PUBLIC HEARING- CONSIDERATION OF GENERAL PLAN AMENDMENT 2024-01
PERTAINING TO CITY OF KINGSBURG HOUSING ELEMENT AND
ACCOMPANYING CEQA DETERMINATION - Staff Report Prepared by Community Development Director Holly Owen
Mayor Pursell, Jr. opened the Public Hearing at 6:06pm.
Community Development Director Holly Owen presented components of Kingsburg General Plan.
This is required by state law. This is a joint effort with 13 other cities. There is a regional section and a section that is specific to us. The state must review it, we have had 2 formal reviews. We are in compliance. If we make changes, we will have to start over. The Planning Commission has recommended this action to you. Council discussed stakeholder interviews. Ms. Owen reports every year to the state, some of these items are included in this report. Council discussed the affordable housing and RHNA numbers.
Council Discussion: 6:14pm.
Council Member Smith asked if the state has an opinion on how a project looks and the impact it may have on Kingsburg. Director Owen said they will look for low-income housing, ADUs and single-family projects. Council Member Silva asked if they approve this document tonight, is this the final steps or are there more steps. Director Owen answered that this would be the final offer and it would be a surprise if there was something new. Mayor Pursell Jr. asked if anything in here could hinder the Kingsburg experience. Director Owen said our consistent message will continue to be expressed to developers and that our city has a certain brand and expectations.
Director Owen handed the presentation to Amy Sinsheimer to further discuss the project.
Amy Sinsheimer, Placeworks, is planning for a fair share of housing that all cities are responsible for. She discussed zoning, the upcoming senior housing, and fair housing from the state. Council discussed the different programs.
Mayor Pursell Jr. asked about the RHNA, he wanted clarification on what vacant meant. Ms.
Sinsheimer clarified that they are not parking lots or agriculture but are strictly dirt lots without any structures on them. Mayor Pursell Jr. asked to see a certain map to clarify that the map that showed vacant lots, are not actually vacant but have houses on them. Staff confirmed the map was incorrect, the lots marked are not vacant.
Council Member Palomar asked if they require a number for the homeless. She explained what the number is and how they need to allocate land for homelessness.
Council Member Smith asked if we are required to re-zoning. Ms. Sinsheimer answered it is in the plan, and to have a document pass and be compliant than it would be.
City Manager Henderson answered we are working on having this accepted by the state. The challenge is most of what is required, is not in line with the keeping the Kingsburg experience. The market dictates what is built, but if it is re-zoned and a project comes forward, that is something we would have to work through. If you don’t adopt the housing element, the state can take us to court.
Essentially, we will need to pass something, despite it not aligning with the Kingsburg experience Kingsburg City Council, City of Kingsburg Public Financing Authority and Board of Directors of the Successor Agency ofthe Kingsburg Redevelopment Agency Joint Meeting Minutes June 19, 2024
to avoid extra legal costs from the state.
The accuracy of the maps was discussed, Ms. Sinsheimer considered the changes substantive if the map is not accurate. Mayor Pursell Jr. asked if we submitted these maps with lots that are not vacant, what does it mean for the state? Director Owen answered she would take directions from the city attorney on the matter.
Mayor Pursell, Jr. opened the Public Comment at 6:21pm.

Mayor Pursell, Jr. closed the Public Comment at 6:21pm.
Continued Council Discussion: 6:49pm
Council discussed the implications of passing an inaccurate document. The general feelings are to erring on the side of caution and to reevaluate the documents and maps. Council Member Smith has concerns regarding re-zoning to higher densities. City Manager Henderson stated we would need to table the discussion to July 17, 2024, City Council Meeting. City Attorney Mike Noland agreed with the tabling due to inaccuracies.
Mayor Pursell, Jr. closed the Public Hearing at 6:55pm.
A motion was made by Council Member North, seconded by Council Member Smith, to continue the Public Hearing to the July 17, 2024, City Council Meeting. The motion carried by a unanimous voice vote.

Jian Wu, Senior Manager at DTA, reviewed his presentation that shows the proposed CFD fees.
Council Member Silva asked the difference between the single family and multifamily CFD fees.

Award the Laurel Street Dog Park Improvements Project Base Bid and Additive Alternate 1 to Don Berry Construction, in the amount of $989,270.00 and authorizes the City Manager to include additional additive alternates to the contract as funding is secured for the various items of work.- Staff Report prepared by City Engineer David Peters
Sponsor: City Engineer’s Department
City Engineer Dave Peters reviewed that the City received a Prop 68 grant in the amount of 1.2 million for the Laurel Street Dog Park. The City received bids for the project, but there is not enough grant funds to cover the project. The grant award says you have to have everything in the grant application. Staff is working on lowering the costs. Mr. Peters recommend the base BID and alternate 1 for the bathrooms, which we have already purchased, to be awarded.
Council Member North asked what the timeline is for the project. Engineer Peters estimated that if it is approved tonight, we could start the process tomorrow and begin construction in July and be done by October when the rain hits and water goes in the basin.
Council Member Silva asked what we are cutting costs on, will it be something that will cause more maintenance? Engineer Peters stated it will not add more maintenance; it will just not be the Cadillac version of different items, like the shade structure. It would be more in line as to what you see everywhere.
