ACTION REQUESTED: ___Ordinance ___Resolution ____Motion ____Receive/File
EXECUTIVE SUMMARY
Provost & Pritchard staff, consultants for the Kingsburg General Plan Update, will provide a briefing on the General Plan Update process.
Each City and county is required by the State to have a General Plan for their community. State guidelines outline specific requirements for these plans. General Plans also establish guiding principles, development policies, consideration of long-range area development, and typically affirm community-held values. Kingsburg’s last General Plan Update was thirty years ago, and needs to be updated to include recent requirements, such as a Hazard Management section as well as an Environmental Justice section.
The General Plan Update contract was finalized earlier this year with the consultants. Tonight’s discussion will cover the following objectives:
Brief the Council and Commission on the reasons for a General Plan update. Provide the Council and Commission with an opportunity to comment on the scope, project schedule and tasks for this process and provide direction to staff as appropriate. Provide a public forum for members of the community to learn about and comment on the General Plan Update process, including ways to become involved.
RECOMMENDED ACTION BY CITY COUNCIL/PLANNING COMMISSION
1. Receive a presentation of the General Plan Update process from Provost & Pritchard, the City’s General Plan Consultant, solicit public input, hold a discussion and, if desired, provide direction to Provost & Pritchard and/or City Staff.
ENVIRONMENTAL REVIEW
Comments from the City Council and the Planning Commission do not constitute any final action on the General Plan Update and no formal decision is requested. Therefore, no review under CEQA is required at this time.
POLICY ALTERNATIVE(S)
1. None.
REASON FOR RECOMMENDATION/KEY METRIC

Subject: Proposal to Prepare a Focused General Plan Update, City of Kingsburg, California Dear Ms. Owen:
Thank you for the opportunity to submit this proposal to work with the City of Kingsburg on a focused update to the General Plan. This proposal discusses our understanding of the project, recommends a scope of services together with associated fees, deliverables, and approximate schedules.
PROJECT UNDERSTANDING
The City of Kingsburg General Plan was last comprehensively updated in 1992. While there have since been several updates and amendments, its vision, land uses, goals, and policies have remained relevant and continue to serve the community well. However, in the last 30 years, State general plan regulations have evolved significantly, and the community has grown by more than 50 percent. An update to the General Plan is an opportunity to not only bring the General Plan into conformance with new legislative requirements but also confirm that the vision and goals that have driven community growth since 1992 remain unchanged.
The current format of the Kingsburg General Plan is also reflective of an approach that was popular at the time the Plan was developed. It integrates the Environmental Impact Report (EIR) into the General Plan policy document, which at the time, allowed for a more wholistic approach to implementation. However, it has also resulted in a document that is rather dense with a higher degree of technical information that can be less accessible to a broader audience.
This proposal is focused on bringing the City’s General Plan into compliance with State law, confirming the current community’s vision for growth and development, and establishing a user-friendly policy document.
PROJECT APPROACH
Our proposed scope of work takes into consideration our experience preparing general plan policies designed to comply with recent State requirements, including for the safety and environmental justice elements. It also reflects our experience functioning as planning staff for various communities within the San Joaquin Valley.
Key features and strategies of our approach are outlined below.
BUILD ON RECENT PLANNING EFFORTS
Fresno County has prepared a Multi-Jurisdictional Hazard Mitigation Plan (HMP), of which the City is a participating agency. With the adoption of the HMP there is an opportunity to streamline the level of effort required by the City to respond to new safety element requirements. A preliminary review of the HMP City of Kingsburg December 8, 2023
Focused General Plan Update Letter Proposal Page 2 of 12 Job No.: P-23-63
\\ppeng.com\pzdata\docs\Marketing\Proposals\2023\City of Kingsburg - General Plan Update 23-63\Revised Approach\Kingsburg Focused GPU Letter Proposal_F.docx document indicates that many, if not all, of the safety element legislative requirements have been addressed.
This includes climate adaptation, fire hazard, and flooding requirements.
Our project approach includes a more detailed review of the HMP to determine what requirements have already been satisfied for the City and what additional actions, if any, are needed to ensure the Kingsburg General Plan is in compliance with recent safety element requirements. The level of effort in this scope of work accommodates updated mapping and revisions to the element to reflect current conditions, if necessary, but assumes that many of the State requirements are covered within the HMP.
TAILORED ENVIRONMENTAL JUSTICE MAPPING ANALYSIS
While CalEnviroScreen is a useful tool for establishing a community’s level of environmental burden in relation to other communities throughout California, there are some limitations to the tool. Since data is collected and analyzed at the census tract level, it may not fully represent the nuanced issues faced by communities that have relatively large or aggregated census tracts, such as the census tracts in Kingsburg.
Our project approach includes a more comprehensive, customized, and local analysis of environmental justice issues facing the City, which includes conducting a mapping exercise to consider additional indicators of equity, such as access to parks and open space as well as access to health care facilities.
COORDINATION WITH OTHER ONGOING EFFORTS
The City is currently in the process of updating their 6th Cycle Housing Element as part of a regional effort through Fresno Council of Governments. Outreach is a particular focus of the 6th Cycle updates and includes numerous engagement opportunities with community stakeholders.
Our approach to maximizing outreach efforts is to coordinate with the Housing Element consultants, as appropriate, to understand what stakeholders have been engaged in those processes and how issues being raised or addressed, particularly through the Housing Element update, may inform the General Plan update.
The General Plan update effort will build on the stakeholder list developed as part of the Housing Element effort and provide notice to those interested in participating in the focused General Plan update process.
STREAMLINED ENVIRONMENTAL REVIEW
We do not anticipate that any land use changes to the Kingsburg General Plan would be required to respond to State legislative requirements. Therefore, Provost & Pritchard’s project approach assumes that a General Plan Consistency Exemption in accordance with California Environmental Quality Act (CEQA) Section 15183 would be an appropriate determination for this effort.
Provost & Pritchard also recognizes the importance of initiating requests for tribal consultation early, due to the length of the required consultation request timelines under Senate Bill (SB) 18. Our approach initiates this request for consultation early in the process so that the statutory timeline does not delay the overall project timeline.
STAFFING
Provost & Pritchard has assembled the following key staff to prepare the focused Kingsburg General Plan update. They have been selected based on their relevant experience and will be integrally involved in the management and preparation of deliverables throughout the General Plan update. Additional staff resources may be used, as needed.

\\ppeng.com\pzdata\docs\Marketing\Proposals\2023\City of Kingsburg - General Plan Update 23-63\Revised Approach\Kingsburg Focused GPU Letter Proposal_F.docx PHASE 2: DOCUMENT REPACKAGING AND DATA COLLECTION
TASK 2.1 GENERAL PLAN AND EIR DOCUMENT PREPARATION
Provost & Pritchard will repackage the existing General Plan and EIR into two separate documents: the policy document (i.e., General Plan) and the environmental document (i.e., EIR). Currently, these two documents are co-mingled, making the documents less accessible to the public and making it more difficult to find and implement key goals and policies. While we anticipate adding organizational components, such as a Table of Contents to assist users in navigating the documents, other additions will be limited and no changes will be made to the vision, goals, or policies of the General Plan or to the analysis, mitigation measures, or findings of the EIR. This task includes establishing a style template consistent with the City of Kingsburg branding. Both documents will be prepared in Word and PDF and maps/figures will be prepared in GIS, as data is available or easily verified.
TASK 2.1 MEETINGS TASK 2.1 DELIVERABLES
− No meetings anticipated − Kingsburg General Plan (Word, PDF) − Kingsburg General Plan EIR (Word, PDF)
TASK 2.2 GIS ONLINE MAPPING
GIS mapping will be a foundational aspect for accessing and assessing data during the audit and analysis of the Kingsburg General Plan. Ensuring that the most recent available City data is consolidated and made accessible for both City staff and the consultant will support the focused General Plan update effort. GIS mapping will also be an integral part of repackaging the General Plan and EIR documents.
To support the preparation of repackaged General Plan and EIR documents, and to facilitate the analysis proposed as part of this focused General Plan update, we are proposing to create an ArcGIS Online Application to provide Kingsburg with access to spatial data in a web-based format in the form of an interactive digital map. This task would incorporate existing data sets into a single interactive map that can support the focused General Plan update effort as well as future engineering and land use planning decision-making for the City.
The interactive map would also create a framework for future map interfaces that can be for internal use or made publicly. This effort would include establishing a base map template and standard symbology type for each dataset created.
This task would require the City to establish an ESRI ArcGIS Online account. Licensing fees would be paid directly by the City to ESRI. Provost & Pritchard will work with City staff to determine the appropriate licensing structure. Initial recommendations would include the establishment of one Creator license and one Field Worker license, which would allow access for the creation and administration of the account and allow viewing and data collection for the GIS map. Additional licenses can be purchased as needed. Initial map creation would include up to 12 data sets, including the following:
• City limits,
• Sphere of influence,
• General plan land use,
• Zoning,
• City streets and alleys, and
• Parcels.
Additionally, the map layers would include preconfigured ESRI base map themes such as aerial imagery, topographic, roads, and places.

\\ppeng.com\pzdata\docs\Marketing\Proposals\2023\City of Kingsburg - General Plan Update 23-63\Revised Approach\Kingsburg Focused GPU Letter Proposal_F.docx Typical search query tools will be included as part of the ArcGIS online map, such as finding by address, Assessor Parcel Number (APN), City owned by APN, measuring distance and areas, and the ability to turn layers off and on. The draft online map will be tested internally then shown in a meeting demonstration for the City to review and comment on. Change requests based on this review may include map layer color or style adjustments, adding map tools that are preconfigured in the software, and edits to built-in map function (i.e., labels, identify windows). Edits that require custom functions would necessitate an additional scope of work effort. The online map will be finalized and made ready for access by City staff. Provost & Pritchard will demonstrate to key City staff how to interact with the map and tools via one virtual meeting.
TASK 2.2 MEETINGS TASK 2.2 DELIVERABLES
− Attendance by up to 2 Provost & Pritchard staff
at up to 3 virtual meetings with City staff
− Confirmed list of layers for inclusion in draft
online map (up to 12 data sets)
− Draft online map (ArcGIS Online)
− Final online map (ArcGIS Online)
PHASE 3: POLICY REVIEW AND ANALYSIS
TASK 3.1 GENERAL PLAN AUDIT REPORT
Provost & Pritchard will review the repackaged Kingsburg General Plan relative to applicable State legislation governing general plans. The focus of the review will be to determine compliance with legislation passed since 1992, the date the current General Plan was adopted. The outcome of the audit will determine what new requirements will need to be addressed through this focused General Plan update effort. This may include the addition of new goals or policies or the deletion/adjustment of any goal or policy language that is found to be inconsistent with new State general plan requirements. We anticipate needing to address Senate Bill (SB) 1000 (Environmental Justice) and SB 379 (Climate Adaptation), which each require specific analyses for compliance.
Additional topics that will be reviewed as part of the audit include, but are not limited to, compliance with new flooding, wildfire, military facilities, and disadvantaged unincorporated community requirements.
The outcome of the audit will be documented in a General Plan Audit Report, which will include recommendations for compliance with State law. An administrative draft Audit Report will be provided to City staff for review and comment. Provost & Pritchard will provide City staff with an administrative draft Audit Report for internal review and comment. Our expectation is that the City’s Project Manager will resolve conflicts in staff comments before sending the administrative draft to Provost & Pritchard to make updates in response to City comments. It is also assumed the City will provide one round of comments. Provost & Pritchard will make the appropriate changes and prepare a final Audit Report.
TASK 3.1 MEETINGS TASK 3.1 DELIVERABLES
− No meetings anticipated − Admin Draft General Plan Audit Report (Word) − Final General Plan Audit Report (PDF)
TASK 3.2 PUBLIC WORKSHOP NO. 2 – AUDIT AND CONFIRM
Provost & Pritchard will facilitate a workshop to present the findings and recommendations contained in the General Plan Audit Report prepared under Task 3.1. The purpose of this workshop will be to get input and confirmation of the recommendations for compliance with State law and to provide an opportunity for the community and decision-makers to ask questions or provide input on the recommendations. We propose holding the workshop as a joint City Council/Planning Commission study session during or just prior to a regularly scheduled City Council meeting.

TASK 3.3 GENERAL PLAN POLICY ANALYSIS PAPER
Based on the recommendations of the General Plan Audit Report prepared under Task 3.1, Provost & Pritchard will prepare the required analyses for compliance with the applicable recent State general plan requirements.
As noted above, we anticipate preparing analyses specific to SB 1000 (Environmental Justice) and SB 379 (Climate Adaptation). Additional data and mapping may also be required to address other new Sate general plan requirements, such as flooding risk, wildfire risk, impacts to military facilities, and planning for disadvantaged unincorporated communities. It is assumed that the analyses included within the Fresno County Multi-Jurisdictional HMP, of which Kingsburg is a participating agency, are adequate to satisfy the requirements under SB 379. All required information to address new State general plan law will be documented in a General Plan Policy Analysis Paper. The outcome of this Policy Analysis Paper will inform the development of new policy language and establish the required information for incorporation into the Kingsburg General Plan in accordance with State general plan requirements.

TASK 3.4 PUBLIC WORKSHOP NO. 3 – POLICY APPROACH
Provost & Pritchard will facilitate a workshop to present the findings and recommendations contained in the General Plan Policy Analysis Paper prepared under Task 3.3. The purpose of this workshop will be to get input on and confirmation of the policy recommendations for compliance with the specific State laws analyzed within the Policy Paper and to provide an opportunity for the community and decision-makers to ask questions or provide input on the recommendations. We propose holding the workshop as a joint City Council/Planning Commission study session during or just prior to a regularly scheduled City Council meeting.
Provost & Pritchard will prepare the presentation for the workshop and any related exhibits needed for the workshop. Provost & Pritchard will also prepare the following materials for promotion of the workshop:

As noted previously, we assume that no land use changes will be made. The City will provide Provost & Pritchard with one consolidated, internally consistent, set of comments for review and revision.
Provost & Pritchard will revise the documents based on comments received and re-submit the revised administrative draft General Plan to City staff for review and confirmation. Should additional comments be provided by City staff, one consolidated, internally consistent set of comments will be provided.

We do not anticipate that any land use changes will be necessary during the focused General Plan update and, therefore, we assume that a General Plan Consistency Exemption in accordance with CEQA Section 15183 would be an appropriate determination. Provost & Pritchard will prepare language for the City to incorporate into the staff report, confirming and documenting the use of the General Rule Exemption. There are no formal public notices required for the exemption prior to action. However, SB 18 consultation is required to amend the General Plan and consultation request letters will be sent during Task 2.1 so that the 90-day request period for Native American Tribes is initiated early in the process. Provost & Pritchard will prepare the Notice of Exemption (NOE) following adoption by the City Council.

\\ppeng.com\pzdata\docs\Marketing\Proposals\2023\City of Kingsburg - General Plan Update 23-63\Revised Approach\Kingsburg Focused GPU Letter Proposal_F.docx • Assumptions related to Task 2.2 (GIS Online Mapping):
o Provost & Pritchard will rely on existing data for this project. Requests to add data that requires creation or editing before it’s compatible with the online map, will be evaluated on a per request basis. An estimate of time and cost will be provided to the client before proceeding.
o The project includes an interactive digital map only, no printed maps will be created. o The City will be billed for the licensing of GIS software directly by ESRI Inc., and fees will be dependent on the licensing structure determined by the City. Additional costs would be required to establish an ESRI creator account (for preparing and hosting maps) and an annual subscription fee for viewing/editing. These costs are in addition to the estimated budget amount and would be paid directly by the City. They can vary but may generally be from $650 to $1,000 annually, depending on the options selected. o Provost & Pritchard can assist the City with the initial licensing set up and billing through ESRI Inc.
o Some performance limitations of a web-based map are created by either the licenser of the software, ESRI Inc., or due to internal software issues and are beyond the control of Provost & Pritchard to fix (such as servers being offline or poor computer performance).
Performance issues should be specifically noted by the City so Provost & Pritchard can evaluate if we can help resolve the issue. Screen captures or sharing screens via Teams meeting can be an effective way to show what the problem is and help Provost & Pritchard decide if ESRI should be contacted to help fix the problem. • Work is contingent upon all terms and conditions as agreed up by both parties, following Provost & Pritchard review of the City’s Standard Agreement.
We look forward to working with the City of Kingsburg on this focused General Plan update. Please reach out to me directly should you have any questions. This proposal is valid for 30 days from the date above.
Sincerely Yours,
Provost & Pritchard Consulting Group
