CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar and City Council
REPORT FROM: Adam Castaneda, Community Services Director REVIEWED BY:
AGENDA ITEM: Clean California Local Grant Program Resolution ACTION REQUESTED: ___Ordinance ____Resolution ____Motion ______Receive/File
EXECUTIVE SUMMARY
The Clean California Local Grant Program was developed by the California Department of Transportation (Caltrans) and allocates funds to local communities for beautifying and enhancing local streets and roads, tribal lands, parks, pathways, and transit centers. Cycle 2 of the program will provide approximately $100 million in grant funding to local communities throughout California.
The City of Kingsburg has secured a grant of $168,975 for the Heritage Park Shade & Play Project. This initiative aims to enhance Heritage Park by installing an all-weather shade structure, allowing year-round utilization for the residents of our underserved community.
The Clean California Local Grant Program calls for a contractual agreement between the City of Kingsburg and Caltrans to be signed and a resolution to be passed before funding can be reimbursable. A signed resolution by the City Council must be recorded with Caltrans before a Restricted Grant Agreement is drafted.
RECOMMENDED ACTION BY City Council
1. Adopt Resolution 2023-059 authorizing the City Manager to execute contract(s) with Caltrans for the Clean California Local Grant Program Cycle 2 performance period, including any subsequent amendments and all necessary supporting documents.
POLICY ALTERNATIVE(S)
None.
REASON FOR RECOMMENDATION/KEY METRIC
1. Ensure financial stability.

On the March 1, 2023, City Council meeting, the Public Works and Community Services Department staff compiled a list of possible project ideas and sought the council’s input on applicable grant projects. Of the project ideas presented, the council moved forward by selecting grant submittals for improvements at Heritage Park. Each grant award shall not exceed five million dollars ($5,000,000), and there is no minimum award amount. A local match may be required and range from 0% to 50% of the project cost. The applicant must be a local or regional public agency, transit agency, or federally recognized tribal government, and eligible projects must meet the goals of the CCLGP.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Alma Colado, Finance Director REVIEWED BY: AH AGENDA ITEM: Treasurer’s Reports
ACTION REQUESTED: ___Ordinance ___Resolution _√_ Motion ____Receive/File
EXECUTIVE SUMMARY
Attached for the Council’s information is the Treasurer’s Report for the Quarter ended September 30, 2023.
Historically, the City invested most of our reserves with the Local Agency Investment Fund (LAIF). LAIF is a pooled investment fund established by the state to provide cities with safe investment option that is administered by the State of California Treasure’s Office. Interest rates in LAIF lag behind the current economic trends; earnings or returns are typically lower than other investment channels. At the end of the first quarter, the interest rate for LAIF was at 3.53%.
Currently the cash balances of the City of Kingsburg are invested in Local Area Investment Fund Pool (LAIF) and California CLASS Pool investments.
In the first half of the 2022-23 Fiscal Year, the Council amended the city’s financial policy to allow for investment with California CLASS. CA CLASS is a local government investment pool that provides public agencies with the opportunity to pool their funds together with the goal of collectively earning interest on investments. The California CLASS philosophy is to provide competitive returns while focusing on safety and liquidity. While CA CLASS operates a similar formula, the short to medium term securities portfolio offers the opportunity to optimize interest earnings, while not sacrificing safety or liquidity of the funds. At the end of the first quarter, the interest rate for CA CLASS was at 5.47%.
The monthly financial summaries attached provide a detailed report of the City’s cash and investments.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Palomar & City Council
REPORT FROM: Alma Colado, Finance Director REVIEWED BY: AH AGENDA ITEM: Development Impact Fee Report for FY 2022-23 ACTION REQUESTED: ___Ordinance ___Resolution _√_ Motion ____Receive/File
EXECUTIVE SUMMARY
The Mitigation Fee Act (Government Code Section 66006 et. seq.) requires local agencies to submit an annual report detailing the status of development impact fees. The annual report must be made available to the public within 180 days after the close of the fiscal year, and must be presented to the City Council at least 15 days after it is made available to the public. The Development Impact Fee Annual Report for Fiscal Year ending June 30, 2023 is enclosed herein as Attachment “A”.
With the passage of Proposition 13 in 1978 and the resulting decline in local government revenues, local governments have increasingly relied on impact fees in order to mitigate the impacts created by new development. Development impact fees are collected to finance the design, construction and acquisition of facilities and equipment necessary to accommodate future development.
In response to the growing use of impact fees, the state Legislature passed AB 1600 in 1987, the California Mitigation Fee Act, setting forth standards and procedures for how impact fees are imposed, collected and expended. The Mitigation Fee Act requires local governments to segregate and place development impact fees collected in special funds. Those funds are held to finance the construction of the specific facilities for which the fee was imposed. The Mitigation Fee Act also requires local governments to prepare annual reports detailing the status of development impact fees until the funds collected are expended.
AB 1600 requires the City to annually prepare a report for the preceding fiscal year concerning the activity of the City’s Development Impact Fees (Gov. Code Section 66006 (b) (1) and (2)). AB 1600 was enacted to regulate the establishment of any new development fee or fee increase after January 1, 1989. The primary purpose of the annual report is to show the necessity of continued imposition of development impact fees. AB 1600 requires the annual report to be review by the City Council at least 15 days after the report is made available for public review.
To be in full compliance with the State law the City must either (1) spend or commit DIF within five years of collection; or (2) adopt a resolution that makes the findings as required by Government Code section 66001(d), every five years.
Annual Compliance Reporting for all Development Impact Fees The enclosed Development Impact Fees Annual Report provides information on the amount of development impact fees collected and expended, and the interest earned on unexpended funds from July 1, 2022 through June 30, 2023. The City of Kingsburg has nine types of development impact fees.
Meeting Date: 11/15/2023
Agenda Item: 6.3
They are:
Water System Development Fee:
Funds the water supply, treatment, and distribution facilities needed to provide potable domestic water and to meet fire flow requirements for new development.
Traffic Capital Facility Fee:
Funds transportation improvements that include arterial streets, intersections, and traffic signals to accommodate new development.
Public Safety Fee:
Funds the acquisition of land for Police and Fire facilities, the upgrade of existing facilities, and the purchase of vehicles and equipment to accommodate new development.
Specialized Recreation Fee:
Funds the acquisition of land and building for playing fields, open spaces, corridor development, and facility improvements to accommodate new development.
General Government Fee:
Fund the acquisition of land for City Hall, Public Works yard and Library facilities, and the upgrade of existing facilities to accommodate new development.
Sewer Connection Systems Fee:
Funds the connection systems required to provide sanitary sewer service to new development.
Storm Drain System Systems Fee:
Funds drainage facilities for flood control and water management to accommodate new development.
Traffic Impact Zone Fee:
Funds improvements to streets, signals, and ramps due to the development in the K-Mart benefit area.
Park & Recreation
- Neighborhood Park
- Community
Funds new facilities for park and recreation activities to serve development.
The annual report provides the pubic with the requisite information as to the status and use of impact fees collected for fiscal year ending June 30, 2023 in compliance with the Mitigation Fee Act.
Five Year SB 1693 Findings for Development Impact Fees
Effective January 1, 1997, the California State Legislature made certain changes to the previous AB 1600 reporting rules with the adoption of SB 1693. If the money in those Development Impact Fee funds has not been spent, then SB 1693 requires the City to make required findings regardless of whether those moneys are committed or uncommitted. Those findings need to be made only once every five years.
Government Code Section 66001(d)(1)(2)(3)(4) sets forth the five-year findings requirements as:
(d) For the fifth fiscal year following the first deposit into the account or fund, and every five years thereafter, the local agency shall make all of the following findings with respect to that portion of the account or fund remaining unexpended, whether committed or uncommitted:
(1) Identify the purpose to which the fee is to be put. [Provide] A brief description of the type of fee in the account or fund.
(2) Demonstrate a reasonable relationship between the fee and the purpose for which it is charged.
(3) Identify all sources and amounts of funding anticipated to complete financing in incomplete improvements identified in paragraph (2) of subdivision (a). (4) Designate the approximate dates on which the funding referred to in paragraph (3) is expected to be deposited into the appropriate account or fund.
When findings are required, the City must also make them in connection with an annual compliance report. (Government Code Section 66001 (a)). This report complies with both the annual and five-year findings required by AB 1600 and SB 1693.
DISCUSSION:
Development Impact Funds were established for the City of Kingsburg with the adoption of Title 4 – Development Fees as part of the City’s Municipal Code for the purpose of “mitigating the impacts caused by new development throughout the City” and that “development bears a proportionate share of the cost of public facilities and service improvements necessary to accommodate such development.” This report will keep the City in compliance of all aspects of AB 1600 and SB 1693. It is staff intent to report on this timely every year, despite variations in the legislation mandating annual and/or five year reporting so that the Council and the public will have the best information available to them and there will never be doubt about whether the City is compliant or not.
This report is required by AB 1600 to be review by City Council at least 15 days after the report is made available for public review. The reports were originally posted in our website on 11/1/2023.

FINANCIAL INFORMATION
Tracking of the fund activities, summarizing the activity for this report, and preparation of the report requires resources of the Finance Department. No funds were expended to comply with this unfunded State mandate.
This is a required compliance reporting per the California Government Code and failure to report on activity and account balances per regulations in AB 1600 or SB 1693 could allow a successful challenge to the collection of the related fees in the future.

EXECUTIVE SUMMARY
On January 14, 2022, the Fresno Council of Governments (FCOG) Policy Board officially initiated the Cycle X Measure C Transit Oriented Development (TOD) Program Call for Projects. A grant application package for these funds was submitted by the City of Kingsburg on February 28, 2022. The grant application project includes the first phase of implementing the Downtown Kingsburg Strategic Plan and consists of pedestrian and bike facility improvements in the downtown area.
FCOG notified the City on March 28, 2022 that it will receive $396,165 in Measure C Transit Oriented Development (TOD) Program funds for the project.
Staff has developed preliminary designs for the facilities described in the grant application which consist of curb ramp extensions on Lewis Street at Marion Street, Smith Street, Lincoln Street and Washington Street as well as bike lanes on Draper Street between California Street and Sierra Street.
Staff presented the project to the Business Improvement District on November 7, 2023. The District Board members provided feedback in support of the project including:
• Support for the Draper Street bike lanes which they believe will alleviate undesirable bicycle use on sidewalks adjacent to downtown businesses.
• Desire to enhance crosswalks along Draper Street with thermoplastic decorative pavement markings (for example: www.decopavement.net)
• The Board discussed a desire to phase the construction of the bike lanes to minimize disruptions to the businesses along Draper Street.
Staff will present Council with feedback received from the Chamber of Commerce after a project presentation made to the Chamber on November 14, 2023.
