Call Meeting to Order - At 6:31 p.m., Mayor Engelhardt called the Regular City Council Meeting to order.

Present: Mayor Carol Engelhardt, Mayor Pro Tem John Pespisa, and Council Members Brian Bergman, Dennis Laherty, and Norm Zezula
Absent: None

Minutes: January 8, 2024 - Special City Council Meeting Action: Moved (Laherty), seconded (Pespisa) and voted 5-0 with the correction of item 17 within the minutes to state the City will move forward with the proposed purchase of the property and work through the existing contract and provide phase 2 of the environmental review. Council Member Zezula made the correction of stating the Mayor Engelhardt adjourned the meeting.

14. Approval of Community Development Block Grant (CDBG) 2024-2025 Program Year Project
Resolution No. 2024-03: A Resolution of the City Council of the City of La Habra Heights, California, Authorizing the Allocation of the 4gth Year Community Development Block Grant (CDBG) Funds for Fiscal Year 2024-25 At 7:30 p.m. Mayor Engelhardt opened the public hearing.
At 7:31 p.m. Mayor Engelhard closed the public hearing.
Action: Moved (Bergman), seconded (Laherty), and voted 5-0 to approve the Community Development Block Grant allocation as outlined in Resolution No. 2024-03, adopt Resolution No. 2024-03 with the correction of the 5'h "WHEREAS" date to February 12, 2024.
15. Protest Hearing - Unpaid Brush Clearance Costs
Resolution No. 2024-04: A Resolution of the City Council of the City of La Habra Heights Declaring that Weeds, Rubbish, Refuse, or other Combustible Materials Growing Upon or in Front of Properties Constitute a Public Nuisance. In Addition, Dirt/Debris Runoff from Private Property upon Public Roadways also Constitutes a Public Nuisance. Further Declaring its Intention to Provide for the Abatement of such Nuisance, and Setting a date for a Public Hearing
At 7:38 p.m. Mayor Engelhardt opened the public hearing.
At 7:39 p.m. noting no protests, Mayor Engelhardt closed the public hearing.
Action: Moved (Bergman), seconded (Pespisa), and voted 5-0 to overrule protests, if any, offered during protest hearing and adopt Resolution No. 2024-04 confirming the report of costs incurred by the city and authorizing the assessments as liens to be placed on the tax rolls effective February 12, 2024 and amend charges to be assessed, placed as liens and adopt Resolution No. 2024-04.

17. Proclamation of the Existence of a Local State of Emergency due to Storms and Torrential Rain
Action: Moved (Pespisa), seconded (Zezula) and voted 5-0 to ratify and proclaim the existence of a Local State of Emergency due to February Winter Storms and Torrential Rain and adopt Resolution No. 2024-05.

18. Government Finance Officers Association (GOA) Certificate of Achievement (COA) for Excellence in Financial Reporting Program Award for FY 2021-22
Action: Reviewed and discussed.
19. Fiscal Year 2022-23 Annual Comprehensive Financial Report Action: Received and filed.
20. General Services Agreement with Los Angeles County
Action: Moved (Laherty), seconded (Bergman) and voted 5-0 Adopt Resolution No. 2024-06 approving the renewal of the General Services Agreement with the County of Los Angeles and authorize the Mayor to sign the General Services Agreement.
21. Executed Retired Annuitant Employment Agreement
Action: Moved (Bergman), seconded (Pespisa) and voted 5-0 to execute retired annuitant employment agreement.
22. 2024 Brush Clearance Program
Resolution No. 2024-07: A Resolution of the City Council of the City of La Habra Heights, California, Declaring that Weeds, Rubbish, Refuse, or other Combustible Materials Growing Upon or in Front of Properties and Dirt/Debris Runoff from Private Property upon Public Roadways Constitutes a Public Nuisance, Declaring Intention to Provide for the Abatement of such Nuisance; and Setting a date for a Public Hearing
Action: Moved (Bergman), seconded (Pespisa), and voted 5-0 to Adopt Resolution No. 2024-07 declaring that in addition to weeds, rubbish, refuse, or other combustible materials, dirt/debris runoff from private property upon public roadways in front of properties are a public nuisance, and declaring City's intention to provide for the abatement of such nuisance and set the date as April 8, 2024 for the public hearing. ...
