Measure C Golden State Blvd Project Update - Report by City Engineer Dave Peters Sponsor: City Engineer’s Office
City Engineer Dave Peters presented that Fresno Council of Governments, Fresno County and Fresno County Transportation Authority has been working collaboratively for improvements on Golden State.
With the project there were supposed to be bike paths that pass over the railroad tracks. Union Pacific Railroad (“UPRR”) required improvements, and the project decided to not go forward with the proposed bike path that would cross over the tracks. With these changes, UPRR required additional improvements and permits. The Project has been split into 2 phases. Phase 1 is removing the corridor, and not the intersection. Phase 2 would be the intersections.
Phase 2 might not begin for 1 year. They are going temporarily improve the Kamm/Bethel intersection and but not temporarily improve the Stroud intersection due to complicated nature of the temporary work.
Council discussed funding and the design. The full project is funded by Measure C, including Phase 2.
Mr. Peters believes the MOU states that the City will fund any shortages, but there should be enough funding.
Council Member Pursell, Jr. asked if we have pay for the temporary improvements at Stroud if we want to have it done before the County does it. Engineer Peters answers yes, $56,104.

Council Member Smith asked about the 18th avenue sidewalks. Mr. Peters said we have permits, we are waiting for a federal approval. We will notify residents, go out to bid and then come to council for bid approval.
Council Member Smith asked about the local road safety plan. Mr. Peters said it looks at where accidents occur, how can we resolve it, rank them and then we can apply for grants.
Mayor Palomar asked if the Sinclair site plan, if it includes where Pubs and Subs was. Mr. Peters said yes, it takes up the whole lot. Asked about the grace church streetlights. Sponsor: City Engineer’s Office

Typical projects include intersection improvements, bike lanes, sidewalks, etc. Staff has identified the following candidate projects to be submitted for funding consideration: Gilroy Ave / Mariposa Ave/ 18th Avenue Roundabout, 19th/20th Alley Paving from Sierra St to Mariposa Street, 18th / 19th Alley Paving from Sierra Street to Mariposa Street, Sierra Street (SR 201) / 18th Avenue Intersection Improvements, and Sierra Street (SR 201) / Marion Street Roundabout.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Daniel Perkins, Fire Chief REVIEWED BY: AP AGENDA ITEM: Federal Emergency Management Agency (FEMA) and California Office of Emergency Services (Cal OES) Grant funding approval.
ACTION REQUESTED: ___Ordinance __√__Resolution Motion ______Receive/File
EXECUTIVE SUMMARY
FEMA, as a result of the COVID-19 emergency -4482-DR-CA, has allocated federal funds passed through to Cal-OES as a subrecipient. This reimbursement of expended funds is required to be approved by the local governing body for acceptance. The funds were initially expended in FY 21/22 by the Kingsburg Fire Department and the City in direct operating costs of personnel and equipment to operate a vaccine site for communities in rural Southern Fresno County to counter the rising occurrence of COVID -19 cases in the area. The $ 42,826.35 will be disbursed to the City after the approval and acceptance of the Grant Funds.
RECOMMENDED ACTION BY CITY COUNCIL
1. Adopt Resolution 2023-035- A resolution stating the designation of applicant’s agent for non-state agencies for FEMA/Cal OES funding for reimbursement of expended funds.
POLICY ALTERNATIVE(S)
1. Council could choose to not adopt the resolution; however, this would cause the city to lose the nearly $43,000 in funding for COVID response reimbursement.
REASON FOR RECOMMENDATION/KEY METRIC
1. To approve of the funding for reimbursement of expended funds by the city

Failure to perform the requisite audit functions as required by this paragraph may result in the County performing any necessary audit tasks, or, at the County's option, the County contracting with a public accountant to perform the audit. All audit costs related to the City's failure to perform the requisite audit are the sole responsibility of the City, and such audit work costs incurred by the County shall be billed to the City, as determined by County’s Auditor-Controller/Treasurer-Tax Collector. In the event the City is only required to perform an audit under the provisions of the Act because the City is receiving CDBG funds, the County may perform, or cause to be performed, the required audit to determine whether funds provided through this Agreement have been expended in accordance with applicable laws and regulations. Any audit-related costs incurred by the County under this provision shall be charged to the County CDBG Program. The City agrees to take prompt and appropriate corrective action on any instance of material noncompliance with applicable laws and regulations.
K. The City shall send a copy of the audit to:

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Community Services Director Adam Castaneda REVIEWED BY: AP AGENDA ITEM: Special Event Street Closure Requests for Kingsburg Community Church ACTION REQUESTED: ___Ordinance ___Resolution ___Motion _____Receive/File
EXECUTIVE SUMMARY
On October 5, 2022, the City Council approved the updated Special Event Application and the street closure policy update. The policy states that all closures of central commercial streets must be approved by the Council unless there is a pre-approved agreement.
Under this policy, local non-profit organizations can request the closure of central commercial streets for community-based events. Applications must be received at least forty-five (45) days before the proposed event date for Council approval. Administrative approval must be sought and granted for event rescheduling due to inclement weather forecasts or emergencies.
Kingsburg Community Church is submitting two requests for partial street closures for their upcoming community events.
1) Closure of Smith Street between Ellis Street and Draper Street for their “Costume Carnival” event on October 29, 2023, from 530 p.m. to 8 p.m.
2) Closure of Ellis Street between Smith Street and Lincoln Street for their “Family Christmas” event on December 8, 2023, from 530 p.m. to 9 p.m.
This event will be open to the public and consist of pop-up retail and food vendors. Staff believes the proposed event meets most current policy guidelines and is eligible for street closure consideration by the Council. The application has been distributed internally for departmental input and has received several conditions of approval.
Additional conditions of approval:
• Fire lane to be maintained between vendors in case of an emergency. • No vehicle access allowed within the street closure during event hours. • Additional trash receptacles and restrooms to be ordered based on attendance projections. • At least one (1) green organic trash cart on site for food vendors to discard food waste. • Certificate of liability insurance listing the City of Kingsburg as additionally insured.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Alma Colado, Finance Director REVIEWED BY: AJH AGENDA ITEM: City Investments Returns for Quarter 1 & 2, 2023 ACTION REQUESTED: ___Ordinance ___Resolution __ Motion _√__Receive/File
EXECUTIVE SUMMARY
Recently, the City Council authorized staff to explore investment options outside the traditional Local Agency Investment Fund (LAIF), specifically utilizing California CLASS, an investment program that is a California Joint Powers Authority (JPA) created pursuant to the California Joint Exercise of Powers Act and is governed by a Board of Trustees comprised of special district and city finance professionals.
After approval, staff attempted to split investments equitably between the two pools in order to provide a side by side comparison of returns. Included in your packet are statements of each.
Highlights include:
• California CLASS interest earned on investments for Quarter 1 is $86,596 effective date 3/31/23 and Quarter 2 is $97,459 effective date 6/30/23. Total Q1/Q2 = $184,055. • Local Agency Investment Fund (LAIF) interest earned on investments for Quarter 1 is $53,684 effective date 4/14/23 and Quarter 2 is $65,993 effective date 7/14/23. Total Q1/Q2 = $119,677 As discussed when originally presented, each of the pools operates similarly, but California CLASS short to medium term securities portfolio offers the opportunity to optimize interest earnings, while not sacrificing safety or liquidity of the funds. Essentially, they are able to more quickly take advantage of higher interest rates, which has become especially beneficial as the Federal Reserve has been aggressively raising interest rates in order to combat ongoing inflation.
Given the recent returns, staff has and will be transitioning additional investments into California CLASS to maximize our interest returns. LAIF Investments balance is $3,566,433 and California CLASS investments balance is $11,789,895 as of 8/31/2023.

Senate Bill 231
Amended, June 16, 2023
SUMMARY
Senate Bill 231 requires the Department of
Water Resources (DWR) to adopt key
recommendations made by the independent
California State Auditor. These
recommendations stem from a recently released
audit which examined DWR’s management of
the state’s water supply. Specifically, SB 231
would require DWR to
Establish a formal process to annually
evaluate the accuracy of its water supply
forecasts and establish plans to improve
those forecasts.
Adopt a new water supply forecasting
model and implement procedures that
address the effects of climate change.
Implement a formal policy and
procedures for documenting DWR’s
operational plans for the state’s water
supply. The Department of Water
Resources is also required to address the
rationale for its operating procedures.
Develop a comprehensive, long-term
plan for mitigating and responding to the
effects of drought
PROBLEM
Due to the impacts of climate change, accuracy
in modeling is imperative to managing water
resources properly. During Water Year 2021,
DWR's modeling errors resulted in the excessive
release of around 700,000 acre-feet of water
from California reservoirs. Billions of gallons of
water were released into the Sacramento-San
Joaquin Delta without benefiting humans or
wildlife. This loss of water had severe
consequences for California due to the
significantly lower runoff than anticipated
BACKGROUND
In March 2022, former Assemblymember Gray
submitted a letter requesting an audit of the
Department of Water Resources investigating the
management and administration of surface
water. This audit included investigations into the
accuracy of data collection, predictive models,
and procedures used by the state. The findings of
the audit can help ensure forecast modeling
mistakes are avoided in future water years. In
addition, improved transparency by the DWR
may offer clarity and a better understanding of
the policies it implements.
SOLUTION
SB 231 requires DWR to update its policies and
procedures to better combat the impacts of
climate change. The bill also requires DWR to
document and address the decisions behind its
water operating decisions. Accurate water data
collection, planning, and accountability will
ensure water stays a vital resource for the public
for generations to come.

Senate Bill 265
The Critical Infrastructure Cybersecurity Preparedness Act As Amended June 19, 2023
SUMMARY
SB 265 takes action to combat the growing issue of
cyber threats and cyberattacks by directing the
California Office of Emergency Services (Cal-OES)
and the California Cybersecurity Integration Center
(Cal-CSIC) to develop outreach and funding plans to
improve cybersecurity preparedness in California’s
critical infrastructure sectors.
PROBLEM
Recent reports regarding various cybersecurity
attacks in the education, health care, energy, and
financial sectors have demonstrated that California’s
critical infrastructure sectors are vulnerable to attack and suffer from a stark lack of cybersecurity
preparedness.
Research has shown an increase in the number of
cyberattacks targeting critical infrastructure sectors.
These cyberattacks are predominantly made up of
phishing attempts and ransomware.
In December 2022, the California Department of
Finance, itself, was hit by a cybersecurity threat that took several days to control. And, in September
2022, the Los Angeles Unified School District
experienced a cybersecurity attack where attackers
threatened to release highly confidential information.
This lack of preparedness threatens California’s
economy and the livelihood of those who rely on
these sectors. Unless at-risk companies and systems
begin to prioritize their cybersecurity, any cyber
threats they face will have the potential to harm not
only California’s economy, but also the well-being
of individual Californians.
BACKGROUND
In 2018, Governor Brown signed legislation which
defined and established the California Cybersecurity
Integration Center (Cal-CSIC). Cal-CSIC operates
under the Office of Emergency Services (Cal-OES),
and is responsible for planning California’s
cybersecurity strategy and coordinating with both
federal and state government entities to execute that
strategy. Cal-CSIC continues to build California’s
cybersecurity strategy, and work with individual
state departments to ensure individual infrastructure
sectors have cybersecurity policies and protocols.
In 2022, Governor Newsom signed similar
legislation which requires Cal-OES to direct the
California Cybersecurity Integration Center (CalCSIC) to prepare a multi-year outreach plan to assist the agriculture and water industries specifically in
efforts to improve cybersecurity, and options for
providing grants and other support to improve
cybersecurity preparedness.
SOLUTION
SB 265 expands on previous work by requiring CalOES and Cal-CSIC to develop cybersecurity preparedness plans for California’s critical
infrastructure sectors. The plans must include a
strategic, multiyear outreach strategy focusing on
methods for coordinating with other state and federal
agencies, nonprofit organizations, and associations
that provide cybersecurity services or resources in
the critical infrastructure sector, as well as plans
outlining the funding options necessary to achieve
this outreach.

to the California Fire and Arson Training Act.
Permitting the State Fire Marshall to receive
additional funding sources for training
programs will help to mitigate rising fees for
those seeking fire training certification.
PROBLEM
California State Fire Training (SFT) provides
curriculum and certification to current fire
department, firefighters, and individuals
seeking a career in the fire service. These
courses meet or exceed National Fire
Protection Association and National Wildfire
Coordination Group standards. This training is
provided to over 23,000 paid and volunteer
firefighters every year.
When SFT was established, it only allowed for
user fees to recover the cost of staff, course
development and certification. Over the years
the fire service has become more professional
and certifications are now required for every
position in the fire service. To generate enough
revenue, fees needed to be raised by over
200% and in some cases 400%. This has
resulted in courses and certification becoming
unaffordable to volunteer firefighters and
individuals seeking entry level positions.
BACKGROUND
The California Fire Service Training and
Education) Division under the CAL FIRE – Office
of the State Fire Marshal provides an essential
need for a diverse California fire service. It is
responsible for rules and regulations, course
development, oversight of course delivery,
certification, instructor registration, evaluator
registration, and certification testing. This division
is vital to the fire service because it provides the
course curriculum for over 160 different courses
and 26 certification levels, including some
nationally accredited certifications.
In the era of climate change, the fire service is
regularly responding to mass conflagration
wildfires and the need for well-trained fire
personnel has never been greater. Central to
achieving this goal is making SFT courses both
accessible and affordable to all fire personnel,
especially the next generation of firefighters.
Historically, SFT has been able to provide these
services at a minimal cost to its users. However,
doing so in an increasingly complex and
expanding arena of fire protection has resulted in
funding shortfalls, requiring a significant increase
in their fees.
Solution
SB 577 allows the State Fire Marshal to accept
additional funding sources for the California Fire
Service Training and Education Program. The bill
would make the same change relative to the
California Fire and Arson Training Act. Given the
enormous risk of fire and other disasters that face
California, we must make SFT an affordable
solution for our paid and volunteer firefighters,
as well as students wishing to enter the fire
service. Permitting the State Fire Marshall to
receive additional funding sources for training
programs will help to mitigate rising fees for
those seeking fire training certification. The
financial obstacles the fee increases have
created for students and fire departments
demands a legislative solution.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Daniel Galvez- Public Works Director REVIEWED BY: AP AGENDA ITEM: Solar Finance Options – Wells 13 & 16, Police Department & Public Works Yard ACTION REQUESTED: ___Ordinance ___Resolution ____Motion ____Receive/File
EXECUTIVE SUMMARY
City Staff has continued to develop the Solar project for Wells 13 & 16, Police Department and Public Works Yard.
The applications for NEM 2.0 have been submitted to PG&E and have been approved. The designs remain relatively unchanged except for additional landscaping/ cover options at Well 16 (Erling Park). The biggest change has come from the financing options to pay for the project. The project financing as initially proposed to Council utilized an Energy Conservation Assistant Act Loan (ECAA), which provides up to $3,000,000 at 1% interest. The ECCA loan program is a revolving fund with funding coming from project payments as they begin to realize savings, the soonest the City could potentially receive funding is June or December 2024. Due to the NEM 2.0 deadline and abundance of submitted applications to the ECCA loan program may no longer be viable for our project to meet the NEM 2.0 construction deadline. The City has approximately 3 years from the date of the NEM 2.0 application (April 2023) to complete construction and interconnect the solar arrays, with average construction and interconnection timelines being 12-18 months (including engineering and permitting).
Staff worked with SiteloIQ and the Oppenheimer Group to discuss the possibility of utilizing a Tax-Exempt Municipal Lease to fund the project. Pursuing this funding source does come at a cost as the interest is higher than the 1 % originally proposed (Attachment 1) utilizing an ECCA Loan, even with the increased cost this project still provides financial savings (see Attachment 2). PGE is requesting a 20.8% increase in rates later this month and if approved would bring the increased total in rates for 2023 to 31.8% (Attachment 3).
SiteloIQ has recognized the additional financial burden on the project and has included some cost-cutting measures to move the project forward. Their staff is available to discuss the cash flow, cost cutting, and project timelines based on a possible TEML.
Staff from the Oppenheimer group will give Council a presentation (Attachment 4) covering:
• Market Update
• Finance Process
• Preliminary Numerical Analysis
• Next Steps
RECOMMENDED ACTION BY CITY COUNCIL
1. Staff recommends that the Council authorize The Oppenheimer Group to solicit term sheet on behalf of the City for a Tax-Exempt Municipal Lease for the City solar project.
Meeting Date: 09/06/2023
Agenda Item: 6.2
POLICY ALTERNATIVE(S)
1. Council could choose not to proceed with the Tax-Exempt Municipal Lease option and provide staff direction on how to proceed.
STRATEGIC GOAL(S) MET:
1. Ensure Financial Stability
2. Promote Sustainable Development
FINANCIAL INFORMATION
PRIOR ACTION/REVIEW
City Staff and SitelogIQ presented financing options to the Finance Committee on August 14, 2023, and the Committee provided directions to return with additional information. City Staff, SitelogIQ and Oppenheimer group provided updated financing options to the Finance Committee on Aug 28, 2023.
NEM 2.0 Applications for all sites have been submitted.
BACKGROUND INFORMATION
Net Energy Metering (NEM) - governs how rates are calculated for rooftop solar customers as their panels interact with the grid throughout the day. The NEM tariff allows customers to receive a financial credit on their electricity bills when their rooftop solar system sends excess electricity to the electric grid.
The California Public Utilities Commission (CPUC) unanimously voted to approve NEM 3.0. Under NEM 3.0, customers of PG&E, SCE, and SDG&E with solar systems will receive an average of 8 cents per kWh for the excess power they push onto the grid. This is roughly 75% less than the average export rate of 30 cents per kWh under NEM
2.0. IOU customers have until April 14, 2023, to grandfather a new solar system into NEM 2.0 by submitting a complete interconnection application. The biggest change between NEM 2.0 and NEM 3.0 is the value of export rates — or the price of excess electricity produced by solar systems. Under NEM 3.0, residential solar export rates will be based on an “Avoided Cost Calculator” instead of retail rates (what customers pay for electricity).
NEM 3.0 key takeaways:
• Current solar owners will remain under their existing net metering policy. • Solar owners under NEM 3.0 will earn around 75% less for the excess electricity they push onto the grid. • UnderNEM 3.0,the payback period for solar and battery storage systems will be roughly equalto the payback period of solar only systems.

• Economic data on inflation and actions taken
by or hinted at by the Federal Reserve
continue to drive the bond market.
• At the July FOMC meeting, the Federal Reserve
Board unanimously voted to raise interest
rates by 25 basis points, pushing rates to their
highest levels in over 22 years. The decision
was widely expected and investors were
hopeful that this would be the final rate hike of
the year.
• However, recent details from the Fed's July
meeting and comments by Fed Chairman
Powell have revealed that Fed officials are still
considering additional rate hikes as inflation
remains a top concern. The Federal Reserve’s
next policy meeting is scheduled for
September 19th.
• The rate of inflation continues to moderate.
The July CPI Report showed that inflation rose
moderately at a 3.2% annual pace. The August
CPI Report is due out on September 13th.

Direct Placement Method of Sale
Direct Placement
• A Placement Agent places the financing directly with an accredited investor (bank) via a competitive process.
• Unlike a public bond sale, a rating is not needed, and a POS is not produced nor distributed.
The responsibility of due diligence resides with the investor. • Reduced costs of issuance and faster process.
• Less staff time required.
• Limited continuing disclosure requirements.
• Typical maximum term of 20 years.
• Ideal for smaller issue sizes.

REPORT TO: Mayor Palomar & City Council
REPORT FROM: Community Services Director Adam Castaneda REVIEWED BY: AP AGENDA ITEM: Park Naming Proposals for Weststar Phase 1 & Phase 3 ACTION REQUESTED: ___Ordinance ___Resolution ___Motion _____Receive/File
EXECUTIVE SUMMARY
On August 4, 2021, the City Council approved a park/facility naming policy establishing that the City Council has authority over the naming of park assets, pursuant to the prior evaluation and recommendation of the City Manager and city staff. Under the newly approved naming policy, city staff receives and evaluates proposals for formally naming or renaming new or existing parks, recreation facilities, or other park assets under City jurisdiction. The new policy outlines criteria and guidelines that must be followed before staff consideration and approval by the council.
Criteria and Guidelines for Evaluating Park Asset Naming Proposals:
1) The Naming of parks after individuals shall be limited to those who are deceased and have made exceptional contributions to the park or community within which the park is located. 2) The Naming of a park after a major historic event must be based on a direct connection between the park and such event.
3) The Naming engenders a positive public image which does not unduly commercialize the park or recreational facility.
4) No specialized signage or advertisement containing a commercial message to purchase a good or service shall be authorized for use on park property.
5) There shall be no religious symbols included on Naming signage. 6) Parks should not be subdivided for purposes of Naming unless there are readily identifiable physical divisions in the park (major roads, waterways, hillsides, etc.) which facilitate or warrant a subdivision or there exist other compelling reasons for having more than one name connected to a park. This should not prevent independently Naming a recreational facility or amenity located within a park, as long as the selected name will not cause confusion for park patrons. 7) Any exception to the above shall be subject to the Naming criteria contained herein and the Council's prior approval.
On July 6, 2023, city staff published an online survey seeking community input on a potential name for the newest park in Kingsburg. Located north of Solig Avenue and east of 18th Avenue, the park is part of phase three of the Weststar housing development. In addition, another park without a name is located within Weststar’s housing development phase one, located south of Kamm Avenue and east of 18th Avenue. Over 140 online responses were recorded, and the top 10 were narrowed down based on the city’s park naming policy adopted in 2021. Staff intends to utilize the community-generated list of park names for the council to make a selection for both park locations.
Meeting Date: 09/06/2023
Agenda Item: 6.3
Weststar Housing Development Top 10 Park Names:
Phase 1 (Kamm Ave/18th Ave) Phase 3 (Solig Ave/ 18th Ave) Dala Horse Park Dala Horse Park
Freedom Park Discovery Park
Kings Park Freedom Park
Dala Park Solig Recreational Park
Independence Park Liberty Park
Valkommen Park Satterberg Park
Viking Park Olson Park
Nelson Park Oracle Park
Liberty Park Valkommen Park
Discovery Park Viking Park
After initial review by the Community Services Commission, city staff is confident the list of names meets all required criteria and guidelines for each location. The lists above do contain names associated with families located in Kingsburg. These names have been proposed for the respective parks based on prior ownership of the land on which the park is located. Currently, the City only has one park with the name of a Kingsburg family, Athwal. The Athwal Park dedication was done in 2006 after the park property was donated to the City in memory of Jesse Athwal. The land Weststar Construction has set aside for phase one and phase three park spaces was acquired by the city as part of a condition of approval for the developments, including the amenities within. No outside donations or contributions have been received for these parks.
RECOMMENDED ACTION BY CITY COUNCIL
1. Provide recommendations and adopt park names for phase one and phase three of the Weststar housing development projects.
POLICY ALTERNATIVE(S)
1. Provide City staff with additional recommendations, do not adopt park names at this time.
STRATEGIC INITIATIVE
1. Preserve the Kingsburg Experience

PRIOR ACTION/REVIEW
City staff recognizes that parks and recreation facilities are an essential and integral part of the community. The names of parks and recreation facilities and the park amenities within them play a significant role in fostering identities in the surrounding communities. As new parks are developed, they are given temporary names for administration and accounting in accordance with the traditional protocol of staff assigning an initial park name based on geographic features such as street or prominent geographic features.

City of Kingsburg Naming Policy, Procedures and Guidelines for Parks and Recreational Facilities
Policy:
City Staff recognizes that parks and recreational facilities are an essential and integral part of the community and that the names of parks and recreational facilities, and park amenities within them, play a significant role in fostering identities in the surrounding communities. This Naming Policy ("Policy") establishes the criteria and requirements, and sets forth the guidelines and procedures, for the naming and renaming (collectively, "Naming") of parks, recreational facilities and any other assets determined appropriate by City Staff (collectively referred to herein as "Park Assets"), which are owned, managed or controlled by the City of Kingsburg.
Pursuant to this Policy, the initial name of a new park or recreational facility, which may be temporary for purposes of administration and accounting, shall be administratively assigned by City Staff in the traditional manner utilized prior to the establishment of this Policy, based on geographic features such as street and community names or prominent features. In addition, the Naming of existing Park Assets, pursuant to City Staff recommendations relevant to a Naming proposal received from a private or public entity, shall be subject to the approval of the City Council ("Council"), as described herein. In accordance with this Policy and pursuant to City Staff recommendations, the Council shall consider the following two types of Naming proposals. The first type encompasses situations in which City Staff receives or is offered a donation, gift, sponsorship, and/or other contribution from an outside entity that presents a decisive benefit and shows a direct connection to a Park Asset and serves the interests of the City and its residents. This type of Naming proposal would require a Naming Agreement to summarize the terms and conditions necessary to effectuate the financial or other benefits connected to the Naming proposal with a term (time period) recommended by the City Manager and approved by the Council, depending on the scope or nature of the agreement, and value, visibility, and lifespan of the donation, gift, sponsorship and or other contribution. The second type comprises Naming proposals to use a major historic event and/or unique significance of a specific place or person, as the basis for the proposed Name; again with the requirement that there be compelling and impressive substantiation demonstrating how the interests of City and its residents were served or impacted. The key in both types of Naming proposals is the importance of demonstrating direct connections to the Park Asset and clear community benefits as a foundation for considering any Naming proposal.
For purposes of this Policy, and with the exception of the temporary Naming of new Park Assets, the authority to approve the Naming of existing Park Assets shall be solely with the Council. Any exceptions to this Policy shall be subject to the prior approval of the Council.
Criteria and Guidelines for Evaluating Park Asset Naming Proposals:
For purposes of this Policy, the following shall be considered when evaluating the appropriateness, feasibility, and implementation of Naming proposals:
• The Naming of parks after individuals shall be limited to those who are deceased and have made exceptional contributions to the park or community within which the park is located. • Parks shall only be named after living persons under circumstances requiring such naming as a condition precedent of a grant deed or covenant.
• The Naming of a park after a major historic event must be based on a direct connection between the park and such event.
• The Naming engenders a positive public image which does not unduly commercialize the park or recreational facility.
• Park Assets that are held by the City through a lease or use agreement may be considered for Naming under this Policy.
• City Staff reserves the right to limit the duration of time a Name will be in effect. • No specialized signage or advertisement containing a commercial message to purchase a good or service shall be authorized for use on park property. • All forms of signage placed on or within a Park Asset shall meet City graphic and sign standards.
• There shall be no religious symbols included on Naming signage. • Park Assets not under the operation of the City, although under the ownership or jurisdiction of the City, shall not be subject to this Policy. • Parks should not be subdivided for purposes of Naming, unless there are readily identifiable physical divisions in the park (major roads, waterways, hillsides, etc.) which facilitate or warrant a subdivision; or there exist other compelling reasons for having more than one name connected to a park. This should not prevent independently Naming a recreational facility or amenity located within a park, as long as the selected name will not cause confusion for park patrons.
• City Staff shall seek to inform the public with regard to the Naming of a park in their community.
• Any exception to the above shall be subject to the Naming criteria contained herein, and the Council's prior approval.
Procedures:
The City retains the authority to name or rename Park Assets situated on park property. The following shall be the protocol for evaluating, considering and denying or approving Naming proposals:
1. A written proposal for the Naming of a Park Asset must be initially submitted to the Council, to the attention of the City Clerk. In accordance with this Policy, the Council shall forward the proposal to the City Manager for consideration.
2. Prior to any form of Naming Policy being implemented, sponsorship proposals shall be evaluated by City staff, with recommendations to the City Council for possible consideration.
CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Adam Castaneda, Community Services Director REVIEWED BY: AJH AGENDA ITEM: Kingsburg Dog Park Renovation Project Final Draft Update ACTION REQUESTED: ___Ordinance ____Resolution √ Motion ______Receive/File
EXECUTIVE SUMMARY
This staff report provides an update on the progress of the Kingsburg Dog Park renovation project, funded by California Proposition 68. The City of Kingsburg was awarded $1.244 million during the round 4 application process to renovate the dog park at 1225 Laurel Street. The project's primary objective is to enhance the park's recreational amenities, including restrooms, a walking track, landscaping, shade structures, and lighting.
As of the date of this report, the project’s final landscape design has been reviewed by the Community Services Commission and is ready for council review and approval. On August 23, 2023, the Community Services Commission held its monthly meeting and publicly discussed the proposed landscape rendering for the dog park.
After a detailed review of the project by City Engineer Dave Peters, the commission moved to accept the submitted landscape design and present it to the council as their recommendation to move forward. The architectural design firm that developed the renovation plans did receive additional comments from the commission to keep in mind moving forward. These other comments were minimal and included substituting the oleander bushes along the east fence and researching the cost of a block structure fence on the freeway side of the park. The Community Services Commission understood these comments would be researched and final project specifications would be selected based on cost.
Once the council has reviewed and deemed that no further action is required to approve the proposed landscape design, city staff will work with the city engineer to determine project costs and prepare for the bid process. The Kingsburg Dog Park renovation project, funded by California Proposition 68, is making significant progress, with a well-defined and scheduled completion timeline.
The current timeline for the project is as follows:
July 2023 – September 2023: Community Services Commission Review and Final Design of Project January 2024: Project Bid Process and Award
February 2024: Enter Construction Phase
June 30, 2024; Project Completion • Project Open to the Public • Final Payment Request June 30, 2028: End of Grant Performance Period
To ensure transparency and gather final project approval, city staff plans to provide one last update to the council in late November before the project documents are finalized and put out to bid. City staff remains committed to creating a revitalized and inclusive recreational space for our community members and their furry friends. We will continue to work diligently to deliver a successful project that aligns with the city's vision and meets the community's expectations.

BACKGROUND INFORMATION
On April 19, 2023, the council authorized the City Manager to execute the Kingsburg Dog Park Task Order for $108,500 with Peters Engineering Group for completion of the design phase of this project. Since then, several crucial initial tasks have been completed to lay the groundwork for the renovation project. A comprehensive survey of the park area was conducted to gather accurate data on the site's existing conditions, which will inform the design process. In addition, a thorough geotechnical investigation and environmental assessment were carried out to assess the soil and subsurface needs, helping to plan the construction process and ensure its stability and safety.
