SUBJECT: PRESENTATION OF AUGUST 2023 INVESTMENT REPORT
BACKGROUND
This report presents the City’s investment portfolio for the period of August 2023. The attachment provides details of the City’s portfolio. It has been prepared to comply with regulations contained in California Government Code Section 53600 and the Statement of Investment Policy approved by the City Council on May 23, 2023.
The investment objectives of the City of La Puente are first, to provide safety of principal to ensure the preservation of capital in the overall portfolio, second, to provide sufficient liquidity to meet all operating requirements, and third, to earn a commensurate rate of return consistent with the constraints imposed by the safety and liquidity objectives.
The City follows the practice of pooling cash and investments for all funds under its direct control.
Interest earned on pooled cash and investments is allocated to the various funds based on the respective fund’s average quarterly cash balance. It is common for governments to pool the cash and investments of various funds to improve investment performance. By pooling funds, cities are able to benefit from economies of scale, diversification, liquidity and ease of administration.
DISCUSSION

FISCAL IMPACT
Idle cash invested in certificates of deposit, government securities, and corporate bonds typically return higher yields than LAIF (Local Agency Investment Fund). This maximizes returns without assuming substantial additional risk.
SUMMARY
In summary, the City has conservatively placed its investment portfolio in LAIF, federal agency securities, corporate bonds, and certificates of deposit. The portfolio complies with the Statement of Investment Policy and the City has the ability to meet its expenditure requirements for the next six months.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

On April 24, 2018, the City Council adopted several ordinances and accompanying resolutions amending the City’s purchasing procedures to streamline and make the procurement process more efficient. One of the amendments to the purchasing procedures was a provision setting a $5,000 spending limit for Department Heads and a separate provision increasing the City Manager’s spending limit to $20,000 for professional services, supplies and equipment. In order to document purchases approved by the City Manager and/or Department Heads the City Council directed that a monthly report be prepared and filed with the City Council. This action is to receive and file the requisition summary report for the month of August 2023.
DISCUSSION
City staff initiated ten (10) requisitions during the month totaling $27,651.96.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

AGENDA ITEM NO. D-4
To: Mayor and City Council For meeting of: September 26, 2023 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF APPROVAL OF A PURCHASE ORDER CONTRACT WITH
UNITED RENTALS FOR THE PURCHASE OF A MOBILE GENERATOR AND
UTILITY TRAILER TO BE USED THROUGHOUT THE CITY
BACKGROUND/DISCUSSION
City Staff are recommending the purchase of mobile generator and utility trailer noted in sales quotes no: 224718647 (Attachment A) and 224718563 (Attachment B) to be purchased from United Rentals.
This equipment will be used throughout the City for emergency power outages. The equipment can also be used for park and special events like the concerts in the park, movies in the park, or the parade.
By having a generator of our own we can cut costs on all generator rental expenses for recurring and future events or emergencies. A generator of this size can power the essential operating functions of an entire building if the building is equipped with a panel that can be connected to the generator.
The equipment will be awarded through a competitively bid contract (Master Contract #062320-URI) by Sourcewell (formerly the National Joint Powers Alliance). Sourcewell is a public agency service cooperative that serves over 50,000 members. Through national solicitations, they provide the opportunity for members to purchase through nationally leveraged, competitively bid contracts.
Sourcewell contracts offer a multitude of products, equipment, and services to government agencies and non-profit entities. The City of La Puente is a member of Sourcewell and has used Sourcewell contracts in the past. Section 2.20.090 (e) of the La Puente Municipal Code authorizes the City to participate in cooperative purchasing plans or programs such as Sourcewell.
FISCAL IMPACT
The total purchase price for the mobile generator and utility trailer including tax and delivery is $51,150.00 and will be paid for using General funds that were appropriated for this equipment at the council meeting on August 22, 2023.
RECOMMENDATION
It is recommended that the City Council: (1) approve the purchase order contract with United Rentals for the purchase of a mobile generator and utility trailer; and (2) authorize the City Manager to execute, on behalf of the City, all documents necessary to effectuate this action.

SUBJECT: PRESENTATION OF AUGUST 2023 BUDGET REPORT
BACKGROUND
The City Council adopted the Fiscal Year 2023-2024 Budget and Capital Improvement Program on May 31, 2023. The attached report examines fiscal activity taking place during the month of August 2023 and includes all funds within the operating budget. The report analyzes year-todate transactions in comparison to budgeted amounts for the entire fiscal year, expressing each category using a percentage-of-completion methodology. It additionally provides comparisons in activity level to the same time period last fiscal year.
DISCUSSION
As of August 31, 2023, sixteen (16) percent of the fiscal year has elapsed.
REVENUES
General fund revenues year-to-date total approximately $407,367 or 2.1% of the annual budget.
This is in comparison to $350,590 (1.9%) at this time last fiscal year. The vast majority of tax revenue received in the August period was accrued back to fiscal year 2022/2023, meaning they are not pertinent in the new period and are reported with the prior fiscal period. This is especially true of large-scale receipts such as Sales & Use Tax and Property Tax. On a smaller scale, strong revenues are shown in the Charges for Services category, with an emphasis on recreation programs and building plan check fees.
EXPENDITURES
Year-to-date expenditures in the General Fund are 9.8% of budget, comparable to 7.0% at this time in FY 2022-2023. There are slight increases in expenditures in several departments, with the following justification:
- Administrative Services – increases in insurance premiums for Workers Compensation, Property, and General Liability policies.
- Development Services – addition of the Community Outreach Division (previously funded through a different source). This includes six (6) FT PROS Team members and multiple PT Beautification Program participants and related program expenses.
City of La Puente
AGENDA REPORT
Monthly Budget Report – August 2023
For Meeting of September 26, 2023
- Public Safety – increases staffing levels year-over-year, with a focus on safety and security of families at La Puente Park.
- Community Services – inclusion of Social Media Technology contract, previously funded through a different source.
RECOMMENDATION
It is recommended that the City Council receive and file this report.

SUBJECT: CONSIDERATION OF AN ORDINANCE AMENDING TITLE 8 (BUILDING
REGULATIONS) OF THE LA PUENTE MUNICIPAL CODE ADDING CHAPTER
8.50 SETTING FORTH PROCEDURES FOR AN EXPEDITED PERMIT PROCESS
FOR ELECTRIC VEHICLE CHARGING SYSTEMS
BACKGROUND
On October 8, 2015, the State of California adopted Assembly Bill (“AB”) No. 1236 that added Section 65850.7 to the Government Code requiring local agencies to adopt an ordinance that creates an expedited permitting process for electric vehicle (“EV”) charging stations. AB 1236 requires that local agencies administratively approve EV charging station applications, provide a checklist on the city’s website, and accept applications electronically.
On October 8, 2021, the State of California adopted AB 970, updating Government Code Section 65850.7 and added 65850.71, which specified processing and approval timelines for EV charging station applications. According to AB 970, EV charging station permits may be automatically approved if a local government official takes no action. For a site containing twenty-five (25) charging stations or less, a completeness check shall be performed within five (5) business days, and within ten (10) business days for sites with more than twenty-five (25) charging stations. AB 970 also required local agencies of less than 200,000 in population to adopt an ordinance codifying the provisions of both bills by January 1, 2023.

Although current City procedures are generally consistent with the State law in that the City requires only ministerial review and approvals for EV charging stations, the proposed ordinance (See Attachment “A”, as required by law, will further reinforce ministerial procedures (with exceptions), provide for a streamlined review, and require a checklist be adopted to clarify submittal requirements. Once adopted, the proposed ordinance will require only Building and Safety Plan Check, except for any projects that could result in “specific adverse impacts”. Consistent with AB 1236 and AB 970, projects that could result in specific adverse impacts will require Minor Review of a Site Plan and Design Review application, which may be approved administratively by the Development Services Director.
City of La Puente
AGENDA REPORT
Agenda Report: EV Charging Ordinance
For meeting of: September 26, 2023
Proposed Ordinance
The proposed ordinance would add Chapter 8.50 (Expedited Permit Process for Electric Vehicle Charging Systems) to Title 8 (Building Regulations) of the La Puente Municipal Code, establishing provisions for EV charging stations that include a Purpose, Definitions, Expedited Permitting Process, Permit Application Process, Technical Review, and Electric Vehicle Charging Station Installation Requirements. The expedited procedures established by the ordinance will be applicable to all EV charging systems or stations located on residential or non-residential properties in the City.
EV Charging Application Checklist
Consistent with State law, the proposed ordinance requires that a checklist be adopted and made available on the City’s website to clarify application submittal requirements, materials, and procedures. Several California jurisdictions have opted to make the checklist a required form to assist their staff in verifying completeness. La Puente City staff has determined that doing so will result in additional paperwork that is not currently required. As such, City staff has opted to provide the required checklist as an optional guide to assist the applicant. A draft checklist is attached for future consideration at the second reading of the ordinance and adoption via Resolution by the City Council (See Attachment “B”, Draft EV Charging Application Checklist).
Environmental Assessment
The City Council finds that this Ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines, as it is not a “project” and has no potential to result in a direct or reasonably foreseeable indirect physical change to the environment. (Cal. Code Regs., tit.14, § 15378, subd. (a)(5).) Further, this Ordinance is exempt from CEQA as there is no possibility that it or its implementation would have a significant negative effect on the environment. (Cal. Code Regs., tit.14, § 15061, subd. (b)(3).) Effective Date
If the City Council introduces the proposed ordinance as described in this report, the second reading of the ordinance will be tentatively scheduled for City Council consideration on October 10, 2023, at which time the City Council may also adopt a resolution for the required EV Charging Application Checklist.
The ordinance will take effect and be in full force thirty (30) days from final adoption and passage in accordance with California Government Code Section 36937.
FISCAL IMPACT
No fiscal impact. Fees are already established for the review, approval, and issuance of these types of permits.
RECOMMENDATION
It is recommended that the City Council: (1) waive reading of Ordinance No. 23-983 and read by title only; and (2) introduce Ordinance No. 23-983, an ordinance of the City Council of the City of La Puente amending Title 8 (Building Regulations) of the La Puente Municipal Code adding Chapter 8.50 setting forth procedures for an expedited permit process for Electric Vehicle Charging Systems.

OF LA PUENTE, CALIFORNIA AMENDING TITLE 8
(BUILDING REGULATIONS) OF THE LA PUENTE
MUNICIPAL CODE ADDING CHAPTER 8.50 SETTING
FORTH PROCEDURES FOR AN EXPEDITED PERMIT
PROCESS FOR ELECTRIC VEHICLE CHARGING
SYSTEMS
WHEREAS, the State of California has consistently promoted and encouraged the use of fuel-efficient electric vehicles; and
WHEREAS, the State of California adopted Assembly Bill 1236 and Assembly Bill 970, which requires local agencies to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging systems; and WHEREAS, creation of an expedited, streamlined permitting process for electric vehicle charging stations would facilitate convenient charging of electric vehicles and help reduce the reliance on fossil fuels.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA PUENTE HEREBY FINDS, DETERMINES AND ORDAINS AS FOLLOWS:
Section 1. Findings.
The City Council finds that the above Recitals are true and correct and are incorporated herein by reference.

8.50.010 Purpose.
The purpose of this Chapter is to promote and encourage the use of electric vehicles by creating an expedited, streamlined permitting process for electric vehicle charging stations while

promoting public health and safety and preventing specific, adverse impacts in the installation and use of such charging stations. This Article is also intended to comply with California Government Code Section 65850.7.
8.50.020 Definitions.
For the purpose of this Chapter, the words, terms and phrases as defined in this section shall be construed as hereinafter set forth, unless it is apparent from the context that a different meaning is intended:
A. “Charging station”, “charging system”, or “electric vehicle charging station” means any level of an electric vehicle supply equipment station that is designed and built in compliance with Article 625 of the California Electrical Code, as it reads on the effective date of this Chapter, and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle.
B. “Electronic submittal” means the utilization of one or more of the following:
1. Electronic mail or email.
2. Facsimile.
3. The internet.
C. “Specific, adverse impact” means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete.
8.50.030 Expedited Permitting Process.
Consistent with Government Code Section 65850.7, the Building Official shall implement an expedited, streamlined permitting process for electric vehicle charging stations, and adopt a checklist of all requirements with which electric vehicle charging stations shall comply in order to be eligible for the expedited review. The City’s adopted checklist shall be published on the City’s website.
8.50.040 Permit Application Process.
A. A permit application that satisfies the information requirements in the City’s adopted checklist shall be deemed complete and be promptly processed. Upon confirmation by the Building Official, or his/her designee, that the permit application and supporting documents meets the requirements of the City adopted checklist, and is consistent with all applicable laws and health and safety standards, the Building Official shall, consistent with Government Code Section 65850.7, administratively approve the application and issue all necessary permits.
B. If the Building Official determines that the permit application is incomplete, a written correction notice shall be issued to the applicant within five (5) business days for projects with up to twenty-five (25) charging stations at a single site or within ten (10) business days for projects with twenty-six (26) or more charging stations at a single site. The ORDINANCE NO. 23- PAGE 3 OF 5 __________, 2023
written correction notice shall detail all deficiencies in the application and any additional information required to be eligible for expedited permit issuance. This correction notice may be in the form of a printed document, electronic mail, or “red line” corrections on the submitted plans.
C. Consistent with Government Code Section 65850.7, the Building Official shall allow for electronic submittal of permit applications covered by this Ordinance and associated supporting documentation. In accepting such permit applications, the Building Official shall also accept electronic signatures on all forms, applications, and other documentation in lieu of a wet signature by any applicant, provided that the City has the software necessary to accept electronic signatures.
D. In conjunction with the application process, the applicant shall verify that the installation of an electric vehicle charging station will not have a specific, adverse impact to public health and safety or building occupants. Verification by the applicant includes but is not limited to the following documentation: electrical system capacity and loads; electrical system wiring, bonding and overcurrent protection; building infrastructure affected by charging station equipment and associated conduits; areas of charging station equipment and vehicle parking.
E. In the technical review of a charging station, consistent with Government Code Section 65850.7, the Building Official shall not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association of a common interest development, as that term is defined by Civil Code Section 4080.
F. Approval of the expedited permit does not authorize an applicant to energize or utilize the electric vehicle charging station until the required inspection and approval to energize the system is granted by the City. The inspection shall be performed in a timely manner and include consolidated inspections, if required.
8.50.050 Technical Review.
It is the intent of this Chapter to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations so long as the action does not supersede the Building Official’s authority to address higher priority life-safety situations. If the Building Official makes a finding based on substantial evidence that the electric vehicle charging station could have a specific, adverse impact upon the public health or safety, as defined in this Chapter, the City may require the applicant to apply for a Site Plan and Design Review subject to a Minor Review and consideration by the Development Services Director pursuant to Chapter
10.94 of the Zoning Code.
8.50.060 Electric Vehicle Charging Station Installation Requirements.
A. Electric vehicle charging stations and associated equipment shall meet all applicable health and safety standards and requirements, including but not limited to any requirements imposed by the state and the La Puente Municipal Code, the Los Angeles County Fire Department, the California Electrical Code, the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing ORDINANCE NO. 23- PAGE 4 OF 5 __________, 2023
laboratories such as Underwriters Laboratories, rules of the Public Utilities Commission or an Electric Utility Company regarding safety and reliability, and any applicable Federal laws including the Americans with Disabilities Act.
B. Installation of electric vehicle charging stations and associated wiring, bonding, disconnecting means, and overcurrent protective devices shall meet the requirements of Article 625 and all applicable provisions of the California Electrical Code.
C. Installation of electric vehicle charging stations shall be incorporated into the load calculations of all new or existing electrical services and shall meet the requirements of the California Electrical Code. Electric vehicle charging equipment shall be considered a continuous load.
D. Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations shall meet the requirements of the California Building or Residential Code as applicable per occupancy, and the provisions of the manufacturer’s installation instructions.
Mounting of charging stations shall not adversely affect building elements.
Section 3. CEQA Findings.
(b)(3).) Section 4. Clerical Errors.
The City Council directs the City Clerk to correct any clerical errors found in this Ordinance including, but not limited to, typographical errors, irregular numbering and incorrect section references.
Section 5. Severability.
Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, sentence, clause, and phrase hereof would have been prepared, proposed, approved, and ratified irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid, unenforceable, or unconstitutional.
Section 6. Effective Date.

SUBJECT: CONSIDERATION OF A RESOLUTION NOMINATING A BOARD MEMBER TO
THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY
BACKGROUND/DISCUSSION
The San Gabriel Basin Water Quality Authority (“WQA”) was established by the State Legislature (SB 1679) on February 11, 1993, to develop, finance and implement groundwater treatment programs in the San Gabriel Valley.
The WQA is under the direction and leadership of a seven-member board comprised of one member each from an overlying municipal water district, one from a city with water pumping rights, one from a city without water pumping rights and two members representing water purveyors.
The term of the board member representing cities without pumping rights, Valerie Munoz, expires on January 1, 2024. An election to fill this seat is scheduled for December 20, 2023, at 12:00 p.m. at WQA offices. Cities without pumping rights (Baldwin Park, Bradbury, Duarte, La Puente, La Verne, Rosemead, San Dimas, San Gabriel, San Marino, Sierra Madre, South El Month, Temple City and West Covina) may nominate one candidate, who must be a current city council member.
Resolutions nominating a candidate must be received by the WQA by October 19, 2023.

La Puente, CA 91744
Dear Mayor Klinakis,
My name is Jason Moss, and I am the Executive Director of the Jewish Federation of the Greater San Gabriel and Pomona Valleys. The mission of the Jewish Federation is to build community by strengthening and enhancing Jewish life for the estimated 30,000 – 45,000 Jews living between Glendale and Rancho Cucamonga. We do this by providing programs and services that support the needs of the Jewish community and act as the Jewish voice on issues that affect the greater Jewish community.
It is in this capacity that I am writing you today to share with you that the Jewish community is on edge.
Our country has witnessed an unprecedented spike in antisemitic incidents and attacks over the last several years. In its Audit of Antisemitism Incidents 2021, the Anti-Defamation League (ADL) recorded 2,717 incidents of assault, harassment, and vandalism. The ADL also recently reported that widespread belief in antisemitic conspiracy theories and tropes nearly doubled since 2019 and the highest levels in 30 years. In November 2022, FBI Director Christopher Wray stated, "A full 63% of religious hate crimes are motivated by antisemitism—targeting a group that makes up just 2.4% of our population. Foreign terrorist organizations like ISIS have promoted antisemitic violent extremism for decades.
They continue to target Jewish Americans in their attack plots. But we also confront the threat of people here, on our soil, whose hateful views—often paraded online—boil over into acts of violence."
Locally, over the last year, driveways throughout our community have been strewn with hate-laden flyers, blaming Jews for everything from COVID, "how every aspect of Disney grooming," "Trump's Campaign Funding," and linking Jews to the pornography industry.
And the number of antisemitic verbal attacks and confrontations Jewish students are having in local schools has also dramatically increased. As a result of these incidents and others, along with the pervasiveness of antisemitism online, the Jewish community feels like we are being hit from all sides. The very essence of our right to live as Jews is under attack.
In December 2022, I wrote the enclosed Op-ed expressing the local Jewish community's concern about this latest rise of antisemitism and its impact on people's mental health and well-being.

Antisemitism has emerged at all levels of our society and must be confronted through a multifaceted, targeted approach, including at the City, County, State, and Federal government levels.
As the mayor of La Puente, we need your and La Puente City Council's help, and I am asking you to commit to this effort by taking the following steps:
1. Join over 700+ Mayors nationwide and sign the American Jewish Committee (AJC) and US Conference of Mayors statement to combat antisemitism.
2. La Puente City Council adopt the International Holocaust Remembrance Alliance's (IHRA) working definition on antisemitism
3. Propose, approve, and adopt a resolution denouncing and condemning antisemitism and all forms of hatred (including the jew-hatred flyers thrown on driveways)
4. Appoint a City of La Puente staff member to create and convene a task force made up of representatives from various ethnic and racial groups to work with the city to:
• Foster relationships between the groups
• Develop a Zero-tolerance policy against all forms of hatred. • Develop an educational plan to train La Puente’s staff and law enforcement personnel on detecting and reacting to all forms of hatred.
5. Allocate resources for initiatives fostering interfaith acceptance, understanding, and harmony.
As an elected official, you are in an important and unique position to affect change through your direct engagement with our local Jewish community.
Now, I know that if the City of La Puente takes each of these steps, there is no guarantee that antisemitism or hatred will be immediately eradicated. However, I do know that if you do nothing, things will continue to get worse.
I urge you to stand with us, and let's show people that antisemitism and all forms of hatred will not be tolerated or accepted in La Puente.
Respectively,
Jason Moss, MSW, MAJCS
