AGENDA ITEM NO. B-1
To: Mayor and City Council For meeting of: January 9, 2024 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Gisel Rubio, Rehabilitation Grant Specialist
SUBJECT: CONSIDERATION OF A RESOLUTION APPROVING THE CITY’S
COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FOR FISCAL
YEAR 2024-25
BACKGROUND
The primary national objectives of the Federal Community Development Block Grant (“CDBG”) program are to undertake activities that benefit low- and moderate-income persons and/or eliminate slum and blight conditions in the City. The program requires that at least 70 percent of the program funds be spent on activities that benefit low- and moderate-income persons.
The Federal Department of Housing and Urban Development (“HUD”) promulgates the funds and regulations for the CDBG program. Cities with populations below 50,000 do not receive funding directly from HUD, but instead participate through the Los Angeles Urban County Program. For La Puente, the City receives its CDBG funds as a “participating city” through the Los Angeles County Development Authority (“LACDA”).
LACDA has notified the City that the estimated CDBG allocation for Fiscal Year (“FY”) 2024-25 will be $308,667. Each City’s allocation is based on a formula that factors in the City’s population, poverty level, and overcrowding percentage. The allocation for FY 2023-2024 was $312,039. The allocation amount may change slightly when the final figures are announced by HUD later this spring.
The City Council is required to hold a public hearing to solicit input from the community for the use of CDBG funds for FY 2024-25. A resolution approving the City’s use of the funds must be submitted to LACDA by February 1, 2024. The funds become available to be expended on the intended activities beginning on July 1, 2024.
PUBLIC HEARING NOTICE
A notice of the public hearing was posted on December 20, 2023, in three (3) public places as required by HUD and the City’s municipal code.
City of La Puente
AGENDA REPORT
FY 2024-25 CDBG Program
For Meeting of January 9, 2024
ONGOING PROJECTS
For the FY 2024-25 program year, Staff is proposing the continuation of the City’s three (3) current year and regular on-going projects. A description of each of the projects is provided below.
Public Services
Public Service Activities are programs that undertake social activities, such as family counseling, health care, senior citizen services, and day care activities. The public service expenditure for FY 2024-2025 is set at 15 percent (15%) of the City's annual CDBG allocation which is $46,300.05.
Currently, all CDBG public service funds are being used for staffing at the Senior Center facility to provide services and activities for seniors.
Housing Rehabilitation
This program offers grants to rehabilitate single family homes that are owned and occupied by low- and moderate-income households. Approximately 1,535 homes in the City have been improved since the program began in 1979.
Grants of up to $12,000 are offered, with $5,000 of this amount reserved for testing, abatement, and clearance monitoring of asbestos and/or lead, if necessary, with $7,000.00 directed towards improvements to the property. For more substantial repairs, eligible applicants can also receive a zero (0%) percent interest deferred loan of up to $37,790.00 through the City’s separately funded Cal-Home loan program.
Based on the City’s FY 2024-25 allocation; Staff recommends that the Housing Rehabilitation Program be budgeted at $137,366.95. Based on this funding, it is anticipated that 12 grants will be completed during the 2024-25 fiscal year. This funding level is consistent with amounts spent in prior years
Code Enforcement
This program would continue to fund Code Enforcement personnel activities in low- and moderate-income residential areas of the City to identify property maintenance and code violations. The Code Enforcement division works with the property owners and/or residents to correct the violations. Code Enforcement staff will refer those property owners who may be income eligible to the Housing Rehabilitation Program for improvements to the property. Staff recommends that funding for FY 2024-25 be set at $125,000. Staff is also recommending utilizing $95,000 in un-programmed funds from loan repayments and unspent funds from previous fiscal years for a total of $220,000 for FY 2024-25. This is based on the number and area of low- and moderate-income block groups as a percentage of the entire City and the cases developed from those areas. An allocation of $220,000 to fund these Code Enforcement services is appropriate and consistent with previous years allocations.
FY 2024-25 CDBG Program
For Meeting of January 9, 2024
FY 2024-25 CDBG PROJECTS SUMMARY
Staff is seeking City Council’s approval of the recommended FY 2024-25 CDBG projects as discussed above and summarized in the funding table below:
Project Title Funding Amount
Public Service/Senior Services $ 46,300.05
Housing Rehabilitation 137,366.95
Code Enforcement 125,000.00*
FY 2024-25 ANNUAL ALLOCATION $ 308,667.00
Un-Programmed Funds 95,000.00*
GRAND TOTAL $ 403,667.00
* $95,000 of un-programmed funds will also be programmed to the Code Enforcement Program for a total of $220,000 for the Program
The attached resolution has been prepared which includes the recommended funding amounts as listed above by project name.
FISCAL IMPACT
There is no impact to the current 2023-24 Fiscal Year budget. As part of the budget planning process for the 2024-25 Fiscal Year, CDBG funding will be budgeted for the three (3) projects in the amounts listed in the table above.
RECOMMENDATION
It is recommended that the City Council: (1) open the public hearing and take public testimony; and (2) adopt Resolution No. 24-5842 authorizing the City’s CDBG Program for Fiscal Year 2024-

To: Mayor and City Council For meeting of: January 9, 2024 From: Bob Lindsey, City Manager
By: City Attorney’s Office
SUBJECT: DISCUSSION AND CONSIDERATION TO APPROVE A FIRST
AMENDMENT TO THE EXISTING AGREEMENT FOR CITY ATTORNEY
SERVICES WITH OLIVAREZ MADRUGA LAW ORGANIZATION, LLP
BACKGROUND/DISCUSSION
Olivarez Madruga Law Organization, LLP (OMLO) has ably served the City of La Puente (“City”) as its City Attorney since December 8, 2020 as the Interim City Attorney, then on February 23, 2021 when the City Council approved the Agreement (“Master Agreement”) for general legal counsel services.
OMLO is a public agency-focused law firm with approximately 30 attorneys and staff. OMLO attorneys have extensive experience on a broad range of municipal law matters, including the transparency laws like the Ralph M. The La Puente legal team is headed by Founding and Managing Partner Rick Olivarez, City Attorney Susie Altamirano, and Assistant City Attorney Adrian De Leon. During its tenure, the City has benefited from the Firm’s expert handling of legal issues on a range of subject areas, including contracts, open meetings and public records, planning, zoning, land use and development, CEQA, election law, constitutional law, compliance matters, water, complex transactional as well as litigation involving employment, personal injury and review and defense of subpoenas. In addition, OMLO has advised and assisted City staff with various pandemicrelated challenges and initiatives, including the City’s tenant eviction moratorium and compliance with County and State pandemic orders. OMLO staff is also available on a day-to-day basis to provide advice and counsel to City staff and City Councilmembers alike.
City of La Puente
AGENDA REPORT
OMLO First Amendment
For Meeting of January 9, 2024
OMLO has not increased its fees since December 8, 2020. Although OMLO was eligible for annual Consumer Price Index (CPI) increases on January 1, 2022, and January 1, 2023, the firm waived increases at that time in light of fiscal uncertainties created by the COVID-19 Pandemic. OMLO currently charges an hourly rate of:
Partners/Of Counsel $ 220
Sr. Associates $ 210
Associates $ 200
Paralegals $ 175
Law Clerks $ 90
In light of substantial increases in CPI over the past few years, OMLO’s current rates have not adequately kept pace with the market and inflation, placing adverse pressures on the retention of key personnel and the recruitment of new personnel.
The proposed hourly rate schedule requested by OMLO as part of the latest amendment to its agreement with the City is as follows:
Partners/Of Counsel (25+ years) $310
Sr. Associates/Of Counsel (10 years to 24 years) $275
Associate Attorneys (Less than 10 years) $265
Paralegal $155
Law Clerks $155
The proposed rates would take effect February 1, 2024. The proposed rates shall apply prospectively and shall have no application to any legal services rendered prior to February 1, 2024. The proposed rates automatically increase commencing on January 1, 2025, and annually on January 1st of each calendar year thereafter by a percentage equal to the lesser of either five percent (5%) or less CPI.
FISCAL IMPACT
Pending City Council approval, adjustments will be incorporated through the Fiscal Year 2023- 2024 midyear budget process. Please note that some legal fees are payable from non-general fund sources or are reimbursable from third parties.
RECOMMENDATION
It is recommended that the City Council: (1) Consider and approve the First Amendment to the existing Agreement for City Attorney Services, in accordance with Government Code Sections 53262, 54953(c)(3) and 54956(b); and (2) authorize the City Manager to make nonmaterial changes and execute all implementing documents.
