AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: June 13, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
William C. Pagett, City Engineer
SUBJECT: CONSIDERATION OF ACCEPTANCE OF NOTICE OF COMPLETION FOR
CONSTRUCTION SERVICES WITH NPG CORPORATION FOR
COMMUNITY CENTER PARKING LOT IMPROVEMENTS
BACKGROUND
On November 15, 2022, the City Council awarded a construction contract to NPG Corporation in the amount of $200,989 to complete the Community Center Parking Lot Improvements Project (“Project”). The contract award also included a 10 percent contingency of $20,099 to cover any quantity adjustments and/or unforeseen construction items.
DISCUSSION
On January 9, 2023, NPG Corporation commenced work on the Project and the Project was completed on May 12, 2023. The Project consisted of color stamped concrete, crack seal and seal coat, curb ramps, asphalt paving, bollards, signing and striping, and curb markings.
The contractor’s bid price for this Project was $200,989. During construction, there were three change orders that amounted to $59,947. Change Order No. 1 ($20,000) included the removal and replacement of stamped concrete areas; patching the chipped curbs; constructing a walk path through the raised islands; and additional pavement milling and overlay work to meet ADA standards. Change Order No. 2 ($28,155) involved the removal of saturated soils underneath the ADA parking lot area, treatment with cement stabilization product, and regrading and compaction of treated soils. Change Order No. 3 ($11,792) involved the removal of saturated soils underneath the ADA curb ramp areas, and replacement with crushed aggregate base material.
The total construction cost for this Project was $260,936, which is 29.8% above the original contract amount due to the necessary change order work discussed above. At the meeting of February 7, 2023, the City Council approved Change Orders No. 2 and 3 in the amount of $39,947, thereby authorizing the additional work.

CONSTRUCTION SERVICES WITH OPPENHEIMER NATIONAL FOR THE
COFFEE SHOP KIOSK INSTALLATION AT LA PUENTE PARK
BACKGROUND
On February 28, 2023, the City Council awarded Oppenheimer National a $64,425.80 construction contract, inclusive of change orders up to 10% of the original bid amount, for the installation of a coffee shop kiosk at La Puente Park (the "Project").
DISCUSSION
Oppenheimer National (“Oppenheimer”) began the Project on April 6, 2023, and it was completed on June 7, 2023. The project included the delivery of a modified shipping container ("Container") from the manufacturer located in Ventura County to La Puente Park. Pouring of a 60’ x 26’ 4-inch-thick concrete slab and placement of the Container on the slab; installation of a new sewer line connecting the Container to an existing VCP sewer line in the park, and connection of the Container electrical and water lines to existing utilities already in place at the location.
Due to the grade surrounding the Project site and layout design, a change order in the amount of $5,809.80 was required for additional concrete work for the concrete slab. The total construction cost for this project was $70,235.60, which is 8.6% above the original contract amount due to the change order work discussed above.
FISCAL IMPACT
The total cost for this Project was $70,235.60. Funding for this project was available from the FY 2022-23 Miscellaneous Grant Fund.

AGENDA ITEM NO. D-5
To: Mayor and City Council For meeting of: June 13, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
SUBJECT: CONSIDERATION OF AMENDMENT NO. 4 TO THE PROFESSIONAL SERVICES AGREEMENT WITH WEST COAST ARBORISTS, INC. FOR STREET TREE
TRIMMING AND URBAN FORESTRY SERVICES
BACKGROUND
At the meeting of August 11, 2020, the City Council approved Amendment No. 2 to the Professional Services Agreement (“Agreement”) with West Coast Arborists, Inc. (“WCA”) to extend the term to June 30, 2022. The rates for Amendment No. 2 were kept at the same rates approved by the City back in October 2018. WCA agreed to keep the rates constant during the 2-year term of Amendment No. 2.
At the meeting of June 28, 2022, the City Council approved Amendment No. 3 with WCA to extend the term to June 30, 2023. With approving the Amendment, WCA was approved for a 5% adjustment to their rates.
DISCUSSION
Amendment No. 3, which will expire on June 30, 2023, allows the City the option of renewing the Agreement for an additional, one-year term. WCA has requested the City’s consideration to exercise its option to extend the Agreement another year and has request a modest increase to their rates of 3.80% for the 12-month period.
The most regularly used service of WCA is the annual grid pruning of residential (as well as commercial) parkway trees. Under the current Amendment No. 3, the fee per tree for grid pruning is $66.65. For the proposed Amendment No. 4, the rate adjusts to $69.20 per tree, or an increase of $2.55 per tree. For this coming fiscal year, the City will trim approximately 1,650 parkway trees as part of the annual grid pruning. With the rate increase noted above the cost will increase $4,207.50 for Fiscal Year 2023-24.
The City continues to receive quality tree trimming services from WCA while their staff maintains a positive working relationship with City staff. Their field staff is very responsive to meeting the service level needs of the City, especially when the need arises for emergency tree trimming and removal services in the evenings and on the weekends.

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: June 13, 2023 From: Bob Lindsey, City Manager
By: John Di Mario, Director of Development Services
SUBJECT: CONSIDERATION OF APPOINTMENTS TO THE PLANNING COMMISSION
BACKGROUND/DISCUSSION
At the meeting of June 28, 2022, the City Council reappointed Daniel Stowell and Marty Paz to a two-year term on the Planning Commission and left a vacant seat unfilled. The vacant unfilled seat was as a result of former Commissioner Nadia Mendoza being appointed to the City Council. In May 2023, Commissioner Daniel Stowell resigned from his seat on the Planning Commission due to relocating outside of La Puente. Commissioner Stowell’s seat is set to expire in June of 2024. Additionally, terms of office for the two seated Planning Commissioners, Gary Dudley and Allen Maes, will expire on June 13, 2023.
In response to the above noted expiration of terms and vacancies on the Planning Commission, the City issued a Notice of Vacancies (“NOV”) requesting interested residents to apply for consideration of appointment to the Commission. The City received completed applications from incumbents Gary Dudley and Allen Maes seeking reappointment to the Planning Commission for a two-year term expiring in June 2025. Both incumbents meet the requirements as set forth in the La Puente Municipal Code to be considered for reappointment and Staff would recommend reappointment at this time.
In addition, the City also received completed applications from five other individuals in response to the NOV. Interviews of the five applicants to be considered to fill the additional 2 vacant seats will occur at a future City Council meeting.
Planning Commissioners are appointed by a majority vote of the City Council pursuant to Section 2.16.020 of the La Puente Municipal Code.
RECOMMENDATION
It is recommended that the City Council reappoint Gary Dudley and Allen Maes to the Planning Commission for a two-year term.
