Call Meeting to Order - At 4:31 a.m., Mayor Zezula called the Special City Council meeting to order.
Roll Call
Present: Mayor Norm Zezula, Mayor Pro Tem Carol Engelhardt, and Council Members Brian Bergman, Dennis Laherty and John Pespisa
Absent: None
Also Present: City Manager Fabiola Huerta, Assistant City Manager Rafferty Wooldridge, Finance Manager Angie Martinez, Deputy City Attorney Ryan Stager, Public Works Specialist Graces Andres, Administrative Assistant Christina Aguilar

5. Update Governor's Office of Emergency Services (CALOES) Form130 Resolution No. 2023-09: A Resolution of the City Council of the City of La Habra Heights, California, Approving the Designation of Applicant's Agent Resolution for Non-state Agencies and Designating the City Manager, Assistant City Manager and Fire Chief as the City's Authorized Agents
Action: Moved (Bergman), seconded (Laherty) and voted 5-0 to approve Resolution No. 2023-09 to adopt the State of California Governor's Office of Emergency Services Designation of Applicant's Agent resolution (Cal OES Form 130) designating the City Manager, Assistant City Manager, and Fire Chief as authorized agents to execute applications on behalf of the City for the purpose of obtaining post-disaster public assistance grants from Cal OES and FEMA.

At 4:46 p.m., Mayor Zezula resumed the meeting.
Public Hearing
Conduct Tax Equity and Fiscal Responsibility Act (TEFRA) Hearing, adopt a Resolution approving the form of Associate Membership Agreement between the City of La Habra Heights and the California Enterprise Development Authority, and adopt a Resolution approving the issuance of not to exceed $36,100,000 of California Enterprise Development Authority Revenue obligations for the benefit of Heights Christian Schools Resolution No. 2023-07: A Resolution of the City Council of the City of La Habra Heights, California, Approving Associate Membership by the City of La Habra Heights in the California Enterprise Development Authority and the Execution of an Associate Membership Agreement Relating to Associate Membership of the City in the Authority
Resolution No. 2023-08: A Resolution of the City Council of the City of La Habra Heights, California, Approving the Issuance of Revenue Bonds by the California Enterprise Development Authority in an Aggregate Principal Amount Not to Exceed $36,100,000 for the Purpose of Refinancing Certain Educational Facilities and Certain Other Matters Relating Thereto for the Benefit of Heights Christian Schools At 4:47 p.m., Mayor Zezula opened the Public Hearing.
At 5:17 p.m., Mayor Zezula closed the Public Hearing.
Action: Moved (Bergman), seconded (Laherty), and voted 5-0 to approve Resolution No. 2023-07 with the inclusion to terminate the City's Associate Membership in the Authority once the bonds have been issued.
Action: Moved (Bergman), seconded (Engelhardt), and voted 5-0 to approve Resolution No. 2023-08 with the addition of the word City in Section 3 and execution of an indemnification agreement.
