I don't want the dispensary to open on this spot but, if the dispensary is going to open anyway, can we allow them to have the access to the store on El Cajon Blvd? My main concern is that the additional traffic and congestion on the streets behind the store (i.e. Hillside, Clearview, and Culowee) will put the lives of the children that live and play in that area at risk.

A REQUEST FOR A PROPOSED COMMERCIAL BUILDING AND A CONDITIONAL USE PERMIT FOR A PROPOSED STOREFRONT RETAIL MEDICINAL CANNABIS USE AT 7901 HILLSIDE DRIVE Notice of the hearing was given in accordance with legal requirements, and the hearing was held on the date and at the time specified in the notice.

Director of Community Development Kusiak provided a PowerPoint presentation regarding the initial appeal hearing held on February 8, 2022, and its outcome, the legal actions taken by the applicant following the initial hearing, the Measure U dispensary requirements, the property of the proposed medical marijuana dispensary, and the proposed project's compliance with Measure U. Community Development Director Kusiak reviewed the approval process and explained the reason for the appeal. Community Development Director Kusiak said staff recommended the Council rescind their February 8, 2022, decision, deny the appeal, and uphold the Planning Commission’s approval of Conditional Use Permit ("CUP") 17-88 based on the findings and subject to conditions set forth in Planning Commission Resolution No. PC-2021-17.

Following Council questions and comments, Mayor Arapostathis opened the hearing for Item No. 11.1 and asked if anyone from the audience wished to speak.

The following members of the audience spoke in opposition to the proposed project and in support of the appeal:

Dana Stevens, Community Action Service Advocacy ("CASA") Executive Director, appellant Aaron Amerling
Dianne Osterling
Noel Bray-Hoagland
Janet Castanos
Rebecca Branstetter
Marie Knox
The following members of the audience spoke in support of the proposed project and in opposition to the appeal:

Phil Rath, applicant representative
