CONSIDERATION OF BALLOT MEASURE TO RENEW/ENACT PUBLIC SAFETY TRANSACTIONS AND USE TAX – Staff Report prepared by Matthew E. Richardson, Special Counsel Presentation by: City Manager Alexander Henderson
Sponsor: City Manager's Office
City Manager Alexander Henderson presented a summary of Measure E, the City's one-percent Public Safety Transactions and Use Tax. He reported that Kingsburg voters originally approved Measure E on June 5, 2018, with 72 percent voter approval. The measure became effective on October 1, 2018, for a ten-year term and was scheduled to expire on September 30, 2028, unless renewed by the voters.

City Manager Henderson reviewed the City Council's previous direction to place a renewal measure on the June 2, 2026, statewide primary election ballot and summarized the ballot measure, which proposed extending the existing one-percent public safety sales tax without increasing the voter-approved rate. He reported that the measure was approved by the voters with 2,537 "Yes" votes and 718 "No" votes, receiving

77.94 percent voter approval, exceeding the required two-thirds majority. Staff recommended that the City Council certify the election results and approve the agreements necessary to implement the renewed transactions and use tax.

Mayor Smith thanked the public safety employee associations and the community for their efforts in supporting the measure. She expressed appreciation for the exceptional service provided by the Kingsburg Police and Fire Departments and the community's continued investment in public safety.

A motion was made by Council Member Palomar, seconded by Council Member Pursell, to adopt Resolution No. 2026-028 certifying the final election results received from the County of Fresno for the June 2, 2026, Public Safety Transactions and Use Tax Measure. Sponsor: Council Member North
City Manager Alexander Henderson presented the proposed Backyard Chicken Ordinance, which would allow up to five hens per residence, subject to specified development and operational standards.

During Council discussion, Council Member Palomar asked staff about the number of complaints the City currently receives regarding chickens and other animals. Council Member North provided background on the request, explaining that the topic had been brought forward at the request of residents and that she wanted to honor her commitment to revisit the ordinance.

Mayor Smith opened the item for public comment.

John Smith, Kingsburg resident, spoke in opposition to the proposed ordinance.

Ally Smith, Kingsburg resident, spoke in opposition to the proposed ordinance.

Leah Underwood, Kingsburg resident, spoke in support of the proposed ordinance.

Following public comment, the Council discussed enforcement procedures, the absence of a permitting process, reactive code enforcement, and potential revisions to the ordinance language. Council Member North asked whether a permit requirement would make Council Member Pursell more comfortable with the proposal, to which he responded affirmatively. The Council also discussed the possibility of including a waiver allowing Code Enforcement staff to conduct inspections as part of the permitting process. Mayor Smith inquired whether drones would be used for enforcement, and staff indicated they would not. Mayor Smith also asked about the frequency of complaints related to other types of animals.

By Council consensus, staff was directed to revise the proposed ordinance to include a permitting process and related enforcement provisions and return the item for further consideration at a future meeting.

A motion was made by Council Member Pursell, seconded by Council Member Palomar, to table the item and direct staff to return with a revised ordinance incorporating permitting requirements. The motion carried by a unanimous voice vote.

CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Kingsburg City Council
REPORT FROM: Holly R Owen, Community Development Director REVIEWED BY:

AGENDA ITEM: Ordinance No. 2026-02, An Ordinance Amending Section 17.16.040 of the Kingsburg Municipal Code to add Cemeteries and related uses as conditional uses in the Resource Conservation and Open Space Zoning District
ACTION REQUESTED: ___Ordinance ___Resolution ____Motion ____Receive/File

EXECUTIVE SUMMARY
On February 17, 2026, the Kingsburg Cemetery District attended a Site Plan Review with City Staff to obtain comments on a proposed new building and potential lot line adjustments to the existing Kingsburg Cemetery District land, located at 12782 Clarkson Avenue. The Kingsburg Cemetery District, serving the community since it was formed in 1925, requested comments from City Staff regarding this project. As part of the typical review of the project, it was noted that the list of uses for the Resource Conservation and Open Space Zone District (where the Cemetery District is located) did not identify cemeteries as a use, permitted or conditional, in the zone district. This was apparently an oversight when an update to the zoning code was adopted in 1982 for the City, as historical maps from 1891 (Attachment B) show the cemetery as a use within the city limits, and cemeteries and accompanying uses were permitted in what was known as Precise Planned Zones in the City in the zoning ordinance from October 1, 19641 .

PRIOR ACTION
1) On May 14, 2026, Planning Commission, at their regularly scheduled meeting, made the findings required by Section 17.60.10, reviewed proposed changes to Section 17.16.040 of the Kingsburg Municipal Code and recommended adoption of Ordinance 2026-02, adding cemeteries and related uses as conditional uses in the Resource, Conservation and Open Space Zone District, with a recommendation to Council the adoption of Ordinance 2026-02.
(2) On July 15, 2026, the City Council held a public hearing regarding an amendment to Title 17 of the Kingsburg Municipal Code as identified in Ordinance 2026-02. After Staff presentations, consideration of the Planning Commission action, public testimony and Council discussion, the City Council on a vote of 5-0: (i) made the finding that the amendment to Section to Section 17.16.040 of the Kingsburg Municipal Code to add “cemeteries including burial parks, columbarium and mausoleums dedicated to the permanent, perpetual interment of human remains and ancillary structures related thereto.” to the list of Conditional Uses in the Resource Conservation and Open Space District is covered by the common sense exception provided in Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility that this amendment to Section 17.16.040 may have a significant effect on the environment; and (ii) waived the first reading of Ordinance 2026-02 and passed the Ordinance to a second reading.

RECOMMENDED ACTION BY CITY COUNCIL

1. CITY COUNCIL MEETING STAFF REPORT
REPORT TO: Mayor Smith & City Council
REPORT FROM: Community Services Director Adam Castaneda REVIEWED BY: AJH AGENDA ITEM: Kingsburg Senior Center Meal Program Update FY 25-26 ACTION REQUESTED: ___Ordinance ___Resolution ___Motion __Receive/File

EXECUTIVE SUMMARY
The lunch and breakfast Programs at the Kingsburg Senior Center are the largest and most resource-intensive programs offered at the senior center. Currently, the programs are facilitated five days a week, Monday through Friday, and require substantial staff time and resources.

The Kingsburg Senior Citizens Incorporated Board of Directors and City Staff advocated for the city to start preparing hot meals on-site in 2024. Although this transition away from the Fresno Madera Agency on Agingsponsored meal program was not the cheapest option and might result in an additional annual City investment of approximately $7,000, the goal was to significantly improve the quality of meals and overall participant satisfaction for Kingsburg seniors. With the support of the Kingsburg Health Care District and the Larry Hillblom Foundation, the transition was made possible and has continued to grow and improve each year.

City staff is pleased to submit this report for the Kingsburg Senior Center lunch and breakfast programs, funded in part by the Kingsburg Health Care District for fiscal year 2025-2026. The programs have continued to provide high-quality, nutritious hot lunches to local seniors along with a continental-style breakfast fully funded by the Kingsburg Health Care District. We are happy to report that the programs are running smoothly, and the feedback from our senior participants has been overwhelmingly positive regarding both the meals and the service provided by City staff.
