CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Pursell Jr. & City Council
REPORT FROM: Daniel Galvez, Public Works Director REVIEWED BY: AJH AGENDA ITEM: Consideration Of Extraterritorial Water Service Connection By The City Of Kingsburg To C.H Warlow Safety Roadside Rest Area Located Outside The City Limits Of The City Of Kingsburg
ACTION REQUESTED: ___Ordinance _√__ Resolution __√_ Motion ____Receive/File
EXECUTIVE SUMMARY
In early 2020, the city received a request from the California Department of Transportation (Caltrans) to connect to the City’s municipal water system. The C.H. Warlow Safety Roadside Rest Area (SRRA), is located on northbound Highway 99 between Avenue 384 and Ward Drive, just south of Kingsburg.
The request involves a domestic water supply from private well the serves the C. H Warlow rest area that has exceed its life expectancy and has faced reliability and water quality issues. The Public Works Department has confirmed the issues of the private well and the need for connection of the property to the City’s municipal water system. The property is in Tulare County and outside of the city limits of the City. On March 4, 2020, staff presented the item to Council for consideration. Council ultimately gave direction to move forward with studying the project for feasibility. Subsequently, the California Department of Transportation commissioned a water model study in 2020. The water model study found domestic water could be provided, but due to the distance of the connection, water for fire suppression could not be provided. Caltrans estimates water usage at roughly 2,000 gallons per day.
The project lost momentum shortly thereafter given the COVID-19 pandemic and other exterior factors. The project is also applicant driven and Caltrans reengaged the city in late 2023 seeking to establish the connection (Attachment #4).
The Kingsburg Municipal Code Section 13.04.050 allows the City to provide water service to properties outside the city limits of the City when approved by the City Council upon terms and conditions prescribed by the City Council. Additionally, California Government Code Section 56133 requires the approval of the Local Agency Formation Commission (LAFCo) for the County where the property is located before the City can extend municipal water service to property located outside the city limits of the City.
If approved by Council, the proposed Agreement for Extension of Water Service (Attachment #3) will be signed by the applicable property owner and identifies payment of fees by the property owner as a condition to connecting the property to the City’s municipal water system. The agreement addresses the issues and the conditions for providing municipal water service to the property as identified in Kingsburg Municipal Code and California Government Code Section 56133 (approval by LAFCo).
Meeting Date: 12/04/2024
Agenda Item: 8
The municipal water system connection process is initiated with the City Council’s approval of the Agreement for Extension of Water Service, and after Tulare County LAFCo approval, the City may authorize Caltrans to commence the connection process.
All costs associated with the connection to city water, as well as staff time and an encroachment fee, are to be paid by the applicant (Caltrans). All costs for the use of water are to be paid by the applicant now and into the future, including any future water fees as set by City Council.
Water Conservation
The City has been asked to significantly reduce water use by 2040. A portion of the formula integrates the City population as a ratio of the amount of groundwater being pumped and factors; Residential Indoor Use, Residential Outdoor Use, CII (Commercial, Institutional, Industrial) Landscapes with Dedicated Irrigation Meters (DIMS) Real Water losses.
Staff had concerns that this connection could adversely affect the City’s calculation since the rest stop does not have a population to offset the use. The City contacted the State Water Board for directions and has also asked if a variance is possible, since water is being provided to the State and due to the State being unable to procure reliable potable water at the site. The City has confirmed with the State Water Board that at this time Commercial indoor use (CII) connections are excluded from the Water Use Objective, but the State Water Board has indicated it cannot speak for other state agencies or the Governor’s office regarding measures that could be taken in possible future droughts, executive orders, or other legislation that would require temporary reductions.
To address this future unknown and protect the City’s interests, staff included language in Section 5 of the proposed agreement that allows the city to terminate, disconnect, or modify the connection within 1 year of notice. Caltrans has asked for a three (3) year period from the termination notice.
RECOMMENDED ACTION BY FINANCE COMMITTEE
1. Adopt Resolution 2024-066 approving the agreement with Caltrans authorizing the connection to the City’s municipal water system to the C.H. Warlow Safety Roadside Rest Area (SRRA) located outside the city limits.
POLICY ALTERNATIVE(S)
1. The Council could choose to recommend the connection with changes to the proposed agreement specifically to Section 5 of the agreement: Owner shall have three (3) years after the date of the Termination Notice to replace the water source for the Property. Owner will indemnify, defend and hold the City harmless from any and all loss, costs, damages, fines, sanctions, claims and expenses incurred by the City as a result of continuing to provide water to the Owner during the three (3) year period.
2. The Council could choose not to recommend the connection to the City’s municipal water system.
REASON FOR RECOMMENDATION/ STRATEGIC GOAL
1. Community Safety
FINANCIAL INFORMATION
FISCAL IMPACT:
1. Is There A Fiscal Impact? Yes, but is offset by fees, see Exhibit “B” of Agreement
2. Is it Currently Budgeted? No
3. If Budgeted, Which Line? N/A
Caltrans initially anticipated using about 2,000 gallons of water a day. However, recently Caltrans provided an updated estimate of 1,500 gallons of water a day due to new low flow plumbing fixtures. Staff has been able to estimate the anticipated monthly billed amount base on 2,000 gallons a day. 2,000 gallons per day x 30 days = 60,000 gallons a month Monthly Rate Fee Gallons in thousands* Total
0-11,000 32.25 11* 32.25
11,001-22,000 .80 per 1K gallons 11*, X.80=8.80 8.80
22,001-34,000 .95 per 1K gallons 12* X.95=11.40 11.40
Above 34,001 1.14 per 1K gallon 26*x1.14=29.64 29.64
Monthly Total 82.09
Yearly Total 82.09 x 12 985.08
Costs for water consumed now and, in the future would be subject to any proposed changes identified by the recently commissioned water rate study and Prop 218 process. All costs related to connection would be covered by the fees identified in Appendix B of the proposed agreement.
PRIOR ACTION/REVIEW
The California Department of Transportation previously commissioned a water model update in 2020. The water model update found domestic water could be provided, but due to the distance of the connection water for fire protection could not be provided. The domestic water connection will not have a significant impact on our water system or supply.
BACKGROUND INFORMATION
Since Caltrans commissioned the water model in 2020, there were delays due to COVID as well as some confusion as to what the water model authorized. The water model did not show any adverse effects to the water system, but did not give Caltrans or staff the authority to approve the connection. During this time CalTrans did spec and bid the project, in late 2023, construction of the water line began as well as the improvements to the rest stop. The remaining task is to complete the connection to the City Municipal system.
The City has worked to Cal-Trans to review the terms of the agreement as some sections of the City’s boiler plate extraterritorial agreement were not applicable due to the proposed agreement being with another government agency and not a private party. These changes have been reviewed by the City’s legal counsel. This item was reviewed by the Finance Committee on October 28, 2024 and staff was given direction to determine if allowing this connection would have any adverse effects on the City’s Conservation efforts. The Committee also discussed the timeframe for Caltrans to find an alternative water connection or source and Caltrans indicated it would need a minimum of three years to budget, program and build a new well and/or find an alternative water connection/source, if and when a connection was authorized.
The City has confirmed with the State Water Board that at this time Commercial indoor use (CII) connections are excluded from the Water Use Objective, but the State Water Board has indicated it cannot speak for other state agencies or the Governor’s office in regard to measures that could be taken in possible future droughts, executive orders, or other legislation that would require temporary reductions.

Warlow Safety Roadside Rest Area (SRRA) located on northbound Highway 99 between Avenue 384 and Ward Drive, south of the City, and more particularly described in Exhibit “A” which is attached hereto and made a part hereof (“Owner’s Property”). Owner’s Property is located approximately 2.15 miles from the City’s city limit boundary.
B. A domestic water well located on the Owner’s Property (“Water Well”) provides the Owner’s Property with water. However, the current water system for the Owner’s Property has exceeded its life expectancy and is deteriorating The Water Well's capacity is likely inadequate to meet site irrigation and potable water needs, particularly during drought conditions and increased groundwater pumping.
C. The Water Well is insufficient to provide the Owner’s Property with fire protection, irrigation and domestic use. As a result, Owner has requested the City provide municipal water to Owner’s Property through the City’s municipal water system. City has agreed to provide Owner’s Property with water through the City municipal water system, in accordance with the provisions of Sections 13.04.050 and 13.04.060 of the Kingsburg Municipal Code and the provisions of this Agreement. The existing Water Well will remain to provide water for irrigation and fire suppression.
D. In March of 2020, a water model study was done to assess the impact on the City’s municipal water system. The result of the water model study indicated the City could provide water service to properties located outside the City limits without adversely Recording Requested By

2 impacting water service to City residents. The SRRA anticipates using approximately 2,000 gallons of water per day. The connection will use a 3- inch plastic water line crossing the Kings River via the northbound Highway 99 bridge to Earl Street and Frontage Road in the City.
E. Considering hydraulic losses in the pipeline and appurtenances conveying water from the watermain on Frontage and Earl to structures on the Owner’s Property, Owner assumes all responsibility for determining the adequacy of the water flows supplied by the City system and the acceptance of this flow by Tulare County. As system flows vary, the City does not warrant or guarantee specific water volume or pressures at the point of connection to the City’s municipal water system, system water pressure at the connection point ranges from 32 psi to 49 psi. Planned service interruptions of water service will be notified to the State with at least 24-hour notice prior to the interruption.
NOW, THEREFORE, in consideration of the mutual covenant herein contained and for other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, and intending to be legally bound, the parties hereto, agree as follows:
1. Connection to City’s Municipal Water System. Owner represents and warrants to City that:
a) Owner has been advised the Water Well on Owner’s Property is insufficient to provide fire protection, landscape and domestic use and drilling of a new well on Owner’s Property will cost substantially more than the cost of connecting Owner’s Property to the City’s municipal water system.
b) Based upon Owner’s representations and warranties and conditioned upon Owner’s full and complete performance of all the terms and conditions of this Agreement, and subject to terms and conditions of this Agreement, City agrees to provide Owner’s Property with water from the City’s municipal water system.

DANIEL GALVEZ
Public Works Director
City of Kingsburg
1200 Kern St, Kingsburg CA 93631
Dear Mr. Galvez:
Caltrans is requesting water service for the C.H. Warlow Safety Roadside Rest Area (SRRA) on Highway 99 near Kingsburg, south of Fresno. We need a reliable water supply for daily restroom operations and drinking water for visitors and employees. We seek to transition to the City of Kingsburg municipal water service due to the urgent need to replace our current system, which is no longer sustainable.
The reasons for this request are as follows:
Aging Infrastructure: The current water system at C.H. Warlow SRRA has exceeded its life expectancy and is deteriorating.
Water Quality Issues: Bacteria were found in the well, requiring the installation of a chlorination system with ongoing maintenance costs.
Infrastructure Deficiencies: The motorized ball valve at the inlet to the potable water pressure tank is leaking, as is the irrigation water pressure tank, both requiring repair or replacement.
Water Supply Insufficiency: The well's capacity is likely inadequate to meet site irrigation and potable water needs, particularly during drought conditions and increased groundwater pumping.
To address these challenges, connecting to the City of Kingsburg municipal water service is the best solution. Anticipated water use for building operations, including flushing toilets and handwashing, is approximately 2,000 gallons per day. The connection will use a 3-inch plastic water line, crossing the Kings River via the northbound Highway 99 bridge to Earl Street and Frontage Road in the City.
The existing well will continue for site irrigation, and the municipal service won't be used for irrigation or fire suppression. The well source and the municipal water service will not be connected to avoid potential cross contamination. Restroom fixtures will be Mr.Galvez, Public Works Director, City of Kingsburg

“Provide a safe and reliable transportation network that serves all people and respects the environment” updated to ultra-low flow fixtures to meet 2016 plumbing code requirements, minimizing water use.
Prior to this request, Caltrans communicated with David Peters PE, the City of Kingsburg’s consulting engineer, who recommended a water modeling study in March 2020 to assess the impact on the city’s water system. The city indicated it could likely provide the connection.
We kindly request your assistance in expediting the new water connection to ensure an uninterrupted water supply. Please provide any necessary forms, documents, or fees to initiate this process.
