4. Item 12.1 Ordinance - Licensing of Tobacco Retailers_PowerPoint.pdf Jerry Jones
Mayor and council members,
I serve as chair of the planning commission, but my comments on this item reflect my personal views, and I do not speak on behalf of the commission.
This measure is timely, and I encourage the council to pass it.
I recently became aware of just how many places of business are selling retail tobacco in La Mesa without the proper state permits.
I generally favor simplicity and consistency between state and city laws, and have advocated in the past for avoiding redundant ordinances. However, I also believe it is paramount that we provide city staff with the appropriate tools for ensuring that local businesses are in compliance with state law.
As of today, enforcement of state retail tobacco laws fall to state agencies and relies on complaints lodged by residents. This leaves far too much space for some businesses to skirt the law.
Passing this ordinance will have no adverse impact on those who play by the rules. Let’s give city staff the means to ensure a safe and healthy La Mesa. -Jerry Jones
City Attorney Sabine read the title of the Ordinance.
Assistant City Manager Lee provided a PowerPoint presentation on the proposed Ordinance, highlighting the development process of the Ordinance, the cities in San Diego County that have a tobacco retailer license program, and the requirements, compliance monitoring, fee, and implementation date of the proposed tobacco retailer license program.
