REPORT TO THE CITY COUNCIL
DATE: AUGUST 25, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: ROBERTO MORENO, FINANCE CONSULTANT
THROUGH: JOSE ARREOLA, CITY MANAGER
RE: RECEIVE FINANCIAL REPORTS FOR JULY 2026
RECOMMENDATION:

It is recommended City Council receive and file.

BACKGROUND:

On a monthly basis, staff will submit to the City Council financial reports for the previous month, showing budget to actual comparisons and checks issued.

On a quarterly basis staff will provide additional detailed information.

DISCUSSION:

Attached are the following reports for the month of July 2026 with commentary:
• Checks Issued – this is a list of the $3,427,043 paid in July. July is a big month for checks paid since some of the City’s large bills are paid upfront in July such as
o $814,100 CalPERS Unfunded Accrual Liability
o $379,570 2016 Tax Allocation Bonds debt payment
o $126,228 Solar panels debt payment
o $171,905 TAMC Regional Impact Fees
o $466,293 MBASIA Insurance Premiums
• General Fund Summary by Category – this is a one-page summary by category. While July is only 8.3% of the year, Salaries & Benefits show

21.46% spent because the CalPERS UAL is paid for the entire year.

Revenues are below a straight 8.3% collection because Property Taxes will not be collected until December.

REPORT TO THE CITY COUNCIL
DATE: August 25, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JOSÉ ARREOLA, CITY MANAGER
RE: CONSIDERATION OF REIMBURSEMENT OF REPAIR COSTS

TO THE MONARCH INN
RECOMMENDATION:

It is recommended the City Council approve and authorize the City Manager to reimburse the listed repairs at a cost not to exceed $60,000 in grant funds in a form approved by the City Attorney.

BACKGROUND:

The City has experienced an ongoing significant level of homelessness. A substantial number of homeless individuals formerly resided in encampments in the Salinas Riverbed area, which created issues regarding unsafe living conditions, environmental damage, public safety concerns, and fire hazards. The City has undertaken efforts to do its part in addressing homelessness in a proactive manner.

The City Council approved an overall Interim Riverbed Homeless Strategy at the June 13, 2023 meeting. Implementation began in July 2023, which has been successful and operated within the budget approved by City Council. This strategy placed homeless residents at the Monarch Inn. In 2023, the City committed to $45,000 in General Fund revenues to address a portion of the costs of the first phase of the project. Since that time, all other costs have been paid from a variety of grant funds.

Residents completely moved out of the Monarch Inn on May 1, 2026. Since then, the owners of the Monarch Inn, Meld LLC have sought to recoup additional repair costs. In addition to the monthly rent of 21 rooms for nearly three uninterrupted years, the city had provided a $45,000 security deposit to cover repair costs.

CITY COUNCIL

CONSIDERATION OF REIMBURSEMENT OF REPAIR COSTS TO THE

MONARCH INN
August 25, 2026
The original agreement was established for 18 rooms with the motel owner through the end of October 2023. Extensions were later approved by the City Council at December 12, 2023, January 9, 2024, May 14, 2024, October 8, 2024, June 10, 2025 and January 27, 2026, meetings and the number of rooms leased was expanded to 21. Additional agreement amendments took us through to the May 1st , 2026 move out date.

DISCUSSION:

On May 4, 2026 Building Inspector Mark McClain and then Planning Assistant, Maricruz Aguilar joined the City Manager to inspect the condition of the rooms following the May 1st moveout date. The purpose of the inspection was to document the condition of the rooms ahead of negotiating repair costs. After nearly three years of continuous use, the rooms were in rough condition. Per our agreement we began using the rooms in an “as is” condition and do acknowledge the rooms at the time were “in good and tenable condition. Unfortunately, there is no photographic or written record of the condition of the rooms when the agreement began in June of 2023.

Initially we provided a $30,000 security deposit because the initial plan was only to be at the Monarch Inn for 12-18 months. As we continued to extend the agreement, we added an additional $15,000 to the security deposit for a total of $45,000. All approved repair cost will first be deducted from this amount.

Here are excerpts from the original agreement pertaining to repairs that remained the same through the amendments:
“2. Condition of Leased Premises. City acknowledges that (i) the Leased Premises are in good and tenable condition; (ii) City has determined that the Leased Premises are acceptable for City’s use; (iii) neither Landlord nor any of its officers, employees or agents has made any representations or warranties in connection with the physical condition of the Leased Premises or their fitness for City’s use upon which City has relied directly or indirectly for any purpose; and (iv) City accepts the Leased Premises in “AS-IS” condition and agrees that Landlord.”
“7. Maintenance and Repairs.

7.1. Landlord’s Duties. Landlord shall maintain the Leased Premises in good condition.

Landlord’s obligation to provide services is limited to providing basic utilities to the unit, including water and heat. No other services will be provided to City..” The third amendment to the lease agreement (included as an attachment) signed on June 10, 2025 increased the security deposit from $30,000 to $45,000.

“Section 4. Section 5.3 of the Lease Agreement shall be amended as follows, with the underline and strikeout text indicating the modified text: Security Deposit. City has provided to Landlord a security deposits in the amount of fifteen thousand dollars ($15,000) thirty thousand dollars ($30,000) and shall provide an additional fifteen thousand dollars ($15,000).”
Meldi LLC, owners of the Monarch Inn, submitted multiple cost estimates to replace nearly all bathroom fixtures, window screens, air conditioners, tv’s, sheets, towels, mattresses, nightstand, mirrors and mini-fridges. This is in addition to more structural repairs mold remediation, dry-wall and floor tile replacement. The full list of items can be found in the attachments. Under California Civil Code Section 1950.5, landlords must return a tenant’s security deposit within 21 days of moving out. They may only deduct money for unpaid rent, cleaning to restore the unit to its original condition, or repairing tenantcaused damage that exceeds normal wear and tear. Since the deposit has not been returned all repair reimbursements will be deducted from the security deposit balance.

Our City Attorney has advised that consumables and items that would need replacement due to normal wear and tear over three years are not eligible This includes sheets, pillows, blankets, pillowcases, flooring, shower curtains, shower rods, and small bathroom fixtures. The replacement of missing or damaged furniture and mattresses will be reimbursed at 50% of the replacement costs since much of the value of these items had already been enjoyed and realized by the owner prior to our tenants moving in. We can approve the repairs listed in the NGM Property Services estimate with the exception of the flooring and one of the 22 AC units cleaning/inspections since we only used 21 rooms. We can also replace the missing 10 televisions, 13 microwaves, 16 mini fridges, 21 mirrors and 25 window screens. Here is a breakdown of the cost of approved reimbursements:

Vendor & Items Estimate
NGM Property Services
$70,000 original quote - $8,000 for flooring
$62,000.00
Home Depot (21 Mirrors & 16 mini fridges) $7,874.21
Milgard Window Screens $407.55
Mattresses, 50% of $27,422.04 $13,711.00
Furniture, 50% of $16,627.88 $8,313.94
Walmart (13 microwaves, 10 tv’s) $1,877.00
TOTAL $94,183.7
Security Deposit ($45,000)
New Total $49,183.70

CONSIDERATION OF REIMBURSEMENT OF REPAIR COSTS TO THE

MONARCH INN

COST ANALYSIS:

The staff approved repair costs not to exceed $60,000 will be paid on a reimbursement basis with grant funds from the Homeless Housing, Assistance and Prevention (HHAP) grant funding obtained from the County and Encampment Resolution Funding returned from Step Up to the City.

Reimbursements are only to be made once the $45,000 security deposit is exhausted. In 2023, the City committed to $45,000 in General Fund revenues to address a portion of the costs of the first phase of the project. Since that time, all other costs have been paid from a variety of grant funds.

ENVIRONMENTAL REVIEW:

The Temporary Homeless Shelter Program is not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it is temporary and does not involve construction or modification to buildings, property or facilities. Therefore, it does not have the potential for resulting in either a direct physical change to the environment or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.

ALTERNATIVES:

The following alternatives have been identified for City Council consideration:

1. Approve staff’s recommendation;

2. Request to modify the terms of the Agreement;

3. Do not approve the reimbursement for repairs;

4. Provide staff other direction.

REPORT TO THE CITY COUNCIL
DATE: JUNE 13, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JOSE ARREOLA, CITY MANAGER
RE: CONSIDERATION OF ROAD TO SUCCESS YOUTH DIVERSION

PROGRAM MEMORANDUM OF UNDERSTANDING
RECOMMENDATION:

It is recommended the City Council: 1) approve and authorize the City Manager to execute a Memorandum of Understanding (MOU) with the South Monterey County Joint Union High School District (SMCJUHSD), the King City Union School District (KCUSD), and Sun Street Centers for funding and operation of the Road to Success youth diversion program; and 2) authorize the City Manager to make minor non-substantive changes to the MOU as necessary in a form approved by the City Attorney.

BACKGROUND:

The King City Comprehensive Plan to End Youth Violence Phase II was adopted by the City Council in December 2025. The plan adopted 5 new categories in addition to continuing the work in the original plan consisting of prevention, intervention, enforcement, re-entry, and public outreach.

One of the key intervention measures recommended was to establish a youth diversion program. This was accomplished by contracting with Sun Street Centers to provide the Road to Success Program. It was initially established in 2018 as a joint effort with the other South County cities funded by a State grant.

Since that time, it has been funded partially or fully by other grants. Most recently, the City was able to expand the program utilizing a CalVIP grant approved by the Board of State and Community Corrections (BSCC). The grant ended June 30, 2023. Staff proposed maintaining the program by jointly funding it with SMCJUHSD and KCUSD. The council approved this joint funding approach for a three year term which just ended on June 30, 2026.

CONSIDERATION OF ROAD TO SUCCESS YOUTH DIVERSION PROGRAM

MEMORANDUM OF UNDERSTANDING
August 25, 2026
Staff would like to propose a new joint funding agreement with SMCJUHSD and KUSD for two years. An MOU has been drafted to continue to contract for the program with Sun Street Centers funded through the partnership.

DISCUSSION:

The Road to Success is designed for youth, first time offenders of crimes. Youth that come into contact with the Police Department due to an offense for the first time and are determined to be good candidates for the program are referred by the Police Department if they agree to participate in lieu of an arrest. Referrals are also made directly by the schools in lieu of expulsion or suspension. In addition, referrals are also now coming from the Monterey County Probation Department.

On August 11, 2026, Sun Street Centers staff presented to the City of King City Council on the outcomes of the previous three years of programming. From July 1, 2023, to June 30, 2026, they received 130 referrals, served 82 youth and guided 54 to full completion of the program. They averaged 43 referrals a year.

The program focuses on youth accountability, community responsibility through mentorship, community service, the 10 week “Why Try” program and participation in transformative community engagement.

This 3 to 6-month program seeks to prevent school expulsion and/or entry into the juvenile justice system by offering youth offenders individualized diversion plans that include substance abuse intervention and education, participation in pro-social activities, individual and/or family counseling, parent workshops, and community service hours. Diversion plans are developed in collaboration with the student, their parents and a case management specialist with the goal of offering a path to success through education, employment, community involvement, Life Skills Training and counseling.

Early intervention includes providing an assessment of individual needs, referrals to outside agencies, individual counseling, and recreational activities with incentives; evidence-based training that addresses youth drug abuse and cooccurring psychological, situational and life skills deficits; and coordination with school regarding attendance and grades. For each youth admitted into the program, one parent must also complete 8+ hours of parent education through Life Skills Training. Each youth completes 8-10 weeks of Life Skills Training covering topics such as anger management, coping with anxiety, and making healthy choices. Each individual case plan requires youth to become involved in their community by completing community service hours at local agencies/organizations. Hours are completed by volunteering at local churches, elementary & middle schools, city/county libraries, businesses such as beauty

salons & barber shops, through Sun Street Centers Safe Teen Empowerment Project in South County or through community clean-ups at parks or beaches.

A Community Activity Board comprised of community volunteers describes the diversion process, reviews the reasons the offender committed the offense and discusses the impact of that offense. They then formulate a diversion agreement that includes community service hours, restitution to the victim and/or counseling.

Staff believe the program has continued to be successful and offers a valuable tool in the City’s overall gang and violence prevention efforts. Of those completing the program, the success rate of those not repeating offenses within the next 12 months is 89%. Therefore, staff recommend it be continued by jointly funding it through an MOU with SMCJUHSD and KCUSD. An additional 2-year term is proposed. The SMCJUHSD Board is scheduled to consider the MOU at their meeting on August 26. The KCUSD Board is scheduled to consider it at their meeting on August 18. This will enable the program to continue to serve the youth of the city of King.

COST ANALYSIS:

The total annual cost of the program is $200,000, which will increase by CPI each year. The recommended cost allocation is as follows:

City of King 37.5%
SMCJUHSD 37.5%
KCUSD 25.0%
The annual cost to the City will be $75,000, which will be paid using a Chevron Corporation grant of $20,000 and $55,000 in General Funds.

ENVIRONMENTAL REVIEW:

The youth diversion program is not a “project” for the purposes of the California Environmental Quality Act (CEQA) as it does not have the potential for resulting in either a direct physical change to the environment or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.

ALTERNATIVES:

The following alternatives have been identified for City Council consideration:

1. Approve staff’s recommendations;

2. Direct staff to modify the terms of the MOU;

3. Approve funding for the program, but direct staff to decrease costs by reducing the staffing level of the program;

4. Do not approve the MOU and terminate the Road to Success Diversion Program; or

5. Provide staff other direction.

REPORT TO THE CITY COUNCIL
DATE: AUGUST 25, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JOSE ARREOLA, CITY MANAGER
RE: CONSIDERATION OF TRANSPORTATION AGENCY FOR

MONTEREY COUNTY MASTER FUNDING AGREEMENT
RECOMMENDATION:

It is recommended the City Council approve and authorize the City Manager to execute a Master Funding Agreement with the Transportation Agency for Monterey County (TAMC).

BACKGROUND:

The Transportation Agency Master Funding Agreement memorializes conditions and requirements for local agencies to use state funds passed through by TAMC.

Each agency receiving Regional Surface Transportation Program, Regional Development Impact Fee, and Transportation Development Act 2% funds will be required to enter into a Master Agreement. The Master Agreements are in effect for a period of three years and are updated with each new cycle of the Regional Surface Transportation Program to incorporate any new provisions. The current funding agreement between TAMC and the City has expired, and a new agreement will need to be executed before reimbursements can be approved.

DISCUSSION:

TAMC has provided the City with the new Master Funding Agreement for signature, which is attached. Staff has reviewed it and recommends approval.

State transportation funding is critical for the City’s street improvement and other infrastructure and transportation projects.

CONSIDERATION OF TRANSPORTATION AGENCY FOR MONTEREY

COUNTY MASTER FUNDING AGREEMENT
AUGUST 25, 2026
COST ANALYSIS:

There is no cost to the recommended action. The Agreement will enable reimbursement to the City of hundreds of thousands of dollars over the next three-year period.

ENVIRONMENTAL REVIEW:

This action is not considered a “project” for the purposes of the California Environmental Quality Act (CEQA) because it is not linked to any specific project at this time. Therefore, it will not have the potential for resulting in either a direct physical change to the environment or a reasonably foreseeable indirect physical change in the environment. No further action is required under CEQA for City Council action.

ALTERNATIVES:

The following alternatives are provided for City Council consideration:

1. Approve staff’s recommendations;

2. Modify and approve the Agreement;

3. Delay action to request more information;

4. Do not approve the Agreement; or

5. Provide staff other direction.

RE: CONSIDERATION ADOPTION OF AN ORDINANCE OF THE

CITY COUNCIL OF THE CITY OF KING AMENDING CHAPTER

17.79 OF TITLE 17 OF THE KING CITY MUNICIPAL CODE

PERTAINING TO SEASONAL EMPLOYEE HOUSING

ORDINANCE
RECOMMENDATION:

It is recommended that the City Council introduce to be read by title only an Ordinance amending Chapter 17.79 of Title 17 of the King City Municipal Code pertaining to seasonal employee housing, open the hearing, allow for public testimony, close the hearing, waive first reading of the Ordinance, and approve the introduction of the Ordinance.

BACKGROUND:

The City is initiating a request to amend Title 17 Zoning of the King City Municipal Code Chapter 17.79 Seasonal Employee Housing in order to eliminate restrictive, development standards to align with the state guidelines. The removal of these local barriers ensures the city remains in compliance with state housing mandates for agricultural workforce.

Chapter 17.79 Seasonal Employee Housing currently has standards for seasonal and agricultural worker housing. Over time, statutory updates at the state level have created legal conflicts between local discretionary standards and state-mandated allowances.

DISCUSSION:

The proposed Ordinance is presented at this time for your review and the introduction and first reading of the Ordinance is recommended. The proposed Ordinance is to repeal and replace with the following:

ORDINANCE NO. 2026-845

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF KING
AMENDING CHAPTER 17.79 (SEASONAL EMPLOYEE HOUSING) OF
TITLE 17 OF THE KING CITY MUNICIPAL CODE GOVERNING

SEASONAL EMPLOYEE HOUSING TO ALIGN WITH STATE LAW
WHEREAS, the City initiated Zone Text Amendment Case No. ZON26-000003 to amend Title 17 of the King City Municipal Code by repealing and replacing Chapter 17.79, Seasonal Employee Housing; and
WHEREAS, Municipal Code Chapter 17.79 currently contains local development standards applicable to seasonal employee housing; and
WHEREAS, the California Department of Housing & Community Development (HCD) interprets that the City’s ordinance exceeds guidelines as stated in Health and Safety Code Section 17021; and
WHEREAS, the proposed zoning text amendment would repeal and replace text for compliance with California Health and Safety code Section 17008(a); and WHEREAS, the proposed zoning text amendment would remove local discretionary barriers that may conflict with state-mandated allowances for seasonal employee housing while maintaining compliance with applicable health, safety, building, and permitting requirements; and WHEREAS, on August 18, 2026, the Planning Commission conducted a duly noticed public hearing, considered the proposed amendments, and adopted Resolution No. 2026-359 recommending approval to City Council; and
WHEREAS, the City Council finds that this Ordinance is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that this administrative modification will cause a direct or reasonably foreseeable indirect physical change to the environment; and
WHEREAS, the original ordinance was adopted in 2018 pursuant to an adopted Negative Declaration. Here, the zoning designations authorizing the building of seasonal employee housing are not changing; rather, the ordinance is being amended to ensure consistency with regulatory requirements from the State of California. As such, pursuant to Code of Regulations, Title 14 section 15162, the repeal and replace does not require any additional environmental review or documentation since on the basis of substantial evidence in the light of the whole record, there is no evidence establishing one or more of the following exists:
(1) Substantial changes are proposed in the project which will require major revisions of the previous negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects;
Exhibit 1
4935-9238-4201 v1 2
(2) Substantial changes occur with respect to the circumstances under which the project is undertaken which will require major revisions of the previous negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; or (3) New information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous negative declaration was adopted, shows any of the following:
(A) The project will have one or more significant effects not discussed in the previous negative declaration; or
(B) Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative.

WHEREAS, new seasonal employee housing or agricultural employee housing, projects, as well as projects consisting exclusively of repair or maintenance of existing farmworker housing, are now exempt from CEQA review, streamlining the creation of safe, affordable dwellings for farm workers (See Public Resources Code § 21080.44 and Health and Safety Code § 17021.8.); and NOW THEREFORE, the City Council of the City of King does hereby ordain as follows:

SECTION 1. Recitals. The above recitals are incorporated by reference.

SECTION 2. Purpose and Intent: The purpose of this Ordinance is to amend Chapter

17.79, of Title 17 (Zoning) of the King City Municipal Code to remove local discretionary barriers and ensure compliance with the California Employee Housing Act (Health and Safety Code Section 17000 et seq.) and the Fair Employment and Housing Act. This amendment standardizes local review processes to match state-mandated allowances for employee and seasonal housing while safeguarding community health, safety, and building standards.

SECTION 3. CEQA. The City Council finds and determines that the adoption of the proposed Ordinance is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) (the "common sense" exemption). This exemption applies because the Ordinance consists of text amendments to align local zoning codes with mandatory state housing law and health and safety requirements. It can be seen with certainty that there is no possibility that this administrative modification will cause a direct or reasonably foreseeable indirect physical change to the environment.

In addition, the original ordinance was adopted in 2018 pursuant to an adopted Negative Declaration.
4935-9238-4201 v1 3
(1) Substantial changes are proposed in the project which will require major revisions of the previous negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects;

Lastly, new seasonal employee housing or agricultural employee housing, projects, as well as projects consisting exclusively of repair or maintenance of existing farmworker housing, are now exempt from CEQA review, streamlining the creation of safe, affordable dwellings for farm workers. (See Public Resources Code § 21080.44 and Health and Safety Code § 17021.8.) Therefore, based on the above, the proposed Ordinance is not subject to further environmental review or documentation.

SECTION 4. Code Amendment. Chapter 17.79 ("Seasonal Employee Housing") of Title 17 of the King City Municipal Code is hereby amended to read as follows:

Chapter 17.79: Seasonal Employee Housing
Section 17.79.005 –Seasonal Employee Housing
(a) Compliance with State Law: Seasonal employee housing provided by the employer and maintained in connection with the work or place where work is being performed must comply with all provisions of federal, state, and local regulations, as applicable, including Section 17008(a) of the California Health and Safety Code. Seasonal employee housing not maintained in connection with any workplace and provided by someone other than an employer shall comply with all provisions of applicable local, state, and federal laws.
(b) Dual Land Use Designation: the general plan allows a dual land use designation for seasonal employee housing, as shown on the general plan diagram and zoning map.
4935-9238-4201 v1 4
(c) Conversion of Use: In the event structures used for seasonal employee housing facilities are proposed to be converted to some other use, the facilities shall be subject to all applicable zoning ordinance and other applicable ordinances or standards for the proposed new use that are in effect at the time of approval of the proposed change of use.
(d) State Permit Verification: Seasonal employee housing for five or more employees is subject to the permitting requirements of the California Housing Employee Act.

The property owner shall obtain and maintain a permit(s) with the State Department of Housing and Community Development (HCD), pursuant to the Employee Housing Act and the California Code of Regulations. A copy of the HCD permit shall be provided to the city Building and Safety Department within fourteen (14) days of issuance or at the time of building permit application submittal, whichever is earlier.

SECTION 5. Severability. If any provision(s) of this Ordinance or the application thereof to any person or circumstances is held invalid or unconstitutional by any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any other provision or application, and to this end the provisions of this ordinance are declared to be severable. The City Council hereby declares that they would have adopted this ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses, phrases, parts or portions thereof be declared invalid or unconstitutional.

Item No. 11 (A)

REPORT TO THE CITY COUNCIL
DATE: AUGUST 25, 2026
TO: CITY COUNCIL
FROM: ROBERTO MORENO, FINANCE CONSULTANT
THRU: JOSE ARREOLA, CITY MANAGER
RE: CONSIDERATION OF FISCAL YEAR 2026-27 APPROPRIATION
LIMIT
RECOMMENDATION:

It is recommended the City Council: adopt a Resolution approving the FY 2026- 27 Appropriation Limit from tax proceeds.

BACKGROUND:

Article XIII B of the California Constitution, added by Proposition 4 in 1979 and commonly referred to as the Gann Limit, requires each local agency that receives proceeds of taxes to adopt an annual appropriations limit. The limit is the prior year’s limit adjusted by two factors elected by the legislative body: a change in the cost of living and a change in population. Appropriations funded from proceeds of taxes may not exceed the limit.

Revenue and Taxation Code section 2227 requires the California Department of Finance to transmit the price factor and population change data to local jurisdictions each year. Finance issued its letter to fiscal officers on May 1, 2026.

On June 10, 2025 Council approved the Biennial Budget for FY 2025-26 and FY 2026-27. At that time Council also approved the Appropriations Limit for FY 2025-26. The approved budget for FY 2026-27 is now in place.

DISCUSSION:

The City’s FY 2025-26 appropriations limit of $27,424,575, adopted by Resolution No. 2025-5046 on June 10, 2025, is the starting point for the FY 2026-27 calculation.

CONSIDERATION OF FY 2026-27 APPROPRIATION LIMIT

Election of factors. The City Council elects both adjustment factors by vote.

Consistent with prior years, staff recommends electing the change in California per capita personal income as the price factor, reported by the Department of Finance at 4.95 percent for FY 2026-27, and the change in City population as the population factor, reported at 0.87 percent for the period January 1, 2025 to January 1, 2026.

Calculation. Applying a price ratio of 1.0495 and a population ratio of 1.0087 to the prior year limit produces a combined adjustment factor of 1.0586 and an FY 2026-27 appropriations limit of $29,032,496. The calculation is shown in Attachment 2.

Compliance. Appropriations subject to limitation in FY 2026-27 are $10,808,644, or 37.2 percent of the limit, leaving $18,223,852 of remaining capacity. The figure is drawn from the FY 2026-27 adopted budget for the General Fund and UUT Safety Fund and consists of property and sales taxes, the transient occupancy tax, utility users tax, business licenses tax, the real property transfer tax, state subventions, and the share of investment earnings attributable to invested tax proceeds. The City is not approaching its appropriations limit and no action under Article XIII B is required.

COST ANALYSIS:

The appropriations limit has no impact on the City’s appropriations.

ALTERNATIVES:

The following alternatives are provided for City Council consideration:

1. Approve staff’s recommendations;

2. Provide staff other direction.

Dear Fiscal Officer:

Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments.

Each local jurisdiction must use their percentage change in population factor for January 1, 2026, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2026–27. Attachment A provides the change in California’s per capita personal income and an example for utilizing the factors to calculate the 2026–27 appropriations limit. Attachment B provides the city and unincorporated county population percentage change. Attachment C provides the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.

Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code section 2228 provides additional information regarding the appropriations limit. Article XIII B, section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.

Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office. Finance will certify the higher estimate to the State Controller by June 1, 2026. Please note: The prior year’s city population estimates may be revised.

The per capita personal income change is based on historical data.

Attachment A
A. Price Factor: Article XIII B specifies that local jurisdictions select their cost of living factor to compute their appropriation limit by a vote of their governing body. The cost of living factor provided here is per capita personal income. If the percentage change in per capita personal income is selected, the percentage change to be used in setting the fiscal year 2026–27 appropriation limit is:

Per Capita Personal Income
Fiscal Year Percentage change
(FY) over prior year
2026-27 4.95
B. Following is an example using sample population change and the change in California per capita personal income as growth factors in computing a 2026–27 appropriation limit.
2026–27:

Per Capita Cost of Living Change = 4.95 percent
Population Change = -0.14 percent
Per Capita Cost of Living converted to a ratio: 4.95 + 100 = 1.0495 100
Population converted to a ratio: -0.14 + 100 = 0.9986

Calculation of factor for FY 2026–27: 1.0495 x 0.9986 = 1.0480 About the Data
