RE: CONSIDERATION OF REJECTION OF BIDS FOR THE 2025
CDBG PAVEMENT REHABILITATION PROJECT
RECOMMENDATION:
It is recommended City Council: 1) reject all bids for the 2025 CDBG Pavement Rehabilitation Project; and 2) direct staff to solicit new bids for the project with revised street improvement specifications.
BACKGROUND:
Improvement Plans and Specifications were put out to bid for the 2025 CDBG Pavement Rehabilitation Project. The pavement rehabilitation project covers several street segments. The work generally includes the following: performing dugouts, raising and lowering utility covers, cold planing, HMA leveling course and surface course, cape seal (Type 2 Slurry Seal over Rubberized chip Seal, striping and markings.
The City was awarded a CDBG grant in the amount of $3,300,000.00 of which $3,029,112.15 is available for design, construction and project management.
The City received 11 bids with the apparent low bidder being Mckim Corporation with a base bid of $1,257,076.92. The official bid opening results are attached.
DISCUSSION:
After bids were received, staff have identified the potential to upgrade the treatment to provide full street replacement to S Third Street, S Vanderhurst Street and S San Lorenzo Street within the budgeted CDBG grant. As a result, staff is recommending rejecting all bids and rebidding the project for construction after the sewer job is complete in early 2025.

CONSIDERATION OF REJECTION OF BIDS FOR THE 2025 CDBG
PAVEMENT REHABILITATION PROJECT
DECEMBER 9, 2025
Given the large gap in available CDBG funds intended to make neighborhood street improvements and the apparent low bidder, staff recommend rebidding the project to upgrade the treatment to provide full street replacement on the three major north south streets, specifically, S Third Street, S Vanderhurst Street and S San Lorenzo Street included in this project.
Although staff believes the bids were good, having the project designed to fully replace the above-mentioned streets will increase their useful to 25 to 30 years which will benefit the City’s pavement management program. If additional streets were added instead, it would be difficult to complete the environmental review in time to change the scope of the CDBG project description.
COST ANALYSIS:
A revised engineers estimate of probable costs was prepared with the updated street specifications and came in at $3,136,509. King City will be utilizing CDBG funds for this project. The City was awarded a CDBG grant in the amount of $3,300,000.00 of which $3,029,112.15 is available for design, construction and project management. Measure X funds are intended to be used to cover the gap between available CDBG funds and the actual project costs.
ENVIRONMENTAL REVIEW:
Staff have performed a preliminary environmental assessment of this project and have determined that if it falls within the Categorical Exemption set forth in Section 15301 of the CEQA guidelines because the contract is for the maintenance and repair of existing streets, which will not result in the expansion of capacity of these streets. Staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, section 15300.2 apply to this project. NEPA review on the project was also completed. In addition, since this item is to reject bids and not approve the project, no environmental review is necessary for this action.
ALTERNATIVES:
The following alternatives are provided for Council consideration:
1. Reject all bids of the 2025 CDBG Pavement Rehabilitation Project and solicit new bids with revised street improvement specifications;
2. Award Base Bid of the 2025 CDBG Pavement Rehabilitation Project as proposed by low bidder, McKim Corporation in the proposed amount of $1,257,076.92 and identify additional streets to add to the project under a separate bid;

RE: CONSIDERATION OF REJECTION OF BIDS FOR THE KING
CITY GOLF COURSE RESTORATION PROJECT
RECOMMENDATION:
It is recommended City Council: 1) reject all bids for the King City Golf Course Restoration Project; and 2) direct staff to solicit new bids for the project.
BACKGROUND:
Improvement Plans and Specifications were put out to bid for the King City Golf Course Restoration Project.
During the incident period December 27, 2022, through January 31, 2023, the San Lorenzo Creek flooded the golf course. The flood damaged 6 holes on the course, by washing away various features, and depositing sediment, pollutants, and invasive plants, which have or will kill the turf. The project will remove between 1 to 2 feet of sediment to minimize flood rise impacts and restore the golf course to pre-disaster condition by following the United States Golf Association (USGA) industry standards.
In general, the work to be done in this project shall include, but is not limited to demolition, removal, offsite disposal, grading, compaction, repair, and/or construction of fairways, greens, tee boxes, irrigation, golf cart paths, concrete sidewalks, and ramps at the King City Golf Course.

COURSE RESTORATION PROJECT

DISCUSSION:
The City received the following bids:
Contractor Base bid Add Alt 1 Add Alt 2
Don Chapin Company $6,895,600.00 $245,600 $428,800
Specialty Construction Inc. $7,890.034.32 $241,164 $1,281,000 The City has been processing the damage claims to FEMA for the past two years. Everything was going well until the construction bids came in well above the Engineers Cost Estimate of $4,025,000 and the approved project FEMA allocations. The City spent considerable amount of time requesting the project allocation amounts be changed to have the funds available during construction as opposed to waiting for reimbursement at the end of the project as this would put a strain on the City’s finances.
Since it has been over a year since the City received the bids, the bids are no longer valid. Staff recommend updating the bid documents and soliciting new bids. The project will be posted in various builder’s exchanges and will be hosting mandatory prebid meetings to answer any questions contractors may have.
COST ANALYSIS:
The City was successful in having the project cost estimates updated. FEMA will be paying 75% of all eligible project costs and Cal OES will be funding 75%. King City’s portion will be 6.25%.
ENVIRONMENTAL REVIEW:
Staff have performed a preliminary environmental assessment of this project and have determined that if it falls within the Categorical Exemption set forth in Section 15301 of the CEQA guidelines because the contract is for the maintenance and/or repair of existing infrastructure, which will not result in the expansion of park lands or capacity. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, section 15300.2 apply to this project. NEPA review has already been completed.
In addition, this action is only a rejection of bids and does not constitute project approval, so no environmental review approval is required for this action.
