ORDINANCES AND RESOLUTIONS

9.1 SECOND READING AND ADOPTION OF ORDINANCE NO. 750 APPROVING AMENDMENT NO. 1 TO A DEVELOPMENT AGREEMENT TO INSTALL AN ELECTRONIC BILLBOARD AT 14655 FIRESTONE BOULEVARD, WITHIN THE

FREEWAY COMMERCIAL (C-F) ZONING DISTRICT
City Manager Boynton said that on December 10, 2024, the City of La Mirada adopted Ordinance No. 735 approving the Development Agreement (DA) with Bulletin Displays, LLC (Developer) for the placement of an electronic billboard at 14655 Firestone Boulevard, which was effective on January 10, 2025. He said due to project timing and the delayed commencement of revenue generation, the Developer requested relief related to the timing of the second annual Development Fee payment required under the Development Agreement. He said the Developer remains in communication with the City regarding project progress and is current on its required obligations to date. He said to address this request while preserving the City's contractual interests, the proposed Amendment No. 1 would defer the second annual Development Fee payment, originally due in March 2026 in the amount of $153,000 until September 2026.

He said the deferred payment would then be paid in six (6) equal monthly installments of $25,500 each from September 2026 through February 2027. He said Ordinance No. 750 was introduced for first reading and the required public hearing was conducted at the April 14 City Council meeting.

Councilmember Lewis moved and Councilmember Bean seconded to accept for second reading and adopt Ordinance No. 750 approving Amendment No. 1 to a Development Agreement to install an electronic billboard at the property located at 14655 Firestone Boulevard, within the Freeway Commercial (C-F) Zoning District.
