AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: February 8, 2022 From: Bob Lindsey, City Manager
SUBJECT: CONSIDERATION AND APPROVAL OF A 30-DAY RESOLUTION REGARDING
THE CONDUCT OF TELECONFERENCED MEETINGS OF THE CITY COUNCIL
AND OTHER CITY BODIES UNDER THE MODIFIED RULES SET FORTH UNDER GOVERNMENT CODE SECTION 54953(E) AND OTHER APPLICABLE
PROVISIONS AS AMENDED BY AB 361
BACKGROUND
On March 4, 2020, Governor Gavin Newsom proclaimed a State of Emergency throughout the state of California, in response to the rapid spread and threat of the Novel Coronavirus (COVID-19). On the same day, the Los Angeles County Board of Supervisors and Los Angeles County Department of Public Health (“LACDPH”) declared a local emergency and local public health emergency throughout Los Angeles County. On March 13, 2020 in response to the conditions of extreme peril to the safety of persons within the City of La Puente, the Director of Emergency Services for the City of La Puente declared a local emergency. The declaration was ratified by the La Puente City Council (“City Council”) on March 17, 2020.
On September 16, 2021, Governor Newsom signed Assembly Bill (AB) 361 (Rivas, 2021), which authorizes local agencies to continue to hold public meetings remotely under modified teleconferencing requirements set forth in the Brown Act (Government Code section 54953(b)(3)) during a state-declared emergency, as that term is defined, and when either state or local health officials have imposed or recommended measures to promote social distancing, or in situations when the legislative body has determined that meeting in person would present imminent risks to the health or safety of attendees. AB 361 went into effect immediately and sunsets on January 1, 2024.
Modified Brown Act requirements under AB 361, include, among other provisions, that:
• Members of the public must be allowed to address the body and offer comments in real-time during the meeting.
• In the event of a technical disruption, the public agency cannot take any further action on the agenda until the issue is resolved.
• Public agencies may not require public comments be submitted in advance (this is still a permissible option but cannot be the only option).
• Members of the public must be given a reasonable time to register to provide public comment, if necessary, and agencies that provide a timed public comment period shall not close the remote public comment option until that timed period has expired.

AGENDA REPORT
Agenda Report: AB 361 Monthly Extension
For meeting of: February 8, 2022
DISCUSSION
Since the initial emergency declaration, the health crisis and public agency protocols have evolved for public agencies. In La Puente, the City Council, Planning Commission and other legislative bodies of the City have conducted in-person meetings, hybrid in-person/remote meetings and fully remote teleconferenced meetings.
Under AB 361, legislative bodies of the City can meet remotely during a declared State of Emergency by the Governor that includes the jurisdictional boundaries of the City, if the legislative body determines that one of the following is also true:
1. State or local officials have imposed or recommended social distancing; or
2. To determine, by a majority vote, whether to hold remote meetings as a result of the State of Emergency, because meeting in person would present imminent risks to the health or safety of attendees; or
3. The legislative body holds a meeting having already determined by a majority vote to hold remote meetings.
Pursuant to AB 361, the City Council must revisit the findings every 30 days. Therefore, staff is requesting that the City Council adopt the attached resolution authorizing remote teleconference meetings for the period from February 14, 2022 through March 15, 2022, pursuant to Brown Act provisions.
FISCAL IMPACT
None.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 22-5687, authorizing the City Council, City Boards, and all Commissions of the City continue to hold teleconferenced meetings from February 14, 2022 through March 15, 2022.

By: John Di Mario, Development Services Director
William C. Pagett, City Engineer
SUBJECT: CONSIDERATION OF A RESOLUTION IN SUPPORT OF THE LOS
ANGELES COUNTY METROPOLITAN TRANSPORTATION
AUTHORITY’S COMPLETE STREETS POLICY
BACKGROUND
The State of California enacted the California Complete Streets Act of 2008 (also known as AB1358) which requires that when cities and counties make substantive revisions to the circulation elements of their General Plans, they identify how they will provide for the mobility needs of all users of the roadways. The term “Complete Streets” describes a comprehensive, integrated transportation network with infrastructure and design that allows safe and convenient travel along and across street for all users. This includes pedestrians, users and operators of public transit, bicyclist, persons with disabilities, seniors, children, motorists, users of green modes, and movers of commercial goods.
The California Department of Transportation, Deputy Directive 64, explained that it “views all transportation improvements as opportunities to improve safety, access, and mobility for all travelers in California and recognizes bicycle, pedestrian, and transit modes as integral elements of the transportation system.”
The Los Angeles County Metropolitan Transportation Authority (Metro) through its Metro Complete Streets Policy, requires all jurisdictions address complete streets policies at the local level through the adoption of a supportive complete streets policy or through a General Plan update that complies with the 2008 California Complete Streets Act to be eligible for Metro capital grant funds.
DISCUSSION
The City recognizes that the planning and coordinated development of Complete Streets infrastructure provides benefits for local governments with infrastructure cost saving; public health; and environmental sustainability. The City further acknowledges the benefits and value for the public health and welfare of reducing vehicle miles traveled and increasing transportation by walking, bicycling, and public transportation.
City of La Puente

SUBJECT: CONSIDERATION OF A PURCHASE ORDER CONTRACT WITH MOON VALLEY
NURSERY FOR THE PURCHASE AND INSTALLATION OF LARGE SPECIES TREES AT LA PUENTE PARK IN THE AMOUNT OF $431,749
BACKGROUND
Included in the State of California’s budget for Fiscal Year 2021-2022 was an allocation to the City of La Puente for improvements and enhancements at La Puente Park. This allocation is being administered through the California Department of Parks and Recreation (“CDPR”) as a specified grant that can be used to complete capital projects based on the previously Council approved Parks Master Plan. The approximate amount of the specified grant is $6.4 million.
At the meeting of October 26, 2021, the City Council approved Resolution No. 21-5666, approving the application(s) for the Specified Grant Funds with the CDPR. In addition, the City has received grant funding for the park from the Rivers and Mountains Conservancy.
DISCUSSION
The City sought out tree nurseys which could provide certain mature species of mature trees to be planted in the east side of the park as part of the park Master Plan. Only one vendor was identified that could provide the species type, mature size, quantity and planting of the trees. Provided as Attachment “A” is a sales agreement provided by Moon Valley Nursery to supply and plant 82 trees at the park per the City’s requirements.
List below are the species type and the relative heights at time of planting:
Coral Tree - 17 – 18 feet
Coast Live Oak (a) – 20 – 22 feet
Coast Live Oak (b) - 24 – 26 feet

AGENDA REPORT
Agenda Report: Purchase Order Contract Moon Valley Nursery For meeting of: February 8, 2022
Redbud Western – 14+ feet
As part of the purchase and planting of the trees, the sales agreement also includes weather protection/warranty program. This warranty program provides for two free tree replacements within the first year should the tree die due to frost or extreme heat, disease from insects or pests, lighting or wind breakage or from over- or under-watering.
Section 2.20.090 (b) of the City’s Purchasing Ordinance provides for exceptions to competitive bidding when a sole source vendor has been determined. As discussed on the previous page, only Moon Valley Nursery was responsive to the desired commodities and services of the City for this procurement and thus satisfies the definition of sole source.
FISCAL IMPACT
The total price for purchase, delivery, installation and warranty for the trees is $431,749. Funding is available for this cost utilizing the grants from the Rivers and Mountains Conservancy and the Specified through the CDPR.
RECOMMENDATION
It is recommended that the City Council: (1) approve the purchase order contract with Moon Valley Nursery for the purchase and installation of large species trees at La Puente park in the amount of $431,749; and (2) authorize the City Manager to execute, on behalf of the City, all documents necessary to effectuate the purchase order.

AGENDA ITEM NO. D-5
To: Mayor and City Council For meeting of: February 8, 2022 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF A RESOLUTION DECLARING AS SURPLUS PROPERTY ONE VEHICLE IN THE CITY’S FLEET, AUTHORIZING THE SALE OF THE
SURPLUS VEHICLE BY ENTERPRISE FLEET MANAGEMENT FOR THE SALE OF
THE VEHICLES
BACKGROUND
The City has adopted a system for disposing of surplus personal property that is for the common benefit of the City, and that ensures the City recoups the highest revenues for the property.
Pursuant to Section 2.20.120(a) of the City’s Municipal Code (“Code”), at such times as determined by the purchasing officer, reports shall be prepared showing all supplies and equipment which are no longer used or which have become obsolete or worn out. The purchasing officer shall have the authority to sell, trade or exchange all supplies and equipment. All surplus property valued at more than five hundred ($500.00) dollars requires a council resolution declaring it surplus. Additionally, Section 2.20.120(b)(3) of the Code states the purchasing officer is hereby authorized to dispose of surplus goods which are not used or needed or which have become unsuitable for city use. Such goods may be disposed of by any of the following procedures; sold at public auction conducted by a professional auctioneer.
DISCUSSION
The City fleet shows 1 vehicle which will be replaced by a newer vehicle that the City will now lease through Enterprise Fleet Management. Those vehicles are:

AGENDA REPORT
Agenda Report: Surplus Vehicle Disposal
For Meeting of: February 8, 2022
Staff recommends that the City Council declare the vehicle as surplus and authorize disposal of said items. The City’s purchasing officer has determined that the auction process will allow the City to recoup a greater amount of revenue from the sale than selling the vehicle through the informal bidding process, and will require the use of less valuable City resources, including staff time.
One of the many services that Enterprise Fleet Management provides is the ability to take surplus vehicles and sell them through the auction process. This is the same process that the City has used in the past with another vendor. Enterprise Fleet Management will charge a service fee of $300 for each vehicle that is auctioned off. The service fee noted also includes picking the vehicles up from the City locations and transporting to the facility for auction.
FISCAL IMPACT
The expected General Fund revenue from the sale of this vehicle is $5,000 - $6,000.
RECOMMENDATION
It is recommended that the City Council: (1) adopt Resolution No. 22-5689 declaring as surplus property, one vehicle in the City’s fleet, authorizing the sale of the surplus vehicle at auction; and (2) authorize the City Manager to execute the Agreements on behalf of the City.

To: Mayor and City Council For meeting of: February 8, 2022 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
SUBJECT: CONSIDERATION OF A COMMUNITY CENTER PARKING LOT AND STREET
USE AGREEMENT FOR LA PUENTE YOUTH COALITION CARNIVAL WITH LA PUENTE SOFTBALL INC., LA PUENTE NATIONAL LITTLE LEAGUE, GUERREROS ATHLETIC FOUNDATION, AND JR. ALL AMERICAN FOOTBALL OF LA PUENTE, INC.
BACKGROUND
The La Puente Youth Coalition (“Coalition”) traditionally puts on an annual community carnival event at La Puente Park (“Park”) to raise funds for the four-member organizations which include La Puente National Little League, La Puente Girls Softball, La Puente Jr. All American Football and Boys/Girls Guerreros Judo.
On March 4, 2020, Governor Newsom issued State Executive Order N-33-20 to preserve public health and safety throughout the entire State of California as a result of the threat of COVID-19 by imposing a statewide shutdown of non-essential businesses and governmental operations. Since then, many actions have been taken over the last several years by federal, state, and county officials to address the consequences of this pandemic and minimize the spread of the coronavirus. Furthermore, the Park has been under renovation during this time with construction still on-going at the eastern portion of the park.
DISCUSSION
The Coalition has expressed their interest in bringing the carnival back in 2022 to be held from Thursday, March 10th through Sunday, March 13th. Due to the new improvements to the grass and walkway areas of the west side of the Park and the current construction underway on the east side of the Park, the Coalition would like to hold the carnival in the Community Center parking lot and a portion of Glendora Avenue as shown in Figure A on the following page.
The proposed fund-raising event for the Coalition members is similar to that held in previous years.
The Coalition plans to have its booths open and conduct its activities, along with the carnival rides and attractions, from Thursday, March 10th to Sunday, March 13th. The carnival arrival and setup are anticipated to begin on Monday, March 7th in the parking lot area with the portion in Glendora Avenue beginning on Wednesday. The carnival tear down will begin immediately following the closing of the carnival on Sunday evening.

AGENDA REPORT
Agenda Report: Youth Coalition Carnival 2022
For meeting of: February 8, 2022
Figure A: Carnival Boundary
The Coalition’s Carnival is a valuable community event that provides for an outdoor event for the residents of the City and serves as a positive, family-friendly activity. Moreover, the event serves as a fundraiser for the Coalition and its membership as it allows for reduced costs for the youth of La Puente who participate in the membership’s activities.
The attached Use Agreement (“Agreement”) outlines the general terms and conditions for use of the Community Center Parking lot and Glendora Avenue. The provisions of the Agreement include the following: a general release, hold harmless and indemnity provision; standard insurance requirements; detailed site plan; all necessary permits and licenses and; LiveScan fingerprinting for the carnival company owner and all ride operators.
The City will cover the costs associated with City maintenance personnel needed to implement and remove the street closure of Glendora Avenue, as illustrated in Figure B on the following page. In addition, the City will provide maintenance staff to be present during the hours of operation of carnival.
Agenda Report: Youth Coalition Carnival 2022
For meeting of: February 8, 2022
Figure B: Carnival Street Closure
Security for the event will be provided by the Los Angeles County Sheriff’s Department. The City will cover the costs associated with Sheriff’s personnel to police the event.
The cost for the City to take out additional special event liability insurance will be paid for by the Coalition members. The additional insurance is based on the types of rides at the event and the estimated attendance. The cost for this insurance is expected to be not more than $1,000.00.
The Coalition will also be responsible for providing additional temporary lighting for the operation of the Carnival and paying for the City’s cost for the lighting in the parking lot which is $360.00.
In addition, the City will make available use of the restroom near the parking lot; however, the Coalition shall provide ten (10) porta-potties for the event at their cost.
Agenda Report: Youth Coalition Carnival 2022
For meeting of: February 8, 2022
FISCAL IMPACT
The City will cover the costs associated with the street closure and Sheriff costs for the 2022 carnival, with all other carnival-incurred costs to be borne by the Coalition.
RECOMMENDATION
It is recommended that the City Council: (1) approve the Community Center Parking Lot and Street Use Agreement for the La Puente Youth Coalition Carnival; and (2) authorize the City Manager to execute the Agreement on behalf of the City.

AGENDA ITEM NO. D-7
To: Mayor and City Council For meeting of: February 8, 2022 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
William C. Pagett, City Engineer
SUBJECT: CONSIDERATION OF ACCEPTANCE OF NOTICE OF COMPLETION FOR
AMAR ROAD AND ELLIOTT AVENUE RIGHT-OF-WAY PARKWAY
IMPROVEMENTS PROJECT
BACKGROUND
On July 9, 2019, the City Council awarded a construction contract to Mariposa Landscapes, Inc. in the amount of $477,306.68 to complete the Amar Road and Elliott Avenue Right-ofWay Parkway Improvements Project (“Project”).
DISCUSSION
The scope of work for the Project included enhancements to the City’s public right-of-way along the south side of Amar Road from Unruh Avenue to Elliott Avenue. Specifically, it involved the redesign of the landscaped area at Amar and Elliott which included the removal of the existing turf and replacement with new flowering shrubs and groundcover, additional trees (including date palm trees), dry streambeds and water retention/infiltration basins. The Project also included a decomposed granite walking path, sitting areas, pedestrian lighting, and a new seven (7) foot high split-face concrete block wall with decorative pilasters along the City’s right-of-way on the south side of Amar Road from Elliott to Unruh.
On December 2, 2019, Mariposa Landscapes began work on the Project. A few weeks later, the Project was put on hold for nine months due to an unforeseen SoCalGas pipeline that required relocation. Work resumed on the Project in October 2020 but experienced further delays due to COVID illnesses impacting Mariposa’s work crews and subcontractors at various times. The project was eventually completed by Mariposa Landscapes on July 16, 2021.
The contractor’s bid price for this Project was $477,306.68. During construction, there were a few bid item quantity adjustments that resulted in a net increase of $6,220.92, due to additional quantities of sidewalk removals and reconstruction that were underestimated in the original construction estimate. There were also two change orders on the Project that amounted to $34,850.81 and included the following items: trenching of the electrical service in the roadway as required by SCE; extended temporary fence rental; site cleanup due to the extended delay; concrete additives for the wall footings; and enhanced pilaster caps for the split-face block wall. The total construction cost for this project was $518,378.41, which is 8.6% above the original contract.

AGENDA ITEM NO. D-8
To: Mayor and City Council For meeting of: February 8, 2022 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF AWARD OF CONSTRUCTION CONTRACT TO SPOHN RANCH, INC. FOR THE ADDITION TO THE IAN C. CALDERON SKATE PARK AT LA PUENTE PARK IN THE AMOUNT OF $208,000.00
BACKGROUND
At its Special City Council Meeting on November 17, 2022, City staff gave a report regarding a proposal from Spohn Ranch to construct a beginner area and a bowl at the skatepark.
Funding for the expansion of the skatepark would come from the Prop 68 per capita funds. An application was submitted in December 2021 to use the $202,000 from the Prop 68 per capita funds. Additionally, to utilize these funds it would require the City to provide a 20% match.
The match would come from the General Fund, which has already been budgeted in the fiscal year 2021/2022 Capital Improvement budget.
The City Council approved the funding of the skatepark expansion in the amount of $202,000.00 using Prop 68 grant funds.
DISCUSSION
City staff is recommending awarding a construction contract to Spohn Ranch, Inc. for the addition to the Ian C. Calderon skatepark in the amount of $208,000.00.
The design and construction of the skatepark will be awarded through a competitively bid contract (Master Contract #112420-SRI) by Sourcewell (formerly the National Joint Powers Alliance). Sourcewell is a public agency service cooperative that serves over 50,000 members.
Through national solicitations, they provide the opportunity for members to purchase through nationally leveraged, competitively bid contracts. Sourcewell contracts offer a multitude of products, equipment, and services to government agencies and non-profit entities. The City of La Puente is a member of Sourcewell and has used Sourcewell contracts in the past. Section
2.21.090 of the La Puente Municipal Code authorizes the City to participate in cooperative purchasing plans or programs such as Sourcewell.
Based on the scope of work, the Project should take approximately 12 weeks to complete the project. It is anticipated that the construction will commence at or around February 28th.

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: February 8, 2022 From: Bob Lindsey, City Manager
By: JD Buckwell, Code Enforcement Supervisor
SUBJECT: PRESENTATION, DISCUSSION AND DIRECTION REGARDING GRANT FUNDING TO VOLUNTEERS IN DEFENSE OF ANIMALS (“VIDA”)
BACKGROUND/DISCUSSION
Since 2019, VIDA has been the City’s primary sheltering service for dogs and cats recovered by the City’s Animal Control Services. VIDA’s “per animal” service rates range from $65-$125, whereas the City’s alternative sheltering service (LA County) offers the same services in the range of $244-$488, or more.
The remarkable cost benefit that VIDA provides the City, as well as their humane “no-kill” policy, is why it is imperative that the City does what it can to assist this 501(c)3 Organization with its COVIDrelated fiscal hardship. This pandemic has stripped VIDA of their primary income stream, which is pet adoption fees. VIDA’s primary overhead is their service location’s $5,000 per month rent. A grant in the amount of $60,000 from the City would offer a full year of rent relief to assist in VIDA’s recovery, ensuring the City and its residents continue to receive a high level of service from VIDA. The alternative would be much more costly as it would require the City to utilize the services of LA County at much higher per animal rates.
FISCAL IMPACT
If approved, $60,000 would be allocated from the City’s ARPA funds to assist with operational costs for VIDA, as they directly relate to the City.
RECOMMENDATION
It is recommended that the City Council discuss this item and provide direction to Staff.
