AGENDA ITEM NO. B-1
To: Mayor and City Council For meeting of: May 9, 2023
From: Bob Lindsey, City Manager
By: JD Buckwell, Sr. Supervisor, Public Safety Services SUBJECT: INTRODUCTION AND CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER 6.40 OF THE CITY OF LA PUENTE MUNICIPAL CODE, RELATING TO PARKING, STOPPING AND STANDING OF RECREATIONAL VEHICLES;
ESTABLISHMENT OF CITY RECREATIONAL VEHICLE PARKING PERMITS
BACKGROUND
In recent years, the city has experienced an increase of recreational vehicles (RVs) parking on City streets, both in residential and non-residential areas. This increase in RV parking activity has created public health and safety concerns and has reduced the City’s available parking spaces. Staff has prepared a proposed ordinance prohibiting the parking of RVs on non-residential streets, and the requirement of a City-issued Resident and/or “Out-of-Town” Visitor RV parking permit for the residential streets of the City.
DISCUSSION
California Vehicle Code Sections 22507 and 22507.5 authorize cities to regulate vehicular parking within their jurisdictions. In recent years, staff has seen a significant increase in the use of public streets within the City to park, to store or stand, for extended duration, recreational vehicles, haulers and trailers (collectively RVs) creating public health and safety concerns.
Many of these RVs are being used as temporary or permanent housing for both humans and animals, creating public health concerns due to the illegal discharges of septic waste, wastewater, fuels, trash and garbage from such vehicles into City streets, sewers and storm drains. In addition to the public health and safety concerns associated with parking RVs on City streets, parking such vehicles on City streets also reduces the availability of parking spaces for other uses and reduces driver and pedestrian visibility near intersections.
Staff believes the proposed ordinance restricting the parking of RVs will mitigate the public health and safety concerns associated with RV parking, increase the availability of parking for City residents and visitors and preserve the character of neighborhoods to benefit the health, safety, and welfare of City residents.
City of La Puente
AGENDA REPORT
Agenda Report: RV Ordinance
For meeting of: May 9, 2023
The proposed ordinance adds Chapter 6.40.300 to the La Puente Municipal Code (LPMC). It prohibits the parking, stopping, or leaving standing of any recreational vehicle, as defined, on any private street, highway or alley or residential-zoned areas within the City, at any time, except pursuant to a temporary RV parking permit issued by the City Public Safety Services staff. RV parking within non-residential areas of the City may not exceed two (2) hours. The proposed ordinance authorizes the City Manager, or his/her designee, to issue temporary RV parking permits to residents and out-of-town visitors, as defined. Pursuant to the proposed ordinance, temporary City-issued RV permit parking is only permitted, and shall only be issued for, residential zones of the City.
The proposed ordinance sets forth requirements relating to the duration of permits, restrictions regarding the number of permits that may be issued annually, restrictions relating to where RVs may be parked and prohibited activities such as using slide outs / pop outs that encroach into the roadway, parkway and/or sidewalk in such a manner as to interfere with the path of safe travel for vehicles or pedestrians, causing utility connections to cross over, above, on or across any street or sidewalk or dumping waste onto public or private land or into streets, gutters or storm drains.
Pursuant to the proposed ordinance, City Council may, by resolution, establish fees to recover the City's costs associated with processing temporary RV parking permits. Finally, vehicles parked in violation of Chapter 6.40.300 are subject to citation, towing and/or revocation of temporary RV parking permits.
FISCAL IMPACT
The fiscal impact, by calculation, is approximately $10 per RV Permit issuance (material and labor) fully recoverable by a permit issuance fee.
RECOMMENDATION
It is recommended that the City Council: (1) waive reading of Ordinance No. 23-982 and read by title only; (2) introduce Ordinance No. 23-982 amending Chapter 6.40 of the La Puente Municipal Code regarding parking, stopping and standing of recreational vehicles; establishment of city recreational vehicle parking permits.

CITY OF LA PUENTE PUBLIC SAFETY SERVICES
FEE STUDY FOR PROPOSED RV PERMIT ORDINANCE
PREPARED BY JD BUCKWELL, SR. SPVSR., PUBLIC SAFETY SERVICES 3/7/23
Conceptual Approach
The basic concept of a User Fee Study is to determine the “reasonable cost” of each service provided by the City for which it charges a user fee. The full cost of providing a service may not necessarily become the City’s fee, but it serves as the objective basis as to the maximum amount that may be collected.
The standard fee limitation established in California law for property-related (non-discretionary) fees is the “estimated, reasonable cost” principle. Under California law, the City council may adopt a fee structure by Resolution or Ordinance. To maintain compliance with the letter and spirit of this standard, every component of the fee study process included a related review. The use of budget figures, time estimates, and improvement valuation clearly indicates reliance upon estimates for some data.
Fully Burdened Hourly Rates
The total cost of each service included in this analysis is primarily based on the Fully Burdened Hourly Rates (FBHRs) that were determined for City personnel directly involved in providing services. The FBHRs include not only personnel salary and benefits, but also any costs that are reasonably ascribable to personnel performing the tasks necessary to provide the service such as operating costs, department support and administrative overhead and overall overhead costs not captured by the former. The FBHRs do not include time spent on paid vacation, PTO and other non-billable activities i.e. the net hours worked are used to calculate the fully burdened rate.
Allowable Costs
Costs are defined as direct labor, including salary and benefits, departmental overhead costs, and the City’s central services overhead, where departmental and central service overhead costs constitute support costs. These cost types are defined as follows:
• Direct Labor (Personnel Costs): The costs related to staff salaries for time spent directly on fee-related services.
• Departmental Overhead: A proportional allocation of departmental overhead costs, including operation costs such as supplies and materials that are necessary for the department to function.
ATTACHMENT B
Fee Calculation
The cost burden has been calculated via the sum of both the direct labor and departmental overhead. The fee calculations are as follows:
Direct Labor:
The 15-minute timeframe used is estimated via the average time to complete similar forms/applications within this services division. This includes the applicant’s filling-out the form, Office Specialist’s obligation to properly identify applicant, review the completed form to ensure it complies with the information requested and meets criteria established, provide copy to applicant and process the fee transaction. This equation is as follows:
$35. (FBHR) divided by 4 = $8.75. (Round-off to nearest dollar is $9.00.) Department Overhead
This cost burden has been calculated via the per-unit cost (including applicable tax) of an NCR-3 printed form (application) utilizing the printing estimate provided by the City’s contracted printing service. The cost of a 300-unit order is quoted at $162.00, which equates to a per-unit cost of $0.54. (Round-off to nearest dollar is $1.00)
Calculated Total (actual) $9.54 Calculated Total (rounded-off to nearest dollar) $10.00.
Cost Recovery
Cost recovery shall be satisfied via a one-time applicant fee relating to the permit applied for and granted. No other cost recovery mechanism is in place. An application processing fee of $10 would fully-satisfy the cost burden of the permit relating to this proposed ordinance. -END OF FEE STUDY-

AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: May 9, 2023
From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
William C. Pagett, City Engineer
SUBJECT: CONSIDERATION OF AWARD OF CONSTRUCTION CONTRACT TO FS CONTRACTORS INC. FOR THE CITYWIDE CONCRETE REPAIRS FY 2022- 23 IN THE AMOUNT OF $195,409.00
BACKGROUND
City staff frequently receives resident complaints of damaged, cracked or displaced concrete sidewalk, curb and gutter, and driveway aprons. The damage may often be caused by parkway tree roots uplifting the concrete improvements, or the daily wear and tear from heavy vehicles.
In order to address the concrete repairs in a cost effective manner, staff compiled a list of concrete repair locations that can be completed under one project as funds become available.
The concrete repairs are necessary to eliminate trip hazards, improve pedestrian safety and accessibility, address drainage problems, preserve the asphalt paving, and reduce the potential for claims against the City.
DISCUSSION
The project involves the removal and reconstruction of damaged sidewalk, curb and gutter, and driveways at 70 locations Citywide. The work will also include some localized asphalt pavement repairs and re-establishing survey monuments. The Engineer’s Estimate for construction was $182,000.
The project was advertised for bids on April 3, 2023, and the bid opening was held on April 18, 2023. The City received a total of five (5) bids for the project. The results of the bids are as follows:
FS Contractors Inc. $195,409.00
Grigolla & Sons Construction Co. $210,790.00
Onyx Paving Company $211,999.00
All Cities Engineering Inc. $218,969.00
Kalban Inc. $246,585.00
After the process of verifying the contractor’s bid submittal, references were contacted for FS Contractors Inc. References confirmed that the contractor’s prior work was completed satisfactorily. FS Contractors has been determined to be the lowest responsible bidder for the project.
City of La Puente
AGENDA REPORT
Agenda Report – Authorization to Award Contract Citywide Concrete Repairs For Meeting of: May 9, 2023
Based upon the scope of work for the project, the project should take approximately forty (40) working days to complete after the date the contractor is issued the notice to proceed.
FISCAL IMPACT
The Fiscal Year 2022-23 Capital Improvement Program (“CIP”) Budget includes $150,000 in Measure M funds for the Concrete Repairs project.
The bid schedule for construction of this project totals $195,409. With a 10 percent (10%) project contingency of $19,541, the total construction project budget is $214,950. In addition, there are associated project costs for construction management, inspection, and material testing estimated at $24,000 which brings the total project cost to $238,950. Therefore, an additional allocation of $88,950 is needed to cover the total project costs. Funding is available through the City’s Transportation Development Act Article 3 (“TDA 3”) funds for pedestrian improvements and available Measure M funds for this project. However, a budget amendment is necessary to formally allocate these funds.
There is no impact to the City’s General Fund associated with this project.
RECOMMENDATION
It is recommended that the City Council: (1) award the contract to FS Contractors Inc. in the amount of $195,409; (2) authorize the City Manager to execute the Agreement and approve change orders up to 10% of the original bid amount; and (3) adopt Resolution No. 23-5794 authorizing an additional allocation of $70,000 in TDA Article 3 funds and $19,500 in Measure M funds to cover the total project cost.

SUBJECT: CONSIDERATION OF AMENDMENT NO. 2 TO THE MEMORANDUM OF
AGREEMENT BETWEEN THE SAN GABRIEL VALLEY COUNCIL OF
GOVERNMENTS AND THE CITY OF LA PUENTE FOR PARTICIPATION IN
THE SAN GABRIEL VALLEY REGIONAL VMT ANALYSIS MODEL
BACKGROUND
SB 743 has eliminated automobile delay as the primary measure of transportation impacts of environmental significance and required the Governor’s Office of Planning and Research (“OPR”) to implement revisions to CEQA Guidelines establishing criteria for determining the significance of transportation impacts. Therefore, OPR selected Vehicles Miles Travelled (“VMT”) as the preferred metric to comply with SB 743. As a result of these changes, lead agencies under CEQA (such as La Puente) will be required to analyze project related VMT’s to determine whether transportation impacts from a given development would constitute a significant environmental impact under CEQA which began July 1, 2020.
At the City Council meeting of April 9, 2020, the City Council approved a Memorandum of Agreement (“MOA”) with the San Gabriel Valley Council of Governments (“SGVCOG”) to partner with the SGVCOG and other member cities to establish methodologies and quantified thresholds from which to determine levels of significance related to transportation impacts in response to SB 743.
At the City Council meeting of August 25, 2020, the City Council approved Amendment No. 1 to the MOA with the SGVCOG to develop a Regional VMT Analysis Model to be used among the member cities as participants in the MOA and to employ a new web-based analysis tool in reviewing transportation impacts under CEQA.
DISCUSSION
Memorandum of Agreement Amendment No. 2
CEQA requires the use of the most recent data available when conducting environmental impact analyses. The existing VMT model, thresholds, and web-based tool are based on the Southern California Associated Governments (“SCAG”) Reginal Transportation Plan (“RTP”) Model (2016), which is unfortunately obsolete and no longer CEQA-compliant. The model, thresholds, City of La Puente

and web-based application must therefore be updated to reflect the current SCAG RTP Model (2020), which is an activity-based model (“ABM”), was not available prior to the regulatory deadline for implementing Senate Bill 743. In conjunction with the revised California Air Pollution Control Officers Association (“CAPCOA”) Handbook for Analyzing Greenhouse Gas Emission Reductions, Assessing Climate Vulnerabilities, and Promoting Health and Equity (December 2021). SGVCOG has been collaborating with the consultant Fehr & Peers to develop a new scope of work for the five-year update and maintenance of the instrument.
The Amendment, which can be found as Attachment A, identifies the term, services, and costs associated with the update. The Scope of Work details the services to be performed by Fehr & Peers and by the SGVCOG as project manager, including the costs for each.
FISCAL IMPACT
After receiving confirmation from 24 cities to participate in the study, the SGVCOG confirmed that the total cost per city to participate in the study would not exceed $15,000 for the entirety of the five-year contract (including the update phase and maintenance and SGVCOG project management costs). Funding is available in the Fiscal Year 2023-24 budget from the Gas Tax fund.
RECOMMENDATION
It is recommended that the City Council: (1) approve Amendment No. 2 to Memorandum of Agreement with the San Gabriel Valley Council of Governments; and (2) authorize the City Manager to execute the Amendment on behalf of the City.

TO
MEMORANDUM OF AGREEMENT BETWEEN THE SAN GABRIEL
VALLEY COUNCIL OF GOVERNMENTS AND THE CITY OF LA
PUENTE FOR PARTICIPATION OF THE SAN GABRIEL VALLEY
REGIONAL VMT ANALYSIS MODEL
This Second Amendment to Memorandum of Agreement (“Amendment No. 2”) is made and entered into as of date executed by both parties, by and between the San Gabriel Valley Council of Governments, a joint powers authority (“SGVCOG”) and the City of La Puente (“City”) with reference to the following:
A. SGVCOG and the City entered into that certain Memorandum of Agreement dated as of April 9, 2020, which is incorporated herein by this reference (the “MOA”).
B. The MOA assigned various responsibilities to the parties wherein the SGVCOG was to retain a consultant to create a program for cities, including the City, to implement a Regional VMT Analysis Model (PROGRAM) to streamline the City’s VMT-related impact analyses and ensure successful compliance with Senate Bill 743.
C. SGVCOG’s consultant performed analysis and created a Regional VMT Model and Assessment Tool which the City was able to utilize for the purposes set forth in the MOA, which was based on the Southern California Associated Governments (SCAG) RTP Model (2016).
D. SCAG has adopted a new model, the RTP Model (2020), which was not available prior to the regulatory deadline for implementing Senate Bill 743 and at the time the SGVCOG’s consultant created the Regional VMT Model and Assessment Tool.
E. The effect of SCAG’s adoption of the new model is that the Regional VMT Model and Assessment Tool created by the SGVCOG’s consultant, if used by the City, may not meet requirements of the California Environmental Quality Act (CEQA), which requires the most current available data when a project’s environmental impacts are being analyzed.
F. SGVCOG and the City desire to have the SGVCOG’s consultant update the Regional VMT Model and Assessment Tool so it can continue to be used to fulfill the purpose set forth in the MOA.
NOW, THEREFORE, the Recitals are made a substantive part of this Agreement and the Parties further agree as follows:
1. Defined Terms. Except as otherwise defined herein, all capitalized terms used herein shall have the meanings set forth for such terms in the MOA.
2. Revised Scope of Services. Exhibit "A" of the Agreement entitled “Scope of Work”, is modified to include additional services as outlined in Exhibit “A”, attached hereto and
ATTACHMENT A
incorporated herein by this reference.
3. Term of MOA. The term of the MOA as set forth in Article I, thereof, shall be extended up to and including April 1, 2028.
4. Responsibilities of the Parties.
Article II.A. Subsection 7 shall be deleted in its entirety and replaced with the following:
“7. Submit three invoices to the City, in an amount that does not exceed $29,329.00, as follows:
The payment of the first invoice will be due within thirty (30) days upon the City’s receipt of the first invoice for $12,229.00.
The payment of the second invoice in an amount that does not exceed $550.00 will be due by September 30, 2020 and a third invoice that does not exceed $550.00 will be due by September 30, 2021, following City’s receipt of the invoices from SGVCOG.
The payment of the fourth invoice will be due by July 31, 2023 for an amount that does not exceed $15,000.00.”
Article II.A setting forth SGVCOG’s responsibilities shall be amended to add the following:
“8. Amend the contract with its consultant to update the PROGRAM based on the SCAG RTP Model (2020) to fulfill the purpose of the MOA.”
5. Other Terms and Conditions. Article VII of the MOA shall be amended to add the following:
L. Should the data utilized to update the PROGRAM as set forth in this Amendment No. 2 be revised at some point in the future in such a manner that the SGVCOG reasonably determines has rendered the PROGRAM noncompliant with CEQA, the SGVCOG may discontinue the PROGRAM or upon further amendment to the MOA, the SGVCOG and City may agree to update the PROGRAM.
6. Integration. This Amendment No. 2 and all attachments hereto (if any) shall integrate all of the terms and conditions mentioned herein, and supersede all negotiations with respect hereto. This Amendment No. 2 amends, as set forth herein, the Agreement and except as specifically amended hereby, the Agreement shall remain in full force and effect. To the extent that there is any conflict or inconsistency between the terms and provisions of this Amendment No. 2 and the terms and provisions of the Agreement, the terms and provisions of this Amendment No. 2 shall control.
IN WITNESS WHEREOF, the Parties hereby enter into this Amendment No. 2 upon the Effective Date as is set forth above.

Scope of Work
A. Consultant Work
For purposes of this Scope of Work, the term “Client” shall mean the SGVCOG and those member agencies which have entered into an agreement with SGVCOG to share in the cost of the Scope of Work set forth herein. During the term of the Agreement, and pursuant to its terms and conditions, Fehr & Peers (F&P) agrees to provide to Client the following services and deliverables:
Work Product
F&P will perform tasks necessary to update the VMT Assessment Tool. F&P will also perform tasks necessary to update existing city thresholds for VMT impacts under CEQA, as required by SB 743. SGVCOG’s VMT Assessment Tool was developed in 2020 and is based on the SCAG RTP Model (2016), which is a TransCAD model. The SCAG RTP Model (2020), which is an activity-based model (ABM), was not available prior to the regulatory deadline of July 1, 2020, for implementing SB 743. CEQA requires the most currently available data be used for conducting environmental impact analyses, as such, this scope of work describes updates to the SGVCOG VMT Assessment Tool to reflect the current SCAG RTP Model (2020) and the updated CAPCOA Handbook for Analyzing Greenhouse Gas Emission Reductions, Assessing Climate Vulnerabilities, and Advancing Health and Equity (December 2021) (GHG Handbook).
TASK 8: PROJECT MANAGEMENT, COORDINATION, AND MEETINGS
Task 8.1 Kickoff Meeting
F&P will attend a kick-off meeting with SGVCOG staff. The purpose of the meeting will be to discuss the goals, objectives, and member cities’ expectations for the study.
This meeting will cover an overview of the scope, schedule and deliverables for the Project as follows:
• Staffing
• Schedule
• Subarea engagement
• Actions local jurisdictions may need to consider (e.g., potential changes to thresholds and baselines)
F&P will also discuss and outline the key questions that will need to be addressed as part of this effort:
How will the change to ABM affect VMT estimates and forecasts? What VMT reduction strategies are considered feasible for mitigation purposes under the updated CAPCOA Guidance?
How will the Tool be updated to reflect these changes to VMT calculations/forecasts and mitigation options?
If the SGVCOG member agencies, SCAG, and/or Metro implement a VMT bank option, can the Tool be updated to calculate the VMT fee to mitigate a project? Additionally, F&P will discuss communications protocol, invoicing requirements, and other key items to ensure the project is initiated correctly. Deliverable 1.1.1: Kickoff Meeting documentation and action items Task 8.2 Regular Status Update Meetings
F&P staff will prepare for and attend up to twelve (12) internal meetings, coinciding with Tasks 2, 3, and 4, with the SGVCOG Project Manager (and other SGVCOG staff as identified) (once to twice a month depending on activity), which will be conducted by Teams calls. These meetings will cover status updates on deliverables, any upcoming meetings with cities/subareas, and budget/invoicing. F&P have found that such meetings are critical to making decisions over the course of the project.
Deliverable 1.2.1: Twelve (12) Monthly Meeting agendas, minutes, and action items Task 8.3 Agency Coordination
In addition to the kick-off meeting and internal status update meetings, F&P will participate in five (5) meetings with member agency staff to discuss the outcome of Task 2. Notes on action items and project decisions shall be documented and provided to the SGVGOC Project Manager within two weeks of the meeting. Agendas will be prepared by mutual agreement between F&P and the SGVCOG Project Manager and distributed by SGVCOG. Meeting arrangements will also be made by SGVCOG.
Deliverable 1.3.1: Five (5) Stakeholder Meeting agendas, presentations, meeting minutes, and list of action items
TASK 9: PREPARE DATA FOR VMT TOOL UPDATE
Task 9.1 SCAG Coordination and Development of VMT Methodology Using SCAG ABM
The initial step will be to review the current baseline data derived from the SCAG ABM model for Los Angeles County and compare it with data derived from the SCAG 2016 RTP (TransCAD model). The comparison will cover existing and future VMT data for the following metrics:
Citywide VMT
VMT per capita
Household VMT per capita
Work VMT per employee
VMT per service population
This analysis will require close coordination with SCAG staff to appropriately convert the ABM outputs (using scripts) for incorporation into the SGVCOG VMT Assessment Tool.
This review and comparison will provide the basis for assessing and potentially updating the preferred VMT screening and threshold options in the subsequent portions of this task.
The VMT accounting between the SCAG ABM Model and the 2016 RTP TransCAD model are different. For example, the 2016 RTP TransCAD model uses home-based trips in the VMT per capita calculation (trip-based VMT) and the ABM model uses the home-based tours in the calculation, as illustrated in the following graphics. F&P will provide a detailed description of each metric and describe the differences in the calculations derived from the two models.
Deliverable 2.1.1: SCAG RTP 2020 baseline model run.
Deliverable 2.1.2: SCAG RTP 2040 model run.
Deliverable 2.1.3: Comparison of SCAG RTP 2016 (existing model runs prepared for SGVCOG Tool) to SCAG RTP 2020 model runs.
Deliverable 2.1.4: Draft Technical Memorandum on Baseline VMT Methodology and Baseline Data Comparison of the SCAG 2016 RTP and SCAG 2020 RTP model outputs. The memo will include documentation of coordination with SCAG. Deliverable 2.1.5: Final Technical Memorandum on Baseline VMT Methodology and Baseline Data Comparison of the SCAG 2016 RTP and SCAG 2020 RTP model outputs. The memo will include documentation of coordination with SCAG.
Task 9.2 Develop VMT by Zone and Regional Averages
F&P, in coordination with SCAG, will develop VMT outputs by traffic analysis zone (TAZ), city, subarea, and the SGVCOG region using the SCAG 2020 RTP/SCS Activity Based Model (ABM). This effort will require development, review, and approval of scripts, review of TAZ VMT outputs, and aggregation of TAZ VMT outputs to develop city, subarea, and subregional averages by VMT type.
Deliverable 2.2.1: SCAG Coordination Meeting Notes
Deliverable 2.2.2: Excel file with ABM outputs for each member agency, each subarea, SGVCOG region, and SCAG region
Deliverable 2.2.3: Draft Memorandum documenting SCAG 2020 RTP/SCS ABM Outputs for different jurisdictional boundaries (city, subarea, and SGVCOG region) Deliverable 2.2.4: Final Memorandum documenting SCAG 2020 RTP/SCS ABM Outputs for different jurisdictional boundaries (city, subarea, and SGVCOG region) Task 9.3 Summary of SCAG 2020 ABM Updated VMT Metrics
Fehr & Peers will prepare information that will be shared with each participating member city to provide the differences in the VMT outputs (SCAG 2016 vs SCAG 2020). In addition, F&P will produce maps to show where the VMT screening outcome is different between SCAG 2016 vs SCAG 2020 (for example, places that were VMT efficient under SCAG 2016 and are not longer under the SCAG 2020 ABM model and visa versa). Note that the Task 1.3 Agency Coordination meeting would happen as part of this sub-task to discuss the next steps and whether changes to their thresholds would be needed (see Task 3). Deliverable 2.3.1: Technical Memorandum and Maps Template Deliverable 2.3.2: Twenty-eight (28) Technical Memorandums (one for each participating member agency) with maps documenting the comparison of SCAG 2016 RTP/SCS TransCAD and SCAG 2020 RTP/SCS ABM VMT outputs for different jurisdictional boundaries (city, subarea, SGVCOG region, and SCAG region) Task 9.4 Review List of TDM Strategies To Support Updating the VMT Assessment Tool To Reflect the 2021 CAPCOA GHG Handbook
The existing SGVCOG VMT Assessment Tool incorporated the CAPCOA guidance from 2010 into the mitigation function of the tool. CAPCOA identified a number of GHG/VMT reduction strategies (e.g., travel demand management or TDM measures) accompanied by methods to estimate VMT reduction. This guidance has since been superseded by the new CAPCOA Handbook for Analyzing Greenhouse Gas Emission Reductions, Assessing Climate Vulnerabilities, and Advancing Health and Equity (December 2021). The new guidance reduces the number of VMT reduction options, and it generally reflects a more conservative VMT estimation for various TDM options. F&P will provide a summary of the changes between the 2010 and 2021 CAPCOA guidance and provide recommendations for updates needed in the VMT Assessment Tool to reflect the latest guidance. Deliverable 2.4.1: Draft Technical Memorandum Describing Changes in CAPCOA Guidance and Recommendations for Updating the VMT Assessment Tool with the current data.
Deliverable 2.4.2: Final Technical Memorandum Describing Changes in CAPCOA Guidance and Recommendations for Updating the VMT Assessment Tool with the current data.
TASK 10: VMT THRESHOLDS AMENDMENTS FOR PARTICIPATING CITIES F&P will share and discuss the results of Task 2 with participating cities (indicated as the Task 1.3 Agency Coordination meetings). These discussions will focus on similarities or differences between the VMT estimates calculated by each model. In addition, F&P will discuss the changes in CAPCOA guidance and recommendations for updating the VMT Assessment Tool. F&P will prepare recommendations for each city, which may include revisions to adopted baselines (e.g., city, subarea, SGVCOG region), updates to project screening, and/or changes to the adopted thresholds. In addition, F&P will confirm which TDM measures from the CAPCOA 2021 GHG Handbook should be included.
F&P will also discuss the state of the practice as it relates to establishing VMT thresholds throughout the State of California and within the Southern California Region.
Based on the outcome of Task 2, some participating cities may wish to update their VMT baseline, significance thresholds, or the geographic area that the thresholds are based on. The following tasks are provided for those participating agencies that wish to make changes and/or present the new findings to stakeholders/elected officials.
Task 10.1 Staff Reports and Public Hearings Support
For participating cities that request changes to their baseline or significance thresholds, F&P will support amendments to adopted thresholds by assisting with staff reports, preparing presentations for public hearings, and/or presenting at public hearings. Deliverable 3.1.1: VMT threshold recommendations for each participating city provided as a brief memorandum (executive summary of the Task 2 deliverables with brief recommendations tailored to each city)
Deliverable 3.1.2: Staff report/presentation support for up to 28 participating cities Deliverable 3.1.3: Presentations at 56 public hearings for up to 28 participating cities (56 virtual meetings)
Task 10.2 Update Thresholds of Significance in the VMT Assessment Tool As part of Task 4 (VMT Assessment Tool Updates), F&P will incorporate changes to baseline or significance thresholds requested by participating cities. All Tool updates will be completed at one time for all cities that request a change to ensure the most efficient use of programming time.
Deliverable 3.2.1: Update VMT thresholds in the SGVCOG VMT Assessment Tool Task 10.3 Update TIA Guidelines
F&P will update the TIA guidelines for each of the participating cities (as-needed) to reflect changes to VMT baselines or thresholds of significance. Deliverable 3.3.1: Update the VMT sections of the TIA guidelines for each participating city, as needed to reflect amendments to VMT significance thresholds.
TASK 11: VMT ASSESSMENT TOOL UPDATE
F&P will utilize the results of Tasks 2 and 3 to update the SGVCOG VMT Assessment Tool.
Task 11.1 Prepare Data for Tool Update
F&P will use the results of Task 2 to update the VMT data in the SGVCOG VMT Assessment Tool.
Deliverable 4.1.1: Summary of Data Scripts
Task 11.2 VMT Assessment Tool Updates
F&P will update the VMT Assessment Tool to reflect the changes. In addition, the tool documentation will be updated to reflect changes to the tool. This task assumes one round of review and revisions of updated tool.
Deliverable 4.2.1: Update the SGVCOG VMT Assessment Tool’s (version 1.0) documentation (metadata) to reflect updates
Deliverable 4.2.2: Update the SGVCOG VMT Assessment Tool (version 1.0) to reflect the 2020 RTP/SCS ABM and the 2021 CAPCOA guidance (based on Task 4.1 data preparation)
Deliverable 4.2.3: Provide Beta version of the tool (SGVCOG VMT Assessment Tool version 2.0
- beta) for review by participating cities.
Deliverable 4.2.4: Updated “for publish” SGVCOG VMT Assessment Tool version 2.0 based on 1 round of comments on the Beta version (up to 12 staff hours).
TASK 12: VMT ASSESSMENT TOOL DOCUMENTATION, HOSTING, UPDATES, AND MAINTENANCE; AND TECHNICAL USER (HELPDESK) SUPPORT
Task 12.1 Website Development
Modify the SGVCOG VMT Assessment Tool website to reflect updates to references (SCAG RTP 2020 and CAPCOA 2021), updates to metadata, and any other changes requested by SGVCOG and/or its participating member agencies.
Deliverable 5.1.1: Update the VMT Assessment Tool website to reference updates.
Task 12.2 Documentation, Regular Maintenance, and Annual Assessor Parcel Number updates
Fehr & Peers will continue to host, update, and maintain the current SGVCOG VMT Assessment Tool up until the updated Tool is available. F&P will document all changes to the Tool and provide this information to all Tool users. Due to changes implemented by ESRI, F&P is required to host the tool in a cloud hosted environment with its own license F&P will manage for SGVCOG. The annual cost of hosting will be passed through directly to SGVCOG with no mark-ups by F&P. The new cloud-based format is anticipated to provide more stability, faster computing, and a safer environment for the SGVCOG VMT Assessment Tool and provides opportunity for SGVCOG to host additional spatial resources in the same environment only for the cost of production. F&P will manage the ESRI licensing requirements, monitor and maintain the tool, provide all data updates in the tool, and implement and manage the hosting agreement with Azure. SGVCOG requested a five-year hosting agreement; however, given the unknown potential cost updates that either ESRI or Azure may implement each year, the costs for these are shown as actual year one costs only.
Future year invoices for software and hosting by ESRI and Azure, respectively, will be passed through directly to SGVCOG. The budget shows an estimate for future year costs, but this is only an estimate.
At the end of the 5-year period, F&P will prepare the SGVCOG VMT Assessment Tool for Transfer to SGVCOG unless a contract extension is executed. Note that major updates that are not already addressed in this scope (such as incorporating new versions of the model data/new TDM measure guidance in upcoming years) will require a separate scope/budget.
F&P anticipate that there will be updates necessary to reflect the 2024 SCAG So Cal Connect Plan since the model will be updated as part of the process. F&P anticipate that the model will remain an activity-based model (ABM) in the same modeling platform as used for the 2020 SCAG RTP/SCS. F&P expect that updating the tool with the 2024 RTP data will be relatively straightforward and that F&P can use the same scripts that are developed in Tasks
2.1/2.2 to convert the 2024 model output into the format needed to flow into the tool. F&P have included some additional budget for updating to the 2024 model data. Note that this scope does not include major updates resulting from the model type/version changing, or if the results from the model drastically change requiring additional coordination with cities. Deliverable 5.2.1: Continue to host, update, and maintain the SGVCOG VMT Assessment Tool V.1.0 until the Update is completed
Deliverable 5.2.2: Host, update, and maintain the SGVCOG VMT Assessment Tool (V.2.0) in new cloud environment for five years beginning on the date of public release. Maintenance includes updating the tool to reflect the 2024 SCAG So Cal Connect Plan (assuming that the data is available within the five-year maintenance period)
Task 12.3 Technical (Helpdesk) Support
This contract includes approximately 24 staff hours per year over the 5-year period for technical support. F&P will notify the project manager when they have utilized 16 hours in a given year. Helpdesk will be billed on an hourly basis. Deliverable 5.3.1: Operate Helpdesk
Deliverable 5.3.2: Document helpdesk requests and responses for inclusion in progress reports that accompany invoices

AGENDA ITEM NO. D-5
To: Mayor and City Council For meeting of: May 09, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: CONSIDERATION OF A CAPITAL RESERVE AGREEMENT BETWEEN THE
CITY OF LA PUENTE AND THE LOS ANGELES COUNTY METROPOLITAN
TRANSPORTATION AUTHORITY FOR THE USE OF PROPOSITION C LOCAL
RETURN FUNDS IN CONJUNCTION WITH THE AMAR ROAD COMPLETE
STREETS PROJECT
BACKGROUND
On July 13, 2021, the City Council received a presentation from the Los Angeles County Department of Public Works proposing a partnership for the purpose of funding the Amar Road Complete Streets project. This capital project entails roadway enhancements, pedestrian and bike improvements, and safety upgrades along the Amar Road corridor within both the City and County rights-of-way. The project is currently in the early design phase with construction anticipated to begin in the summer of 2025.
DISCUSSION
The Los Angeles County Metropolitan Transportation Authority (“MTA”) allows jurisdictions to accumulate local return funds past their lapsing date by establishing a special reserve account set aside for large capital projects. Under normal circumstances, Proposition C Local Return funds must be expended within four (4) years of their remittance to the local agency to satisfy the “timely use of funds” requirement, or risk being returned to the MTA. The proposed Capital Reserve Agreement would provide a mechanism for the City to retain its Proposition C funds until June 30, 2027, and dedicate them towards the Amar Road Complete Streets Project. The project and Agreement have already received approval by the MTA Board of Directors.
FISCAL IMPACT
Staff projects the Proposition C fund balance to be approximately $3,370,800 as of June 30, 2023.
Of this amount, up to $3,000,000 may be reserved through this Agreement for project expenditures associated with the Amar Road project.

CAPITAL RESERVE AGREEMENT
This Capital Reserve Agreement (this “Agreement”) is entered into as of June 30, 2022, by and between the Los Angeles County Metropolitan Transportation Authority (“LACMTA”) and the City of La Puente (the “City”).
RECITALS:
A. The City receives Proposition C local return funds (the “Local Return Funds”) from LACMTA.
B. Pursuant to the Proposition C Local Return Guidelines (the “Guidelines”), which are incorporated herein by reference, the City has four years, beginning the last day of the Fiscal Year in which funds were originally allocated, to expend the Local Return Funds. By method of calculation, each jurisdiction has three years plus the Fiscal Year of allocation to expend the Local Return funds. This period is identified in the Guidelines as Timely Use of Funds.
C. As of Fiscal Year 2021-22, the City desires to commit and accumulate its Local Return Funds beyond the Timely Use of Funds period in order to provide the funds for a Amar Road Complete Streets Project as more particularly described in City’s project description attached hereto as Exhibit A (the “Project”).
D. The LACMTA Board at its June 15, 2022, board meeting approved the City’s establishment of a capital reserve fund for the Project.
NOW, THEREFORE, the parties hereby desire to agree to the following terms and conditions:
AGREEMENT
1. The City acknowledges that establishing a capital reserve fund for the Project constitutes a long term financial and planning commitment.
2. The City shall establish a separate interest bearing account or sub-account to be designated as the Capital Reserve Account for the Project. The City desires to set aside $3,000,000 Proposition C of its Local Return Fundsinto the Capital Reserve Account. Commencing with Fiscal Year 2021-22 and for each Fiscal Year thereafter, the City shall deposit into the Capital Reserve Account the amount specified in its Project Annual Update submitted to LACMTA for that fiscal year, provided, however, if the City fails to submit its Project Annual Update, the City shall deposit into the Capital Reserve Account its Local Return Funds in an amount equal to the amount deposited into the Capital Reserve Account for the immediately preceding fiscal year. In no event will the total aggregate amount deposited by City into the Capital Reserve Account exceed $3,000,000 Proposition C.
3. All interest accruing on the Capital Reserve Account shall remain in such account.

4. The City shall complete the Project by June 30, 2027. If the Project is not completed by this date, any unexpended funds shall lapse and be returned to LACMTA for further programming.
5. The City shall comply with all terms and conditions for the Capital Reserve Account as provided in the Proposition C Local Return Guidelines, including, without limitation, the following:
A. Each fiscal year updating the project’s annual expenditures by submitting an Actuals form in the Local Return Management System (LRMS)
B. Every five years commencing with the Commencement Date of this Agreement, LACMTA will evaluate the Capital Reserve Account, the status of the Project and the projected amount of available funds. Based on this evaluation, LACMTA may require the City to take certain actions including, without limitation, terminating the Capital Reserve Account.
C. If the City uses the Local Return Funds in the Capital Reserve Account for a project different from the Project described above, the City shall return an amount equal to the improperly used funds to the Proposition C Central Account held by LACMTA.
If the City fails to return the amount within 30 days from the date LACMTA notifies City that it must return the funds, the City hereby authorizes LACMTA to offset future Local Return allocations to the City in an amount equal to the improperly used funds.
D. If the City fails to complete the Project as specified by the date in paragraph 4 above, the Local Return Fundsin the Capital Reserve Account may be subject to lapse unless otherwise agreed to in writing by the parties.
E. If the Project is a rail project, LACMTA may decide that the rail corridor is no longer a high priority. LACMTA can then terminate this Agreement and the City shall:
(i) close the Capital Reserve Account and return the outstanding balance of the Capital Reserve Account, including accrued interest (the “Returned Funds”), to the City’s local return account; and
(ii) reprogram the Returned Funds to be used within three years from the termination date of this Agreement. Any funds remaining after such threeyear period shall lapse.
F. If the City, independent of LACMTA action, desires to reprogram all or part of the funds in the Capital Reserve Account, the City must prior to such reprogramming, receive LACMTA’s written approval. The City shall provide LACMTA with notice of its desire to reprogram the funds in the Capital Reserve Account and indicate the proposed use of the funds to be reprogrammed and the effect of such reprogramming MOUCRAMLAP22

on the Project. LACMTA approval may be based on, among other things, whether after exhausting all Local Return funds, additional funds are necessary to meet the City’s critical immediate or pending transit needs. If LACMTA approves reprogramming the funds, this Agreement shall be amended or terminated as appropriate. If LACMTA does not approve reprogramming the funds, the City must continue the Capital Reserve Account as provided herein or draw the funds down for LACMTA approved capital related project.
6. This Agreement shall commence on June 30, 2022. This Agreement shall continue until such time as terminated by either party with a 30 day written notice under the conditions set forth in the Proposition A and Proposition C Local Return Guidelines.
