SPECIAL CITY COUNCIL MEETING AGENDA FEBRUARY 16, 2022
HABRA City of La Habra Heights

AGENDA REPORT
Meeting Date: February 16, 2022
1978 Agenda Item # 4
TO: Honorable Mayor and Members of the City Council
FROM: Fabiola Huerta, City Manager/City Clerk
Michael Maurer, City Attorney
SUBJECT: ACTION TO FILL VACANT CITY COUNCIL SEAT BY APPOINTMENT

OR BY CALLING A SPECIAL ELECTION (CONTINUED FROM
FEBRUARY 14, 2022)
At the February 14, 2022 City Council meeting, the discussion regarding the vacant City Council seat was tabled to Wednesday, February 16, 2022 at 3pm. The City Council also directed staff to promote the vacancy application again. As of the writing of this report, no new applications were received.

BACKGROUND
At the January 10, 2022 City Council meeting, the Council discussed the seat vacated by Jane Williams. Mrs. Williams submitted a letter to the City Clerk resigning her position on the City Council, effective January 10, 2022. Section 2.3.40(C) of the La Habra Heights Municipal Code directs the City Council to make an appointment within 30 days, which was on February 9, 2022. Government Code Section 36512 provides that once a vacancy occurs on the City Council, the Council must fill the vacancy within 60 days by either appointing a replacement or calling a special election (Gov. Code, §36512(b).

The City Council directed staff to post an application for interested applicants and schedule a special meeting for discussion of the item. The application was posted on the City's website on January 11, 2022 and distributed through Guac Taik and Community Nixle alerts. The deadline to submit an application was January 24, 2022 and staff received a total of 12 applications which are all attached. The special meeting was not held due to two Council Members not being available.

To be eligible for appointment, citizens must be registered voters of La Habra Heights and be otherwise qualified to serve on the City Council. The appointment will only be until the November 8, 2022 general municipal election. The winning candidate in November will serve the remaining two years of the term.

Neither the Government Code nor the City's Municipal Code contains any required process for making an appointment. If any Council Members have a candidate in mind, they may make a motion to nominate appointing that candidate; if the motion obtains three votes in favor, the candidate will assume the office.

If the Council calls a special election, the special election must be held at the next "regularly established election date" that is at least 114 days after the call for the special election. The next two established election dates are: (1) June 7, 2022; or (2) November 8, 2022.

To hold a special election in June, the City Council would have to call the special election and submit the resolutions to the Los Angeles County Registrar-Recorder/County Clerk.

The required resolutions will be provided at the meeting, if necessary. The City will be responsible for the County's costs of the special election. The estimated cost for a special election in June is $21,649. Whoever is elected to fill the vacant seat - whether in June or November - would hold office until the end of the current term (i.e., until November 2024.)
Another possible option pursuant to the Elections Code, is to hold a special vacancy all- mail ballot election. That adds another potential election date - August 30, 2022. However, this would be a "standalone" election, meaning a "one issue" ballot would go to City voters.

That would likely result in higher election costs that cannot be shared with other public agencies.

FISCAL IMPACT
If the City Council calls a special election, the City will be responsible for the costs of the election. A mail ballot election would likely be the costliest option, followed by a special election that is consolidated with the June primary date. If the City Council makes an appointment, there will be an additional seat on the November 8, 2022 election, which will increase the City's elections costs.

RECOMMENDATION
It is recommended that the City Council appoint a qualified person to fill the vacant Council seat.

i.".

Briefly explain your background, training and education as well as anything that specifically qualifies you as an appointee to the City Council (Feel free to submit a resume) Having the good fortune to grow up in La Habra Heights, I realize how much we all benefit from the rural lifestyle that our city provides. I am grateful that I was able to return to our city to build a new home (completed in 2006), raise a family and take care of my parents who | orginally moved here with back in 1970, I appreciate why they, as many of us, want to live out the rest of their lives In our extraordinary community.

As for professional experience, for the past 11 years, I have been the Vice President of Technical Services & Government Affairs, for Synagro Technologies, a company that provides residuals management services for over 600 municipal government and industrial clients in 34 states. I provide direction to the Company by serving as the primary resource for developing legislative and regulatory advocacy. I actively coordinate with municipal government representatives, consultants, lobbyists, and professional trade associations to promote favorable legislation and regulations at the local, state, and federal level. I also manage the activitles of the Company's staff of over 40 wastewater professionals in Synagro's Technical Services Department.

Prior to Joining Synagro in 2009, I worked for 23 years at the Orange County Sanitation District (OCSD), enforcing the requirements of the Federal Clean Water Act Pretreatment Program and subsequently managing the Agency's Air Quality and Biosolids Management programs.

I received a B.S. Degree from the University of Southem California and a JD Degree from Western State University College of Law, and l am a member of the State Bar of California.

As for experience with the City, for almost three years I served on our Planning Commission. Much of my time on the Planning Commission was focused on Interpreting our General Plan's goats and policies as the bass for the development of revisions to our Municipal Code. I believe that having a detailed understanding of the basis for, and content of, the Municipal Code is of critical importance since Council members are often called upon to opine on the applicability of the rules for residential development, animal husbandry, and other activitles taking place in our community. I believe that my thorough knowledge of both the City's General Plan, and its interpretation that took place during the dozens of meetings that were held to develop the revised Municipal Code, will be beneficial when called upon as a councilmember to address development proposals in a manner that protects both property rights and our rural lifestyle.

After serving on the Planning Commission, I ran for a seat on the City Council. I am proud to say that Whittler Daily News endorsed me as a "top pick": "..Baroldi should have a good grasp of the fiscal ins and outs of the unique hillside community, what with his experience on the city's Planning Commission." According to the Whittier Dally News' Editorial Board, Baroldi's "depth of background" is why he is being endorsed as being a candidate to best serve La Habra Heights and to be voted for on March 6th." I served for four years on the City Council. I am proud to say that I received over 1,000 votes from our neighbors during my City Council election. I belleve my successful four-year term served on the City Council "qualifies" me for filling the several months of the vacated seat term.

Prior Professional Affillations:
• Board Member of the Los Angeles County Sanitation Districts • Board Member, Southern California Association of Governments (SCAG) Energy & Environment Committee
• Technical Advisory Committee Memberto California's Mobile Source Air Pollution Reduction Revlew Committee (MSRC)
Executive Board Member of the Callfornia Assoclation of Sanitation Agencies (CASA) • Member, Water Environment Federation (WEF)
• Member, National Association of Clean Water Agencies (NACWA) What do you see as the objectives and goals of the City Council? The basic objectives and goals of our City Council is to utilize prudent policy-making efforts, implemented through our exceptionally competent staff administration, to ensure that we have a safe, healthy and equitable community. Maintaining fiscal and economic stability is an essential requirement to ensure all objectives and goals are realized. Through a secure fiscal base, we can not only maintain but improve our quality of life.

As for specifics beyond that mentioned above, I consider the following issues, of many, to be the top priority objectives and goals for the Council to address:
• Maintaining our rural llfestyle and mitigating potential impacts of SB 9 (also known as "The Duplex Bill")
• Providing quality law enforcement, fire safety and paramedic services • Continuing with the successful infrastructure (road) maintenance program • Beautifying our community through the encouragement and facilitation of the home maintenance and Improvement process
How would you like to help to achieve these objectives and goals? As part of the City Councll team, i would like to utilize mý experience and skills obtained described in the answer to the first question) to assist the Council to achieve the objectives and goals described in the response to the previous question. With my legal, legislative and regulatory advocacy background, believe I could be specifically helpful in addressing the imminent threats to our community character posed by SB 9.

I have reviewed legal analysis that provides the detalls in following assessment of SB 9 (also known as "The Duplex Bill"). SB 9 was legislation that was signed Into law by the Governor that effectively preempts our local control on lot splits and housing development. In plain language, the passage of SB 9 creates the possibility that a single-family residential lot can now be divided and developed with up to four residential units where only one single-family home previously existed.

The challenge for us to work on is to successfully craft language in a way that will allow us as a local agency to impose objective zoning, subdivision, and design standards. Please note that otherwise, SB 9 does not aliow us as a local agency to use its subjective judgment In determining whether a proposed, qualifylng lot-split or development should be approved or denied. Although we can impose objective standards, we cannot impose standards that would have the effect of physically precluding the construction of up to two units on a parcel or would physically preclude elther of the two units from being at least 800 square feet in floor area.

I was very pleased by the initial efforts made by Staff, outside counsel, the Planning Commission and the City Councli that resulted in the language in this month's City Council Agenda Item #17. This draft Ordinance to amend our Municipal Code attempts to provide us with protection agalnst SB 9 destroying our rural country living environment that we all moved here for, but much work needs to be done. I belleve that my experience mentioned above provides me with the experience to help our City address the biggest threat to our cherished "Rural County Living", $B 9.

Please provide any additional Information that would help the City Council make a decision.

I believe I have proven through past actions that 1 can listen to all of the volces in our community and bridge the unfortunate divisions that appear to currently exist.

Application for City Council Appolntment - Vacancy
Briefly Explain your background, training and education as well as anything that specifically qualifies you as an appointee to the City Council.

For nearly 20 years, my career has spanned several sectors in publle service and focusing on bringing much needed resources while working with the California State Legislature and the non-profit sector. My track record of service is seen in the professional and community work. I serve as a Cancer Patient Advocate for the American Cancer Society focused on global cancer prevention & research advocacy where l am charged with championing policies that aim to protect the quality of life of cancer patients and their families. This holds a special place in my heart as my mother died from cancer when she was 44 years old. The death of my mother empowered me to serve as a cancer patient advocate to provide countless families the power to be a voice at the federal, state and local levels of government.

As stated, I Worked for the California State Assembly, Senate, and Secretary of State. I understand how laws are created and passed and will advocate for policies that improve the quality of life for the residents of La Habra Heights and ensuring mandates do not hurt our mighty rural community. With over a decade of experience working in the California State Legislature, I have been instrumental in bringing much needed resources to communities from throughout Southern California. In fact, as a result of my relationships at the county, state and federal levels | was fortunate to bring over $600 million in resources for different infrastructure, social, quality of life and other programs. I have cultivated relationships, developed partnerships that expand opportunities in areas of education, transportation, business development and beyond.

Dedicated to serving others, I have been involved in the community with programs aimed at engaging students in learning, providing safe and healthy environments, and overall enhancing the quality of life for youth and families. I have served on various committees and state commissions which promote public health, civio engagement, and opportunities for our local nelghbors. Currently, I serve on the State of Callfornia's Tobacco Education Research and Oversight Commission where our focus is to protect and administer over $300 milllon in annual funding to the University of California, The California Department of Public Health and the Primitivo (Primo) Castro
California Department of Education. Most recently, I served on the Board of Directors for the Boys and Giris Clubs of La Habra. An opportunity to work collectively with the Board to bring much needed programs to the students of the area,
Most Importantly, decisions are not. done unilaterally on a council. It takes teamwork, dedication, and commitment in providing the best quality of life for our neighbors. I feel confident that if given the opportunity to serve in this appointment, the community and council will see that | also strive for what Is important to us all..our safety and relationship with the Los Angeles County Sheriffs Department and our La Habra Heights Fire Department. it is the very reason why we moved to the Heights 13 years ago and raising our famlly, Lastly, I obtained a Bachelor's degree in Political Science from Michigan State University and a Master's in Public Administration from Cal State Long Beach, 1 am the father to four talented young ladies--Madison Eva, Sofia Taylor, the twins Julia Kennedy and Lourdes Carter. My wife, Melba, is the Vice President of Student Services at Santiago Canyon College, which services Central Orange County, What do you see as the objectives and goals of the City Council? I belleve the goal for the individual filling the vacancy Is to work with the council on what those current goals and objectives are. There is no doubt that there is much work to be done but working together is the key to address our neighbors and the city's needs as those issues come up. The council is responsible for maintaining the quality of life that we all have come to enjoy, In addition, maintaining of our roads is no easy task, but a task that we must continue to tackle head on to ensure our public safety officers are able to provide the best service possible when out nelghbors need it. We also need to continue to work with our Fire Department to ensure brush clearance compliance to avoid catastrophe. We live in a sensitive fire danger community and this needs to be a top priority for the council and our neighbors. The council can only do so much with the available resources provided, but l am a firm believer that we can live within our means, without putting our neighbors and city at risk.
•
Primitivo (Primo) Castro
How would you like to help to achieve these objectives and goals? I would like to help achieve these objectives and goals with the teamwork that exists in the city council. As stated before, by working collectively and with the same dedicatlon that we have to make this city the best it Is will provide the peace of mind that our neighbors are looking forward to. It would be my honor to provide my knowledge and help the city council advocate for resources for the benefit of all our neighbors.

Please Provide any additional information that would help the City Council make a decision.

The City of La Habra Heights is nestled between several metropolitan communities and has a great rich history. I have been fortunate to experience working with a vast diverse range of communities. Application for City Council Appointment
Staci Smith
Briefly explain your background, training and education as well as anything that specifically qualifies you as an appointee to the City Council.

My qualifications as an appointee include educational, professional and volunteer experiences.

Educational: | have BS, MS and MBA degrees, My MBA in particular provides strategic, tactical, and leadership skills needed to manage a business and navigate people relationships, which are critical to be an effective Council member.

Professional: I am Vice President Food Safety and Quality at Ventura Foods and I'm responsible for meeting FDA government and customer requirements at 12 manufacturing plants in the US.

I define and implement long range plans, short term initiatives, and over 150 quality processes and programs. I lead, inspire and develop a team of 830 employees, Including management and front line workers. The skill to communicate and execute a strategic plan while balancing alignment, resources, and servant leadership will serve me well as a Council member.

Volunteer: From 2002 to 2010| volunteered as President of the Susquehanna Township PA Shade Tree Commission (STC), We accomplished great things together; created a new ordinance, successfully prevented the removal of over 100 mature street trees, and launched an annual tree planting event. We planted over 200 street trees, and although I moved from this community 12 years ago, the legacy of this betterment for current residents makes me proud. Ilearned from my experience how to balance the needs of a community today with the responsibility to ensure it is sustainable for future generations, I also learned about local government, the structure, the protocols, and how much difference one individual can make.

What do you see as the objectives and goals of the City Council? The goal of City Council is to promote efficient and effective government, maintain the infrastructure, have a qualified city staff, be fiscally responsible, ensure quality of life for residents, be transparent in actions, and innovate solutions to challenges. La Habra Heights is a unique haven within largely urban Los Angeles County. The community has the benefit of a General Plan and Municipal Code which provide a strong foundation for sustainability.

However, there are unque Local/State/Federal challenges and opportunitles which require the Clty Council to continue to thoughtfully evaluate solutions and progress the community in a direction that ensures its desirability, solvency, property values, and character.

Staci Smith, pg 2
How would you like to help to achieve these objectives and goals? I can help the Counci achieve their objectives by contributing my energy and Ideas to the group. I will bring the perspective of a relatively new resident settling into La Habra Heights and interacting with neighbors and the local government and services, as well as draw on my experlences from living and serving in a number of other states and communities, 1 have a track record of spearheading large and complex projects and initiatives, navigating resources and expectations, and leading and communicating with empathy. Additionally, I have the desire, time and resources to commit whole heartedly to the Council and the work required.

Please provide any additional information that would help the City Council make a decision I have been a La Habra Heights resident for 15 months, Before making the decision to move from a renter in Brea to a homeowner in La Habra Heights, I spent significant time on the city website, learning about the City, the vision, and the leadership. I knew from experience that these elements of a city are critical to its viability, protecting property value, and the overal! experience as a resident. My boxes were not even unpacked at 1340 Mayapan Road when I logged onto my first Councll meeting to hear the discussion about ellminating short term rentals. The Council makes very important decisions with considerable impact...! live here and belleve that it is Important to be involved. I would be honored to be a member of the La Habra Heights City Council. Thank you for your support!

RE: Vacant City Council Selection
I watched the City Council meeting last night with great interest and excitement in the selection process to fill the vacant seat of Jane Williams. I was disheartened to see that the City Council could not reach a consensus for a replacement. It was my understanding that there were 12 applicants for this position. That's a great turn out for one seat that runs until the upcoming November 2022 election.

A lot of candidates that spoke last night, I thought, were exceptional with varying backgrounds that could have been an asset as a member of La Habra Heights City Council. I was concerned, if I understood it correctly, only 2 Council Members reached out to these 12 individuals and met with most of them or had phone conversations to get more information as to why they were appiying for a position on the City Council.

My first term on the City Council, we faced the same situation. I am sure Council member Bergman remembers we were at an impasse on several candidates and are only option, if we couldn't agree on a candidate, was to call for a special election. As we all know, special elections will cost time and thousands of dollars which the city cannot afford. The four council members at that time, Stan Carroll, Brian Bergman, Carl Westerhoff and I put politics aside and made a decision to select Jane Williams. Were we all happy, probably not, but we came together to show the community we could work together. The bottom line, we work for the citizens of this community.

So where do we go from here? As I stated above, council needs to put the politics aside and make a decision to appoint a person to fill Jane Williams seat and move on. You have 12 candidates to choose from, if you can't agree on one, I will offer this to the four of you; You all know my background; I am a straight shooter and vote the way I see best works for the whole community not just a few groups or individuals putting pressure on me. I am willing to come back and fill the seat vacated by Jane only till the November election in 2022 and I will not run for an open seat. My intention is to help the city, council and community for this short time.

If there is an interest in this proposal please give me a call if not, thanks for your time and efforts on the City Council and the best to all of you in the future.

Roy Francis
Former City Council Member
