BACKGROUND:
The Irrevocable Offer of Dedication (IOD) of real property was offered to the City of La Mesa for future public road purposes. This IOD was never accepted by the City.
DISCUSSION:
The current property owner, Mr. Alejandro Muela, has requested the abandonment of the IOD being the eastern 25 foot wide strip comprising 2,500 square feet of Parcel 2 per Parcel Map 15264, previously offered for public road purposes. His intent is to facilitate future development and use of his property. See Attachment ‘B’ Over the years properties surrounding his were developed for single family residential use and the existing IOD has become land locked on all sides with no portion being contiguous to any existing public right of way and the City does not intend to construct any public infrastructure.
Attachment ‘A’ is the Council Resolution authorizing the abandonment of the IOD.
CONCLUSION:
Staff recommends that the City order the abandonment of the Irrevocable Offer of Dedication of Real Property over 4005 Massachusetts Avenue.

SUBJECT: Introduction and First Reading of an Ordinance adding La Mesa Municipal Code Chapter 10.30 regulating the
Residential Storage of Firearms and Conducting An
Associated Public Information Program
ISSUING DEPARTMENT: Police Department
SUMMARY:
Issue:
Introduction and First Reading of an Ordinance adding La Mesa Municipal Code Chapter 10.30 regulating the Residential Storage of Firearms and Public Information Program
Recommendation:
None
Fiscal Impact:
None. A public information program may be conducting using existing resources.
City’s Strategic Goals:
● Safe community
● Continue to improve high quality municipal services
BACKGROUND:
At the City Council meeting of January 11, 2022, Vice-Mayor Shu introduced a Councilinitiated item regarding a draft ordinance regulating the residential storage of firearms for consideration and discussion. The City Council-initiated item also included possible

direction regarding a public information program on the safe storage of firearms. Based on a majority vote, the City Council directed staff to return to the City Council within two months with a Residential Firearm Accountability Ordinance. The City Council further directed staff to provide details regarding the implementation of a public information program to inform residents of the federal, state, and local laws for the safe storage of firearms.
DISCUSSION:
As directed by the City Council, staff prepared a draft ordinance for the City Council’s consideration and possible introduction at this meeting. The attached draft ordinance for City Council’s consideration and possible introduction includes, among other things, the following language:
● Recites data indicating the need and support for such an ordinance ● Defines “Locked Container” and “trigger lock” pursuant to the California Penal Code
● Renders it unlawful (an infraction) to keep a firearm within any residence (or accessory structure), unless the firearm is stored in a locked container or Trigger Lock (with limited exception)
● Provides for a limited exception if the Firearm is carried on the body of a person who is an authorized user of the Firearm (or in their immediate control) Finally, it is important to note the draft ordinance mirrors San Diego County Ordinance No. 107765 (N.S.), which became effective on February 25, 2022. Staff has attached the draft ordinance for review by the City Council (Attachment A).
Public Information Program
As noted, the City Council requested a public information program to promote education regarding laws that regulate firearm storage. Staff proposes developing a social media campaign that informs residents of relevant federal, state, and local laws as well as inperson educational opportunities such as at neighborhood watch meetings.
The Police Department will also provide literature at booths when participating in community events such as the annual Safety Fair to encourage dialogue on this issue.

As done in the past, the Police Department will work with local gun stores to seek donations for gun and trigger locks for future community educational events and giveaways. With the expansion of the City Newsletter, the Police Department Public Information Officer will work to provide educational opportunities and links to our social media campaign and upcoming events.

ORDINANCE NO. 2022-
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA MESA ADDING LA MESA MUNICIPAL CODE CHAPTER 10.30 REGULATING THE
RESIDENTIAL STORAGE OF FIREARMS
________________________________________________________________ WHEREAS, having a firearm in the home that is easily accessible to minors, individuals with mental health issues, and convicted felons, increases the dangers of firearm related injuries, deaths, and other crimes, creating a significant public safety concern; WHEREAS, research indicates that suicide rates and unintentional firearm related fatalities are lower in samples of households that store their firearms locked and unloaded; WHEREAS, research indicates that firearms are the second leading cause of death in children under the age of 20;
WHEREAS, data suggested that 54% of owners reported not storing all firearms in a locked location, with a trigger lock, or any other lock; WHEREAS, data suggests that 7% (4.6 million) of U.S. children live in homes where at least one firearm is unsecured;
WHEREAS, 41% of adolescents in gun owning households report having “easy access” to the guns in their homes;
WHEREAS, evidence shows that the presence of a firearm in a home with children substantially increases the risk of suicide and accidental shootings, but that these risks are lower in homes where firearms are secured;
WHEREAS, over the last two decades, the suicide rate of young people has slowly risen and has maintained at a number higher than the California state suicide rate; WHEREAS, suicide attempts are often impulsive, with evidence suggesting that 24% of nearly lethal suicide attempts by individuals 13-24 years old occurred within five minutes of their decision to attempt suicide;
WHEREAS, suicide attempts with a firearm are almost always fatal and studies show that suicide attempts are reduced when access to highly lethal means are reduced; WHEREAS, Analysis of scientific literature on firearm laws concludes that child firearm prevention laws reduce firearm self-injury (including suicides) and unintentional firearm injuries and deaths among children;
WHEREAS, Between 2005 and 2010, around 93% of firearm thefts occurred during property crimes, therefore requiring safe storage of firearms should reduce the number of firearms stolen during household burglaries or other property crimes; WHEREAS, the National Rifle Association (NRA) safety rules instruct gun owners to store guns unloaded so they are not accessible to unauthorized persons;
WHEREAS, the San Diego County Gun Owners Association (SDCGOA) recommends that firearms are stored locked or in a safe, especially around children; WHEREAS, the California Attorney General advocates for secure storage of firearms using safety devices, such as a cable lock, trigger lock or locked containers, such as a lock box or gun safe;
WHEREAS, the International Association of Chiefs of Police advocates for responsible firearms owners to secure firearms from theft and misuse by utilizing safes, trigger locks, and monitored alarm systems;
WHEREAS, the La Mesa City Council finds that this Ordinance addresses risks posed by unsecured firearms in the home and will help prevent accidental shootings, teen suicides, and residential firearm thefts;
WHEREAS, the La Mesa City Council finds and declares that this Ordinance will preserve the peace and protect public health, safety, and general welfare of residents of the City of La Mesa by reducing firearms-related injuries and crime to curb the public health epidemic of firearm violence in San Diego County; and
WHEREAS, this Ordinance is supported by many community organizations such as March for Our Lives San Diego Center for Gun Policy.
