SUBJECT: CONSIDERATION OF ORDINANCE NO. 23-981 ADOPTING BY REFERENCE THE CALIFORNIA BUILDING STANDARDS CODE 2022 AND
OTHER RELATED CODES AND ADOPTING LOCAL AMENDMENTS
THERETO, AND MAKING FINDINGS FOR SAME
PUBLIC HEARING NOTICE
At the meeting of January 10, 2023, the City Council set the date of January 24, 2023, to conduct a public hearing for the proposed Ordinance. The notice of the City Council’s public hearing for Ordinance No. 23-981 was published in The San Gabriel Valley Tribune on January 10, 2023 and January 17, 2023 and posted in three (3) public places pursuant to the La Puente Municipal Code (“LPMC”) and State law.
BACKGROUND
At the meeting of January 10, 2023, the City Council adopted Urgency Ordinance No. 23-980 and introduced non-urgency Ordinance No. 23-981 pertaining to the new 2022 California Building Codes. The State of California Building Standards Commission (“BSC”) adopts mandatory State-wide Building Laws on a tri-annual basis. In January 2022, the BSC adopted the latest model codes after making amendments based on California requirements. The State Building Laws were published on July 1, 2022. The new State Building Laws became effective statewide on January 1, 2023.
Since incorporation, the City of La Puente has adopted the County of Los Angeles Building Laws which both amends and adopts the State Building Laws. On November 15, 2022 the Los Angeles Board of Supervisors adopted Titles 26 (Building), 27 (Electrical), 28 (Plumbing), 29 (Mechanical), 30 (Residential), 31 (Green Building Standards) and Title 33 (Existing Building Code) which adopted the California Building Laws with amendments and made the necessary findings based on climatic, typographical and geologic conditions. The findings of reasonable necessity for modifications are included as Attachment C. Copies of the County Ordinances are available in the City Clerk’s Office for public review.
Due to the State Building Laws becoming effective on January 1, 2023 it was necessary for the City Council to consider and adopt an Urgency Ordinance (so that it takes effect immediately upon adoption) as well as a non-urgency Ordinance for adoption at a noticed public hearing.
City of La Puente
AGENDA REPORT
Agenda Report – Ordinance No. 23-981 to Adopt the 2022 California Building Codes For Meeting of: January 24, 2023
The non-urgency Ordinance (Ordinance No. 23-981) would take effect 30 days after the second reading, which would be February 24, 2023.
DISCUSSION
The BSC adopted the same group of model building, electrical, plumbing, mechanical, residential and green building standards codes that it adopted in 2019. There are no significant code changes proposed in this code cycle, except for the following minor changes which have been identified by the City’s Building Official as new changes that could have an impact on new developments in the City:
Issued permits are now valid for one (1) year upon issuance versus six months with the prior code, including non-residential projects.
New residential units may now utilize “dry pipe sprinkler systems” for fire suppression systems; versus standard water systems in the previous code. Inclusion of new “aging in place” and fall prevention requirements for all new residential units to allow people to stay longer in their homes as they age. New residential units must be “electrical ready” for alternatives to gas appliance installations such as water heaters, space heating, cooking, and clothes drying, etc. providing electrical hook-ups and other infrastructure to allow such spaces to switch over to electricity.
New non-residential buildings must add photovoltaic (PV) and battery storage so these buildings can be more self-sufficient.
Multi-family developments or hotels with less than 20 units must provide no less than 10% of the parking spaces as EV “ready” spaces.
Multi-family developments or hotels with more than 20 units must support EV charging spaces.
The revisions to Title 8 of the La Puente Municipal Code that are herein recommended by Staff as a result of the new model codes include the following:

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA PUENTE DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Findings.
(A) Pursuant to California Health and Safety Code Sections 17958.5, 17958.7 and 18941.5, the City Council hereby makes each finding of reasonable necessity for modifications as stated separately in Attachment D to the January 10, 2023 City Council Agenda Report for each such modification as identified in Los Angeles County Titles 26, 27, 28, 29, 30, 31 and 33. These modifications to the California Building Standards Code, incorporating the model codes are reasonably necessary due to the local climate, characterized by hot, dry summers and the high potential for seismic activity which make structures particularly vulnerable to rapidly spreading fires and structural damage.
(B) California State law requires localities, such as the City of La Puente, to adopt the 2022 California Building, Plumbing, Mechanical, Electrical, Green Building, Residential, and Existing Building Codes and any modifications there to, which became effective January 1, 2023.
The City Council finds that it is essential and imperative that the City adopt this Ordinance, adopting by reference the above-listed Los Angeles County Code and modifications necessitated by local topographical; geological, and climatic conditions by that date. The City Council further finds that in the absence of legislation effective by that date, technical codes adequate to meet the City's special circumstances will not be in effect and hazards will be posed which would

Accordingly, the City Council finds and determines that this Ordinance is exempt from California Environmental Quality Act (“CEQA”, Public Resources Code § 21000 et seq.) pursuant to the general rule in Section 15061(b)(3) of the CEQA Guidelines (Chapter 3, of Title 14, of the California Code of Regulations) that CEQA applies only to projects which have the potential for causing a significant effect on the environment and thereby the City Council approves and adopt the Notice of Exemption. The City Council further directs Staff to file the Notice of Exemption, as authorized by law.

AGENDA ITEM NO. C-1
To: Mayor and City Council For meeting of: January 24, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Abraham Tellez, Senior Planner
SUBJECT: CONSIDERATION OF A RESOLUTION ADOPTING THE LA PUENTE SAFE
ROUTES TO SCHOOL PLAN
BACKGROUND
In response to the Southern California Association of Governments (“SCAG”) 2017 Active Transportation Call for Proposals, the City submitted a proposal to develop the La Puente Safe Routes to School Plan (“SRTS Plan”). In March 2018, the SCAG Regional Council adopted an Authorization to Accept the Grant for the SCAG 2017 Local Active Transportation Planning Initiative that would fund the La Puente SRTS Plan. On January 28, 2020, the La Puente City Council approved a Memorandum of Understanding with SCAG and by May of 2020, the City selected Alta Planning and Design, Inc. in association with ActiveSGV as consultants to prepare the SRTS Plan.
While the SRTS Plan was getting underway, the City Council was previously focused on improving pedestrian and student safety in and around schools as part of the Federal Highway Safety Improvement Program (“HSIP”). At the City Council meeting of November15, 2022, the City awarded a $1,042,198 contract to TOWO Enterprise Inc. for the improvement of eight (8) crosswalk locations throughout the City. The improvements include the installation of rectangular rapid flashing beacons, curb extensions, advanced pavement markings, warning signs, high-visibility crosswalks and ADA compliant access ramps. These improvements are focused on enhancing pedestrian safety by improving the visibility of the pedestrian at the crossings and reducing the distance for pedestrians to cross the street. This project is anticipated to begin construction in early March of this year.
On February 23, 2021, Alta Planning presented project updates to the City Council identifying project branding, goals, scope of work, and community outreach strategies. The last SRTS Plan update to the City Council was on August 9, 2022, which provided a summary of community engagement outcomes and survey results. The SRTS Plan is included as an attachment to the resolution (see Attachment “A” – Resolution No. 23-5773) which is the final document resulting from all the data gathering and community engagement efforts.
DISCUSSION
SRTS is a planning strategy that improves travel conditions for pedestrians, bicyclists, or other forms of non-automotive travel around schools (ex: rolling). It also educates and informs the public, City of La Puente
AGENDA REPORT
Agenda Report: Adoption of Safe Routes to School Plan
For meeting of: January 24, 2023
providing information that would encourage non-automotive forms of travel. The La Puente SRTS Plan focuses on 16 public and private schools that are located or have enrollment areas in La Puente.
The SRTS Plan promotes goals that aim to encourage walking, biking, and rolling, decrease obesity and diabetes, identify safe routes between home and school, identify and prioritize infrastructure improvements, and make the City highly-competitive for future grants and funding opportunities.
The SRTS Plan is divided into five (5) sections that are easy to navigate. The first section provides an introduction and most importantly identifies the vision and goals of the SRTS Plan for the City of La Puente. The second section describes and analyzes the input received from the stakeholder and community engagement efforts. The third section describes existing conditions in the City, providing context of the built environment, background from collision data, and observations gathered from walk audits. The fourth section makes recommendations on proposed programs and policies (noninfrastructure), as well as infrastructure improvements. The final fifth section makes recommendations on implementation utilizing a methodology with prioritization metrics. The fifth section also identifies potential funding sources to implement components of the SRTS plan.
As explained above, the La Puente SRTS planning effort involved robust stakeholder engagement and extensive community input opportunities. Input opportunities and information dissemination included announcements on the City’s website, social media pages, text banking, and mailers. Input efforts also involved in-person events, parent/caretaker surveys, an interactive webmap, virtual workshops, pop-up outreach at schools, focus groups, and walk audits. The results of these efforts are included in the SRTS Plan and were vital to create suggested route maps for the schools, an infrastructure improvement plan, and program recommendations that meet the vision and goals of the SRTS Plan.
With a completed SRTS Plan, the City is now in the position to seek available grant funding to implement improvements that are recommended in the Plan.
FISCAL IMPACT
The recommended action has no direct fiscal impact; however, with an adopted Safe Routes to School Plan, the City will be competitive and in a good position to pursue grants for capital improvements or programs.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 23-5773 adopting the La Puente Safe Routes to School Plan.

AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: January 24, 2023 Via: Bob Lindsey, City Manager
By: Troy O. Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF NOVEMBER AND DECEMBER 2022 REQUISITION
SUMMARY REPORTS
BACKGROUND
On April 24, 2018, the City Council adopted several ordinances and accompanying resolutions amending the City’s purchasing procedures to streamline and make the procurement process more efficient. One of the amendments to the purchasing procedures was a provision setting a $5,000 spending limit for Department Heads and a separate provision increasing the City Manager’s spending limit to $20,000 for professional services, supplies and equipment. In order to document purchases approved by the City Manager and/or Department Heads the City Council directed that a monthly report be prepared and filed with the City Council. This action is to receive and file the requisition summary report for the months of November and December 2022.
DISCUSSION
City staff initiated seventeen (17) requisitions during the month of November totaling $307,238.46 and seven (7) requisitions during the month of December totaling $30,770.93.
RECOMMENDATION
It is recommended that the City Council receive and file the requisition summary reports for November and December 2022.

AGENDA ITEM NO. D-3
To: Mayor and City Council For meeting of: January 24, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF NOVEMBER AND DECEMBER 2022 INVESTMENT
REPORTS
BACKGROUND
This report presents the City’s investment portfolio for the periods of November and December 2022.
The attachments provide details of the City’s portfolio. They have been prepared to comply with regulations contained in California Government Code Section 53600 and the Statement of Investment Policy approved by City Council on June 14, 2022.
The investment objectives of the City of La Puente are first, to provide safety of principal to ensure the preservation of capital in the overall portfolio, second, to provide sufficient liquidity to meet all operating requirements, and third, to earn a commensurate rate of return consistent with the constraints imposed by the safety and liquidity objectives.
The City follows the practice of pooling cash and investments for all funds under its direct control.
Interest earned on pooled cash and investments is allocated to the various funds based on the respective fund’s average quarterly cash balance. It is common for governments to pool the cash and investments of various funds to improve investment performance. By pooling funds, cities are able to benefit from economies of scale, diversification, liquidity and ease of administration.
DISCUSSION
The Investment Reports for November and December 2022 has been provided as an attachment for your review.
The following table summarizes the City’s investment activity for the period:
City of La Puente
AGENDA REPORT
November & December 2022 Investment Report
For Meeting of January 24, 2023
FISCAL IMPACT
Idle cash invested in certificates of deposit, government securities, and corporate bonds typically return higher yields than LAIF (Local Agency Investment Fund). This maximizes returns without assuming substantial additional risk.
SUMMARY
In summary, the City has conservatively placed its investment portfolio in LAIF, federal agency securities, corporate bonds, and certificates of deposit. The portfolio complies with the Statement of Investment Policy and the City has the ability to meet its expenditure requirements for the next six months.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

AGENDA ITEM NO. D-4
To: Mayor and City Council For meeting of: January 24, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: CONSIDERATION OF APPROVAL OF A PROFESSIONAL SERVICES
AGREEMENT FOR BUDGET SOFTWARE SERVICES WITH IGM TECHNOLOGY CORPORATION IN THE AMOUNT OF $72,600
BACKGROUND
Since Fiscal Year 2020/2021, the City has received the Distinguished Budget Presentation Award from the Government Finance Officers Association (GFOA) on a consistent annual basis. With the passage of time, preparation of the annual budget and capital improvement program using Microsoft Office products has become progressively complex, owing in large part to increases in revenues and expenditures, growth in funding sources, and expanding document requirements. Staff has determined that a specialized budget software tool would be of significant benefit to the annual process and would allow for a reduction in labor hours and improvements in data analytics and financial forecasting.
DISCUSSION
On December 08, 2022, a Request for Proposals (“RFP”) was issued for budget software solutions.
The RFP was posted to the City website, as well as sent directly to major vendors in the industry.
Proposals were due after fourteen (14) days on December 22, 2022. The following specifications were listed as requirements:
• The ability to produce a consolidated annual budget document (operating budget and capital improvement program).
• The document must be producible as a printed book and as an Adobe PDF document. • The ability to export revenue and expenditure data into Tyler ERP Pro 10 general ledger. • Must include a personnel cost forecasting feature.
• Must be a cloud-based system with offsite server hosting (SaaS). • Must include user accounts for non-finance staff to enter budget requests. • The ability to create a budget document meeting all criteria required for the Government Finance Officers Association (GFOA) Distinguished Budget Presentation award.
City of La Puente
AGENDA REPORT
Professional Services Agreement for Budget Software
For Meeting of January 24, 2023
Two (2) firms provided proposals responsive to the RFP. The following table represents the pricing structure of each proposal. IGM Technology (with a software platform known as Gravity) submitted the lowest responsive price quotation.
Name Implementation Yr. 1 Yr. 2 Yr. 3 Total Fees
ClearGov - $22,440 $26,400 $26,400 $75,240
IGM Technology $12,000 $20,000 $20,000 $20,600 $72,600
Staff received product demonstrations for the purpose of evaluating the functionality of each software solution. After consideration of numerous characteristics including ease-of-use, capability, and scalability, it was determined that the Gravity software from IGM Technologies offered the solution best suited to the needs of the City, in addition to the most competitive pricing. Features included in the IGM Gravity package include, but are not limited to, personnel cost forecasting, a capital budgeting module, ability for each operating department to enter budget requests directly, and the production of a unified budget book within the same software system.
The professional services agreement attached herein is for a three (3) year term, with the option of extension for up to two (2) additional years. After the conclusion of the initial contract term, the pricing for the extension periods allows for escalations of up to 5% annually, subject to negotiation by both parties.
FISCAL IMPACT
The total pricing for the initial contract term is $72,600 to be appropriated within the Equipment Replacement internal service fund. The annual expenditure will be financed with a transfer from the American Rescue Plan Act (ARPA) fund.
RECOMMENDATION
It is recommended that the City Council: (1) approve a professional services agreement for budget software services with IGM Technology Corporation in the amount of $72,600; and (2) authorize the City Manager to execute the agreement.

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: January 24, 2023 From: Bob Lindsey, City Manager
By: Troy O. Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF NOVEMBER AND DECEMBER 2022 BUDGET
REPORTS
BACKGROUND
The City Council adopted the Fiscal Year 2022-2023 Budget and Capital Improvement Program on May 16, 2022. The attached reports examine fiscal activity taking place during the months of November and December 2022 and includes all funds within the operating budget. The report analyzes year-to-date transactions in comparison to budgeted amounts for the entire fiscal year, expressing each category using a percentage-of-completion methodology. It additionally provides comparisons in activity level to the same time period last fiscal year.
DISCUSSION
As of December 31, 2022, fifty (50) percent of the fiscal year has elapsed.
Revenues
The General Fund has realized approximately 25% of budgeted revenues to date, on par with the results seen in December of 2021. This equates to $4,758,306 – an increase of 5% over last year in terms of dollars. All major categories within the fund are trending within the margin of expectations. It is typical for the pace of revenue collections to lag behind the elapsed time for any fiscal year, due to varying schedules of remittances from other agencies. In the next period, staff expects to receive a large deposit of property tax in-lieu of vehicle license fees, bolstering the taxes and assessments category.
Noteworthy areas thus far include Licenses and Permits, at 78.4% of budget, and Charges for Services, at 65.2%. These outliers are propelled by building permit and plan check activity for developments within the city limits.
Special revenue funds register at 51.9% of budgeted revenue, a reduction when compared to
61.9% at this time last fiscal year. Subventions across the board, including Gas Tax, RMRA, and the MTA funds appear to be arriving at a slightly slower pace. This is not an area of concern at this time, and staff continues to closely monitor all receipts. This notwithstanding, the gross dollar amount received year-to-date in the special revenue funds totals $9,295,928, an City of La Puente

For Meeting of January 24, 2023
increase of about $1.3 million over this time last fiscal year. This is due largely to reimbursements in grant funding for the capital projects at La Puente Park.
Expenditures
General Fund expenditures to date total $6,589,811 or 35.1% of budget – comparable to the
34.8% posted in December of 2021. General Government expenditures are down 11% yearover-year, owing in large part to savings on legal services as cases are resolved. Administrative Services, which houses the Human Resources function, shows expenditures increased by 20% from this time last year. This is due to increases in special event insurance and unemployment claims. No other General Fund departments display significant fluctuation.
Across all funds, 33.3% of the City’s operating budget has been expended to date, identical to the percentage expended at this point in FY 2021/2022.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

AGENDA ITEM NO. E-2
To: Mayor and City Council For meeting of: January 24, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Director of Development Services
Juan Galvan, MPA, Associate Planner
SUBJECT: DISCUSSION AND DIRECTION REGARDING THE EXTERIOR ELEVATIONS
OF THE PROPOSED ACTIVITY CENTER BUILDING AT LA PUENTE PARK
BACKGROUND/DISCUSSION
At the City Council meeting of February 22, 2022, the Council awarded Westberg + White a Professional Services Agreement for design services for a new separate activity center building to be located west of the Community Center.
Included as Attachment “A” are the proposed elevations for the building. A site plan showing how the building will layout on the site along with a new outdoor volleyball court and a rock climbing tower/wall will be presented at the City Council meeting.
Partial funding for this project has been provided through Congresswoman Grace Napolitano’s office as the project was awarded $750,000.00 through the FY23 Omnibus Appropriation Bill (H.R. 2617) which was signed into law by President Biden on December 29, 2022. In addition, at the City Council meeting of January 10, 2023, the Council allocated $375,000 from the American Rescue Plan Act funds to put towards the cost of the project.
FISCAL IMPACT
Funding has been secured in the amount of $1,125,000.00. The estimated total construction cost for the proposed building is approximately $2,750,000.00, plus soft costs during construction of approximately $415,000.00 resulting in a funding gap of roughly $2,040,000.00. Staff continues to explore other grant funding sources to fully fund this project.
RECOMMENDATION
It is recommended that the City Council discuss this item and provide direction to Staff.
