Agenda Item No. 4 October 1, 2024 | 1
City of La Palma
Agenda Item No. 4
MEETING DATE: October 1, 2024
TO: City Council
FROM: City Manager
SUBMITTED BY: Andy Ramirez, Director of Public Works & Community Services
AGENDA TITLE: Amendment to the Signal Maintenance Agreement with Crosstown Electric and Data, Inc.

RECOMMENDED ACTION:

It is recommended that the City Council approve an amendment to the contract for the maintenance of traffic signal services with Crosstown Electric and Data, Inc., in an amount not to exceed $20,000.

SUMMARY
The City contracts maintenance and extraordinary services for its thirty-two traffic signals. These services encompass monthly inspections, cleaning and servicing of traffic signal controller cabinets, ensuring the functionality of all signal and pedestrian bulbs, and conducting general inspections at each signalized intersection. Extraordinary services address urgent repairs and emergency call-outs typical of car accidents and other issues.

The current maintenance contract is set to expire on October 31, 2024, and no further extensions are permitted without initiating a Request for Proposal (RFP) process.

Given current staffing levels, it is not feasible to complete a Request for Proposals (RFP), evaluate proposals, and award a new contract by the October 2024 deadline. Therefore, staff recommends approving an amendment to extend the current contract for an additional six months, with a not-toexceed amount of $20,000.

During this extension period, staff will conduct an RFP and return to the City Council with a recommendation to award a contract to the most qualified firm. An award of a contract is anticipated for recommendation to the City Council no later than February 2025.

FISCAL IMPACT
The 2024-25 Fiscal Year Budget has sufficient funding to cover a six-month contract extension in an amount not to exceed $20,000 (011-410-6000-41020).

City of La Palma
Agenda Item No. 5
MEETING DATE: October 1, 2024
TO: City Council
FROM: City Manager
SUBMITTED BY: Jesse Amend, Captain
AGENDA TITLE: Agreement with SEAACA for Animal Care Services RECOMMENDED ACTION:

It is recommended that the City Council approve and authorize the Mayor to execute a five-year agreement with the Southeast Area Animal Control Authority (SEAACA) for the delivery of animal care services in FY 2025-2029 with the option of terminating the agreement upon 90-days written notice.

BACKGROUND:

The City contracts with the Southeast Area Animal Control Authority (SEAACA) for the delivery of animal care services. The previous five-year Agreement with SEAACA expired July 2024. SEAACA has submitted a proposal for a new five-year agreement (FY 2024-2029) with the same terms as the previous contract other than the cost.

SUMMARY:

For FY 2024-2025, SEAACA is quoting a net cost of $133,255 for animal care services, which is approximately $8,400 more than the cost in FY 2023-24. The increase is a result of a continued rise in SEAACA’s general operating costs. The current figures are based on an annual total cost of $161,955 offset by license fee guarantees of $28,700. Pursuant to the Agreement, any licensing fees collected over and above the guarantee are split evenly between SEAACA and the City.

FISCAL IMPACT:

The FY 2024-25 Budget for animal care services included $131,000 (001-210-6000-21010) whereas the total cost is $133,255. Staff will return at the Midyear Budget Update to formally request an additional appropriation of $2,255.

Said sums shall be paid within thirty (30) days after receipt of invoice. If payment is not delivered to SEAACA within thirty (30) days after CITY's receipt of invoice, SEAACA is entitled to recover interest thereon. Said interest shall be at the rate of ten percent (10%) per year, or any portion thereof, calculated from the last day of the month in which the services were performed. d) The compensation and financial provisions of subsections a) and b) of Paragraph 2 of Section II, shall be adjusted annually by mutual agreement of the Parties. Prior to the end of each year of this Agreement, the parties shall commence negotiations to determine the compensation and financial provisions to apply for the next year of this Agreement. Agenda Item No. 6 October 1, 2024 | 1
City of La Palma
Agenda Item No. 6
MEETING DATE: October 1, 2024
TO: City Council
FROM: City Manager
SUBMITTED BY: Jesse Amend, Captain
AGENDA TITLE: Agreement with ACMS for Providing School Crossing Guard Services
RECOMMENDED ACTION:

It is recommended that the City Council approve and authorize the City Manager, or designee, to execute an agreement with All City Management Services (ACMS), Inc. to provide school crossing guard services for one year, commencing July 1, 2024, through June 30, 2025.

BACKGROUND:

In June 2023, the City Council approved a one-year Agreement with ACMS to provide school crossing guard services within the City from July 1, 2023, to June 30, 2024. While staff would generally complete a formal Request for Proposals (RFP) process when a contract expires, in this case, ACMS is the only viable contractor in the region that exclusively provides crossing guard services to municipalities. Therefore, staff recommends continuing to use ACMS for school crossing guard services.

SUMMARY:

ACMS submitted their proposed one-year agreement for crossing guard services for Fiscal Year 2024-

25. Pursuant to the agreement, ACMS will provide seven crossing guards at six locations within the City for a total of 4,005 hours of service annually. The one-year agreement anticipates an hourly rate of $33.68 per hour for Fiscal Year 2024-25, not to exceed $134,888.40 The agreement includes an adjustment to the hourly rate for crossing guard services. The increased amount of the ACMS proposal is based on several factors, which include a change in the workforce from a traditionally older workforce to a younger workforce. The expectations of the current workforce continue to require higher wages. Due to a significant rise in employee turnover, there has been an increase in costs associated with advertising, recruitment, and training. Additionally, cost-of-living adjustments and competitive wages in other employment sectors, including a recent minimum wage increase for fast-food workers in California to $20.00 per hour, have further contributed to rising expenses. Based on these factors, ACMS has increased its hourly rate from to $30.32 per hour to $33.68 per hour to remain competitive as an employer and offset rising operating costs.

Agenda Item No. 7 October 1, 2024 | 1
City of La Palma
Agenda Item No. 7
MEETING DATE: October 1, 2024
TO: City Council
FROM: City Manager
SUBMITTED BY: Ryan Hallett, Assistant City Manager
AGENDA TITLE: Side Letter between the City and La Palma General Employees Association
RECOMMENDED ACTION:

It is recommended that the City Council:

1. Adopt a Resolution amending the Memorandum of Understanding for the La Palma General Employees Association; and

2. Authorize the City Manager or designee to sign the Side Letter on behalf of the City.

BACKGROUND:

The City’s previous contract for custodial services expired on September 1, 2024. At its August 2024 meeting, the City Council approved a staff recommendation to extend the contract for up to six months, with a cost not to exceed $45,000, allowing additional time to evaluate the City's long-term custodial needs.

In June 2024, the City advertised and solicited bids for custodial services, and by July 2024, staff had completed a review of the submitted bids, including pricing structures. However, staff determined that further analysis was needed to fully assess the financial impact of entering into a new custodial services contract. Upon further evaluation, it became evident that creating and filling an in-house custodial position would not only be more cost-effective but also offer greater benefits. The City would gain more custodial hours from a full-time in-house employee at a lower cost compared to the limited hours provided under an external custodial services contract. This shift to an internal position would increase service coverage and provide a more sustainable solution, ultimately enhancing the City's operational efficiency at a similar cost to outsourcing.

SUMMARY:

The City has recently engaged in discussions with the La Palma General Employees Association (LPGEA) regarding the establishment of a custodian position and the development of its associated salary schedule. Both parties have reached an agreement to move forward with this initiative. As a result, staff is now requesting that the City Council approve the attached Resolution, which formally

Page 88 of 109 ends

Agenda Item No. 7 October 1, 2024 | 2
documents the creation of the custodian position along with its salary schedule. This action will ensure that the new position is officially recognized and aligned with the City's operational needs and compensation standards, reflecting the mutual agreement between the City and the LPGEA. Below is the corresponding salary schedule:

In addition to the base salary, the cost of benefits for the Custodian position is estimated to range between $22,160 and $24,000. These benefits include health insurance, retirement contributions, and other employee-related expenses.

FISCAL IMPACT:

At the highest salary range and with the most expensive benefit package selected, the total annual cost for the newly created custodian position would be approximately $79,750. In comparison, the City has allocated $99,000 for custodial services in this fiscal year (001-370-6050-00000). This demonstrates that even under the most costly scenario for the in-house position, the City would realize a significant cost savings of over $19,000 annually while also benefiting from increased service hours and greater control over the quality and scheduling of custodial work.

Agenda Item No. 8 October 1, 2024 | 1
City of La Palma
Agenda Item No. 8
MEETING DATE: October 1, 2024
TO: City Council
FROM: City Manager
SUBMITTED BY: Andy Ramirez, Public Works & Community Services Director
AGENDA TITLE: Various Median Islands Capital Improvement Project RECOMMENDED ACTION:

It is recommended that the City Council appropriate $202,800 from project savings to the project contingency funds.

BACKGROUND
The Various Median Islands Capital Improvement Project was awarded to Unispec Construction Inc. for a total of $2,553,643.70, with work commencing on April 18, 2024. As of now, the following tasks have been completed on La Palma Avenue between Denni Street and Valley View Street:
• Required tree removals
• Clearing and grubbing of dirt mounds
• The installation of irrigation systems
• Boring for electrical conduits for future monument lighting • Removal of additional asphalt concrete pavement from median planting areas • Planting of new trees (between Denni Street and Walker Street) Along Moody Street south of La Palma Avenue, the following work is now complete:
• The construction of two new raised medians
• The installation of irrigation systems
• The planting of new trees
• Boring for electrical conduits for future monument lighting • Removal of additional asphalt concrete pavement from median areas • Construction of stamped concrete and maintenance bands The above work represents over 50% of the project.

Page 101 of 109 ends

Agenda Item No. 8 October 1, 2024 | 2
Outstanding items that will be under construction on Walker Street and existing Moody Street medians include:
• Installation of river rock on all medians
• Installation of trees and shrubs
• Installation of irrigation drip systems
• Removal and replacement of stamped concrete and the 18" maintenance bands • Removal of additional asphalt concrete pavement from the median planting areas • Any unforeseen conditions
The estimated timeframe for the completion of all median work, excluding the installation of river rock, is December 2024. However, with the inclusion of the river rock installation, the project's estimated completion date will extend to February 2025.

SUMMARY
A 10% contingency fund totaling $253,400 was allocated to address unforeseen costs during construction. To date, these funds have been utilized for several necessary adjustments:

Starting Contingency Balance $253,400

1. Installation of electrical conduits and wiring for
future monument lighting
($108,800)

2. Removal of unexpected additional asphalt
concrete thickness
($65,848.92)

3. Additional tree removals ($66,417.10)

4. Irrigation infrastructure changes ($7,181.81)

5. Other unforeseen expenditures TBD
Remaining Balance $5,152.17

ANALYSIS
Currently, the remaining contingency balance is approximately $5,000. Given the ongoing unexpected field conditions, additional funding is required for construction. To address these issues, the City Manager issued Change Orders #3 and #4, which accomplished the following cost savings:
• Elimination of all boulders: $133,200
• Replacement of eight 24” box trees with 15-gallon trees: $69,600 Bringing the total cost savings to $202,800 minus any negotiated compensation to the contractor for reducing the project scope.

Therefore, staff recommends that the City Council appropriate $202,800 from project savings to the project contingency fund to address the following:
• An additional 305 linear feet of irrigation sleeves

Page 102 of 109 ends

Agenda Item No. 8 October 1, 2024 | 3
• 50 linear feet of curb extension
• Additional stamped concrete repairs
• Asphalt concrete removal due to unexpected thickness

FISCAL IMPACT
This action will result in no net increase to the overall project budget, as the appropriated funds are being reallocated from existing project costs to the contingency fund.

AGENDA TITLE: Resolution to Authorize Cal Recycle Beverage Container Recycling Grant Program Application
RECOMMENDED ACTION:

It is recommended that the City Council approve and authorize the submittal of an application for the Cal Recycle Beverage Container Recycling Grant Program for $54,995.84 for the installation of four (4) water refill stations in various locations within Central Park.

BACKGROUND:

On September 24, 2024, the City submitted an application to the Cal Recycle Beverage Container Recycling Grant Program, requesting $54,995.84 in grant funds to install four (4) water refill stations at Central Park. Cal Recycle requires a City Resolution authorizing the grant application and City Manager signatory authority on the application to be submitted by the secondary deadline of October 23, 2024. There is no cost share required from the City for this application or grant.

The Beverage Container Recycling Grant (BCRG) Program aims to reach and maintain an 80% recycling rate for all California Refund Value (CRV) beverage containers – aluminum, glass, plastic, and bi-metal, and offers a competitive grant program to cities across the State to further this goal.

SUMMARY:

If awarded, the Cal Recycle grant funding will allow the City to acquire and install four (4) ADAcompliant water bottle refill stations in Central Park, two (2) by the softball field, one (1) by the Tiny Tots facility, and 1 (one) by the tennis/pickleball courts. The Resolution will authorize the application and authorize the City Manager’s signing authority to administer and sign all required grant documents and agreements with Cal Recycle. A copy of the submitted application is attached to the staff report.

FISCAL IMPACT:

If awarded, the project will provide $54,995.84 in revenue, which will be offset by expenditures for the same amount without the use of City funds.
