AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: March 11, 2025 From: Robert Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: APPROVAL OF PROFESSIONAL SERVICES AGREEMENT FOR AUDITING
SERVICES WITH VAN LANT & FANKHANEL, LLP
BACKGROUND
In March of 2015, the City Council awarded a three (3) year contract for annual financial statement audit services to Van Lant and Fankhanel, LLP. The professional services agreement provided for a possible two (2) year extension subsequent to the end of the initial three (3) year term. The City Council awarded this two (2) year extension to the firm in March of 2018, maintaining their services through the end of the Fiscal Year 2018-2019 audit.
The initial contract awarded to Van Lant and Fankhanel in 2015 was based on their response to a Request for Proposal for financial statement audit services issued by City staff. The firm responded with the lowest bid out of nine (9) responsive firms.
In March of 2020, the City Council awarded an additional three (3) year contract for annual financial statement audit services to Van Lant and Fankhanel, LLP. The professional services agreement provided for a possible two (2) year extension subsequent to the end of the initial three (3) year term.
The City Council awarded this two (2) year extension to the firm in March of 2023, maintaining their services through the end of the Fiscal Year 2023-2024 audit.
DISCUSSION
The term of the professional services agreement between the City and Van Lant and Fankhanel, LLP expired is set to expire in March 2025. The firm has proposed providing annual audit services to the City for an additional three (3) year term, beginning in Fiscal Year 2024-2025 and ending with Fiscal Year 2026-2027. The proposed pricing schedule provided by the firm is summarized in the table below:
City of La Puente
AGENDA REPORT
Professional Services Agreement for Audit Services
For Meeting of March 11, 2025
The proposed annual contract amount, not-to-exceed $32,250, is slightly higher than the proposed fees of all other nine (9) firms that responded to the 2015 Request for Proposal.
Pursuant to Chapter 2.20.090 (f) of the La Puente Municipal Code, agreements for professional services may be executed without observing formal bidding procedures based on factors such as demonstrated competence, long-standing relationship with the City, and reasonableness of cost to perform work. As such, staff does not intend to conduct a formal bidding process prior to recommending that the City Council award an agreement to Van Lant and Fankhanel, LLP.
The summary of tasks to be performed by the auditors is as follows:
1) Perform an audit of all funds of the City and the Successor Agency to the Community Development Commission private purpose trust. The audit is to be performed in accordance with generally accepted auditing standards and the standards set forth for financial audits contained in Government Auditing Standards issued by the Comptroller General of the United States, and the U.S. Office of Management and Budget Circular A-133, Audits of State and Local Governments and Non-Profit Organizations;
2) Prepare the City’s Comprehensive Annual Financial Report (CAFR). The audit reports shall include a signed opinion, basic financial statements and fund financial statements, accompanying notes to the financial statements and required supplementary information; 3) Perform a single audit on the expenditures of federal grants in accordance with OMB Circular A-133 and render the appropriate reports;
4) Perform agreed upon auditing procedures pertaining to the City’s GANN Limit (Appropriation Limit) and render a letter annually to the City regarding compliance; 5) Prepare and submit a management letter at the conclusion of the annual audit. The management letter shall report all significant opportunities for realistically improving internal controls of the City’s operations and procedures that are discovered or observed by the auditor in the course of the annual audit;
6) Prepare State Controller’s reports for the City;
7) Prepare Gas Tax report;

Violation of this Section shall be a material breach of this Agreement entitling the City to any and all remedies at law or in equity.
12. NO BENEFIT TO ARISE TO LOCAL OFFICERS AND EMPLOYEES No member, officer, or employee of City, or their designees or agents, and no public official who exercises authority over or responsibilities with respect to the Project during his/her tenure or for one year thereafter, shall have any interest, direct or indirect, in any agreement or sub-agreement, or the proceeds thereof, for work to be performed in connection with the Project performed under this Agreement.

Proof of insurance. Current certification of insurance shall be kept on file with City at all times during the term of this contract. City reserves the right to require complete, certified copies of all required insurance policies, at any time.
Duration of coverage. Consultant shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property, which may arise from or in connection with the performance of the Services hereunder by Consultant, his agents, representatives, employees or subconsultants.
Primary/noncontributing. Coverage provided by Consultant shall be primary and any insurance or self-insurance procured or maintained by City shall not be required to contribute with it. The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on a primary and non-contributory basis for the benefit of City before the City’s own insurance or self-insurance shall be called upon to protect it as a named insured.
City’s rights of enforcement. Consultant hereby waives its own right of recovery against City, and shall require similar written express waivers and insurance clauses from each of its subconsultants.
Enforcement of contract provisions (non estoppel). Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to inform Consultant of non-compliance with any requirement imposes no additional obligations on the Agency nor does it waive any rights hereunder.
Requirements not limiting. Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Consultant maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained by the Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City.
Notice of cancellation. Consultant agrees to oblige its insurance agent or broker and insurers to provide to City with a thirty (30) day notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage.
Additional insured status. General liability policies shall provide or be endorsed to provide that City and its officers, officials, employees, and agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess liability policies.
Prohibition of undisclosed coverage limitations. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to City and approved of in writing.
Separation of Insureds. A severability of interests provision must apply for all additional insureds ensuring that Consultant’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the insurer’s limits of liability. The policy(ies) shall not contain any cross-liability exclusions.
Pass Through Clause. Consultant agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by Consultant, provide the same minimum insurance coverage and endorsements required of Consultant. Consultant agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. Consultant agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to City for review.
City’s right to revise specifications. The City reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the Consultant ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the Consultant, the City and Consultant may renegotiate Consultant’s compensation.
Self-insured retentions. Any self-insured retentions must be declared to and approved by the City. The City reserves the right to require that self-insured retentions be eliminated, lowered, or replaced by a deductible. Self-insurance will not be considered to comply with these specifications unless approved by the City.
Timely notice of claims. Consultant shall give the City prompt and timely notice of claims made or suits instituted that arise out of or result from Consultant’s performance under this Agreement, and that involve or may involve coverage under any of the required liability policies.
Additional insurance. Consultant shall also procure and maintain, at its own cost and expense, any additional kinds of insurance, which in its own judgment may be necessary for its proper protection and prosecution of the work.

The proposed Kennel/Dog Park project to be located on the vacant City-owned property at the southeast corner of Valley Boulevard and Old Valley Boulevard will include new kennel facilities, a restroom building and an administrative office. The nearest available sewer mainline pipe, which also serves the Valley Business Center, terminates in Old Valley Boulevard approximately 250 feet east of Hofgaarden Street. In order to provide sewer service to the new kennel/dog park, it will be necessary extend the existing sewer main pipe approximately 960 feet easterly in Old Valley Boulevard to the project site.
DISCUSSION
On September 10, 2024, the Council authorized the Old Valley Boulevard Sewer Extension project (“Project”) to be advertised for formal bid. The Engineer’s estimate for construction was $450,000.
The proposed sewer extension will consist of the construction of approximately 960 feet of 8- inch sewer mainline pipe in Old Valley Boulevard from 250 feet east of Hofgaarden Street to the kennel/dog park site. The project will also include three new sewer manholes; two new sewer laterals; cold milling of existing asphalt pavement; resurfacing with Asphalt Rubber Hot Mix (ARHM); and painting new “traffic calming” striping and installing signage to reduce vehicular speeds on eastbound Old Valley Boulevard approaching the new kennel/dog park.
The project will also included the installation of concrete traffic bollards at the beginning of the curvature of Old Valley Boulevard just before Valley Boulevard.
The bid opening was conducted on February 27, 2025. The City received a total of six (6) bids for the project. The results of the bids are as follows:

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: March 11, 2025 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Abraham Tellez, Planning Manager
SUBJECT: CONSIDERATION OF AN INTERIM URGENCY ORDINANCE APPROVING A CITYWIDE 45-DAY MORATORIUM PROHIBITING THE ADVERTISING AND
OPERATION OF SHORT-TERM RENTALS WITHIN THE CITY
BACKGROUND
The La Puente Municipal Code (“Code”) includes the City’s zoning code, which is established to regulate the use of land within the City. The intent of the zoning code is to protect the public health, safety, comfort, welfare, and general prosperity by means of classifying, designating, regulating, and restricting uses. Specifically, Table 2-1 in Section 10.10.020 of the City’s code establishes uses that are either permitted, conditionally permitted, or expressly prohibited in the residential zones.
Although, Table 2-1 attempts to clearly identify those uses that are permitted or conditionally permitted, it is not efficient to specifically mention all uses that would be generally understood to be prohibited in residential zones. To address uses that are generally understood to be prohibited, Section
10.10.020 specifies that “Any use not listed in Table 2-1 is prohibited.” Since the City’s code does not specifically mention “short-term rentals” in either Table 2-1 or in the definitions Chapter 10.132, and since short-term rentals are NOT generally understood to be a prohibited use, the City is pressed to clarify its position and adopt new regulations that address short-term rentals.
DISCUSSION
Over the last several years, inquiries related to the City’s regulations on short-term rentals have been relatively uncommon with the City’s response being that the City does not identify them as a byright “Permitted” use. However, over the last several months, the City has received complaints and calls about how short-term rentals are being operated and negatively impacting other properties in the neighborhood. Without clear language related to short-term rentals in the Code, the City is unable to regulate or place conditions on the location and operation of short-term rentals throughout the City.
A 45-day moratorium would temporarily prohibit short-term rentals from being established in the City, while Staff considers and evaluates a new permanent ordinance to address them. If adopted, the urgency ordinance approving a citywide, 45-day moratorium would prohibit the advertising and operation of short-term rentals so that appropriate land use decisions can be made, and so that the City Council can provide Staff direction.

AGENDA REPORT
Agenda Report: Interim Urgency Ordinance – Short-term Rentals For meeting of: March 11, 2025
If adopted, the urgency ordinance would take effect immediately, and would expire 45 days from the date of adoption. It is important to note that the City Council, after a noticed public hearing, may choose to extend the ordinance for an additional 10 months and 15 days to further study and evaluate a permanent ordinance to define and regulate short-term rentals in the City.
FISCAL IMPACT
No fiscal impact associated with the urgency ordinance.
RECOMMENDATION
It is recommended that the City Council introduce, waive the reading of, and adopt Interim Urgency Ordinance No. 25-988 approving a citywide 45-day moratorium prohibiting the advertising and operation of short-term rentals within the City.

WHEREAS, during the past several months there has been an increase in vacation rentals within the City and a number of complaints and inquiries received by City associated with the behavior of vacation rental operators and their guests; and WHEREAS, City is considering a local ordinance for short-term rentals to prevent or reduce anticipated complaints relating to noise, parties, over-occupancy, and parking issues at vacation rentals within the City; and
WHEREAS, the State Planning and Zoning Law (Gov. Code §§ 65000, et seq.) broadly empowers cities to plan and regulate the use of land in order to provide for orderly development, the public health, safety and welfare, and balancing property rights and the desires of the community and how its citizens envision their city; and WHEREAS, the State of California continues to experience a state-wide housing shortage and short-term vacation rentals reduce the number of available housing units that could be occupied by families on a long term basis; and

WHEREAS, as a result of the catastrophic Palisades Fire and Eaton Fire in Los Angeles County more than 10,000 structures have been destroyed leaving over 40,000 residents displaced further exacerbating the State’s housing shortage crisis, and WHEREAS, based on the foregoing, it is urgent that the City adopt regulations in order to minimize the adverse impacts vacation rentals may have on surrounding residential properties and the City’s limited law enforcement resources, and as a result, the City desires to establish, on an

urgency basis, an ordinance to enact a 45-day moratorium prohibiting the advertisement and operation of short-term rentals within the City; and
WHEREAS, this Interim Urgency Ordinance is enacted pursuant to the authority conferred upon the City and shall be in full force and effect immediately upon a four-fifths (4/5) vote of the City Council.
NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF LA PUENTE DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Recitals.
The City Council finds that the above recitals are true and correct and are incorporated herein by reference.
Section 2. Definitions.
The following definitions are applicable to this Interim Urgency Ordinance, unless the context clearly indicates otherwise:
(a) “Advertisement” means any announcement, whether in a magazine, newspaper, handbill, notice, display, billboard, poster, email, internet website, platform or application, any form of television or radio broadcast or any other form of communication, whose primary purpose is to propose a transaction for a short-term vacation rental. (b) “Rental,” “rent,” “rented,” or “renting” includes, but is not limited to, rental of the property for any form of monetary or non-monetary consideration, including but not limited to money, goods, or services, as well as in-kind exchanges of goods, services or premises. (c) “Short-term vacation rental” means a single-family dwelling, multi-family unit, bedroom of a primary residence, accessory dwelling unit (Gov. Code § 65852.2), or junior accessory dwelling unit (Gov. Code § 65852.22) within all zones within the City of La Puente that support or include residential uses, whether as a permitted use or conditionally permitted use, which is rented to one or more guests for compensation for the purpose of lodging or hosting events for a period of thirty (30) or fewer consecutive days. “Short-term vacation rental” encompasses such dwelling units regardless of whether the owner, permanent occupant or other Responsible Party is present during the rental period. For purposes of this definition, “for compensation” includes, but is not limited to, rental of the property for any form of monetary or non-monetary consideration, including but not limited to money, goods, or services, as well as in-kind exchanges of goods, services, or premises. “Short-term vacation rental” does not include any commercial use for which a business license or other permit has been issued pursuant to the La Puente Municipal Code prior to the effective date of this ordinance.
(d) “Responsible Party” means any person(s) or entity(ies) that hold(s) legal and/or equitable title to the short-term vacation rental, including any property owner, lessee or tenant, or any agent or representative thereof, who causes or permits any violation of this ordinance. To cause ORDINANCE NO. 25-988 PAGE 3 OF 5 MARCH 11, 2025
or permit includes failure to correct or cause correction after receiving notice from the City of the violation.
Section 3. City Council Findings.
(a) The City has adopted a General Plan, including strategies to invigorate the City’s prosperous community, as well as its well-planned and designed community. (b) Protection of public health, safety and welfare is fully articulated in the General Plan.
(c) State law requires the City’s zoning laws to conform with the General Plan’s goals and policies.
(d) The City’s Municipal Code does not currently regulate or provide an entitlement process specifically for short-term vacation rental uses. The use of short-term vacation rentals are in use and have intensified. In recent years, social media has increased exponentially the popularity and demand for short-term vacation rentals. Recently, short-term vacation rentals have become a substantial threat to the public health, safety and welfare of the City’s residents, and particularly residential neighborhoods. It is well documented in the media and various law enforcement complaints that events hosted at short-term vacation rentals have attracted massive crowds, loud parties, littering, over-parked street conditions, openly disorderly conduct and unsafe vehicle use that have led to multiple arrests and complaints to law enforcement. (e) As a result of the catastrophic Palisades Fire and Eaton Fire in Los Angeles County, displaced persons are seeking decent, safe, sanitary, and long-term housing within the City. (f) City staff and the City Attorney’s office require a period of study to determine the appropriate scope of regulations that may be developed for inclusion into the City’s Municipal Code, which is anticipated, among other measures, to provide for the public health, safety and welfare, relating to short-term vacation rentals.
(g) The City Council finds that allowing any proliferation of short-term vacation rental uses could lead to potentially nonconforming land uses that could defeat the purpose and intent of any later adopted short-term vacation rental ordinance and pose a further threat to the public health, safety and welfare.
(h) Based on the foregoing, it is urgent the City temporarily prohibit the advertising, use and operation of short-term vacation rentals while it undertakes a review of its current Municipal Code provisions to determine whether additional regulations are needed to ensure the public health, safety and welfare remain protected.
Section 4. Moratorium.
(a) Based on the foregoing, the City Council finds and declares there is a current and immediate threat to the public health, safety or welfare and upon that basis has determined an ORDINANCE NO. 25-988 PAGE 4 OF 5 MARCH 11, 2025
Interim Urgency Ordinance pursuant to Government Code section 65858 is warranted and shall take effect immediately upon adoption by a four-fifths (4/5) vote of the City Council. (b) For a period of 45 days after the date of March 11, 2025, short-term vacation rentals shall be prohibited in the City of La Puente. No responsible party shall advertise, rent, operate or allow the operation of a short-term vacation rental within the City. (c) For a period of 45 days after the date of March 11, 2025, any use or condition cause, or permitted or allowed to exist, that continues or remains in violation of any provision of this Interim Urgency Ordinance shall be, and is hereby declared to be, a public nuisance. Violations of this Interim Urgency Ordinance shall be punishable by a $1,000 civil penalty pursuant to Government Code section 36901. Violations of this Interim Urgency Ordinance may be abated on an emergency basis per La Puente Municipal Code section 3.20, et seq., pursuant to Code of Civil Procedure section 38773, or through any other remedy provided for by law. It shall be unlawful for any responsible party to violate any provision or to fail to comply with any of the requirements of this Interim Urgency Ordinance. In addition to any civil penalty, such violation may be prosecuted in the name of the People of the State, redressed by civil action, or resolved by administrative remedies, or in any combination thereof. Any responsible party who violates or fails to comply with any provision of this Interim Urgency Ordinance or any provision of the La Puente Municipal Code is guilty of a misdemeanor. In any proceeding to enforce any violation of this Interim Urgency Ordinance, the prevailing party shall be entitled to its reasonable attorney’s fees and costs. If the City is the prevailing party in any proceeding to enforce any violation of this Interim Urgency Ordinance, recovery of costs, fines, penalties, and/or attorney’s fees shall be in accordance with the La Puente Municipal Code or as otherwise provided by law, including, but not limited to Government Code sections 38773.1 and 38773.5. Upon the second or subsequent civil or criminal judgment issued within a two-year period finding that a property owner is responsible for a nuisance condition, said property owner may be liable to triple the costs of abatement per Government Code section 38773.7.
(d) City staff is directed to study appropriate modifications to the City’s Municipal Code regulations to reduce and mitigate negative secondary effects created by the number, frequency, location and other impacts short-term vacation rental may cause. (e) Pending the completion of such studies and the adoption of an ordinance to establish appropriate operational and zoning regulations, and for the immediate preservation of the public health, safety and welfare, it is necessary for this Interim Urgency Ordinance to take effect immediately, In the absence of immediate effectiveness, short-term vacation rental uses in the City may be in conflict with regulations or requirements established with respect thereto. (f) This Interim Urgency Ordinance does not create or grant any vested rights to any person for the continued operation of any short-term vacation rental during the time of this Interim Urgency Ordinance (or an extension thereof), or after the adoption of updated regulations.
Section 5. California Environmental Quality Act (“CEQA”) Findings.
The City Council finds this Interim Urgency Ordinance is not subject to CEQA pursuant ORDINANCE NO. 25-988 PAGE 5 OF 5 MARCH 11, 2025
to section 15060 (c)(2) and 15060 (c)(3) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly; rather it prevents changes in the environment pending the completion of the contemplated municipal code review.
Section 6. Urgency.
Based on the foregoing recitals, findings and all facts of record stated before the City Council, the City Council finds and determines that the immediate preservation of the public health, safety and welfare requires that this ordinance be enacted as an urgency interim ordinance pursuant to Government Code section 65858(a).
Section 7. Effectiveness; Voting Requirements.
This Interim Urgency Ordinance is hereby declared to be an urgency measure and shall become effective immediately on March 11, 2025, pursuant to Government Code section 65858, upon adoption by at least a four-fifths (4/5) vote of the City Council, and will extend for a period for 45 days after that date, at which time it will automatically expire, unless extended by the City Council in accordance with the requirements and procedures provided for by Government Code section 65858.
Section 8. Severability.
Should any provision, section, paragraph, sentence, or word of this Interim Urgency Ordinance, or any part thereof, is for any reason found to be unconstitutional, invalid or beyond the authority of the City of La Puente by a court of competent jurisdiction, such decisions shall not affect the validity or effectiveness of the remaining portions of this Interim Urgency Ordinance.
Section 9. Certification of Passage.
The City Clerk shall certify to the passage and adoption of this Interim Urgency Ordinance and shall cause the same to be published as required by law.
