REPORT TO THE CITY COUNCIL
DATE: FEBRUARY 24, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: DOREEN LIBERTO, AICP, COMMUNITY DEVELOPMENT DIRECTOR RE: CONSIDERATION OF ORDINANCE AMENDING MUNICIPAL CODE
CHAPTER 17.01 AND 17.14 (R-2) MEDIUM DENSITY RESIDENTIAL DISTRICT OF TITLE 17 OF THE KING CITY MUNICIPAL CODE
RECOMMENDATION:

It is recommended the City Council continue the item to March 10, 2026.

BACKGROUND:

On January 13, 2026, City Council directed staff to prepare a zone amendment establishing victim service provider transitional housing as an allowed use in the R-2 zone. Victim service providers are professionals and organizations offering crucial support, advocacy and resources (counseling, housing and legal aid) to survivors of crime, including domestic violence, sexual assault and stalking. Supporting victim service providers with transitional housing opportunities is an important component of the City's 2023-2031 Housing Element (Cycle 6). One of the goals in the Housing Element includes Program 8 - Special Housing Needs which is to update the zoning code to accommodate a variety of housing types including transitional and supporting housing and to ensure consistency with State regulations.

On February 3, 2026, the Planning Commission considered the Ordinance and had several questions and continued the item to February 17, 2026. Since the timeline is short between February 17, 2026 and the February 24, 2024 City Council consideration of the item, staff recommends continuation to March 10, 2026.

CITY COUNCIL
CONSIDERATION OF ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 17.01 AND 17.14 (R-2) MEDIUM DENSITY RESIDENTIAL DISTRICT TO ALLOW VICTIM

SERVICE PROVIDER TRANSITIONAL HOUSING
FEBRUARY 24, 2026
DISCUSSION:

California law provides that transitional housing operated by a victim service provider shall be permitted in residential zones consistent with the applicable to other residential uses.

Currently, under State law, a residential use serving six or fewer persons must be treated the same as a family dwelling and permitted by right, without the need for a discretionary approval such as a conditional use permit (CUP). State law does not extend the same byright allowance to facilities serving seven or more residents. City proposed text amendment would amend the R-2 zone to allow transitional housing operated by victim service provider as a permitted residential use, not requiring a use permit. The Municipal Code Amendments as proposed include the following: Amend Title 17, Chapter 17.14 of the King Municipal Code to add the following subsection: (1) 17.14.020 (7) Transitional Housing - Victim service provider, subject to the same objective development and property standards applicable to other residential uses in the R-2 zoning district. Amend Title 17, Chapter 17.01 of the King City Municipal Code to add the following subsections:
17 .01 .501 "Transitional housing" has the meaning set forth in California Government Code Section 65582. as may be amended from time to time. 17 .01. 545 "Victim service provider" means a nonprofit, governmental, or faith-based organization that provides shelter and supportive services to victims of domestic violence, sexual assault, human trafficking. stalking. or other crimes. The proposed amendment is consistent with the City's 2023-2031 Housing Element to identify and address emergency shelters and transitional and supporting housing as special housing needs, including housing for femaleheaded households and individuals experiencing homelessness or in need of emergency shelter. Note that the recommendation is restricted to Victim Service Provider housing, which are less likely to experience some of the concerns that may be associated with other forms of transitional housing in a residential neighborhood. In addition, the desire for the ability to house over 6 people would be to accommodate children of adult victims residing in the home.

On February 3, 2026, the Planning Commission considered the Ordinance, raised several questions, and continued the item to February 17, 2026. During the February 3 meeting, the Planning Commission discussed concerns regarding allowing Victim Service Provider Transitional Housing in the R-2 Zoning District. Specifically, the Commission expressed concern that the proposed ordinance does not establish a maximum number of residents and indicated that this use should be reviewed on a case-by-case basis. The Commission also noted existing housing overcrowding within the City and expressed concern that the proposed ordinance could further intensify these conditions.

Responses to the Planning Commission’s questions are provided in the February 17, 2026 Staff Report. However, due to the short timeframe between the February 17, 2026

Item No. 11(A)

REPORT TO THE CITY COUNCIL
DATE: FEBRUARY 24, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: DOREEN LIBERTO, AICP, COMMUNITY DEVELOPMENT DIRECTOR RE: CONSIDERATION OF TRANSFERRING THE KING STATION

MULTIMODAL TRANSIT CENTER PROJECT TO THE

TRANSPORTATION AGENCY FOR MONTEREY COUNTY
RECOMMENDATION:

It is recommended the City Council provide comments on the potential transfer of the King Station Multimodal Transit Center project to the Transportation Agency for Monterey County (TAMC).

BACKGROUND:

The City has been working to reestablish passenger rail service since 2006. Over the past two decades, substantial progress has been made toward development of a Multimodal Transit Center (MMTC), including its inclusion in local, regional, state, and Amtrak planning documents. The City has secured a significant portion of the funding needed to construct the MMTC, prepared engineering plans in coordination with RailPros, and negotiated with Union Pacific Railroad (UP) regarding required improvements prior to the initiation of passenger rail service.

In January 2026, the Public Works Director/City Engineer separated from City employment, and the Community Development Director is anticipated departing in spring 2026. Given these critical staffing changes and the need to manage workload impacts on remaining staff, transferring responsibility for the MMTC project to the Transportation Agency for Monterey County (TAMC) would be beneficial. The TAMC Board is scheduled to consider acceptance of the project at its February 25, 2026 meeting.

DISCUSSION:

Staff recommends that TAMC assume responsibility for planning, engineering, and administration of the MMTC project, including preparation and processing of the required

environmental documentation, due to current staffing limitations. Transferring the project would reduce workload demands on City staff, align with how similar rail projects are managed throughout the State, and may improve the City’s ability to secure additional funding through TAMC.

On February 9, 2026, the Community Development Director met with Todd Muck, TAMC Executive Director, and Christina Watson, TAMC Director of Planning, to discuss the steps required to transfer the MMTC project. The transfer would require formal agreements between the City and TAMC, as well as the transfer of project materials, the RailPros contract, and associated grant funds.

The MMTC project is currently in the design phase under contract with RailPros. The City has been negotiating with UP regarding improvements it would like made prior to the initiation of passenger service. UP has requested the inclusion of a pedestrian overcrossing, and accelerated platforms on both sides of the railroad tracks, which increases project costs and exceeds the current funding commitments for full buildout of the MMTC.

The following lists existing funding.

Existing Funding
SRA $1,475,000
SRA $6,375,000
ITIP $7,500,000
SB 125 $7,500,000
Amtrak $5,000,000
