SUBJECT: PRESENTATION OF MARCH 2024 REQUISITION SUMMARY REPORT

BACKGROUND
On April 24, 2018, the City Council adopted several ordinances and accompanying resolutions amending the City’s purchasing procedures to streamline and make the procurement process more efficient. One of the amendments to the purchasing procedures was a provision setting a $5,000 spending limit for Department Heads and a separate provision increasing the City Manager’s spending limit to $20,000 for professional services, supplies and equipment. In order to document purchases approved by the City Manager and/or Department Heads the City Council directed that a monthly report be prepared and filed with the City Council. This action is to receive and file the requisition summary report for the month of March 2024.

DISCUSSION
City staff initiated six (6) requisitions during the month totaling $34,245.52.

RECOMMENDATION
It is recommended that the City Council receive and file this report.

SUBJECT: PRESENTATION OF MARCH 2024 INVESTMENT REPORT

BACKGROUND
This report presents the City’s investment portfolio for the period of March 2024. The attachment provides details of the City’s portfolio. It has been prepared to comply with regulations contained in California Government Code Section 53600 and the Statement of Investment Policy approved by the City Council on May 23, 2023.

The investment objectives of the City of La Puente are first, to provide safety of principal to ensure the preservation of capital in the overall portfolio, second, to provide sufficient liquidity to meet all operating requirements, and third, to earn a commensurate rate of return consistent with the constraints imposed by the safety and liquidity objectives.

The City follows the practice of pooling cash and investments for all funds under its direct control.

Interest earned on pooled cash and investments is allocated to the various funds based on the respective fund’s average quarterly cash balance. It is common for governments to pool the cash and investments of various funds to improve investment performance. By pooling funds, cities are able to benefit from economies of scale, diversification, liquidity and ease of administration.

DISCUSSION
The Investment Report for March 2024 has been provided as an attachment for your review. No investment purchases or sales took place during the period.

FISCAL IMPACT
Idle cash invested in certificates of deposit, government securities, and corporate bonds typically return higher yields than LAIF (Local Agency Investment Fund). This maximizes returns without assuming substantial additional risk.

SUBJECT: CONSIDERATION OF ACCEPTANCE OF NOTICE OF COMPLETION FOR

IMPROVEMENTS AT EIGHT CROSSWALK LOCATIONS, FEDERAL
PROJECT NO. HSIPL-5331(021)

BACKGROUND
On November 15, 2022, the City Council awarded a construction contract to TOWO Enterprise, Inc. in the amount of $1,042,198 to complete the Improvements at Eight Crosswalk Locations, Federal Project No. HSIPL-5331(021) (“Project”). The award of contract included a 10 percent contingency of $104,220 to cover the cost of any contract change order work approved by the City Manager.

DISCUSSION
On July 10, 2023, TOWO Enterprise commenced work on the Project and the Project was completed on April 2, 2024. The Project consisted of crosswalk improvements at eight locations that included the installation of rectangular rapid flashing beacons (RRFB), curb extensions, advanced pavement markings, warning signs, high-visibility crosswalks and ADA compliant access ramps. These improvements will help enhance pedestrian safety by improving the visibility of the pedestrian crossings and reducing the distance for pedestrians to cross the street at the following locations.
 Glendora Avenue at Sierra Vista Court
 Orange Avenue at Homeward Street
 Unruh Avenue at Giordano Street
 Central Avenue at Albert Street
 Del Valle Avenue at Loukelton Street
 Workman Street at 1st Street
 Main Street at 5th Street
 Main Street at Bluebonnet Street
The contractor’s bid price for this Project was $1,042,198. During construction, there were a several bid item quantity adjustments that resulted in a net increase of $114,125.20 primarily due to increases in the asphalt grinding and paving work and curb & gutter repairs completed on the Project. There were six change orders on the Project in the amount of $127,785.91 that included painting of additional yellow curb; installing flashing edge-lit signs on the RRFBs; City of La Puente

remobilization costs due to work stoppage; backfill and compaction work required by Los Angeles County Public Works at the intersection of Unruh and Giordano; additional concrete demolition work; decorative stamped concrete work; water valve cover adjustments; remobilization and crosswalk modifications at Central and Albert.

The construction work completed for this Project totaled $1,284,109.11 due to the quantity adjustments and approved change order work. However, there was a contract deduction of $150,000 because TOWO did not utilize its declared “DBE” subcontractors for a portion of the contract work as required for a federally funded project.

A DBE, or Disadvantaged Business Enterprise, is a minority-owned or women-owned small business. Federally funded projects typically set a DBE contract goal, requiring the prime contractor to allocate a portion of its contract work to a DBE subcontractor. In its bid proposal, TOWO committed to using two DBE subcontractors for concrete supply and hauling asphalt materials in the amount of $150,000. However, during construction, TOWO did not utilize these subcontractors as required, and did not follow the proper procedures for terminating or replacing the DBE subcontractors. Therefore, in consultation with Caltrans’ DBE Liaison, which oversees the expenditure of federal funds, the City is required to withhold $150,000 from the contract. Hence, the final construction cost totaled $1,134,109.11 which is 9% above the original contract amount.

FISCAL IMPACT
The bid schedule for construction of the Project totaled $1,042,198. With a 10 percent (10%) project contingency of $104,220, the total construction project budget was $1,146,418. The associated costs for contract administration and project inspection was $156,209 which brought the total project estimated cost to $1,302,627 at the time of Project commencement. Final Project total costs were $1,290,318.11 as a result of the DBE penalty deduction.

Funding for this Project was appropriated in the Fiscal Year 2023-24 Capital Improvement Program budget in total amount of $1,203,600 from Federal HSIP funds, Measure M funds and Measure R funds. At the City Council Meeting of November 14, 2023, the City Council approved a change order for this Project in which Staff reported that appropriated Measure M funds were available through a budget transfer to this Project from the HAWK Signal project at Hacienda Boulevard and Prichard Street. The transfer was approximately $86,720.00 to fully fund Project.

There was no impact to the City’s General Fund associated with this project.

RECOMMENDATION
It is recommended that the City Council: (1) accept the project as complete; and (2) authorize the City Clerk to execute the Notice of Completion.

RECTANGULAR RAPID FLASHING BEACON INSTALLATION ON OLD

VALLEY BOULEVARD AND FIRST STREET

BACKGROUND
On January 9, 2024, the City Council awarded a construction contract to Alfaro Communication Construction, Inc. in the amount of $150,184.40 to complete the Rectangular Rapid Flashing Beacon Installation on Old Valley Boulevard and First Street Project (“Project”). The award of contract included a 10 percent contingency of $15,018 to cover the cost of any contract change order work approved by the City Manager.

DISCUSSION
On February 1, 2024, Alfaro Construction commenced work on the Project and the Project was completed on March 15, 2024. The Project involved the installation of new rectangular rapid flashing beacons (RRFBs) at the intersection of Old Valley Boulevard and First Street and included construction of new sidewalk, driveway and curb ramps, and related signage and crosswalk striping.

At the time of award, the Council directed staff to look into Project enhancements that would improve the overall visibility of the new RRFBs and crosswalk to oncoming traffic. Therefore, Willdan Engineering prepared revised construction drawings and staff requested a cost estimate from Alfaro Construction which was in the amount of $32,988.78 to upgrade two advanced pedestrian crossing signs with solar-powered edge-lit flashing signs. Since Alfaro’s cost proposal exceeded the Project contingency, Change Order No. 1 was approved by the Council on February 13, 2024. Following the approval of the change order, on February 27, 2024, the City Council approved a budget amendment in the amount of $33,000.

The contractor’s bid price for this Project was $150,184.40. During construction, there were a few bid item quantity adjustments that resulted in a net increase of $6,454 due to a slight increase in the sidewalk and curb & gutter repairs completed for the Project. There were also two additional change orders on the Project in the amount of $10,315.45 that included removal of overgrown vegetation obstructing the view of the eastbound advanced pedestrian sign and RRFB and removal and replacement of an extraordinarily thick driveway apron. The total City of La Puente

construction cost for this project was $199,942.63, which is 33% above the original contract amount due to the quantity adjustments and approved change order work.

FISCAL IMPACT
Funding for this Project was originally appropriated in the Fiscal Year 2023-24 Capital Improvement Program budget in the amount of $85,000.00 from Measure M funds. At the time of Project award, the Council adopted Resolution No. 24-5844 allocating an additional $98,200 of Measure M and TDA funds which brought the funding to $183,200. With a final cost for construction of $199,942.63 and associated costs of $16,000 for project management and construction observation/inspection the total Project final cost is $215,942.63. As previously noted above, an additional budget amendment in the amount of $33,000.00 was approved by the City Council utilizing Measure M funds bringing the final Project funding total to $216,200.00.

There is no impact to the City’s General Fund associated with this project.

RECOMMENDATION
It is recommended that the City Council: (1) accept the project as complete; and (2) authorize the City Clerk to execute the Notice of Completion.

AGENDA ITEM NO. D-7
To: Mayor and City Council For meeting of: April 23, 2024 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Juan Galvan, MPA, Associate Planner
SUBJECT: CONSIDERATION AND RECEIVE AND FILE OF THE 2023 HOUSING

ELEMENT ANNUAL PROGRESS REPORT

BACKGROUND
Since 1969, California has required that all local governments (cities and counties) adequately plan to meet the housing needs of everyone in the community. California’s local governments meet this requirement by adopting housing plans as part of their “general plan” (also required by the state).

General plans serve as the local government’s "blueprint" for how the city and/or county will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing. The law mandating that housing be included as an element of each jurisdiction’s general plan is known as “housing-element law.” California’s housing-element law acknowledges that, for the private market to address the housing needs and demand of Californians adequately, local governments must adopt plans and regulatory systems that provide opportunities for (and do not unduly constrain), housing development. As a result, housing policy in California rests mainly on the effective implementation of local general plans and, in particular, local housing elements.

DISCUSSION
State housing element law requires each city to prepare and file Annual Progress Reports (“APR”s) with the California Department of Housing and Community Development (“HCD”) and the Office of Planning and Research (“OPR”) describing local housing production and the status of Housing Element program implementation. APRs must be prepared using the format established by HCD and be reviewed by the City Council at a public meeting.

More recent housing element laws require that cities report more than simply housing units entitled by the Planning Division or permitted by the Building and Safety Division as previously required, but also housing units that were completed or issued certificates of occupancy (“C of O’s) in a given calendar year. Additionally, the housing units reported must be broken down by income category of the occupants in the forms provided by HCD.

In 2023, the City's Planning Division received 49 new housing applications and approved 42 applications, for a total of 45 proposed units. The other seven applications were still in various City of La Puente

stages of review at the end of the calendar year. The 42 applications approved consisted of 42 accessory dwelling units or ADUs and the other three were single-family homes (refer to Table A).

In addition, the City issued building permits for 60 new housing units, with 52 of these units being ADUs (refer to Table A-2). For the new housing units that were issued building permits, applications for these units were approved in the prior or previous years. Subsequently, the City issued Certificate of Occupancies (“C of O’s) for 35 new housing units, which includes 5 multifamily units, and 30 ADUs (See Table A-2). The attached tables illustrate the comprehensive entitlement, permit issuance, and certificate of occupancy activity for 2023. The tables also summarize the City’s progress in implementing the programs identified in the City’s most current Housing Element (see Table D).

In contrast to 2022, the City's Planning Division received 29 new housing unit applications, all of which were ADUs and issued C of O’s for 45 new housing units, comprising 22 multi-family units and 23 ADUs. The 22 multi-family units were the townhomes at the former Start Theater site.

FISCAL IMPACT
No fiscal impact associated with filing the report. Although preparation of APRs is required by State law, no State funding is provided in connection with this mandate.

RECOMMENDATION
It is recommended that the City Council: (1) receive and file the 2023 Housing Element Annual Progress Report; and (2) direct Staff to submit the report to HCD and OPR.

2021‐2029 planning period
2021‐2029
Provide information and technical assistance to local property owners regarding housing maintenance and resources for funding maintenance work. Use the Residential Rehabilitation Program to:• Continue to provide barrier‐free housing for handicapped or persons with disabilities. • Continue to provide financial assistance for the construction of bedroom additions to eliminate overcrowding conditions. Encourage residents to address overcrowded conditions through room additions through expanded marketing of this program to target households living in crowded conditions.
• Continue to provide information on the residential rehabilitation program at public counters and provide additional information that is more prominently displayed on the City’s website.

Encourage use of the program to residents who visit the planning department for permits or technical assistance on other types of renovations. Post program information at the city hall, community center, senior centers, and city social media outlets. • Allow for energy conservation measures as eligible projects under the Residential Rehabilitation Program

Senate Bill 197
Staff will continue to explore a religious sites overlay to allow housing as part of a church use and will revisit this option at a later date due to lack of church interest. Staff begun the process to solicit bids for zoning amendments to allow mixed‐uses. Staff has also encouraged the maximizing of densities: a project in the downtown mixed‐use subarea (no maximum density) was approved with an approximate project density of 67 dwelling units per acre. Construction of the project has commenced. Staff continually provides technical assistance for homeowners developing Accessory Dwelling Units on their properties. ADUs are the primary form of development and a portion may be considered low‐ and moderate‐ income housing. The City's ADU ordinance is currently being updated completely to facilitate their construction.

Program 3b:

Replacement Housing
Requirement
Amend Zoning Code to address the
replacement requirement
Amend Zoning Code by
February 2025
There has been no inquiry on development involving non‐vacant sites that would result in the immediate need for replacement housing. Instead staff focused efforts in the ADU ordinance and the mixed‐use ordinance (program 6). However, staff will will continue to solicit professional services to amend the code for compliance with AB 1397 to address the replacemnt housing requirement. Staff is also actively seeking grant funding opportunities to cover the costs including grants from San Gabriel Valley COG and Southern California Association of Governments, such as REAP to implement housing element programs.

Program 3c:

By‐Right Approval of
Projects with 20 Percent

"Reuse" Housing Element
Sites
Amend Zoning Code to provide for by‐
right approval of projects meeting the
20 percent affordable requirements
on Housing Element reuse sites
Complete within three
years of the housing

deadline pursuant to
Senate Bill 197
Staff will continue to solicit professional services to amend the code for compliance with AB 1397 to include language in the municipal code that would allow for by‐right approval of projects with 20% of units designated for low‐income households. The same would be required to be codified for the downtown, but would involve amendment to the Downtown Business District Specific Plan. As part of Program 6 (mixed use), staff is also considering including additional incentives/requirements for affordable housing, including by‐right approvals consistent with AB1397 for mixed use projects that have at least 20% of units designated for low‐income.

Program 4:

Facilitate Residential and
Mixed‐Use Development

Senate Bill 197
Staff is continuing solicitation of professional services to amend the La Puente Downtown Business District Specific Plan to consider an increase in the height allowance, reduce the parking requirement, and require a minimum density from 20du/ac. In discussions with developers, staff has found an increase in height may not facilitate higher density development or interest. Staff has worked and will continue to work diligently with developers to facilitate residential or mixed‐use projects in downtown. Lot consolidations for a viable project remains a challenge that staff is actively working with developers and property owners.

Program 5:

Facilitate Redevelopment

Staff has researched programs that promote streamlined procedures for lot consolidation that include technical assistance. Staff has communicated with housing developers willing to work with property owners for a lot consolidation project in the downtown. A consolidated offer letter to purchase properties owned by several different owners has been sent to the owners and a developer continues to make efforts for acquisition.

Staff continues to seek funding to create a comprehensive mixed‐use program. A preliminary quote was provided by a reputable consultant and will likely require that the city solicit bids.

The City applied for and received a conditional offer for a grant in the amount of $427,350 from Southern California Association of Governments (funded by REAP 2.0) in October 2023 that would cover Program 6. Unfortunately, in January 2024 SCAG's Sustainable Communities Program ‐ Community Engagement, Equity, and Environmental Justice grant for housing and land use strategies was paused until further notice due to a halt in funds from the California Governor's proposed budget as it proposes to change funding for programs such as REAP. As a result, implementation of program 6 is delayed.

Program 7:

Section 8 Rental
Assistance
N/a Ongoing throughout the planning period
The City has supported and will continue to support the Housing Authority of the County of Los Angeles that services four project‐based Section 8 complexes in the City. The City has supported and will continue to support LACDA in efforts to maintain and increase rental assistance targetting the identified census tracts in the City.

Program 8:

Assist Affordable Housing

Increase the development of units
affordable to lower‐and moderate‐
income and speciate needs
households throughout the
community by at least 25 percent
Begin late 2023 and
continue at least
annually and throughout
the planning period
On a case by case basis, the City prioritizes reduction of development costs for lower income and special needs housing projects and will consider waiving or reducing the sewer impact fees or making regulatory concessions to encourage development of a variety of housing types. City is currently working with a developer reconstructing a small extended stay hotel that was destroyed due to fire and is exploring the feasibility of Single Room Occupancy or SRO for at‐ risk/homeless veterans. City proactively reaches out to or responds to inquiries from non‐profit service provides interested in development in the City.

Program 11:

Zoning Code
Amendments
Amend Zoning Code for complicance
with adopted State laws
Complete by February
2025
Staff is seeking grants to solicit professional services to amend the zoning code to include language that would promote and encourage SROs. City is currently working with a developer reconstructing a small extended stay hotel that was destroyed due to fire and is exploring the feasibility of Single Room Occupancy or SRO for at‐risk/homeless veterans. Staff is working on eliminating subjective Site Plan and Design Review application findings and is currently focusing on addressing subjectivity in the City's new ADU ordinance. The ADU ordinance was prioritized over SB9 because ADUs are more typical. No SB9 applications were received in 2023 or since the law took effect. If and when an SB9 request is made, the City is prepared to process in accordance with State law.

Program 12:

Accessory Dwelling Units

by July 2024
Staff is currently working on adopting a revised ADU ordinance for consistency with current State ADU laws. Staff has explored incentives such as pre‐approved plans (intended for new construction ADUs). Although having a pre‐approved program will be inefficient since most ADUs are garage conversions, State law AB 434 is now requiring Cities to have a pre‐approved plans program in place by January 2025. As a result, other program implementation may be affected due to limited staff capacity and resources.

Total Accessory units approved in 2023: 49 units; which some units are distributed in the following Census Tracts.

Census Tract 407101: 4 units
Census Tract 407501: 1 unitsCensus Tract 407601: 2 unitsCensus Tract 407702: 5 units Program 13:

Housing Opportunities
for Persons with
Particular Needs
Facilitate the development of at least
100 new affordable housing units for
those with special needs, specifically
targeting census tracts 407701
Ongoing throughout the
planning period
Staff is actively reaching out to housing developers, including affordable housing developers, to create housing for seniors in our community. In the past couple of years a renovation project was completed at the Sunny Gardens senior apartments and new senior housing was constructed (Arboleda apartments). Staff is also looking at any updates that might be necesary for the Reasonable Accommodation Ordinance. In 2023 the City received a grant from the CA Department of Aging, Local Aging and Disability Action Plan (LADAP) program to create a local action plan that applies California's Master Plan for Aging (MPA). As part of the process and plan, housing for seniors and disabled is considered a primary domain. The plan will help the City identify the needs (including housing) of the aging population in the community.

Program 14:

Fair Housing N/a
Provided individually for
distinct actions as noted
in table Table 37
summarizes the City's
quantified objectives for
the 2021‐2029 planning
period by income group
HIGH PRIORITY: SFR Overcrowding: Staff works closely with residents to construct additions and ADUs to reduce overcrowding. Staff has simplified its application form for both residential additions and ADUs. Mixed‐Use: The city reached out to a consultant to begin mixed‐use code amendment efforts but were paused as a result of having been awarded SCAG's SCP‐CEEEJ grant in October 2023 (see program 6). By January 2024, the State governor's budget proposal halted REAP funding causing a pause to SCP‐CEEEJ. Code Enforcement: The City continues code enforcement efforts to mitigate unsightly residential areas and hazardous living conditions. MEDIUM PRIORITY: Rehabilitation program: The City will continue it's CDBG rehab program in providing residential loans/grants that would improve the city's aging housing stock.

At‐risk Units: The city will continue to monitor and facilitate the preservation of 82 at‐risk units located in the city's four project‐based complexes. Elderly and Disabled Person Housing: The City continues to reach out to senior housing developers (ex: Meta Housing) to encourage senior housing development in the city. ADU: The city has simplified the application process for ADUs and is continually looking for ways to enhance customer service and processing response time for ADUs. AGENDA ITEM NO. D-8
To: Mayor and City Council For meeting of: April 23, 2024 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF A PURCHASE ORDER CONTRACT WITH MARK’S

WELDING SERVICE FOR THE CONSTRUCTION OF AMPITHEATER TRUSS AND

BASEBALL AND SOFTBALL FIELD OUTFIELD NETS AT LA PUENTE PARK IN THE AMOUNT OF $32,000.00

BACKGROUND/DISCUSSION
In October 2023, the City Manager approved a purchase order contract with Mark’s Welding Service under his spending authority for the construction of the amphitheater truss at La Puente Park. Due to changes in the sizing of the posts for the trusses (based on design requirements from the City’s Building and Safety Division), and additional lighting and cosmetic upgrades, an additional $10,000 is needed to complete the project.

Another project that is needed at La Puente Park is the installation of outfield netting down the first base and third base lines of the baseball and softball fields This would allow more on the existing open area to be covered to better protect spectators from foul balls and home runs. Thus, decreasing the liability potential for the City.

City staff is recommending the City Council approve a purchase order contract with Mark’s Welding Service for the completion of construction of the amphitheater truss system and baseball and softball field outfield nets at La Puente Park in the amount of $32,000.

Section 2.21.020 (b) (1) of the La Puente Municipal Code authorizes the City to contract for public works projects by negotiated contract or purchase order.

FISCAL IMPACT
The total price for the construction of the amphitheater truss and baseball and softball field outfield nets at La Puente Park is $32,000.00. The total amount of $32,000.00 will be funded through the General Fund appropriations.

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: April 23, 2024 From: Bob Lindsey, City Manager
By: Troy O. Grunklee, CPA, Director of Administrative Services Alex Merkel Medina, Finance Manager
SUBJECT: PRESENTATION OF MARCH 2024 BUDGET REPORT

BACKGROUND
The City Council adopted the Fiscal Year 2023-2024 Budget and Capital Improvement Program on May 31, 2023. The attached report examines fiscal activity taking place during the month of March 2024 and includes all funds within the operating budget. The report analyzes year-to-date transactions in comparison to budgeted amounts for the entire fiscal year, expressing each category using a percentage-of-completion methodology. It additionally provides comparisons in activity level to the same time period last fiscal year.

DISCUSSION
As of March 31, 2024, seventy-five (75) percent of the fiscal year has elapsed.

REVENUES
General Fund revenues to date have reached $10,974,533. This equates to 57% of budget, the exact same percentage that was displayed at this time last fiscal year. Property Tax receipts have increased 5% over March 2023, resulting in an additional $189,000 in revenue being recognized in the fund. Sales and Use Tax has declined 2% year-over-year, and Measure LP has declined 6% in the same period – causing a combined loss of $178,000. The net effect of these offsetting tax revenues, combined with vigorous returns in the Licenses & Permits, Fines & Forfeitures, and Charges for Services categories, has led to a total dollar increase of $212,733 in General Fund collections in comparison to 12 months ago.

EXPENDITURES

55.6% of budgeted General Fund operating expenditures have been realized, approximately in line with 58.9% at this time last fiscal year. In aggregate of all funds, 54.7% of the annual budget has been expended to date ($19,277,462) in comparison to 53.7% at this time last year.

RECOMMENDATION
It is recommended that the City Council receive and file this report.

FILING OF FAIR POLITICAL PRACTICES COMMISSION CAMPAIGN

DISCLOSURE STATEMENTS)

BACKGROUND
Assembly Bill (AB) 2151 requires a local government agency to post any campaign statement, report, or other document required by the Political Reform Act to its City website within 72 hours of filing. The City Clerk is the local filing officer for the City of La Puente and is responsible for the receiving, filing, and posting of Fair Political Practices Commission (“FPPC”) forms, including Forms 460, 470, and 700.

In February of 2021, the City Clerk’s Department entered into an agreement with NetFile, an electronic/paperless filing system that accommodates online filing of several types of FPPC forms and meets the requirements of the Secretary of State. Since then, the City has been utilizing NetFile for the electronic/paperless filing off all Form 700 (Statement of Economic Interest). Adoption of an ordinance was not required for the use of an electronic filing system for Form 700.

DISCUSSION
With the transition to electronic filing of Form 700 and to provide a more efficient process, Staff recommends all future campaign statements to be filed electronically via NetFile. NetFile will ensure compliance with AB 2151, provide more transparency to the public, and offer an easier way for all filers to complete their required filings. Government Code Section 84615 allows local government agencies to require an elected and appointed official, candidate, or committee, having received contributions or made expenditures of two thousand dollars ($2,000) or more, to file FPPC campaign statements, reports, or other documents online or electronically with a local filing officer.

In order for the City to accept electronically filed statements, the City Council must adopt an ordinance (Attachment “A”) approving the use of an online or electronic filing system for campaign statements, which shall include the legislative finding that the online or electronic filing system will operate securely and effectively and will not unduly burden filers.

It is recommended that the City Council: (1) waive reading of Ordinance No. 24-986 and read by title only; and (2) introduce Ordinance No. 24-986 amending Chapter 2.32 (Municipal Elections) of the La Puente Municipal Code to add Section 2.32.050 (Electronic and Paperless Filing of Fair Political Practices Commission Campaign Disclosure Statements).
