Public Works Manager Marlin Munoz reported that on July 1, 2009, the City entered into a franchise agreement with EDCO Waste and Recycling Services for the collection of refuse, recyclables and green waste. He said pursuant to the franchise agreement, EDCO may submit an adjustment request for the billing period beginning July 1, 2022. 8.2 ORDINANCE NO. 723 AMENDING DRIVE-THROUGH FACILITY
STANDARDS IN TITLE 21, SUBSECTION 21.20.055 OF THE
LA MIRADA MUNICIPAL CODE AND SUBSECTION 5.6.2 OF THE
IMPERIAL HIGHWAY SPECIFIC PLAN
Associate Planner Arturo Cervantes reported that the City was approached by a developer proposing to redevelop the site located at 14861 Imperial Highway. He said the developer requested a zoning amendment to the City's drive-through facility standards because the requirement that prohibits drive-through aisles from being located between a structure and a public street make it difficult for the site to be developed with two separate restaurants with drive-through aisles.
Mr. Cervantes provided information on the proposed ordinance. He said Ordinance No. 723 would amend the Zoning Code to modify the existing standards to allow for drive-through aisles, including menu/ordering boxes and pick-up windows, to be located between a structure and a public street. He said to reduce potential visual and noise impacts, the proposed ordinance would require three-foot (3'-0") high block walls and landscaping along drive-through aisles that are adjacent to a public right- of-way. In instances where nearby residences may be impacted by headlight glare from vehicles in the drive-through aisles, the block wall height requirement would increase to four-feet (4'-0"). Additionally, pursuant to the proposed ordinance, new drive-through facilities would need to be designed to accommodate sufficient on-site queuing to prevent overflow vehicles from impacting adjacent sidewalks or streets.
Mr. Cervantes said the amendment request for limited sites within the City was presented to the City Council during a Study Session meeting on 5 Minutes Regular Meeting June 14, 2021
La Mirada City Council

He said that on April 21, the Planning Commission reviewed the amendment to the drive- through ordinance and approved Resolution No. 03-22, recommending that the City Council approve the amendment.
Mayor Pro Tem Otero opened the Public Hearing.
Tab Johnson represented the property owner and spoke in support of the proposed ordinance. He requested the City Council consider an allowance in the Code so that a beer/wine license could be approved for a restaurant with a drive-through.
Mayor Pro Tem Otero closed the Public Hearing.
Councilmember Lewis moved and Councilmember De Ruse seconded to affirm the CEQA Exemption and introduce for first reading Ordinance No. 723 amending section 21.20.055 "Drive-through facility standards" of the La Mirada Municipal Code and subsection 5.6.2 "Drive-through businesses" of the Imperial Highway Specific Plan, by title only, and waive further reading.
