15. NEW BUSINESS

15.1 COUNCIL CONSIDERATION OF THE APPEAL PURSUANT TO THE

EMPLOYER-EMPLOYEE RELATIONS RESOLUTION BY THE

INTERNATIONAL ALLIANCE OF THEATRICAL STAGE EMPLOYEES
(IATSE) LOCAL 504 OF THE LA MIRADA STAFF DETERMINATION

THAT A PROPOSED BARGAINING UNIT OF TWO CITY EMPLOYEES,

THE TECHNICAL DIRECTOR AND THE THEATRE PRODUCTION

SUPERVISOR IS NOT AN APPROPRIATE UNIT
City Manager Boynton reported that the City received a petition by the International Alliance of Theatrical Stage Employees (IATSE) Local 504 for recognition as the exclusive representative for a proposed representation unit of two employees, Technical Director and Theatre Production Supervisor. He said that in response to the petition, the Employee Relations Officer determined that the proposed representation unit of two employees is not appropriate pursuant to Section 9 of Resolution No. 83-26. He said that pursuant to Section 5 of Resolution No. 83-26, a consultation was held with IATSE's legal representatives to consult over the appropriateness of the proposed unit. Following the consultation, the Employee Relations Officer notified IATSE's legal representatives formally in writing that the prior determination that the proposed unit comprised of the two positions is not an appropriate unit 5 Minutes Regular Meeting May 13, 2025
La Mirada City Council
under Sections 5(b) and 9 of Resolution No. 83-26 remained unchanged.

He said pursuant to Section 11 of the Resolution, IATSE was permitted to appeal the determination to the City Council. He said any decision made by the City Council during this evening's appeal is final and binding.

City Attorney James Markman advised the City Council of the appeal process. He said it would be appropriate for IATSE's representative to address the City Council first.

Brad Marlowe, a Business Representative of IATSE Local 504, provided a statement regarding the merits of the appeal. He said IATSE is an appropriate union to represent the two City employees because it has an understanding of the duties of the positions. He provided an overview of the job duties of the positions and said they are unique positions that are best represented by IATSE. He provided information on IATSE.

Productions Supervisor Wesley Hunt asked the City Council for its support for union representation by IATSE. He provided information on some of his job duties and work with the backstage staff.

Brad Marlowe provided information on the reasons the two employees want to form a union. He said they are concerned for their jobs if representation is denied. He said the original union formed due to unfair treatment by a City staff member.

Councilmember De Ruse expressed displeasure with the manner in which the case was presented and the disparaging statements Mr. Marlowe made about a City staff member.

Katherine Read, Associate at Richards, Watson, and Gershon, presented her brief in response to the union's appeal regarding denial of the two- person unit. She said there was a procedural defect related to the IATSE petition for recognition. She also provided information on the five factors that were considered when the Employee Relations Manager determined two employees was not an appropriate unit.

Councilmember Bean inquired about the supervisory duties associated with the two positions. She also asked if other supervisory positions have specialty roles.

Katherine Read responded and said the two positions sign timesheets, complete projects, and supervise staff assigned to them, which are duties similar to other supervisory positions in the City. She said there are supervisory positions that are unique and specialized such as the Human Resources Manager position.

Mayor Lewis asked and received confirmation on the procedural defect associated with the petition.
6 Minutes Regular Meeting May 13, 2025
La Mirada City Council
Brad Marlowe addressed the City Council and provided a rebuttal. He said the IATSE attorney was not aware the briefs would be argued during the meeting. He said that there was very little commonality among the two positions and other supervisory positions. He said even if there was a procedural error, the Council could still make a decision to confirm the appeal
City Attorney Markman reported that he was in contact with the IATSE attorney and she was aware of the appeal procedure that was to occur during the Council meeting. He said she concurred on the date and provided her brief for the agenda packet.

Wesley Hunt reiterated that the Theatre is unique to every other Department. He said he was seeking representation from an organization that understands his needs.

Councilmember Otero expressed his displeasure with the IATSE representative making allegations against the City. He said that there was a neglect of duty because the two positions seeking representation did not report the allegations prior to the Council meeting.

Mayor Pro Tem Eng said supervisory skills are transferable. Supervising and management is about people.

Mayor Lewis said it was inappropriate to make allegations during the hearing and that it wasn't the issue at hand. He said that a two-person union is not an appropriate union. He said he supported the Employee Relation Officer's decision and was supportive of denying the appeal.

Jim Markman said that a resolution for consideration was included in the agenda packet. He said the adoption of the resolution would deny the appeal by IATSE.

Mayor Pro Tem Eng moved and Councilmember De Ruse seconded to adopt a resolution denying the appeal by the International Alliance of Theatrical Stage Employees (IATSE) Local 504 of the determination of the City staff by and through the City Human Resources Manager that a proposed bargaining unit of two City employees, the Theatre Technical Director and the Theatre Production Supervisor, is not an appropriate bargaining unit.
