Assistant City Manager Haraksin said the proposed ordinance would amend Section 9.90.070(a) and make it unlawful for a private property owner or person responsible for maintaining the property to permit graffiti to remain for a period longer than 72 hours after notification by the City.

She said the ordinance would require the private property owner or responsible person to cover the graffiti with paint that is substantially similar in shade and color to the surface upon which the graffiti is placed.

The ordinance would also delete Section 9.90.090, which allowed for the reimbursement of cellular phone costs for people reporting graffiti. She said the Public Safety and Traffic Commission unanimously voted to recommend the City Council adopt the proposed ordinance at its August 24 meeting, and the ordinance was reviewed and discussed by the City Council at its September 12 Study Session meeting.
