Item No. 9 (C)
REPORT TO THE CITY COUNCIL
DATE: NOVEMBER 25, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: MIKE HOWARD, FINANCE DIRECTOR
RE: CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER
15.44 OF TITLE 15 THE KING CITY MUNICIPAL CODE
PERTAINING TO SEWER-COLLECTION OF FEES AND
CHARGES
RECOMMENDATION:
It is recommended City Council waive the second reading by title only and adopt an Ordinance amending provisions of Chapter 15.44 of Title 15 of the King City Municipal Code pertaining to pertaining to sewer-collection of fees and charges.
BACKGROUND:
The City recently took over billing for its wastewater system fees and charges.
As part of the takeover of the billing, staff reviewed the sewer collection of fees and charges section of the King City Municipal Code. Based upon staff review, several edits were identified which will enable the City and staff to better administer the collection of wastewater fees and charges. The proposed Ordinance was introduced by the City Council at the October 28, 2025 meeting.
DISCUSSION:
The proposed Ordinance amendment is presented at this time for Council consideration and introduction of the Ordinance amendment is recommended.
The primary changes proposed in the Ordinance include the following:
Section 15.44.070 Overdue Payment-Penalty.
A. Date Payment Due. Bills for the charges made pursuant to this division and penalties, if any, are due and payable on the date of billing and become delinquent twenty-one (21) days after the date of such billing.
B. Penalties. A penalty of ten (10%) percent shall be assessed on all unpaid bills twenty-one (21) days after the billing date.
Section 15.44.090 Lien or Special Assessment.
CITY COUNCIL
CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER 15.44 OF TITLE 15 THE KING CITY MUNICIPAL CODE PERTAINING TO SEWERCOLLECTION OF FEES AND CHARGES NOVEMBER 25, 2025
PAGE 2 OF 3
All unpaid penalties, fees, fines and costs imposed by Chapter 15.40 may be confirmed by the city council as a special assessment and collected with property taxes or as a judgment lien upon the respective premises from which sewage and/or industrial waste emanates. Owners of premises subject to such lien may be entitled to reimbursement by any non-owner tenant or other occupant of the premises who produced such sewage and/or waste based upon their private contractual relationship, lease or rental agreement. A special assessment and/or lien shall comply with procedural provisions established within Chapter 7.51, Section 7.51.709 of the King City Municipal Code.
Section 15.44.100 Recordation of Notice of Lien or Special Assessment.
(a) Recordation. Immediately upon the city council’s confirmation of costs or penalties, the city clerk shall record a notice of special assessment and lien in the office of the county recorder, which shall constitute a lien on that property for the amount of the assessment, except that if any real property to which the lien would attach has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attaches thereon, prior to the date on which the first installment of taxes that included the special assessment imposed under this section would become delinquent, then the lien that would otherwise be imposed by this section shall not attach to real property and the costs of abatement and enforcement relating to the property shall be transferred to the unsecured roll for collection. (b) Collection with Taxes. After confirmation and recordation, a copy may be turned over to the Monterey County tax collector. At that point, it will be the duty of the tax collector to add the amounts of the respective assessments to the next regular tax bills levied against the lots and parcels of land for municipal purposes. Those amounts shall be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall be subject to the same penalties and procedures and sale in the cases of delinquency as provided for with ordinary municipal taxes.
(c) Priority. A special assessment and lien imposed under this article shall have the priority of a tax lien, unless prohibited by state law, in which case the special assessment and lien shall have the priority of a judgment lien.
It is staff’s recommendation to establish a process for delinquent wastewater accounts similar to that implemented last year for past due Waste Management refuse collection accounts. This will provide a benefit to the City from assuming control of the wastewater billing because it has been Cal Water’s policy to apply late payments first to water service charges and then to wastewater charges only after the water service charges are fully paid. As a result, if the City is reimbursed for delinquent wastewater accounts through a special assessment, it

It is recommended City Council approve Amendment No. 1 to the Franchise Agreement with USA Waste of California, Inc. (“WM”) amending Section 3.04 B Reimbursement for Franchise Contract Administration.
BACKGROUND:
The Franchise Agreement (Agreement) with WM was approved August 26, 2025, and became effective October 1, 2025. Negotiations for said contract commenced in early 2024 and underwent multiple reviews and revisions before approval of the final document. During the review process, a change was made to Section 3.04.B.
Reimbursement for Franchise Contract Administration that needs to be corrected to include the City in the reimbursement fee.
DISCUSSION:
The Agreement originally intended to distribute the contract administration reimbursement fee, starting at $30,000, between Salinas Valley Solid Waste Authority (Authority) ($20,000), the designated contract administrator, and the City of King ($10,000), subject to annual CPI adjustments in accordance to the terms of the contract. The final approved Agreement only lists the Authority as the recipient of this fee. An amendment to the Agreement is required to correct the contract administration fee distribution as originally intended.
The following correction to Agreement Section 3.04.B is recommended:

WITH THE KING CITY CONFIDENTIAL EMPLOYEES
ASSOCIATION (KCCEA)
RECOMMENDATION:
It is recommended the City Council ratify the Memorandum of Understanding between the City of King and the King City Confidential Employees Association (KCCEA) for the period of July 1, 2025 through June 30, 2026.
BACKGROUND:
The City’s current MOU with the KCCEA expired on June 30, 2025. The City’s appointed negotiators have met and conferred with representatives of KCCEA pursuant to the requirements of the Meyers-Milias-Brown Act and reached agreement on a new MOU.
DISCUSSION:
Key changes and items negotiated and agreed upon in the MOU include the following:
• A 3% Cost of Living Adjustment (COLA) in salaries retroactive to the first full pay period in July 2025
• Additional 4% equity adjustments for the City Clerk and Executive Assistant classifications
• Increase in the limit of compensatory time accumulation from 80 hours to 120 hours
• Increase in floating holiday hours from 24 to 32 hours

RE: CONSIDERATION OF 2025-26 JOB CLASSIFICATION PLAN
RECOMMENDATION:
It is recommended the City Council adopt a Resolution approving the Amended FY 2025-26 Job Classification Plan.
BACKGROUND:
The City maintains a Job Classification Plan that sets forth all existing job classifications and salary ranges. It is also a requirement of CalPERS that the City Council adopt on an annual basis the City’s Job Classification Plan.
DISCUSSION:
The proposed Amended Job Classification Plan now includes the cost of living adjustments for all the City’s labor groups, including the King City Police Sergeants Association and the King City Confidential Employees Association, which were the most recent negotiations to conclude. Since the cost of living adjustments are retroactive, the effective date of the Job Classification Plan is July 12, 2025.
COST ANALYSIS:
All salary and benefit adjustments recommended are included in the FY 2025- 26/FY 2026-27 Biennial Budget.
ENVIRONMENTAL REVIEW:
The Job Classification Plan is not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it does not have the potential for resulting

RE: CONSIDERATION OF DESIGNATION OF AUTHORITY FOR
DETERMINATION OF PUBLIC CONVENIENCE OR NECESSITY
FOR THE ISSUANCE OF ALCOHOL LICENSES
RECOMMENDATION:
It is recommended the City Council adopt a Resolution designating the Community Development Director or designee as the review authority for issuing determinations of public convenience or necessity per the Alcoholic Beverage Control requirements.
BACKGROUND:
Assembly Bill 2897 (AB 2897) established the process for a “Determination of Public Convenience or Necessity” (PCN) under California Business and Professions Code Section 23958.4. Under the law, the Department of Alcoholic Beverage Control (ABC) must deny a liquor license if its issuance would create law enforcement issues or result in an undue concentration of licenses in a given area. AB 2897 allows an exception when the local governing body finds that granting the license would serve the public convenience or necessity. This process enables local jurisdictions to balance community needs with public safety by considering factors such as neighborhood character, existing license density, crime rates, and overall community benefit. If the local agency does not act within 90 days, the ABC may make its own determination.
DISCUSSION:
Only one such CUP has been processed to date. Grocery Outlet is currently requesting an ABC license to sell beer and wine. Given the routine nature of these determinations, staff recommend designating the Community Development Director, or his/her designee, as the authority to issue letters of public convenience or necessity in order to streamline the process for applicants. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KING ESTABLISHING
PROCEDURES AND CRITERIA FOR DETERMINATIONS OF PUBLIC
CONVENIENCE OR NECESSITY FOR THE ISSUANCE OF ALCOHOL LICENSES
AND DESIGNATING THE COMMUNITY DEVELOPMENT DIRECTOR OR DESIGNEE
AS THE REVIEW AUTHORITY
WHEREAS, in 1994, the State of California Legislature passed Assembly Bill (AB) 2897 (the Caldera Bill) and amended the State Business and Professions Code Section 23958 which requires the Department of Alcoholic Beverage Control to deny an application for a liquor license, "if issuance of that license would tend to create a law enforcement problem, or if the issuance would result in or add to an undue concentration of [liquor] licenses . . .”; and
WHEREAS, pursuant to Cal. Business and Professions Code § 23958.4, undue concentration is defined as (1) The premises of the applicant is located in an area that has twenty percent (20%) more reported crimes than the average number of reported crimes for the City as a whole, or (2) premises of the applicant is located in a census tract where the ratio of existing retail on-sale/retail offsale licenses to population in the census tract exceeds the ratio of retail onsale/retail off-sale licenses to population in the County of the proposed premise, or (3) as to off-sale retail license applications, the ratio of off-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of off-sale retail licenses to population in the county in which the applicant premises are located; and WHEREAS, the State Business and Professions Code Section 23958.4 states that if the Department of Alcoholic Beverage Control has determined that there is an undue concentration of liquor licenses, applicants may request that local jurisdictions determine whether public convenience or necessity would be served by the issuance of these licenses and inform the Department of Alcoholic Beverage Control; and WHEREAS, the City Council (Council) may establish criteria and procedures to determine public convenience or necessity; and
WHEREAS, the Council may designate a subordinate officer to determine public convenience or necessity; and
WHEREAS, the adoption of the public convenience or necessity criteria and procedures is not a “project” pursuant to Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, and is therefore not subject to review pursuant to Section 15060(c)(3) of the CEQA Guidelines. The activity will not result in a direct or reasonably foreseeable indirect physical change in the environment.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of King hereby designates the Community Development Director or his/her designee to make Determinations of Public Convenience or Necessity pursuant to, and consistent with, Section 23958.4 of the State Business and Professions Code for alcoholic beverage license applications subject to the following criteria and procedures:
1. Applications for Public Convenience or Necessity will be submitted to and processed and reviewed by the Community Development Department or his/her designee in consultation with the City of King Police Department.
2. The applicant shall submit the fee established in the most recently adopted City fee schedule to cover the cost of actual staff time to review and process the application.
3. Public Convenience or Necessity determinations will be prepared by the Community Development Department for consideration and approval by the Community Development Director or his/her designee.
4. The Community Development Director or his/her designee shall sign the Public Convenience or Necessity Determination and send the letter to the Department of Alcoholic Beverage Control.
5. Any applicant aggrieved by a decision of the Community Development Director or their designee with respect to a Public Convenience or Necessity Determination may file an appeal pursuant to King City Municipal Code Section
7.51.601. The findings of the City Council shall be final.

RE: CONSIDERATION OF CHISPA’S REQUEST TO DEFER
PAYMENT OF DEVELOPMENT IMPACT FEES UNTIL THE
FIRST OCCUPANCY PERMIT AND AUTHORIZE THE CITY
ATTORNEY TO PREPARE AN AGREEMENT
RECOMMENDATION:
Staff recommends the City Council direct the City Attorney to prepare an agreement to defer payment of development impact fees until the first occupancy permit is issued.
BACKGROUND:
On August 30, 2005, the City Council approved the Mills Ranch Specific Plan (Specific Plan) and the Mills Ranch Design Manual (Design Manual). The Specific Plan requires the development of 40 affordable apartment units, known as the Garden Apartments. The Community Housing Improvement System and Planning Association, Inc. (CHISPA) will be responsible for constructing these units. On August 4, 2020, the Planning Commission approved the architectural design for the Garden Apartments (Architectural Review Permit Case No. P20- 000-004).
CHISPA is nearing the issuance of building permits and is working within a very limited budget. Due to the financial challenges associated with funding affordable housing projects, CHISPA is requesting to defer payment of development impact fees until the first occupancy permit is issued. King City Municipal Code section
16.18.105 allows the deferment of fees until the certificate of occupancy or temporary occupancy with an agreement approved by the City Attorney.
DISCUSSION:
Nonprofits face significant challenges when trying to fund and develop affordable housing, largely due to the high costs associated with such projects. Land prices, construction expenses, and regulatory fees can be prohibitively expensive.
Unlike for-profit developers, nonprofits often cannot offset these costs by charging market-rate rents, which limits their financial options.
CITY COUNCIL
CONSIDERATION OF CHISPA’S REQUEST TO DEFER PAYMENT OF
DEVELOPMENT IMPACT FEES UNTIL THE FIRST OCCUPANCY PERMIT NOVEMBER 25, 2025
PAGE 2 OF 3
Another major hurdle is the complexity and scarcity of funding. Nonprofits typically rely on grants, donations, and government subsidies, which are often highly competitive and insufficient to cover total development costs. Affordable housing projects frequently require layered financing—combining tax credits, lowinterest loans, and various grants—each with strict eligibility criteria and administrative requirements. Navigating this complex funding landscape demands expertise that smaller nonprofits may lack, making it harder to secure the resources needed to start or sustain a project. Overall, the combination of high costs, complex financing, regulatory hurdles, and sustainability concerns makes funding and developing affordable housing one of the most difficult challenges for nonprofit organizations.
Due to the reasons identified above, CHISPA is asking that their development impact fees be paid at the issuance of the first occupancy permit instead of at the issuance of building permits. On May 10, 2022, the City Council adopted Resolution No. 2022-4873 approving reduced impact fees for affordable housing projects. The reduced impacts for an affordable housing project totals $305,140.12. If the project were a market rate development, the impact fees would total $371,965.60.
COST ANALYSIS:
No financial impact from this action.
ENVIRONMENTAL REVIEW:
The action is not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it does not have the potential for resulting in either a direct physical change to the environment, or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.
ALTERNATIVES:
The following options are provided for Council consideration:
1. Direct the City Attorney to prepare an agreement to defer development impact fees until the first occupancy permit; or
2. Deny request to prepare agreement authorizing the deferment of development impact fees; or
3. Provide staff with alternative direction.

Re: Request to Defer Impact Fee payment for Mills Ranch Apartments Dear Mayor and City Council:
CHISPA will pay the building permit fees for Mills Ranch Apartments before year end of 2025, to allow us to maintain our current design under the 2019 building code.
Updating the design to the 2026 code will add a lot of expense and delay for re-design, and it would add additional construction costs. So, we appreciate being able to stay in our current code design.
Although we know we need to pay permit fees now, it would be helpful for our budget if we could defer paying the impact fees until we receive certificate of occupancy.
Thank you for considering this request. Our buildings will not actually create public impacts on the City until 2027, when they are leased, so it would be very helpful for us not to pay those fees now.
Funding Updates:
We are hopeful that we will receive $4,000,000 in HOME funds which we applied for in May.

RE: CONSIDERATION OF PURCHASE AND INSTALLATION OF
NEW POLICE STATION EMERGENCY GENERATOR
RECOMMENDATION:
It is recommended the City Council approve an appropriation of $29,000 from King City Community Power (KCCP) funding for installation costs for replacement of the Police Station emergency generator.
BACKGROUND:
The emergency generator that provides power to the Police Station is in need of replacement. The City has received approval of a grant from the Bay Area Urban Area Security Initiative (UASI) for $20,000 for disaster response equipment.
Staff recommend the grant be utilized for replacement of emergency generator.
However, the grant amount will only cover the equipment cost. There are significant installation costs that will also need to be funded to complete the project. Therefore, an additional appropriation is recommended.
DISCUSSION:
The emergency generator in the Police Department is a critical piece of equipment because it may be needed to power the emergency operations center (EOC) in the event of a disaster. The current generator is beyond its useful life and has failed recent testing. Therefore, replacement is a high priority, and the UASI grant provides an excellent opportunity to address this need.
Two bids were received. The low bid is approximately $20,000 submitted by All Tech. However, installation costs are an additional $28,000.

OF THE CITY OF KING AMENDING TITLE 12, CHAPTERS 12.04
AND 12.08 OF THE KING CITY MUNICIPAL CODE ADOPTING
THE 2025 CALIFORNIA BUILDING AND FIRE CODES
________________________________________________________________ RECOMMENDATION:
It is recommended City Council introduce an ordinance adopting the 2025 California Title 24 building and fire codes to be read by title only, open the hearing, allow for public testimony, close the hearing, waive first reading of the Ordinance, and approve the introduction of the Ordinance.
BACKGROUND:
The California Building Standards Commission (CBSC) has published the latest (2025) editions of the Building and Fire Codes (Codes) for the State of California.
They will become effective for every state agency and local municipality as of January 1, 2026. Cities and counties are mandated to adopt the State’s new construction codes every three years with or without local amendments.
Amendments are permitted provided that they are not less restrictive than the State code. Amendments to these codes must be supported by findings demonstrating that they are reasonably necessary to protect the health, welfare and safety of the citizens of King City due to local climatic, geological and topographical conditions. However, amendments to the Residential Code will not be permitted per current state law.
DISCUSSION:
The new codes contain 12 parts that incorporate the latest national standards in the International Building, Residential, and Fire Codes, National Electrical Code, and the Uniform Mechanical and Plumbing Codes. The new CBSC gives high

priority to maintaining elevated levels of fire and emergency safety standards throughout the state. Access to persons with disabilities remains a high priority in California. Additionally, the new standards incorporate the latest seismic safety standards, ensuring that buildings will be designed and constructed utilizing the latest technology to reduce loss in the event of an earthquake.
The updated codes reflect California’s ongoing commitment to being a leader in energy efficiency. Key changes include requiring new homes and businesses to incorporate electric-ready infrastructure, improving the efficiency of HVAC systems, and introducing new standards for non-residential buildings. No amendments are proposed for residential uses.
In accordance with state law, local jurisdictions, through amendments, incorporate additional regulations that address special circumstances in the community, based on geographical, topographical or climatic conditions, provided said changes and modifications are not less restrictive than the State Codes. Amendments to the new CBSC must be adopted by the local jurisdiction and submitted to the State Building Standards Commission prior to enactment.
The City’s Building Official, upon evaluation of both the new CBSC and building code amendments currently in effect, is proposing a number of local amendments to the CBSC. Most of the additional involve the inclusion of the Appendix chapters of each model code. All of the amendments are supported by findings identified in the first part of the proposed ordinance.
The California Fire Code has been incorporated into the attached ordinance and serves as the basis for most of the proposed amendments. The City’s Fire Chief recommends several local modifications to the model California Fire Code to maintain the City’s high level of fire protection. These include updated regulations for pallet storage and photovoltaic systems to enhance firefighter safety. Many of these amendments are continued from the previous King City Fire Code with the exception of reduced fire sprinkler requirements for remodels. These thresholds were not included in this adoption cycle to avoid creating financial barriers for new development, particularly along the future Broadway Street expansion and other commercial infill projects. As noted earlier, no amendments are proposed for residential uses in accordance with current state law.
Supplemental appendix provisions recommended for adoption include the following:

5. California Fire Code (CFC) with all Appendix Chapters except Appendix Chapter “A” and amendments to technical provisions in:
a. Chapter 3 (pallet storage added).
b. Chapter 12 (Energy Systems; signage requirements for photovoltaic systems).
COST ANALYSIS:
Cost of the new code books were $1,565.00 and were identified in the current budget.
ENVIRONMENTAL REVIEW:
The adoption of the 2025 California Title 24 building and fire codes with local amendments is not considered a “project” under CEQA Guidelines Section 15378 because it has no potential to result in a direct or reasonably foreseeable indirect physical change in the environment.
ALTERNATIVES:
The following alternatives are provided for Council consideration:
1. Conduct the first reading of the ordinance as proposed;
2. Postpone consideration and request additional information;
3. Direct staff to add additional requirements for fire sprinklers for remodels;

Section J110 Erosion Control- is hereby amended to read as follows:
General—Building and access envelopes shall be delineated on the development plans when necessary to keep disturbance out of particularly erodible areas.
Exposed soil shall be protected from erosion by temporary and/or permanent measures. Such protection may consist of mulching, plastic sheeting, and/or vegetation.
Runoff Control—where concentrated runoff will occur, it will be carried in pipe or culvert conduits or over a non-erodible surface (paved, rocked, or vegetated) to catchment basins clearly shown on the development plan. All conduits must have proper energy dissipaters at the point of discharge when necessary to prevent erosion.
Building Site Runoff—Runoff from the building site shall be controlled by berms, swales, ditches, structures, vegetative filter strips and/or catch-basins to prevent the escape of sediment from the site. At least one percent (1%) grade will be required toward an improved storm drainage or catch-basin facility, either existing or planned.
Runoff Retention—Permanent holding of runoff on the site through percolation to the ground shall be required during and after construction, by the use of catchbasin, retention grading, pavement collection and recharge systems, and/or individual systems for housing units such as drywells or cisterns. 8 Topsoil—to promote regrowth of vegetation, the topsoil shall be stockpiled and reapplied upon completion of grading on slopes of less than 5:1 (20%) Soil Placement and Disposal—The placing or disposal of soil, silt or other organic and earthen materials from construction and other soil-disturbance activities at locations above the anticipated high-water line of any stream in the basin where they may be washed into said waters by rainfall or runoff in quantities deleterious to fish, wildlife and other beneficial uses, is prohibited.
Temporary Vegetation—Temporary vegetation sufficient to stabilize the soil as permanent vegetation cover is maturing shall be established on all disturbed areas as needed and as each stage of grading is completed.
Winter Operation— (October 15 to April 15
(1) Land disturbance or development operations may be restricted or temporarily halted between October 15 and April 15 (the normal rainy season) and/or other times whenever the city Building inspector determines that the weather, soil, slope and general site conditions may cause serious accelerated erosion or sediment damage either on-site or downstream.
When work is allowed, native ground cover shall not be cleared, destroyed, burned, or disturbed more than 15 days prior to grading or construction work unless approved in advance by the city building inspector. (2) When land development work is allowed during the normal rainy season, adequate erosion and sediment control measures including sediment catchbasins must be in place and effective during any land disturbance. (3) All cut and fill slopes without established vegetation between October 15 and April 15 shall be mulched. The mulching shall be anchored by punching or tacking into the soil or by the use of netting. A minimum of 1,000 pounds of straw, or equivalent, per each 10,000 square feet of slope surface will be required to be anchored. An additional amount may be required by the city building inspector.
(4) All erosion control plantings and mulching shall be closely monitored throughout the winter and runoff problems corrected promptly.
Dust—Dust from grading operations must be controlled. The permittee may be required to keep adequate equipment on the grading site to prevent dust problems.
Erosion Control Coordination with Project Installation. (1) All vegetative and/or structural measures required to safely discharge any accelerated run-off generated by the project shall be installed during the first or initial construction phase of the project.
(2) Land shall be developed in increments of workable size which can be completed in a single construction season. Erosion and sediment control measures shall be coordinated with a sequence of grading, development 9 and construction operations and all necessary erosion control measures shall be put in effect to the commencement of the next work increment and/or winter rainy season.
(3) Prior to completion and final acceptance of the project, all erosion control measures must be in place and all exposed base soil shall be mulched, fertilized and otherwise prepared so that it is planted to a permanent vegetative cover. The city building inspector may require watering of planted areas to initiate and assure growth.
Existing major Developments—as part of an expansion or intensification of existing major developments, silt and grease traps or sediment catch-basins shall be required.
Maintenance—all on-site erosion control facilities shall be properly maintained by the owners for the life of the project so that they do not become nuisances with stagnant water, heavy algae growth, insect breeding, odors, discarded debris, and/or safety hazards. Vegetative maintenance required may include mowing, fertilization, irrigation and/or reseeding.

Item No. 11 (A)
REPORT TO THE CITY COUNCIL
DATE: NOVEMBER 25, 2025
TO: CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF KING CITY COMMUNITY POWER 2026
RATES, ALLOCATION OF HEADROOM REVENUES AND
AMENDMENTS TO THE PILOT ENERGY AGREEMENT
RECOMMENDATION:
It is recommended the City Council 1) adopt a Resolution approving the setting of 2026 King City Community Power (KCCP) residential rates at 5% below current PG&E energy rates and commercial rates at 1% below current PG&E energy rates; the allocation of approximately $230,000 of KCCP earned headroom funding for 2025 customer rebates, to be distributed in a manner substantially similar to the 2024 KCCP customer rebates; and the transfer of approximately $170,000 of KCCP earned headroom funding from KCCP to the City to pay for a portion of the electric charging station lot project, replacement of the Police Station emergency generator; and other budgetary needs of the community; and 2) approve and authorize the Mayor to execute an amendment to the Agreement with Pilot Power Group, LLC, for a reduction in lockbox funding requirements and the operation of KCCP for an additional five years, to expire December 31, 2034.
BACKGROUND:
The City launched its KCCP Community Choice Aggregation (CCA) program on July 2, 2018. The City entered into an agreement with Pilot Power Group, LLC, (“Pilot”) on December 12, 2017 to operate KCCP. At the February 28, 2023 meeting, the City Council approved renewal of the original agreement for an additional 7-year period (Agreement).
The Agreement includes provisions that commit KCCP to maintaining an ongoing minimum reserve of $400,000 (Reserve). In 2022, KCCP was in a concerning financial position due to a number of circumstances, all of which were fully vetted by the City Council. Since that time, tremendous progress has been made.
KCCP finances have stabilized, and the Reserve has remained fully funded since

PILOT ENERGY AGREEMENT

it was rebuilt in the 2022/23 Fiscal Year. In early 2024, qualifying residential customers received gift card rebates approximately equal to a 9% discount off of applicable PG&E energy rates, while commercial customers received a 1% bill discount. In early 2025, KCCP customers were awarded on-bill rebates of approximately $230,000 in total, and $170,000 was transferred to the City to fund electric vehicle charging and other budgetary needs of the community. The gift cards and on-bill rebates placed KCCP among the top of all California CCAs for customer discounts. KCCP’s cumulative customer-direct and community wide benefits are now approaching $3,000,000.
DISCUSSION:
Similar to 2024, KCCP’s 2025 net revenue, or “Headroom,” is approximately $400,000, which is proposed to be allocated in a manner substantially similar to last year’s $400,000 in Headroom. KCCP could, however, significantly increase future Headroom through longer term energy purchases. These purchases would take advantage of California energy prices that have fallen considerably over the last few years. Energy prices are much lower today than in 2023 when the Agreement was last renewed. At that time, the price for a twelve-month block of power was $88.50/MWh. Today, the same product is trading at just below $49.50/MWh, which is nearly a 45% price reduction. Another key energy cost in California is Resource Adequacy. Due to a softening in this market, Pilot anticipates sourcing KCCP’s Resource Adequacy requirements for the next fiveyear term at around 40% lower than current costs.
These favorable market conditions, however, can not be leveraged because KCCP’s Agreement expires in four years. Due to this abbreviated period and other conditions related to the expiration of the Agreement, Pilot is unable to make the longer term purchases that are forecast to further and substantially benefit KCCP’s future financial performance.
Amending the Agreement (see “First Amendement,” Exhibit 3) for an additional five years, to expire December 31, 2034, provides KCCP access to these lower prices and an ability to better stabilize costs for another five years. In addition to revising the expiration date, the Reserve requirement is proposed to be lowered to approximately $250,000. With three years of operating at the higher Reserve of $400,000, Pilot is confident that KCCP’s fiscal soundness is preserved at the considerably lower amount. The reduction in the Reserve allows KCCP to fund to an upfront, monthly discount off of current PG&E rates of 5% to residential customers and 1% to commercial customers, again placing KCCP among the top CCAs for rate discounts. This is in addition to the one-time rebate. At the end of 2026, the forecasted headroom of almost $400,000 would be allocated

consistent with current practices, which could include continuing with upfront, ongoing price discounts off of PG&E rates.
A further benefit of extending the Agreement’s expiration is that Pilot’s fixed charges will remain unchanged, remaining at the pricing in the original 2017 Agreement. The chart below provides a forecast of the anticipated impact of extending the Agreement expiration date, thus enabling longer term energy purchases. As stated in the footnotes, the forecast assumes that upfront, ongoing pricing discounts are maintained, and the reserve is lowered to approximately $250,000, thus Headroom is in addition to the rate discounts. 2026 2027 2028 2029 2030
Revenue* $4,765,654 $4,485,872 $4,223,650 $3,981,852 $3,759,107 Expenses $4,379,694 $3,982,205 $3,339,351 $3,044,307 $2,923,745 Headroom $ 385,961 $ 503,666 $ 884,299 $ 937,545 $ 835,361 Year End Cash $ 785,961 $ 753,666 $1,134,299 $1,187,545 $1,085,361 Cash Reserve $ 250,000 $ 250,000 $ 250,000 $ 250,000 $ 250,000 Cash in Excess of

$ 535,961** $ 503,666 $ 884,299 $ 937,545 $ 835,361
*Revenue reflects an ongoing 5% residential and 1% commercial rate discount. The data is a forecast and thus is not a guarantee of future performance, including the ability to maintain proposed rate discounts.
** The discrepancy between 2026 Headroom and the 2026 Cash in Excess of Reserve is driven by the release of $150,000 in funds from the cash reserve, and would serve to fund the ongoing, monthly rate discounts.
Other noteworthy KCCP enhancements implemented in 2025 include a recently redesigned website that is showing increased public engagement and transparency, expanded call center services with specialized support, and the launch of a targeted win-back campaign to re-engage former customers and strengthen community participation.
Staff recommends the following at this time:
• Set 2026 KCCP residential rates at 5% below current PG&E energy rates and commercial rates at 1% below current PG&E energy rates; • Allocate approximately $230,000 of KCCP earned headroom funding for 2025 customer rebates, to be distributed in a manner substantially similar to the 2024 KCCP customer rebates;

• Consistent with the terms and conditions of the Agreement, the immediate transfer of $170,000 from KCCP to the City, to fund the electric charging station lot project, a civic center emergency electric generator; and other budgetary needs of the community; and
• Approve and authorize the Mayor to execute an amendment to the Agreement with Pilot Energy for a reduction in lockbox funding requirements and the operation of KCCP for an additional five years, to expire December 31, 2034.
COST ANALYSIS:
The total projected KCCP budget for 2026 is approximately $5,000,000. KCCP’s 2026 Calendar Year Budget is attached as Exhibit 2. The recommendations will generate an additional $170,000 in City revenue for General Fund expenditures.
ENVIRONMENTAL REVIEW:
The allocation of KCCP funding is not considered a “project” for the purposes of the California Environmental Quality Act (CEQA). Therefore, this item does not have the potential for resulting in either a direct physical change to the environment or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.
ALTERNATIVES:
The following alternatives are presented for Council consideration:
1. Approve staff’s recommendations;
2. Allocate more or less headroom to rate decreases and rebates;
3. Allocate more or all of the headroom to electric vehicle charging or other projects;
4. Allocate the headroom, but do not approve the amendments to the Agreement;
5. Postpone the decision and request additional information; or
6. Provide staff other direction.

Item No. 11 (B)
REPORT TO THE CITY COUNCIL
DATE: NOVEMBER 25, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF SUSPENSION OF CANNABIS EMPLOYEE
WORK PERMIT REQUIREMENTS
RECOMMENDATION:
It is recommended City Council: 1) adopt a Resolution pausing enforcement of King City Municipal Code Section 17.03.070(b)(6) requiring work permits for commercial cannabis business employees; and 2) direct staff to prepare an ordinance permanently deleting the requirement.
BACKGROUND:
In September 2016, the City Council adopted amendments to Title 17, Chapter
17.03 of the King City Municipal Code pertaining to commercial cannabis activity to facilitate and regulate the allowance of indoor commercial cannabis activity, as well as the manufacturing and testing of commercial cannabis products. In June 2017, the City Council adopted an amendment to the Ordinance that refined the work permit approval process and other provisions. The Ordinance was further amended in September 2021. In March 2025, City Council approved additional changes to exempt labor contractors from worker permit requirements.
The work permit process includes requirements for a background check and approval by the City Manager. The backgrounds were originally conducted by an outside contractor, but it was later transferred in-house to improve efficiency of the process in terms of costs and turnaround time. The major component of the City’s background check is a Livescan. The fee for each employee work permit is $250 for new employees and $200 for renewals. There are separate provisions in Section 17.03.210 covering additional background checks required for owners, investors, shareholders, board members, managers, and supervisors.
CITY COUNCIL
CONSIDERATION OF SUSPENSION OF CANNABIS EMPLOYEE WORK
PERMIT REQUIREMENTS
NOVEMBER 25, 2025
The City has had difficulty obtaining the appropriate authorizations to administer the Livescan. The Police Department was able to categorize them in a way to make it feasible, but changes in State law have now made that approach no longer viable. As a result, staff are recommending the requirements for employee work permits be suspended at this time.
DISCUSSION:
The City’s work permit requirements are costly for the cannabis businesses, who are currently struggling financially due to the product oversaturation of this industry. They also impact their ability to staff their operations due to the tasks involved and waiting period. Meanwhile, the process is labor intensive for City staff, particularly for the Police Department where administrative staff have been reduced due to budget constraints.
The work permit requirements were established by the City when cannabis businesses were first allowed to maximize safety and prevention of illegal activity. However, King City is now one of few jurisdictions that have maintained these requirements. The City has denied very few of the applications and haven’t experienced any issues with illegal activity of employees. Further reducing risks is the fact that the City has a much lower amount of cannabis cultivation activity than was originally projected.
As a result, when evaluating how to address issues with the Livescan process, staff concluded that the best solution at this time would be to simply eliminate the work permit requirement. It is recommended to adopt a Resolution suspending the enforcement while an ordinance making the permanent modification to the Municipal Code can be prepared and presented to the Planning Commission and City Council. Background check requirements for business owners would still be maintained, and staff will develop recommendations on how to address those requirements in the future.
COST ANALYSIS:
There will be legal costs associated with drafting the Ordinance changes. There will be a loss of approximately $10,000 annually in permit revenue. However, most of this loss will be addressed through a decrease in costs for the Livescans.
ENVIRONMENTAL REVIEW:
Staff has performed a preliminary environmental assessment of this action and has determined that is exempt from the California Environmental Quality Act

RESOLUTION NO. 2025-5067
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KING DIRECTING CITY STAFF TO PAUSE ENFORCEMENT OF SECTION 17.03.070(b)(6) OF THE KING CITY MUNICIPAL
CODE GOVERNING EMPLOYEE WORK PERMIT REQUIREMENTS FOR COMMERCIAL
CANNABIS BUSINESSES
WHEREAS, in September of 2016, the City Council adopted amendments to Title 17, Chapter 17.03 of the King City Municipal Code pertaining to commercial cannabis activity to facilitate and regulate the allowance of indoor commercial cannabis activity, as well as the manufacturing and testing of commercial cannabis products; and WHEREAS, in June of 2017, the City Council adopted an amendment to the Ordinance that refined the work permit approval process and other provisions; and WHEREAS, the Ordinance was further amended in September of 2021; and WHEREAS, Section 17.03.070 sets forth provisions and requirements for employee work permits, which requires every employee or independent contractor working at a commercial cannabis business to obtain an employee work permit issued by the City before commencing any work; and
WHEREAS, the work permit process includes requirements for a background check and approval by the City Manager; and
WHEREAS, the work permit process requires an applicant to be fingerprinted by the King City police department or the California Department of Justice LiveScan system and agree to a criminal history records check conducted by the city manager based upon their fingerprints; and
WHEREAS, the State of California has failed to provide the City with authorization to utilize the LiveScan process to verify the criminal history of cannabis business employees; and WHEREAS, the City Council has determined that seasonal workers employed and supervised by a labor contractor pose less safety risks than permanent employees; and WHEREAS, the City Manager and City Attorney have determined that a permanent amendment to the Ordinance is necessary to address the State’s failure to provide appropriate access to the LiveScan system; and
WHEREAS, a pause in the enforcement of Section 17.03.070(b)(6) is necessary to ensure compliance with existing statutes and to prevent the needless expense of City resources to enforce a provision which the City Attorney will request be removed by an amendment to the Ordinance.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the City Council of the City of King approves and does direct City staff as follows:
1. City staff shall not enforce the Section 17.03.070(b)(6) of the King City Municipal Code governing Employee work permits.
