AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: May 14, 2024 From: Bob Lindsey, City Manager
By: Martha Torres, MPA, City Clerk
Jackie Cortez, Office Specialist
SUBJECT: SECOND READING AND CONSIDERATION OF ADOPTION OF AN ORDINANCE AMENDING CHAPTER 2.32 (MUNICIPAL ELECTIONS) OF THE CITY OF LA PUENTE MUNICIPAL CODE ADDING SECTION 2.32.050 (ELECTRONIC AND
PAPERLESS FILING OF FAIR POLITICAL PRACTICES COMMISSION CAMPAIGN
DISCLOSURE STATEMENTS)
BACKGROUND
On April 23, 2024, the City Council introduced Ordinance 24-986 (“Ordinance”), which proposes adding Section 2.32.050 (Electronic and Paperless Filing of Fair Political Practices Commission Campaign Disclosure Statements) to Chapter 2.32 (Municipal Elections) to the City of La Puente Municipal Code.
Assembly Bill (AB) 2151 requires a local government agency to post any campaign statement, report, or other document required by the Political Reform Act to its City website within 72 hours of filing. The City Clerk is the local filing officer for the City of La Puente and is responsible for the receiving, filing, and posting of Fair Political Practices Commission (“FPPC”) forms, including Forms 460, 470, and 700.
In February of 2021, the City Clerk’s Department entered into an agreement with NetFile, an electronic/paperless filing system that accommodates online filing of several types of FPPC forms and meets the requirements of the Secretary of State. Since then, the City has been utilizing NetFile for the electronic/paperless filing of all Form 700 (Statement of Economic Interest). Adoption of an ordinance was not required for the use of an electronic filing system for Form 700.
DISCUSSION
With the transition to electronic filing of Form 700 and to provide a more efficient process, Staff recommends all future campaign statements to be filed electronically via NetFile. NetFile will ensure compliance with AB 2151, provide more transparency to the public, and offer an easier way for all filers to complete their required filings. Government Code Section 84615 allows local government agencies to require an elected and appointed official, candidate, or committee, having received contributions or made expenditures of two thousand dollars ($2,000) or more, to file FPPC campaign statements, reports, or other documents online or electronically with a local filing officer.

AGENDA REPORT
Agenda Report: Electronic and Paperless Filing of FPPC Campaign Disclosure Statements For meeting of: May 14, 2024
In order for the City to accept electronically filed statements, the City Council must adopt an ordinance (Attachment “A”) approving the use of an online or electronic filing system for campaign statements, which shall include the legislative finding that the online or electronic filing system will operate securely and effectively and will not unduly burden filers.
By adopting the proposed ordinance, the City would add Section 2.32.050 (Electronic and Paperless Filing of Fair Political Practices Commission Campaign Disclosure Statements) in Chapter 2.32 (Municipal Elections) of the La Puente Municipal Code.
FISCAL IMPACT
None.
RECOMMENDATION
It is recommended that the City Council adopt Ordinance No. 24-986 amending Chapter 2.32 (Municipal Elections) of the La Puente Municipal Code to add Section 2.32.050 (Electronic and Paperless Filing of Fair Political Practices Commission Campaign Disclosure Statements).

BACKGROUND
For the past two years, the City Council has approved a License Agreement between the City and Jesus Rodriguez for the vacant property located at the southeast corner of Valley Boulevard and Old Valley Boulevard for seasonal holiday sales.
The City recently acquired the previously privately-held parcel adjacent to the City's vacated roadway at this intersection. The City now has full site control of the entire vacant parcel and will allow for seasonal holiday sales to continue at the property for the remaining seven months of the calendar year. Mr. Rodriguez intends to once again use vacant land to sell safe and sane fireworks during the fourth of July holiday, with pumpkins and related items during the month of October, and Christmas trees from the day after Thanksgiving until Christmas.

The Agreement requires that Mr. Rodriguez provide the required types and amounts of insurance, indemnify the City, remove any existing trash, weeds, and debris on the property and repair any damage that might have occurred following use of the property. In addition, the Agreement stipulates a fee of $7,483.93 to be paid to the City for the use of the property. The Agreement will expire on December 31, 2024.
Before the setup and installation of temporary structures, the City will review and approve the site plan for the seasonal holiday sales.
FISCAL IMPACT
The City will receive payment in the amount of $7,483.93 for consideration of use of the City’s property. The payment reflects a 5% increase to the amount Mr. Rodriguez had paid to the City last year.
