REPORT TO THE CITY COUNCIL
DATE: JANUARY 27, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF 2026 FIREWORKS PERMIT PROCESS
RECOMMENDATION:
It is recommended the City Council adopt a Resolution setting forth the number of permits to sell fireworks and the method of selection of permit holders.
BACKGROUND:
In 2011, the City Council adopted Ordinance Number 691 establishing Chapter
7.34 of the King City Municipal Code governing the limited allowance of the sale and use of safe and sane fireworks in the City limits. The City Council adopted some updates to the Ordinance in 2025. Section 7.34.030(c) calls for the City Council, in the calendar month of January, to set by Resolution or by minute order the number of permits to be issued for the sale of safe and sane fireworks, the form of application for such permit and for the method of selection.
DISCUSSION:
Periodic adjustments have been made to the fireworks booth permit process to address concerns identified by non-profit groups that have participated. Staff believe the process has worked well since the adjustments were implemented.
No additional changes are recommended this year. The Resolution sets forth that a maximum of three fireworks booth permits will be issued with no permits allotted to pre-designated groups. If more than three applications are received, a lottery will be conducted at the March 24, 2026 Council Meeting. Due to a lower number of applications, no lottery has been necessary the past few years.
This action deals only with safe and sane fireworks. The City has received a number of ongoing complaints regarding the amount of illegal fireworks that are

WHEREAS, Section 7.34.030(c) calls for the City Council, in the calendar month of January, to set, by Resolution or by minute order, the number of permits to be issued for the sale of safe and sane fireworks, the form of application for such permit and for the method of selection, and
WHEREAS, Section 7.34.040 (a) allows the City Council to set a fee for applying for such permit; and
WHEREAS, Section 7.34.100 allows the City Council to establish a regulatory fee for those entities that do receive a permit to reimburse the City for costs associated with administering and enforcing the permit process and activities allowed under the permits.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of King as follows:
1. The number of fireworks sale permit holders for the calendar year shall be set at three to be awarded to non-profit community organizations.
2. The permit recipients shall be selected by lottery conducted by the City Manager or designee at a public time and place, which shall be notified to all applicants.
3. Permit fees shall be established at $39 for application, $395 for a fireworks sale permit, and $165 if an inspection is requested after business hours.
4. The application is approved as attached and included herein as Exhibit A, which shall be available to the public on February 5, 2026 and due to City Hall by 5:00 p.m., March 5, 2026.

REPORT TO THE CITY COUNCIL
DATE: JANUARY 27, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: STEVEN ADAMS, CITY MANAGER
RE: CONSIDERATION OF FOURTH AMENDMENT TO MONARCH
INN LEASE AGREEMENT
RECOMMENDATION:
It is recommended the City Council: 1) approve and authorize the City Manager to execute a Fourth Amendment to the Lease Agreement for the Monarch Inn for the temporary homeless emergency shelter program; and 2) authorize the City Manager to make non-substantive changes as necessary in a form approved by the City Attorney.
BACKGROUND:
The City has experienced an ongoing significant level of homelessness. A substantial number of homeless individuals formerly resided in encampments in the Salinas Riverbed area, which created issues regarding unsafe living conditions, environmental damage, public safety concerns, and fire hazards. The City has undertaken efforts to do its part in addressing homelessness in a proactive manner.
The most significant step was the application and approval of a Homekey project, which will be a permanent supportive housing facility. The former Days Inn hotel was acquired, but the project experienced serious delays due to foreclosure of the property from the developer. As a result, the City and its agency partners obtained additional grants. The Housing Authority of Monterey County agreed to assume the role of developer and owner, and the property was acquired again with the grant funds approved. Improvements are now under construction and are projected to be completed within the next month.
Due to the extensive delays, the City and its agency partners developed an interim plan to shelter homeless living in the riverbed at the Monarch Inn hotel

until the Homekey project is completed. The City Council approved an overall Interim Riverbed Homeless Strategy at the June 13, 2023 meeting.
Implementation began in July 2023, which has been successful and operated within the budget approved by City Council.
The original agreement was established for 18 rooms with the motel owner through the end of October 2023. Extensions were later approved by the City Council at the December 12, 2023, January 9, 2024, May 14, 2024, October 8, 2024, and June 10, 2025 meetings and the number of rooms leased was expanded to 21. The individuals residing in the Monarch Inn will transfer to the permanent supportive housing project once it is available. Another extension is proposed to maintain them in housing until that time.
DISCUSSION:
The current lease expires on February 15, 2026. The project is scheduled to be complete by that time, but staff believe it would be prudent to plan for limited additional time to accommodate any unforeseen delays, potential weather interruptions, and sufficient time for placement of participants at the new facility.
Therefore, an additional extension to the end of February has been negotiated and agreed to by the Monarch Inn property owner.
COST ANALYSIS:
Additional costs for the extension include the following:
Rent $24,264
Cleaning Services $2,880
Security Services $5,376
Total $32,520
The additional costs will be paid with Homeless Housing, Assistance and Prevention (HHAP) grant funding obtained from the County. In 2023, the City committed to $45,000 in General Fund revenues to address a portion of the costs of the first phase of the project. Since that time, all other costs have been paid from a variety of grant funds.
ENVIRONMENTAL REVIEW:
The Temporary Homeless Shelter Program is not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it is temporary and does not involve construction or modification to buildings, property or facilities. Therefore, it does not have the potential for resulting in either a direct physical change to the

RE: CONSIDERATION OF 2025 COMMUNITY DEVELOPMENT
BLOCK GRANT (CDBG) NOTICE OF FUNDING AVAILABILITY
(NOFA) APPLICATION – PERMANENT SUPPORTIVE HOUSING
PROJECT OPERATIONS AND YOUTH JOB DEVELOPMENT
AND PLACEMENT PROGRAM GRANT
RECOMMENDATION:
It is recommended the City Council adopt a Resolution approving the submission of the 2025 Community Development Block Grant (CDBG) Notice of Funding Availability (NOFA) application for the Permanent Supportive Housing Project Operations and Youth Job Development and Placement Program and authorizing the Mayor to execute all necessary documents related to the application.
BACKGROUND:
The City of King is preparing to submit a 2025 CDBG application in response to the NOFA released on September 30, 2025 by the California Department of Housing and Community Development (HCD). The NOFA outlines the availability of approximately $27 million in federal funding allocated through the United States Department of Housing and Urban Development (HUD) to support nonentitlement communities like King City. The primary goals of the CDBG program are to develop viable urban communities through the provision of decent housing, a suitable living environment, and economic opportunities, primarily benefiting low- and moderate-income (LMI) persons.
Two public hearings were conducted by staff on November 6, 2025 and November 13, 2025 per the requirements of the CDBG grant application guidelines. Staff are recommending the application included a request for funding for two public service activities. The first is funds for operation of Casa de Esperanza, the King City Homekey Permanent Supportive Housing Project.
The second is development of the Youth Job Development and Placement

Program. The application process requires adoption of a Resolution by the City Council, which is attached for City Council consideration.
DISCUSSION:
The City’s Homekey Permanent Supportive Housing Project at the former Days Inn site is projected to be complete and operational in February 2026. It will provide housing and support services to those who are homeless or at risk of homelessness. It is now owned and will be operated by the Housing Authority of the County of Monterey. The acquisition, improvements and initial operation are fully funded through grant sources, but additional funding is needed for ongoing operation in the future.
The Youth Job Development and Placement Program is proposed to be developed and implemented by the Monterey County Workforce Development Board with assistance from City staff. It is a recommendation of the King City Comprehensive Plan to End Youth Violence Phase II and will initially target students from Portola Butler High School and participants at Sun Street Center.
The program would be funded primarily by the CDBG grant funds, but it would be supplemented by other Monterey County Workforce Development Board Federal funding. The proposed program was identified as one of the highest priorities by the Comprehensive Plan to End Youth Violence Phase II Task Force.
Under the 2025 CDBG NOFA guidelines, the City can apply for up to 2 public service activities for up to $300,000 each. CDBG funds must meet a national objective, which include to benefit low-moderate income persons, aid in the prevention of slums and blight, or meet an urgent need.
COST ANALYSIS:
The cost for preparation of the application is $4,000, which is budgeted. All program and grant activities would be funded from the grant proceeds. Some staff time would need to be dedicated for assistance with the programs and grant administration.
ENVIRONMENTAL REVIEW:
An Environmental Review Analysis was conducted on the proposed activities and was determined to qualify as Categorically Excluded not subject to Section 58.5 pursuant to NEPA. The application is also not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it does not have the potential for

RE: CONSIDERATION OF CITY MANAGER APPOINTMENT
RECOMMENDATION:
It is recommended the City Council 1) appoint Police Chief Robert Masterson as Acting City Manager for the period of February 7, 2026 through February 22, 2026; and 2) authorize acting duty pay for the period of the assignment.
BACKGROUND:
City Manager Steve Adams’ final day of employment with the City is February 6, 2026. José Arreola’s first day as City Manager will be February 23, 2026.
Therefore, an Acting City Manager needs to be assigned for the interim period.
DISCUSSION:
Acting assignments are typically approved by the City Manager. However, since there will not be a permanent city manager in place at the time involved, it is appropriate for the City Council to formally approve the assignment. Chief Masterson has served as Acting City Manager in the past and is very qualified to handle this role during the 2-week period.
COST ANALYSIS:
Acting pay will amount to less than $1,000. Maintaining the city manager position vacant for a 2-week period will result in a net savings of approximately $10,000.
ENVIRONMENTAL REVIEW:
The assignment is not a “project” for the purposes of the California Environmental Quality Act (CEQA). Therefore, the proposed action does not have the potential for resulting in either a direct physical change to the environment or a reasonably

foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.
ALTERNATIVES:
The following alternatives are presented for City Council consideration:
1. Approve the temporary appointment;
2. Propose and approve a different appointment;
3. Appoint another staff member for a portion of the time period; or
4. Provide staff other direction.

RE: CONSIDERATION OF AMENDED KING CITY COMMUNITY
POWER 2026 RATES, REALLOCATION OF 2025 HEADROOM
REVENUES, AND AMENDMENT TO THE PILOT ENERGY
AGREEMENT
RECOMMENDATION:
It is recommended the City Council: 1) adopt a Resolution approving the amendment of the 2026 King City Community Power (KCCP) residential and commercial rates such that, until all pending litigation and issues between the Community Choice Aggregation (CCA) community and the California Public Utilities Commission (CPUC) regarding the Power Charge Indifference Adjustment (PCIA) related issues are resolved, all rates are set dynamically, on no less than a monthly basis, at rates that ensure KCCP’s financial stability while maintaining the lowest possible customers rates, which necessitates recovery of zero net revenues, or “headroom”; cancellation of 2026 customer rebates; cancellation of all prior allocations of 2025 earned headroom, with the exception of the transfer of approximately $170,000 of 2025 KCCP earned headroom funding from KCCP to the City to pay for the replacement of the Police Station emergency generator and electric vehicle charging station lot project; and 2) approve and authorize the Mayor to execute a second amendment to the Agreement with Pilot Power Group, LLC, that adds clarity to King City’s rights to terminate CCA service in the event the PCIA-related or other similar issues make it infeasible to maintain rates competitive with Pacific Gas and Electric Company (PG&E) on a long-term basis.
BACKGROUND:
The City launched its KCCP Community Choice Aggregation (CCA) program on July 2, 2018. The City entered into an agreement with Pilot Power Group, LLC, (“Pilot”) on December 12, 2017 to operate KCCP. At the February 28, 2023 meeting, the City Council approved renewal of the original agreement for an

additional 7-year period (Agreement). At the November 25, 2025 meeting, the City Council approved 2026 KCCP customer rates, allocation of 2025 earned headroom, reduction of the reserves to $250,000, and the extension of the Agreement until December 31 2034.
DISCUSSION:
The PCIA is a fee that, generally speaking, is substantial for CCA customers and often a rebate for utility customers. Theoretically, the PCIA is intended to recover from CCA customers the over-market costs of energy procured for them prior to departing utility service. The PCIA has essentially functioned roughly within these parameters from the launch of KCCP until now, or for eight years of KCCP service. During those eight years, KCCP has managed to procure energy for King City citzens that is not only less expensive than PG&E’s energy, but less expensive than the cost of PG&E’s energy plus the PCIA charge.
In June of 2025, the CPUC issued a decision regarding changes to the calculation of the PCIA. However, the impact of the change could not be discerned until the utilities’ Energy Resource Recovery Account (ERRA) proceedings were adjudicated, which provide the inputs for the PCIA calculation.
The ERRA decisions were issued in December of 2025. Upon issuance of the decisions, PG&E, the utility that serves KCCP, proceeded with calculating and issuing the new PCIA charges. KCCP received these new PCIA calculation in early January. PCIA, because it is based on the year the CCA customers left PG&E service for CCA service, calculates a different amount for each year, or “vintage.”
KCCP’s neighboring CCA, 3CE, and Ava Community Energy serving Alameda County and related jurisdictions, all have customers covered by the same 2018 PCIA vintage. Much to the dismay of these and most, if not all, other CCA’s, the PCIA increased between approximately 300% to 500% across all vintages, with the 2018 PCIA vintage on the higher end. This is blatantly anti-competitive, inconsistent with CPUC laws and regulations, and could, cause CCAs to suffer catastrophically in the long-term.
In response, a number of parties, including the CCAs individually and through trade organizations, are litigating the PCIA and related issues. The earlier June 2025 decision is currently on petition for writ of review in the California Court of Appeal, 3rd District, and the December 2026 ERRA decisions are being challenged at the CPUC level, which must occur prior to seeking redress in the California Courts. The two proceedings are estimated to take between a year and two years to resolve.
CITY COUNCIL
CONSIDERATION OF AMENDING KING CITY COMMUNITY POWER 2026
RATES, REVOCATION OF ALLOCATION OF MOST HEADROOM REVENUES
AND A SECOND AMENDMENT TO THE PILOT ENERGY AGREEMENT
JANUARY 27, 2026
While the issues are in litigation, to maintain fiscal stability, KCCP should amend the previously adopted 2026 residential and commercial rates such that all rates are set dynamically, on no less than a monthly basis, and revoke all 2025 headroom/net revenue expenditures, except for the $170,000 allocated for replacement of the Police Station emergency generator. The revocation covers, but is not limited to, funding for the customer rebates and all other programs, such as the electric car charging program. The dynamic rate setting proposal not only allows KCCP to respond to a rapidly changing financial environment and maintain interim fiscal stability, it also allows KCCP to immediately adjust rates should the CCAs be afforded favorable interim PCIA relief.
To provide KCCP with further assurance that should the current PCIA and related concerns not be resolved in a manner that allows CCAs to operate on a level playing field that is not anti-competitive and drastically skewed toward the utilities, Pilot has agreed to amend the termination provision of the Agreement to specifically address this scenario. It would enable the City to terminate the extension recently approved by City Council if it is determined in the next twoyear period that it is infeasible for KCCP to maintain rates less than or equal to PG&E rates in the future on an ongoing basis due to the PCIA calculation or other factors.
Because rates will be set dynamically on at least a monthly basis, the impact on KCCP rates relative to PG&E rates can not be adequately forecasted at this time.
Rates for the month of January 2026, which are based on the prior 2026 ratesetting adopted in November 2025, will be lower than December 2025 rates.
February 2026 rates, while higher than January 2026 rates, will still be lower than December 2025 rates but no headroom will accrue. Bills for average residential and average commercial customers are presented below:
Pilot will provide data on monthly rate adjustments in the pro forma report that is provided on a monthly basis. Once changes occur or more clarity is determined regarding the future impact of the new PCIA methodology, staff will present an update to the City Council. If the PCIA issues causing this rate instability are addressed, staff will return to City Council to recommend a standard rate schedule as has been done in the past.
