AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF MARCH 2023 INVESTMENT REPORT
BACKGROUND
This report presents the City’s investment portfolio for the period of March 2023. The attachment provides details of the City’s portfolio. It has been prepared to comply with regulations contained in California Government Code Section 53600 and the Statement of Investment Policy approved by the City Council on June 14, 2022.
The investment objectives of the City of La Puente are first, to provide safety of principal to ensure the preservation of capital in the overall portfolio, second, to provide sufficient liquidity to meet all operating requirements, and third, to earn a commensurate rate of return consistent with the constraints imposed by the safety and liquidity objectives.
The City follows the practice of pooling cash and investments for all funds under its direct control.
Interest earned on pooled cash and investments is allocated to the various funds based on the respective fund’s average quarterly cash balance. It is common for governments to pool the cash and investments of various funds to improve investment performance. By pooling funds, cities are able to benefit from economies of scale, diversification, liquidity and ease of administration.
DISCUSSION
The Investment Report for March 2023 has been provided as an attachment for your review. The following table summarizes the City’s investment activity for the period:

AGENDA REPORT
March 2023 Investment Report
For Meeting of April 25, 2023
FISCAL IMPACT
Idle cash invested in certificates of deposit, government securities, and corporate bonds typically return higher yields than LAIF (Local Agency Investment Fund). This maximizes returns without assuming substantial additional risk.
SUMMARY
In summary, the City has conservatively placed its investment portfolio in LAIF, federal agency securities, corporate bonds, and certificates of deposit. The portfolio complies with the Statement of Investment Policy and the City has the ability to meet its expenditure requirements for the next six months.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: Troy O. Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF MARCH 2023 REQUISITION SUMMARY REPORT
BACKGROUND
On April 24, 2018, the City Council adopted several ordinances and accompanying resolutions amending the City’s purchasing procedures to streamline and make the procurement process more efficient. One of the amendments to the purchasing procedures was a provision setting a $5,000 spending limit for Department Heads and a separate provision increasing the City Manager’s spending limit to $20,000 for professional services, supplies and equipment. In order to document purchases approved by the City Manager and/or Department Heads the City Council directed that a monthly report be prepared and filed with the City Council. This action is to receive and file the requisition summary report for the month of March 2023.
DISCUSSION
City staff initiated seventeen (17) requisitions during the month totaling $107,616.83.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

AGENDA ITEM NO. D-4
To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Juan Galvan, MPA, Associate Planner
SUBJECT: CONSIDERATION OF THE 2022 HOUSING ELEMENT ANNUAL PROGRESS REPORT
BACKGROUND
Since 1969, California has required that all local governments (cities and counties) adequately plan to meet the housing needs of everyone in the community. California’s local governments meet this requirement by adopting housing plans as part of their “general plan” (also required by the state).
General plans serve as the local government’s "blueprint" for how the city and/or county will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing. The law mandating that housing be included as an element of each jurisdiction’s general plan is known as “housing-element law.” California’s housing-element law acknowledges that, for the private market to address the housing needs and demand of Californians adequately, local governments must adopt plans and regulatory systems that provide opportunities for (and do not unduly constrain), housing development. As a result, housing policy in California rests mainly on the effective implementation of local general plans and, in particular, local housing elements.
DISCUSSION
State housing element law requires each city to prepare and file Annual Progress Reports (“APR”s) with the California Department of Housing and Community Development (“HCD”) and the Office of Planning and Research (“OPR”) describing local housing production and the status of Housing Element program implementation. APRs must be prepared using the format established by HCD and be reviewed by the City Council at a public meeting.
More recent housing element laws require that cities report more than simply housing units entitled by the Planning Division or permitted by the Building and Safety Division as previously required, but also housing units that were completed or issued certificates of occupancy (“C of O’s) in a given calendar year. Additionally, the housing units reported must be broken down by income category of the occupants in the forms provided by HCD.
In 2022, the City's Planning Division received 50 housing applications and approved 46 applications, for a total of 46 proposed units, of which were accessory dwelling units or ADUs City of La Puente
AGENDA REPORT
Agenda Report – Housing Element 2022 Annual Progress Report For Meeting of April; 25, 2023
(See Table A). Furthermore, the City issued building permits for 29 new housing units, all of which are ADUs (See Table A-2). Subsequently, the City issued C of O’s for 45 new housing units, which includes 22 multi-family units, and 23 ADUs (See Table A-2). The attached tables illustrate the comprehensive entitlement, permit issuance, and certificate of occupancy activity for 2022. The tables also summarize the City’s progress in implementing the programs identified in the City’s most current Housing Element (see Table D).
In contrast to 2021, the City's Planning Division received 41 housing applications and approved 69 applications, which totaled 77 proposed units, with 43 of those units being ADUs. In addition, the City issued building permits for 43 new housing units, all of which are ADUs (See Table A2). Additionally, the City issued C of O’s for 16 new housing units, all of which were ADUs.
FISCAL IMPACT
No fiscal impact associated with filing the report. Although preparation of APRs is required by State law, no State funding is provided in connection with this mandate.
RECOMMENDATION
It is recommended that the City Council: (1) receive and file the 2022 Housing Element Annual Progress Report; and (2) direct Staff to submit the report to HCD and OPR.

The city established a Programs Re-employment Outreach Services (PROS) team that is dedicated in coordinating with other agencies and organizations to help the unhoused population find resources and housing.
Program 14:
Fair Housing N/a
Provided individually for distinct
actions as noted in table Table 37
summarizes the City's quantified
objectives for the 2021-2029
planning period by income group
HIGH PRIORITY: SFR Overcrowding: Staff works closely with residents wishing to construct additions and ADUs to reduce overcrowding. Staff has simplified its application form for both residential additions and ADUs. Mixed-Use: The city has reached out to a reputable consultant to begin efforts in amending the code to allow for mixed-use. Code Enforcement: The City continues code enforcement efforts to mitigate unsightly residential areas and eliminate hazardous living conditions. The City's PROS team has also launched a beautification effort that address clean-up assistance of unsightly residential areas. MEDIUM PRIORITY: Rehabilitation program: The City will continue it's CDBG rehab program in providing residential loans/grants that would improve the city's aging housing stock. At-risk Units: The city will continue to monitor and facilitate the preservation of 82 at-risk units located in the city's four project-based complexes. Elderly and Disabled Person Housing: The City continues to reach out to senior housing developers (ex: Meta Housing) to encourage senior housing development in the city. Staff has also discussed (early stages) a possible project that would create affordable voucher-based housing for veterans. ADU: The city has simplified the application process for ADUs and is continually looking for ways to enhance customer service and processing response time for ADUs. The city will investigate a pre-approved garage conversion program.
Complete Streets: The city will explore to establish a citywide complete streets master plan. The city has adopted its Safe Routes to School Master Plan making it more competitive to seek grants/funds for capital improvement projects that could include complete streets improvement projects. Fair Housing: The city continues to provide outreach materials and information brochures to the public on fair housing and tenant rights. Homeless Needs:
The city's PROS team has conducted more frequent homeless population counts (point-in-time) than the County's one-year or State's every other year, consisting of counts of up to once per month, which allowed the city to adequately monitor and quantify its program success. The more frequent point-in-time counts also allows for more effective and timely provision of resources to the unhoused.

AGENDA ITEM NO. D-5
To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Director of Development Services
SUBJECT: CONSIDERATION OF AUTHORIZATION TO SOLICIT BIDS FOR WEST
RESTROOM RENOVATION AT LA PUENTE PARK
BACKGROUND
As part of the City’s funding from the State Grant for improvements at La Puente Park, the City Council has previously identified improvements for the two remaining older restrooms in need of upgrades.
At the City Council meeting of August 23, 2023, the City Council authorized Staff to solicit bids for improvements to the middle restroom located at the west end of the football field. Those improvements are well underway and are expected to be finished in approximately 30 days.
The City Council has previously approved a professional services agreement with Advanced Applied Engineering, Inc., also known as Infrastructure Engineers, for architectural design and construction support services for renovation of the west restroom at the Park. The project scope will be similar to the middle restroom which will encompass new fixtures and partitions, repair/refinish the floor, paint the interior and exterior of the building, and replace the lighting. It will differ from the work being completed at the middle restroom in that it will involve a new roof and additional framing between the existing roof rafters, and so storage area.
DISCUSSION
Plans, specifications and a cost estimate for the West Restroom Renovation have been completed and the project is ready to be advertised for formal bid. The Engineer’s estimate for construction is $215,000.00. The project involves the replacement of all existing Men’s and Women’s plumbing fixtures, accessories, and lighting as well as polishing of the existing concrete floors and repainting of the interior walls and new partitions and a new roof.
The following is the proposed schedule for implementation of the Project:
April 25, 2023 Authorization to Solicit Bids
May 18, 2023 Bid Opening
June 13, 2023 Award of Contract
July 10, 2023 Begin Construction (Projected)

AGENDA ITEM NO. D-6
To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF AN AMENDMENT TO THE PROFESSIONAL SERVICES
AND LICENSE AGREEMENT WITH SEMPER ANTICUS FOR THE OPERATION
AND MANAGEMENT OF AN OPEN-AIR MARKET
BACKGROUND
On November 15, 2022, the City of La Puente (“City”) approved a Professional Services and License Agreement with Semper Anticus for the operation and management of a weekly open-air market. The agreement is effect for an initial three-year term and may be extended for two additional one-year terms by mutual written agreement of the parties and approval of the City Manager. It is important to note that the City and Semper Anticus have a long-standing relationship with each other dating back to the original Professional Services and License Agreement in March 2015 for the operation of a weekly open-air market.
The Professional Services and License Agreement with Semper Anticus also provides the City with five ($5.00) dollars per fully paid retail space paid on a quarterly basis to the City.
DISCUSSION
City staff are recommending the approval of a of an Amendment to the Professional Services and License agreement with Semper Anticus for the operation and management of an open-air market. The Amendment updates Item No. 2 in the SCOPE OF SERVICES to allow the open-air market to be held every Sunday, between 4:00pm and 9:00pm. This will allow the residents a place to gather on Sunday afternoons to enjoy fun, family-friendly entertainment as well as delicious food, and various artisanal goods. The Sunday open-air market would still provide the City with five ($5.00) dollars per fully paid retail space paid on a quarterly basis.
FISCAL IMPACT
There are no costs directly associated with the approval of this agreement as the Contractor has agreed to pay for the staffing, and the fee for each fully paid retail space.

AMENDED AND RESTATED JOINT EXERCISE OF POWERS AGREEMENT AND APPROVAL OF AN AMENDMENT TO THE CIVIC-RECREATIONALINDUSTRIAL AUTHORITY’S AMENDED AND RESTATED JOINT EXERCISE OF
POWERS AGREEMENT WITH THE CITY OF INDUSTRY
BACKGROUND/DISCUSSION
On May 8, 2012, the City Council authorized the City to become a partner with the City of Industry (“Industry”) in the Civic-Recreational-Industrial Authority (“CRIA”). Pursuant to Section 2.03 of the Amended and Restated Joint Exercise of Powers Agreement (“JPA”), the City may appoint one Director who may be an employee but not a member of the City Council. In order to implement this new policy, it is necessary to revise the terms of office of all current Board Members.
The Board Members will each serve a term of four years, in staggered fashion, as set forth herein.

Commencing in 2027, one appointment to the Board shall be made by Industry at the first City Council meeting in July, and one appointment shall be made by La Puente at the first City Council meeting in July. Notwithstanding any provision set forth in this section, the terms of office for all Board Members in office as May 1, 2023, shall run as follows:
A. The three Board Members appointed by Industry whose terms of office expire the soonest shall all expire as of July 2025; and
B. The Board Member appointed by Industry whose term expires the latest, along with the Board Member appointed by La Puente, shall both expire as of July 2027.

POWERS AGREEMENT
WHEREAS, the City of La Puente (“City”) and the City of Industry (“Industry”) entered into a Joint Exercise of Powers Agreement (“JPA”) which created the Civic-RecreationalIndustrial Authority (“CRIA”) to provide for the management, maintenance, operation, and oversight of real and personal property owned and managed by the City or Industry, including, but not limited to, the Expo Center; and
WHEREAS, pursuant to Section 2.03 of the JPA, the CRIA Board consists of five members, one appointed by the City, and four of whom are appointed by Industry, each serving a term of four years, on a staggered schedule. However, the JPA does not contain any language setting forth when the appointments must occur; and
WHEREAS, currently, Industry’s City Council appoints individuals to the City’s boards and commissions at various times of the year, and there is no uniformity for when terms begin and/or expire across Industry’s boards and commissions; and WHEREAS, to allow for continuity across Industry’s boards and commissions, and for administrative ease, Industry desires to amend the JPA to make the appointments for all of Industry’s boards and commissions in July, every two years. Industry has therefore requested an amendment to the JPA to reflect when CRIA Board Members are appointed; and WHEREAS, in order to implement this new policy, it is necessary to revise the terms of office for all current Board Members.

AGENDA ITEM NO. D-8
To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF A LEASE AGREEMENT FOR ADDITIONAL MOWING AND
MAINTENANCE EQUIPMENT TO BE USED EXCLUSIVELY AT LA PUENTE PARK IN AN ANNUAL AMOUNT NOT TO EXCEED $38,613.48
BACKGROUND
On March 26, 2020, the City Council approved a purchase order contract with Turfstar Western for the purchase of mowing and maintenance equipment, as well as a 48-month lease agreement for two additional Reelmaster 3100-Ds mowers.
DISCUSSION
City staff is recommending entering into another fair market value (FMV) lease contract with Huntington National Bank for one Reelmaster 3100-D mower and one Reelmaster 5510-D T4F mower. The FMV lease would be for 48 months and would offer the City the ability to continually have newer mowing equipment without worrying about the maintenance costs associated with using older equipment.
Even though the City has one year left on the current lease, it is necessary to order the new mowers now due to back orders, high demand, and supply chain delays. The expected delivery date of the new equipment will coincide with the expiration of the current lease.
The equipment will be awarded through a competitively bid contract (Master Contract #031121-TTC) by Sourcewell (formerly the National Joint Powers Alliance). Sourcewell is a public agency service cooperative that serves over 50,000 members. Through national solicitations, they provide the opportunity for members to purchase through nationally leveraged, competitively bid contracts.
Sourcewell contracts offer a multitude of products, equipment, and services to government agencies and non-profit entities. The City of La Puente is a member of Sourcewell and has used Sourcewell contracts in the past. Section 2.20.090 of the La Puente Municipal Code authorizes the City to participate in cooperative purchasing plans or programs such as Sourcewell.
FISCAL IMPACT
The monthly lease cost for the mowers will be approximately $3,217.79 per month ($38,613.48 annually) and will be paid for using Lighting and Landscape Funds. The equipment is not expected to be received until late fiscal year 2023-2024.

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: April 25, 2023 From: Bob Lindsey, City Manager
By: Troy O. Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF MARCH 2023 BUDGET REPORT
BACKGROUND
The City Council adopted the Fiscal Year 2022-2023 Budget and Capital Improvement Program on May 16, 2022. The attached report examines fiscal activity taking place during the month of March 2023 and includes all funds within the operating budget. The report analyzes year-to-date transactions in comparison to budgeted amounts for the entire fiscal year, expressing each category using a percentage-of-completion methodology. It additionally provides comparisons in activity level to the same time period last fiscal year.
DISCUSSION
As of the end of March 2023, seventy-five (75) percent of the fiscal year has elapsed.
REVENUES
General fund revenues to date total $10.7 million, equivalent to 57.3% of annual budget.
Property Tax, the largest single revenue source in the City’s matrix, shows collections at 53.6% of budget, approximately on par with this time last fiscal year. Sales and Use Tax and Measure LP are down year over year by $219,400 and $96,800, respectively. This pattern is being noted in jurisdictions throughout the state, as transactions taxes return to baseline levels after pandemic-induced peaks. With several projects currently undergoing the entitlement and permitting process, staff is optimistic that the sales tax accounts will rise in the mid-term future.
That same increase in development activity has also led to a corresponding gain in Licenses and Permits, with 116% of budgeted revenues realized thus far.
EXPENDITURES
In aggregate, 53.7% of budgeted funds have been expended to date in comparison with 52.4% in March of 2023. This equates to $17,536,700 expended. In the General Fund, these figures are 58.9% and 57.2%, respectively. Special revenue funds show expenditures at 46% of budget in both March 2023 and March 2022. This indicates an overall stable expenditure trajectory across fiscal periods.
