best expertise available to address its existing funding needs. As a charter city, awarding a sole source contract in this instance would comply with the City’s purchasing policy and the Consultant has also provided a discounted professional rate.

The scope of work will include auditing the City’s issues, working with the City on coordinating strategies, overseeing design and implementation of up to 2 public opinion surveys, analysis of the survey results, recommendations for strategic community engagement, drafting and design of public messaging, message training, solicitation of additional community input, assistance with media relations, advisement on ballot measure viability, and working with the City Attorney and staff on development of the measure if directed to proceed. If the measure is determined to be unviable, the City may choose to terminate the contract at any time with 10 days notice and cancel the second public opinion survey.

If approved, staff recommend immediately executing the contract and beginning the process. The term of the services provided by the consultant would then be 16 months, extending from July to November. The proposed contract with the full scope of work is attached, which was drafted by the City Attorney.

COST ANALYSIS:

The proposed costs are as follows:

Consultant services (16 months @ $5,750 per month) $92,000 Public opinion surveys (2 @ $30,000 and $32,500) $62,500 Design of public messaging materials (5 @ $400+mail file) $2,500 Printing and postage $5,500
Total $162,500

REPORT TO THE CITY COUNCIL
DATE: JULY 8, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF 2025-26 JOB CLASSIFICATION PLAN
RECOMMENDATION:

It is recommended the City Council adopt a Resolution approving an initial FY 2025-26 Job Classification Plan.

BACKGROUND:

The City maintains a Job Classification Plan that sets forth all existing job classifications and salary ranges. It is also a requirement of CalPERS that the City Council adopt on an annual basis the City’s Job Classification Plan.

DISCUSSION:

Decisions have been reached on salary increases for SEIU positions and nonrepresented executive and management positions for FY 2025-26. Nonrepresented executive management position salaries include a 2.5% cost of living adjustment (COLA). The SEIU Memorandum of Understanding (MOU) was extended last year through June 30, 2026. Therefore, the rates identified in the Classification Plan reflect the increases agreed upon in the MOU. It is also recommended to implement a 5% increase to Fire Department stipends for officers and an additional $1 to the per call pay rate for firefighters.

Staff are recommending the City Council adopt the Job Classification Plan at this time to implement those adjustments in the first pay period of the fiscal year.

SEIU increases will become effective on July 5, 2025 per the terms of the MOU.

RESOLUTION NO. 2025-5054

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KING
APPROVING THE CLASSIFICATION PLAN FOR FY 2025-26
WHEREAS, the City of King maintains job descriptions for each position and a Classification Plan that sets forth all existing job classifications and salary steps; and WHEREAS, adoption of an annual Classification Plan is required by CalPERS; and WHEREAS, the City Council desires to make changes to the Classification Plan to reflect salary adjustments for certain non-represented positions, negotiated increases to pay rates for SEIU represented employees, and increases to Fire officer and firefighter pay rates.

NOW, THEREFORE, BE IT HEREBY RESOLVED that the City Council of the City of King approves the FY 2025-26 Classification Plan as set forth in Exhibit A.

REPORT TO THE CITY COUNCIL

TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: DOREEN LIBERTO, AICP, COMMUNITY DEVELOPMENT

DIRECTOR
RE: CONSIDERATION OF A GENERAL PLAN AMENDMENT AND

ZONE TEXT AMENDMENT TO THE NEIGHBORHOOD
COMMERCIAL CN ZONING DESIGNATION.

RECOMMENDATION:

It is recommended the City Council open the public hearing, consider public testimony, introduce and conduct the first reading of the Ordinance, by title only, and set the second reading and adoption for the next regularly scheduled Council meeting of July 22, 2025.

BACKGROUND:

Chris Madson, Applicant, submitted a request for General Plan Amendments and Zoning Text Amendments to allow market rate housing in the Neighborhood Commercial (NC) Land Use Designation and Commercial Neighborhood (CN) Zoning District. Mr. Madson had two mixed use projects (one on Amherst Drive and one on San Antonio Drive) in the CN Zoning District approved in 2019, which expired in 2020 In 2020, the City amended Municipal Code Chapter 17.64 Permits and Variances and expirations for conditional use permits and variances were granted two-year validity, if a building permit is not issued within this time period, then the project automatically expires. The new code allowed for extensions in twelve month increments but not to exceed a total of three years from the original date of expiration.
• Original CUP Approval: May 7, 2019 (1195 Amherst Ave) July 2, 2019 (126 San Antonio Drive)
• Expiration per COA No. 2: May 7, 2020 (1195 Amherst Ave) July 2. 2020 (126 San Antonio Drive)
• Building Permits submitted: January 8, 2020 (for both sites)

• Expiration of CUPs granted by Municipal Code Section § 17.64.030:

May 7, 2022 (1195 Amherst Avenue)
July 2, 2022 (126 San Antonio Drive)
• Building Permits were not issued by the expiration date and expired on:

October 15, 2022 (126 San Antonio Drive)
June 15, 2020 (1195 Amherst Drive)
On December 15, 2021, Mr. Madson submitted a request for a General Plan Amendment and Zoning Text Amendment for the C-N, however, those applications were deemed incomplete on January 13, 2022 and again on August 22, 2022 due to lack of a project description.

In 2025, Mr. Madson requested to move forward with his 2021/2022 General Plan and Zoning Text Amendments to the Neighborhood Commercial General Plan Designation and C-N Zoning District. The Project Description now includes a citywide change to the General Plan and Zoning Text. (Mr. Madson is also in the process of submitting conditional use permit applications for the proposed modified projects for market rate housing on the Amherst and San Antonio sites.) The current CN Zoning District allows affordable multiple family dwellings or market rate dwellings on the second floor. Mr. Madson would like to build all market rate dwelling units. This requires the General Plan and CN Zoning District text be amended. This request coincides with policies adopted as part of the City’s State approved 6th Cycle Housing Element and Prohousing application. The General Plan needs to clearly state that residential uses are allowed in the Neighborhood Commercial (NC) designation and assign a density. The corresponding zone for the General Plan Neighborhood Commercial land use designation is C-N. The C-N zone needs to be amendment to allow market rate housing with a density. On June 3, 2025, the Planning Commission recommended the City Council adopt the Ordinance.

DISCUSSION:

The Project includes a General Plan Amendment and a Zoning Text Amendment.

On April 21, 2025, Eduardo Bravo Gomez, U.S.A Taxi Cab (“Applicant”), submitted an application for taxi services to operate within the city limits. Per Municipal Code §5.30.020, no person shall operate any public transportation vehicle within the city without first obtaining a permit. Municipal Code Chapter

5.30 Public Transit Vehicles, establishes two (2) types of approvals. The first type of approval is granted by the City Council, which is to establish the taxi service in the city. The second type of approval is granted by the City Manager for approval of the driver/operator of the business. The process of approval can either be a combined application or processed separately.

A public hearing notice was published in the King City Rustler newspaper on June 25, 2025 and notice was posted on the bulletin board at City Hall notifying of this evening’s public hearing and invited to voice any concerns on this application. The public hearing will be conducted on July 8, 2025.

DISCUSSION:

The Applicant has submitted a request for a Combined Approval to establish Taxi Service and approval of a Taxi Driver.

CONSIDERATION OF TAXI SERVICE APPLICATION FOR EDUARDO BRAVO GOMEZ, U.S.A TAXI CAB
PAGE 2 OF 4
Storage of Vehicle
The Applicant proposes to store the vehicle at 321 Lang St, Salinas, CA 93901.

The storage location is not within City limits. The Applicant may need to request additional permits from other jurisdictions.

Fares & Charges
The Applicant proposes to use a charging meter. A flag drop will be charged at $3.50 and each mile thereafter will be charged at $3.50. The hourly rate will be set at $35 per hour. Per Municipal Code §5.30.080, no rates shall be set, established, changed, modified or amended without a hearing before the City Council. A notice of public hearing was published in South County Newspaper The Rustler on June 25, 2025.

Taxi Service Vehicle
The Applicant will be driving a 2007 Mercury Grand Marquis for the taxi services.

Per Municipal Code §5.30.090 every vehicle operating under the provisions of this chapter is subject to inspection at any time by the chief of police or his authorized representative. Any vehicle found to be unsafe or unsuitable for service is immediately taken out of service until the vehicle is in safe and proper condition. The inside of the vehicle must be kept in a clean and sanitary condition and is required to be cleaned thoroughly at least once in every 24-hours.

Taxi Driver
The Applicant is proposed to be the Driver/Operator. Approval by the City Manager of Taxi Driver is required for all drivers. All drivers are required to renew their Driver Permit at the end of each calendar year. Each taxi driver’s application will undergo a background check. Per Municipal Code §5.30.100, no permit shall be issued to anyone under age of eighteen years, to anyone who has been committed of a felony or of a crime involving moral turpitude, or to anyone who has been convicted of reckless driving or driving while under the influence of intoxicating liquors or narcotics; provided, however, that the city council may, in its discretion, issue a permit in cases where such conviction occurred more than three years immediately preceding the filing of the application.

If the driver has violated the provisions of this chapter after the permit has been issued, the City Council has the authority to revoke or refuse to renew a driver’s permit.

Insurance
Per Municipal Code §5.30.110, insurance is required. The Applicant shall provide evidence of an insurance policy of public liability and property damage insurance.

Such policy shall have a single limit of not less than $500,000 liability per vehicle with ten or less passengers.

Hours of Service
The service will be available for operation every day of the week (Monday through Sunday) from 5:00 AM to 8:00 PM. The Applicant will be publishing and advertising his business to inform the community of the service. Sign/Decals will be placed on the vehicle with contact number and business name.

Advantages
Public Hearings are normally required for taxi service in order to determine the need and avoid oversaturation of services. There is a need for this service in King City since no other taxi service is currently operating aside from MontereySalinas Transit (MST) bus service.

The taxi service will also integrate well with the future multi-modal transit being planned for First Street. The Applicant also sees this as an opportunity to provide shuttle service to the community, which will serve a currently unmet need.

Disadvantages
The vehicle does not have a ramp for accessibility needs. There are no other known disadvantages.

ENVIRONMENTAL REVIEW:

As this matter does not require special discretion or judgement in reaching a decision, but instead merely is the application of the law to the facts, this project approval is ministerial and no further action is required under the California Environmental Quality Act (“CEQA”).

COST ANALYSIS:

The Applicant is covering the cost required for review and processing of the application.
