REGULAR CALENDAR
Consideration of a one-time donation to KCAPS (Kingsburg Community Assistance Program & Services) to support community needs during the federal government shutdown- Presentation by Council Member Laura North.
Council Member North and Aida Rushing of KCAPS requested that the Council consider a onetime $10,000 donation to KCAPS to help address increased community needs resulting from the federal government shutdown, and to direct staff to provide monthly status updates if the shutdown continues into December. KCAPS currently receives $5,500 monthly from the Health Care District but has seen a significant rise in demand, recently serving 25 families in a threehour period compared to the usual five. KCAPS serves Kingsburg, London and Traver.
Council discussed that KCAPS does not apply for state or federal grants because they like the flexibility to provide quality food. KCAPS is also funded by the profit that they make at their thrift store.
Council Member North motioned, seconded by Council Member Palomar, to authorize a onetime donation of $10,000 to KCAPS for the month of November, to address the increased community needs resulting from the federal government shutdown, and direct staff to schedule a monthly review item beginning in December to assess ongoing need and potential further support. The motion passed by a unanimous voice vote.
Measure E Renewal – Ballot Language Discussion - Staff report by City Manager Alexander Henderson.
Sponsor: City Manager’s Office
Kingsburg City Council Minutes
November 5, 2025
Council held a detailed discussion regarding the ballot language and whether to include a sunset provision. Council Member North expressed support for having no sunset rather than a 30-year sunset, noting that the measure could still be repealed in less than 30 years.
Council Member Smith stated she is not comfortable with having no sunset but prefers a longer term, such as 30 years. Council Member Silva reported that, after speaking with residents, he did not receive clear feedback on a preferred sunset length. He supports ballot language without a sunset, noting that voters would retain the ability to repeal it. Mayor Pursell stated he struggles with both no sunset and a 30-year sunset, observing that the community cannot know what law enforcement needs will look like 30 years from now.
Council Member Palomar expressed support for having no sunset, commenting that most residents understand the value of Measure E and appreciate the safety it provides.
Council Member Smith noted that when the measure was first passed, there was public concern about how the funds would be spent. Mayor Pursell added that having no sunset could be risky and that he is not comfortable taking that risk given the importance of the measure. He stated that the community has a conservative voter base and indicated a preference for a 20-year sunset, potentially with language allowing voter repeal.
City Manager Henderson explained that, from a staff perspective, the challenge with a sunset provision is that the City is tying ongoing positions to the measure and planning for long-term staffing needs. A sunset creates uncertainty for those positions. He acknowledged concerns about how future councils or managers might administer the funds but noted that if issues arose, it would be expected that a citizens group would intervene. He described the original 10-year sunset as a “prove-it contract” with the public.
Council reviewed the timeline for final action on the sunset provision. Staff prefers placing the item on the November 19 meeting agenda, or, if necessary, the first meeting in December.
Council Member North referenced the 2018 discussions, explaining that the measure was established as a public safety tax with a sunset to demonstrate accountability to the community. She noted that significant safeguards already exist regarding how future councils and managers may spend the funds and expressed support for an “until repealed by voters” provision, citing the City’s active citizen groups. Council Member Palomar added that the community will alert the Council if concerns arise. Council Member Silva stated he supports the ballot language presented in Option 2.

Salinas provided an overview of the FLOCK camera system, explaining that 10 cameras are positioned at key entry points into the city. He stated that the police department determines which agencies receive shared information and that usage is governed by state law. The FLOCK cameras have already assisted in solving property crimes.
Kingsburg City Council Minutes

In response to Council Member Silva’s question about AMBER Alerts, Lt. Salinas explained that the system notifies the department when a wanted vehicle is detected, prompting further review.
In response to Council Member Palomar, he clarified that the department does not have access to live video feeds; the system only captures license plates and vehicle descriptors.
Chief Dadian thanked Lt. Salinas and Lt. Stephens for their work on the project and for maximizing available funding.
Brown Act Updates Under SB 707- Staff Report by City Clerk Abigail Palsgaard Sponsor: City Manager’s Office
City Clerk Abigail Palsgaard reported on Senate Bill 707 (SB 707), signed October 3, 2025, which makes significant updates to the Ralph M. Brown Act effective July 1, 2026. As an “Eligible Legislative Body,” the City of Kingsburg will be required to offer two-way virtual participation, adopt policies for handling virtual disruptions and meeting decorum, maintain an accessible meetings webpage, and make reasonable efforts to engage underrepresented groups.
Translation requirements will apply only if 20% or more of the population has limited English proficiency, which does not currently apply to Kingsburg.
SB 707 also updates teleconferencing rules, expands allowable reasons for remote participation, and permits remote attendance as an ADA accommodation. Additional provisions require providing the Brown Act to all newly elected or appointed officials, standardize posting requirements for special and emergency meetings, and make permanent the current social media communication allowances.
Staff will return with recommended policies and system updates prior to July 1, 2026, to ensure full compliance.
Council discussed options to ensure decorum is kept during virtual comments.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Pursell & City Council
REPORT FROM: Abigail Palsgaard, City Clerk REVIEWED BY: AJH AGENDA ITEM: Kingsburg Downton Business Improvement District Ordinance ACTION REQUESTED: ___Ordinance ___Resolution _ Motion ___Receive/File
EXECUTIVE SUMMARY
In 2020, the Kingsburg City Council adopted Ordinance 2020-003, establishing the City of Kingsburg Downtown Business Improvement District (BID). The ordinance specifies that the BID Board consists of seven members serving one-year terms.
The one-year term structure has created challenges, as all members must reapply annually and terms are not staggered. The attached proposed ordinance updates the language to allow for two-year, staggered terms, providing greater continuity and stability on the Board.
RECOMMENDED ACTION BY CITY COUNCIL
1. Waive the second reading and adopt Ordinance 2025-07 An Ordinance of The City of Kingsburg adding Chapter 5.42.100 Of Title 5 of The Kingsburg Municipal Code regarding the Election of Board Members of The Downtown Business Improvement District with the following recital constituting reading the title of the Ordinance:
“AN ORDINANCE OF THE CITY OF KINGSBURG ADDING CHAPTER 5.42.100 OF TITLE 5 OF THE KINGSBURG

ADDING CHAPTER 5.42.100 OF TITLE 5 OF THE KINGSBURG MUNICIPAL CODE
REGARDING THE ELECTION OF BOARD MEMBERS OF THE
DOWNTOWN BUSINESS IMPROVEMENT DISTRICT
The City Council of the City of Kingsburg does hereby ordain as follows:
Section 1. Chapter 5.42.100 of Title 5 of the Kingsburg Municipal Code is amended in its entirety as follows:
5.42.100 - Advisory board—Budget.
For the purpose of advising the city council and making recommendations regarding the operation of the district, the services performed by the district and the methods and ways in which the revenue derived from the levy of the district assessments imposed by this chapter shall be used within the scope of the services set forth in Sections 5.42.090 of this chapter, and to perform such other powers and duties as the city council may determine, the Kingsburg Downtown Business Improvement District Advisory Board ("advisory board") is created. The advisory board shall consist of seven (7) members appointed by a majority vote of the city council for the following terms. Commencing with the 2026 appointment of advisory board members, the city council shall appoint three (3) advisory board members to a one (1) year term and four (4) advisory board members to two (2) year terms. Thereafter, all advisory board members will be appointed to a two (2) year term. The advisory board members shall be persons who own businesses within the district that pay district assessments as provided by this chapter. Annually, the advisory board shall present an annual budget to the city council for review and approval. The proposed budget shall include an estimate of income and expenditures by the advisory board to carry out the purposes of the district.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Pursell & City Council
REPORT FROM: Alexander J. Henderson, ICMA-CM REVIEWED BY: CW AGENDA ITEM: Measure E Renewal – Ballot Language Discussion ACTION REQUESTED: ___Ordinance ___Resolution _ __Motion ___Receive/File
EXECUTIVE SUMMARY
On June 5, 2018, Kingsburg voters enacted Measure E, a 1% Public Safety Sales Tax that supports ongoing allowed efforts. The Measure passed after receiving 72% support. The Measure went into effect on October 1, 2018 for a period of ten (10) years, as outlined in the original ballot language. Unless it is extended, Measure E will expire on September 30, 2028.
During the November 5 regular meeting, Council discussed ballot language options and the potential inclusion of sunset language. Staff has researched recent ballot information and compiled some data for review. Staff is seeking direction from the Council this evening on proposed ballot language that will be brought back at the January 7, 2026 meeting for formal adoption.
RECOMMENDED ACTION BY CITY COUNCIL
1. Provide direction regarding preferred proposed ballot language.
POLICY ALTERNATIVE(S)
1. N/A
REASON FOR RECOMMENDATION/KEY METRIC
1. Community Safety
2. Preserving the Kingsburg Experience
3. Financial Stability
FINANCIAL INFORMATION
The original ballot measure included ~$10,000 in election expenses for Fresno County to conduct. The Fresno County Clerk has provided an initial estimate of $20,000-$25,000 for a 2026 measure but has said it will ultimately depend upon the number of other entities on the ballot and length of our measure.
Meeting Date: 11/19/2025
Agenda Item: 4
FISCAL IMPACT:
1. Is There A Fiscal Impact? Yes
2. Is it Currently Budgeted? Yes
3. If Budgeted, Which Line? 106 – Measure E
PRIOR ACTION/REVIEW
The Finance Committee began discussing the renewal efforts for Measure E on February 24, 2025, and recommended continuing this discussion with the Council to establish a team that will assist with the renewal effort. This allowed us to establish a timeline for deliverables, community input and education, as well as a budget that coincides with the FY2026 budget.
The Finance Committee & Council subsequently made the following recommendations:
- Preferred Election date of June 2, 2026
- Directed staff to get quotes for both legal and marketing/education consultants to assist in the effort. - Asked for input from the existing Measure E Oversight Committee. - Provided input on the renewal guidelines, including keeping some form of a sunset clause. - Discussion of impacts to both departments if the Measure is not extended.
Staff sought additional council input during the March 5, 2025 Council Meeting. Council supported a renewal effort for the June 2, 2026 election with mixed feedback on the sunset clause. Council also discussed polling but noted how costly it can be; we can add it to the proposals if needed. Mayor Pursell discussed the Council and the labor groups responsibility to reach out to citizens.
Council directed staff to enter into a legal agreement with BBK during their April 2, 2025 regular meeting.
BACKGROUND INFORMATION
Measure E is considered a transaction and use tax, which are allocated to the jurisdiction where the taxed product is received or registered (as in the case of a motor vehicle purchase). Because of this, Measure E revenue collections are higher than the 1% local jurisdiction place of sale or use. For example, if a consumer purchases a new motor vehicle and registers it in Kingsburg (place of residence), the city receives the 1% sales tax for that vehicle for the purposes of Measure E. The same theory applies with destination-based purchases, which is especially relevant for online activity, which saw a sharp increase during the pandemic. It has sensed regressed in each of the last two fiscal years as federal stimulus funding has subsided.
Initially, conservative estimates forecasted that Measure E would generate ~$1,000,000 annually.
Fortunately, receipts have exceeded those estimates by more than double since the first full year of inception.
For FY25, revenues are expected to be ~$2.6mm. Since inception, the City has received over ~$14mm in cash receipts (attachment #1).
The impact Measure E has had on our Police and Fire Departments is significant. Consistent with the Measure’s initial intent, Measure E revenue has been used solely for activities related to public safety. Below is a non-exhaustive list of examples of expenditures intended to illustrate the use of funding since inception.

"Local Tax" is the general term for sales and use taxes imposed under the Bradley-Burns Uniform Sales and Use Tax Law. The basic statewide sales and use tax rate is 7.25% and is divided as follows:
• 6.00% State
• 1.00% Local Jurisdiction (City or county of place of sale or use) • 0.25% Local Transportation Fund (County of place of sale or use) "District Taxes" are imposed locally under the Transactions and Use Tax Law. The total tax rate in Kingsburg is 8.975%, which includes the statewide 7.25% plus the following:
• 1.00% Public Safety District Tax (Measure E)
• 0.725% Fresno County
As required by the ballot language, the City also established a Measure E Oversite Committee. The Committee meets annually (or as needed) to examine expenditures and ensure funds are being used as originally promised by the effort.
