REPORT TO THE CITY COUNCIL
DATE: APRIL 28, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JEFF VAN DEN EIKHOF, CONSULTANT CITY ENGINEER
THROUGH: JOSE ARREOLA, CITY MANAGER
RE: APPROVE THE LIST OF CONSULTANTS ON-CALL
INSPECTION AND CONSTRUCTION MANAGEMENT SERVICES
RECOMMENDATION:
It is recommended that the City Council approve the list of qualified consultants for on-call Inspection and Construction Management services BACKGROUND:
The City utilizes professional consulting firms to provide licensed technical expertise in various disciplines, supporting the implementation of the City’s Capital Improvement Program (CIP) as well as other non-CIP projects and initiatives. These services are necessary to supplement City staff and ensure timely, cost-effective project delivery, particularly for work that requires specialized skills or additional capacity. The use of pre-qualified on-call consultant services is the standard for agencies that prioritize both efficient staffing levels and productivity.
DISCUSSION:
The City publicly solicited proposals on March 2, 2026, for On-call Inspection and Construction Management consulting services. Eight consultants submitted proposals for the disciplines requested from City staff by the due date of March 27, 2026. Submittals were evaluated based on qualifications, relevant experience, and demonstrated ability to perform the services requested. The eight consultants who submitted proposals were deemed to be qualified.
The professional services covered under the on-call categories include:
• Inspection services

CONSTRUCTION MANAGEMENT SERVICES LIST

o The work includes inspecting Capital Improvement Projects for compliance with the plans and specifications. The City generally uses the City of King and Caltrans Standards. The Consultant must have experience with Caltrans standards.
• Construction management services
o The work may include the following:
▪ Oversee construction and post-construction
▪ Regular communication with City staff regarding projects. ▪ Attend project meetings and prepare meeting agendas and action items.
▪ Coordination with engineering consultants, other agencies, and utility companies.
▪ Development and maintenance of project schedules
▪ Coordinating contractors and subcontractors, ensuring construction quality, safety, and keeping the project on schedule and within budget.
This proposed list will serve as the basis for assigning work for CIP and other projects requiring technical expertise in the areas listed above. The list of recommended firms is in Attachment A.
Some of the upcoming projects requiring inspection and construction management include the following:
• 2025 CDBG Pavement Rehabilitation Project
• Golf Course Renovation Project
• San Antonio Path and Safe Routes to School
• Broadway and San Antonio Roundabout Project
• Other minor Capital Improvement Projects
The City will execute agreements on an as-needed basis for each project. Once the need for inspection or construction management services is identified, proposals will be requested from each approved firm. If the Consultant chooses to submit a proposal, it will include a description of the scope of work, their methods, and a cost and schedule for completion. City Staff will review each proposal and make a selection of the firm based on factors that include price, experience, methods, and schedule. A consultant services agreement will then be brought to the City Council for approval.
While the on-call consultant list provides flexibility and efficiency for a wide range of projects, it is not intended for large or complex efforts such as wastewater utility projects. For projects of that scale and complexity, the City will issue a separate Request for Proposals to select a dedicated team tailored specifically to the project’s needs.

RE: APPROVE THE OPERATIONS MANAGEMENT AND MAINTENANCE
AGREEMENT WITH GROCERY OUTLET
______________________________________________________________________ RECOMMENDATION:
It is recommended that the City Council: 1) approve the Operations Management and Maintenance Agreement with Grocery Outlet; 2) authorize the Mayor to sign the agreement on the City’s behalf and 3) authorize the City Manager to approve minor amendments, technical corrections, or inconsequential alterations to this Agreement are approved as to form by the City Attorney.
BACKGROUND:
In compliance with municipal storm sewer system (MS4) requirements imposed on the City by California and other laws, properties of a certain size are required to construct and maintain private drainage improvements at the time of development. These stormwater improvements and maintenance are typically referred to as Post Construction Requirements (PCRs). The attached “Owner’s Agreement to Construct and Maintain Private Drainage Improvements for Water Quality” establishes a formal agreement between the Owner and the City.
DISCUSSION:
To ensure that the PCRs are maintained, the owner must submit annual inspection reports from a licensed professional certifying that the PCRs are properly maintained. If the owner fails to complete the required inspection, repair, maintenance, or replacement of the improvements, the Agreement outlines the remedies the City may pursue.

STAFF REPORT
DATE: APRIL 28, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JEFF VAN DEN EIKHOF, CONSULTANT CITY ENGINEER
THROUGH: JOSE ARREOLA, CITY MANAGER
RE: APPROVE PAVEMENT MANAGEMENT PROGRAM UPDATE
2025 REIMBURSEMENT AGREEMENT WITH THE
TRANSPORTATION AGENCY FOR MONTEREY COUNTY
(TAMC)
RECOMMENDATION:
It is recommended that the City Council approve: 1) the Measure X Pavement Management Program Update 2025 Reimbursement Agreement with the Transportation Agency for Monterey County; 2) Authorize the City Manager to sign the agreement.
DISCUSSION:
The Transportation Safety & Investment Plan (Measure X) outlines the requirements for the use of local road maintenance, pothole repair, and safety funds. It requires each jurisdiction to have a pavement management program (PMP). “Each city and the County of Monterey shall develop, or participate in the development by TAMC, a pavement management program. They shall submit regular reports on the conditions of their streets, to ensure timely repairs and keep the public informed. Development of the pavement management program by TAMC is eligible to be funded out of this program prior to distribution of funds to the cities and the County.”
King City has adopted the “StreetSaver” Pavement Management Program (PMP) developed by the Metropolitan Transportation Commission (MTC), an approved software-based tool for analyzing pavement conditions and reporting findings on rehabilitation/maintenance strategies based on funding levels.
CITY COUNCIL
CONSIDERATION OF AWARD FOR THE 2025 CDBG PAVEMENT
REHABILITATION PROJECT
APRIL 28, 2026
The PMP requires that the City complete the following:
• Review and update the pavement information for all roads every two years.
• Pavement conditions must be reinspected every three years for arterials and collectors.
• Pavement conditions must be reinspected every six years for residential streets and local/rural roads, unless otherwise approved by TAMC.
Pavement condition survey may be done by either automated or manual inspections, and may be done either individually or in conjunction with another agency. A percentage of the network can be scheduled each year so that the entire network is updated on a regular cycle.
To meet the above requirements, TAMC has coordinated a joint procurement and selected Nichols Consulting Engineering to perform these tasks for the agencies. The work includes project management, database review and update, pavement condition survey, update maintenance and rehabilitation funding tree, budget analysis and funding scenarios, a final report, a City Council Presentation, Training and Technical Support, Technical Assistance, and GIS Linkage and Updates.
Staff recommends approving the Measure X Pavement Management Program Update 2025 Reimbursement Agreement between the City and the Transportation Agency for Monterey County.
COST ANALYSIS:
The cost for the Pavement Management Program Update 2025 is $36,850.00.
These costs will be withdrawn from Measure X funds by TAMC.
ALTERNATIVES:
The following alternatives are provided for Council consideration:
1. Authorize the agreement with TAMC.

PAVEMENT MANAGEMENT PROGRAM REQUIREMENTS
The approved ordinance for the Transportation Safety & Investment Plan (Measure X) outlines the requirements for the use of local road maintenance, pothole repair and safety funds. It includes a requirement for each jurisdiction to have a pavement management program. "Each city and the County of Monterey shall develop, or participate in the development of by TAMC, a pavement management program. They shall submit regular reports on the conditions of their streets, to ensure timely repairs and keep the public informed. Development of the pavement management program by TAMC is eligible to be funded out of this program prior to distribution of funds to the cities and the County."
SYSTEM REQUIREMENTS: In order to receive Measure X funds, the cities and the County shall utilize a pavement management program (PMP) and submit regular reports on the conditions of their streets, to ensure timely repairs and keep the public informed. The pavement management program should utilize an approved software-based tool for analyzing pavement conditions and reports findings on rehabilitation/maintenance strategies based on funding levels. The pavement management program used by the jurisdiction must contain, at a minimum, the following features:
• Store the inventory all roadways within a jurisdiction (in a compatible database with other jurisdictions).
• Assess the condition of the roadways (based on seven distresses and three severity levels).
• Provide the current Pavement Condition Index (PCI) for the roadways (as per ASTM D6433).
• Identify all pavement sections needing maintenance, rehabilitation, or replacement. • Calculate budget needs for maintenance, rehabilitation or replacement of deficient pavement sections (for the current year and the next three years at various overall condition levels).
• Develop maintenance strategies for the most cost-effective level of maintenance or repair appropriate at the time of the inspection.
• Generate pavement management program reports (in various formats).
PMP Update 2025 Reimbursement Agmt Page 7 of 7
King City
All jurisdictions must implement and maintain an approved Pavement Management Program (“StreetSaver” or equivalent). The “StreetSaver” Pavement Management Program developed by Metropolitan Transportation Commission (MTC) is the most utilized program in the Bay Area and would be an excellent program for this region as well. The use of the “StreetSaver” Pavement Management Program is recommended (but not required) since it would allow good compatibility between local jurisdictions and also provide regional benefits.
Jurisdictions may elect to use an alternative pavement management program provided it meets the above listed minimum requirements and receives written approval from TAMC.
The Agency will assist with the development of an overall pavement management implementation plan for this region with the participation and coordination of all the cities and the county. The Agency recommends the development of a regional system to benefit from a coordinated system. The regional system would be developed collaboratively between local jurisdictions. In order to have a regional database, it is recommended that all agencies utilize a common pavement management program. This would allow compilation of information on a regional basis. It would also create opportunities for interagency coordination and to guide regional transportation investments and planning.
UPDATE REQUIREMENTS: The jurisdictions must complete the following updates:
• Review and update the pavement information for all roads every two years. • Pavement conditions must be re-inspected every three years for arterials and collectors. • Pavement conditions must be re-inspected every six years for residential streets and local/rural roads, unless otherwise approved by TAMC. Pavement condition surveys may be done by either automated or manual inspections and may be done either individually or in conjunction with another agency. RE: CONSIDERATION OF CAL POLY CRP COMMUNITY PLANNING
LAB 411 SUSTAINABILITY & CLIMATE ACTION PLAN FOR THE
CITY OF KING
RECOMMENDATION:
It is recommended that the City Council accept and file the Sustainability & Climate Action Plan prepared by Cal Poly CRP Community Planning Lab 411.
BACKGROUND:
The Cal Poly City and Regional Planning Lab (CRP 411) is a senior-level studio that provides students the opportunity to work on real-world planning projects for cities and communities. Since last fall, the CRP 411 class has been preparing a Sustainability and Climate Action Plan (SCAP) for the City of King. The Plan was developed by students in the CRP Department under the instruction and supervision of Dr. Michael Boswell. The class is scheduled to present the SCAP to the City Council. This work was completed at no cost to the City. The document can be downloaded at: SCAP_draft.docx
In 2022, the State adopted Assembly Bill No. 1279 (California Climate Crisis Act), which establishes a goal of achieving net-zero greenhouse gas emissions by 2045.
Cities are expected to implement local actions that support these statewide targets.
The attached SCAP for the City of King outlines goals and implementation measures the City may consider adopting to help meet these objectives.

SUSTAINABILITY & CLIMATE ACTION PLAN FOR THE CITY OF KING APRIL 28, 2026

DISCUSSION:
Assembly Bill 1279, known as the California Climate Crisis Act of 2022, establishes a statewide policy for California to achieve net-zero greenhouse gas (GHG) emissions by 2045 and to maintain net-negative emissions thereafter. The legislation directs state agencies to prioritize strategies that reduce emissions at the source, rather than relying primarily on carbon offsets.
AB 1279 builds upon existing climate laws by reinforcing the State’s long-term decarbonization goals and promoting equitable, practical approaches to emissions reductions across all sectors. Although the bill does not impose direct requirements on local jurisdictions, it reflects the State’s expectation that cities will implement policies, programs, and projects that contribute to meeting these targets.
Local actions, such as adopting climate action plans, improving energy efficiency, supporting renewable energy, and reducing vehicle miles traveled, are key components in achieving the State’s net-zero objectives.
The SCAP developed for the City of King is organized around four primary goals:
transportation; energy and electrification; resilience; and land use. As part of the planning process, the Cal Poly studio conducted a public outreach program that included informational booths at Ciclovía, Truck or Treat, and the State of the City Address. Following the State of the City Address, the class also facilitated a brief workshop session.
Outreach materials, including surveys, were provided in both English and Spanish at each event. Survey responses indicated concerns regarding limited bicycle infrastructure, with nearly half of respondents identifying global warming as very important and over one-third identifying it as extremely important. More than onethird of respondents rated the quality of the community’s sidewalks as acceptable, rather than good or very good. Additional feedback highlighted concerns related to air quality, as well as drought and water conservation. The students will present further details on the survey findings.
Beginning with Chapter 8 (page 61), the SCAP includes a range of implementation measures for consideration by the City. These measures will be summarized by the students during their presentation.
ENVIRONMENTAL REVIEW:
This project is “Planning and Feasibility Studies” exemption from CEQA, pursuant to CEQA Guidelines (14 CCR § 15262) because it is a planning study.

REPORT TO THE CITY COUNCIL
DATE: APRIL 28, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JOSE ARREOLA, CITY MANAGER
RE: CONSIDERATION OF SEWER DELINQUENT ACCOUNT
PAYMENT PLAN REVISION
RECOMMENDATION:
It is recommended that the City Council approve amending the City’s Sewer Billing Repayment Plan Policy to extend the maximum repayment term from twelve (12) months to up to thirty-six (36) months and approve the updated repayment structure.
BACKGROUND:
In January the City Council approved a program allowing customers with account balances of over $500 to enter a 12-month payment plan. While the program has been effective in providing a pathway to compliance, staff has found that the current timeframe can result in monthly payments that are not sustainable for some customers. Customers agreeing to the payment plan would not be subject to the property tax assessment while making the agreed upon payments.
DISCUSSION:
Staff is recommending a targeted adjustment to the existing policy by extending the maximum repayment term to thirty-six (36) months for monthly billing accounts. This approach keeps the program simple to administrate, while making repayment more manageable for customers. Lower monthly payments are expected to increase successful plan completion rates, reduce repeat delinquencies, and improve overall collections.
This is a practical change. It does not alter rates or fees, but it does improve how we recover outstanding balances in a way that is more likely to work for both the customer and the City.

CONSIDERATION OF SEWER DELINQUENT ACCOUNT PAYMENT PLAN
REVISION
APRIL 28, 2026
COST ANALYSIS:
There is no additional fiscal impact associated with this change. While extending repayment terms may delay the timing of some revenue, staff expect improved collection outcomes and fewer uncollectible accounts over time.
ENVIRONMENTAL REVIEW:
This payment plan is not considered a “project” for the purposes of the California Environmental Quality Act (CEQA). Therefore, the proposed action does not have the potential for resulting in either a direct physical change to the environment or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.
ALTERNATIVES:
The following alternatives are presented for City Council consideration:
1. Approve the proposed amendment to extend the maximum repayment terms to 36 months;
2. Maintain the current 12-month repayment limit; or
3. Provide other direction to staff.
