AGENDA ITEM NO. D-2
To: Mayor and City Council For meeting of: May 13, 2025 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Rey Alfonso, City Engineer
SUBJECT: CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH NICHOLS CONSULTING ENGINEERS, CHTD TO UPDATE THE CITY’S PAVEMENT MANAGEMENT PROGRAM IN THE AMOUNT OF $24,980

BACKGROUND
A Pavement Management Program (“PMP”) provides public works decision makers with a systematic methodology for assessing pavement conditions, identifying and prioritizing pavement maintenance needs, and evaluating the cost-effectiveness of alternative maintenance and rehabilitation activities. A PMP is an inventory of all roads maintained by an agency and the current condition they are in. This inventory usually includes information such as the type of roadway surface, street length, date of previous resurfacing or slurry seal coating, etc., Once implemented, the PMP should be updated periodically to be an ongoing, effective management tool to guide future decision making.

DISCUSSION
A major emphasis of the PMP is to identify and evaluate pavement conditions and determine the causes of deterioration. A pavement evaluation system should be consistent, economical and easily repeatable. Typically, condition inventories are input, stored, and retrieved on a roadway segment basis. Segments are ideally defined as reasonably sized projects of about 1,000 feet to 1,500 feet in length. The full analysis produces an overall rating factor called the Pavement Condition Index (“PCI”) that ranges from zero (0) to one hundred (100), with one hundred being excellent condition.

The City’s roadway network consists of 75 centerline miles of streets and alleys. The City’s PMP was last updated in 2018 and determined that the City’s overall roadway PCI was 43, which was considered “poor” at the time. However since then, the Cty has invested heavily to improve the roadway conditions and completed several large-scale residential street improvement projects including 18 miles of pavement resurfacing (grind and overlay) and 27 miles of slurry seal.

PMP’s are typically updated every three years to meet LA County Metro Proposition C requirements. Unfortunately, there has been a lapse in updating the City’s PMP, this next PMP report will account for all the street improvement work completed since 2019 and provide a solid report of the progress made thus far to improve the City’s overall PCI and provide recommendations for future street maintenance and rehabilitation efforts.

AGENDA REPORT
Agenda Report – Pavement Management Program Update
For Meeting of: April 22, 2025

Page 2 ends

In order to expedite the PMP update, staff reached out to Nichols Consulting Engineers, CHTD (“NCE”) which is a highly recognized engineering and environmental services firm that specializes in pavement management, asset management, and civil and pavement design projects.

NCE has successfully prepared PMP reports for numerous Los Angeles County cities including:

Baldwin Park, West Covina, Whittier, Burbank, Carson, Downey, Bell, Redondo Beach, Santa Monica, and many others.

Pursuant to Section 2.20.090 of the City’s purchasing Ordinance, agreements for professional services can be executed without observing the City’s bidding procedures based on the determination by the City Manager. As stated in Section 2.20.020, the term “professional services” specifically includes the services of architects and engineers. The City Manager can make his determination based on any or all of the following: demonstrated competence, qualifications, experience, and knowledge of the City and reasonableness of cost to perform the services. Based on Staff’s review of NCE’s proposal, the costs are reasonable when compared to the services being provided and they are qualified to perform the services requested.

As such, staff was able to negotiate a cost proposal from NCE in the amount of $24,980 to bring La Puente’s PMP up to date.

FISCAL IMPACT
The Fiscal Year 2024-25 Annual Budget includes funding for this work from Measure M and Measure R funds.

There is no impact to the City’s General Fund associated with these services.

RECOMMENDATION
It is recommended that the City Council: (1) approve the Agreement with Nichols Consulting Engineers, CHTD to update the City’s Pavement Management Program in the amount of $24,980; and (2) authorize the City Manager to execute the Agreement on behalf of the City.

Primary/noncontributing. Coverage provided by Consultant shall be primary and any insurance or self-insurance procured or maintained by City shall not be required to contribute with it. The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on a primary and non-contributory basis for the benefit of City before the City’s own insurance or self-insurance shall be called upon to protect it as a named insured.

City’s rights of enforcement. In the event any policy of insurance required under this Agreement does not comply with these specifications or is canceled and not replaced, City has the right but not the duty to obtain the insurance it deems necessary and any premium paid by City will be promptly reimbursed by Consultant, or City will withhold amounts sufficient to pay premium from Consultant payments. In the alternative, City may cancel this Agreement.

Consultant hereby waives its own right of recovery against City, and shall require similar written express waivers and insurance clauses from each of its subconsultants.

Enforcement of contract provisions (non estoppel). Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to inform Consultant of non-compliance with any requirement imposes no additional obligations on the Agency nor does it waive any rights hereunder.

Requirements not limiting. Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Consultant maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained by the Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City.

Notice of cancellation. Consultant agrees to oblige its insurance agent or broker and insurers to provide to City with a thirty (30) day notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage.

Page 17 ends

Additional insured status. General liability policies shall provide or be endorsed to provide that City and its officers, officials, employees, and agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess liability policies.

Prohibition of undisclosed coverage limitations. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to City and approved of in writing.

Separation of Insureds. A severability of interests provision must apply for all additional insureds ensuring that Consultant’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the insurer’s limits of liability. The policy(ies) shall not contain any cross-liability exclusions.

Pass Through Clause. Consultant agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by Consultant, provide the same minimum insurance coverage and endorsements required of Consultant. Consultant agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. Consultant agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to City for review.

City’s right to revise specifications. The City reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the Consultant ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the Consultant, the City and Consultant may renegotiate Consultant’s compensation.

Self-insured retentions. Any self-insured retentions must be declared to and approved by the City. The City reserves the right to require that self-insured retentions be eliminated, lowered, or replaced by a deductible. Self-insurance will not be considered to comply with these specifications unless approved by the City.

Timely notice of claims. Consultant shall give the City prompt and timely notice of claims made or suits instituted that arise out of or result from Consultant’s performance under this Agreement, and that involve or may involve coverage under any of the required liability policies.

Additional insurance. Consultant shall also procure and maintain, at its own cost and expense, any additional kinds of insurance, which in its own judgment may be necessary for its proper protection and prosecution of the work.

AGENDA ITEM NO. D-5
To: Mayor and City Council For meeting of: May 13, 2025 From: Bob Lindsey, City Manager
By: John Di Mario, Development Services Director
Rey Alfonso, City Engineer
SUBJECT: CONSIDERATION OF ACCEPTANCE OF NOTICE OF COMPLETION FOR CITYWIDE SLURRY SEAL FY 2024-25

BACKGROUND
On November 12, 2024, the City Council awarded a construction contract to American Asphalt South, Inc. in the amount $335,376.05 to complete the Citywide Slurry Seal FY 2024-25 Project (“Project”). The award of contract included a ten percent (10%) contingency of $33,540 to cover the cost of any contract change order work approved by the City Manager.

DISCUSSION
On January 6, 2025, American Asphalt South commenced work on the Project and the Project was completed on February 28, 2025. The Project involved the application of a Type II slurry seal on 16 street segments Citywide, covering about 2.5 miles of pavement. The work included crack sealing, localized pavement repairs, and repainting of the pavement markings and street legends. In addition, a new cross-gutter on Waringwood Road at Rorimer Street was constructed to alleviate occasional downstream nuisance flooding on Inyo Street between Roxham Avenue and Banbridge Avenue.

The contractor’s bid price for this Project was $335,376.05. During construction, there were some minor bid item quantity adjustments that resulted in a net increase of $4,802.61, primarily due to the slight increase in the quantity of localized pavement repairs completed on the overall project.

There was one change order on the Project totaling $3,635.00 for additional traffic striping that included 25 mph speed limit pavement markings on Inyo Street and “Keep Clear” pavement markings on Temple Avenue at Gaylawn Court. The total construction cost for this Project was $343,813.66 which was 2.5% above the original contract amount, but well within the Project contingency.

FISCAL IMPACT
The Fiscal Year 24-25 Budget included $250,000 in RMRA/SB1 funds for Local Streets Slurry Seal and $500,000 in Measure W funds for the Inyo Street Storm Drain.

City of La Puente

AGENDA REPORT
Acceptance of NOC for Citywide Slurry Seal FY 24-25
For Meeting of: May 13, 2025

The original bid schedule for construction of this Project totaled $335,376.05. With the final cost for construction of $343,813.66 and actual cost of $41,920 for project management, construction observation and material testing, the total Project construction cost was $385,733.66. Therefore, the Project was completed within the budget and there was no impact on the City’s General Fund.

SUBJECT: CONSIDERATION OF CONTRACT CHANGE ORDER FOR THE OLD

VALLEY BOULEVARD SEWER EXTENSION PROJECT IN THE AMOUNT
OF $90,200.00

BACKGROUND
On March 11, 2025, the City Council awarded a construction contract to Excel Paving Company in the amount of $413,360 to complete the Old Valley Boulevard Sewer Extension Project. The award of contract also included a 10 percent contingency of $41,340 to cover the cost of any quantity adjustments and/or contract change order work.

DISCUSSION
The purpose of the Old Valley Boulevard Sewer Extension Project is to provide sewer service to the new kennel/dog park by extending the existing sewer main pipe approximately 960 feet easterly in Old Valley Boulevard to the project site at intersection with Valley Boulevard. The kennel/dog park facilities will include two new kennel buildings, an administrative office, two restroom buildings, food truck parking area, storage container, and Animal Control washing and storage port area which will all require connection to the sewer main line via a sewer lateral pipe system.

Construction of the Old Valley Sewer Extension began on April 14, 2025 and is nearing completion. During construction of sewer main line, Excel Paving excavated excessively wet soil which was tested and determined to be unsuitable for use as trench backfill material. To insure the long-term integrity of the sewer trench, Excel was directed to backfill the trench with a sand slurry mixture. The cost of the sand slurry backfill totaled $41,250 which was covered by the Project contingency.

At the time Excel Paving was awarded the construction contract, the sewer lateral pipe system was still in development and intended to be bid out as part of the overall kennel/dog park project. However, to take advantage of Excel Paving’s immediate availability to complete the sewer lateral work, Staff requested a cost proposal from Excel to complete the work as part of the Old Valley Sewer Extension Project.

Excel Paving has provided cost proposal in the amount of $82,000. The scope of work for the sewer lateral pipe system will include the installation of 684 linear feet of 4- and 6-inch sewer City of La Puente

AGENDA REPORT

Page 2 ends

pipe, and construction of 11 sewer clean-outs and two sewer dump stations for the food truck area. Willdan Engineering determined this to be a reasonable cost in comparison to unit bid pricing received on other sewer projects.

Since this additional work exceeds the original Project contingency, staff is requesting Council’s approval of a contract change order with Excel Paving in the amount of $82,000 plus a 10 percent contingency of $8,200. Upon the Council’s approval, Excel Paving is currently mobilized onsite and is ready to complete the sewer lateral work over the next few weeks.

FISCAL IMPACT
The Fiscal Year 2024-25 Capital Improvement Program Budget includes $549,700 in Sewer Funds for the Old Valley Boulevard Sewer Extension project as approved by City Council on March 11, 2025 under Resolution No. 25-594. The original Project contingency will be utilized for the sand slurry backfill of the sewer main line trench as discussed on page one of this report.

Since the change order amount for the sewer lateral work exceeds the remaining Project contingency, an additional allocation of $90,200, which includes the additional 10 percent contingency, is necessary to effectuate the change order. Funding for this change order is available from the Sewer Fund. Therefore, attached for the Council’s consideration is a budget amendment to fund this additional work.

There is no impact to the General Fund associated with this change order.

RECOMMENDATION
It is recommended that the City Council: (1) authorize the City Manager to execute a contract change order with Excel Paving Company in the amount of $90,200; and (2) adopt Resolution No. 25-5933 amending the Fiscal Year 2024-25 Capital Improvement Program Budget.

At the City Council meeting of April 9, 2019, the City Council approved Development Agreement No. 17-01 (“Development Agreement”) and other items related to the development of a 22-unit, three-story, attached condominium residential project at 135 and 145 1st Street, formerly the Star Theater site (“Property”).

The Development Agreement, as approved, was between the City and Star of La Puente, LLC (“Developer”). Pursuant to Section 7.11 of the Development Agreement, the Property and the rights and obligations of the Developer may be transferred or assigned by the Developer subject to an assignment and assumption agreement approved as to form by the City.

The Developer subsequently identified a purchaser of the property, Hacienda MBX Venture LLC (“HMBX Venture”) under the provisions of the Development Agreement. At the City Council meeting of July 9, 2019, the City Council approved the Consent to Assignment of Development Agreement to allow HMBX Venture to develop the Property per the Development Agreement.

The Development Agreement required the Developer to pay a public benefit fee to the City in the amount of $75,000.00. The payment of the fee was required to be paid prior to the issuance of building permits. Payment to the City was made in November 2020. The former La Puente Community Development Commission previously recorded a restrictive covenant on the Property, requiring the use and maintenance of 40 parking spaces on the Property for members of the public.

Following the payment of the public benefit fee, the City and Successor Agency to the La Puente Community Development Commission, will record a release of the restrictive covenant, thereby extinguishing the parking requirement.

Now that the project has been fully completed, it would be appropriate for the City to approve the Release of Covenant document provided as Attachment “A”.

RECOMMENDATION
It is recommended that the City Council approve the Release of Covenant for property located at 136, 138, 140, 142 Glendora Avenue, La Puente.

SUBJECT: CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH DRAKE TRAFFIC CONTROL SERVICES INC. FOR SPECIAL EVENT TRAFFIC CONTROL SERVICES IN THE AMOUNT OF $140,000.00

BACKGROUND
On April 11, 2025, the City issued a Notice Inviting Formal Bids for Traffic Control Services for the Fortunato Jimenez July 3rd Independence Day event (“Event”). The selected contractor will provide personnel, materials, and equipment to implement traffic control measures per approved plans.

Responsibilities include deploying message boards in advance, installing traffic control devices, managing road closures, and staffing closure points. The contractor must coordinate with law enforcement and City staff, ensure emergency access, monitor traffic conditions, respond to issues, remove all equipment promptly after the event, and evaluate the effectiveness of traffic operations to recommend future improvements.

Section 2.20.080(a) of the La Puente Municipal Code requires the purchasing officer to obtain quotes for purchases having an estimated value of $25,000.00 or more. In accordance with this provision, the City prepared and issued a Notice Inviting Bids for traffic management services related to traffic closures and detour implementation for the Event. Although several firms requested the bid package; only one firm submitted a proposal.

DISCUSSION
The bid opening took place on April 28, 2025, and the City received one (1) response. The results of the received proposal are as follows:

Drake Traffic Control Services: $33,360.00
Staff evaluated the proposal in relation to the Traffic Control and Detour Plan (Attachment "A").

Drake Traffic Control Services ("Drake") was determined to be the qualified consultant to provide these services to the City. Furthermore, Drake has successfully provided professional traffic control services for this Event since 2022 and brings extensive experience and knowledge to the role. Based on their proven expertise and familiarity with the Event, staff recommends awarding the contract to City of La Puente

AGENDA ITEM NO. E-1
To: Mayor and City Council For meeting of: May 13, 2025 From: Bob Lindsey, City Manager
By: Troy Grunklee, CPA, Director of Administrative Services SUBJECT: CONSIDERATION OF AMENDMENT NO. 2 TO THE SOLID WASTE

COLLECTION AND STREET SWEEPING SERVICES AGREEMENT WITH

VALLEY VISTA SERVICES TO UPDATE THE DISCOUNT PERCENTAGES FOR

THE SENIOR CITIZEN AND LOW-INCOME RATES

BACKGROUND/DISCUSSION
On January 8, 2019, the City restated an exclusive agreement with Valley Vista Services, Inc. (“VVS”) to provide solid waste and street sweeping services throughout the City (“Agreement”) and amended the Agreement to add an organics program and rate schedule to comply with the State-mandated requirements of AB 1826 and SB 1383. Per the Agreement, the City established limits on the rates VVS could charge its customers for solid waste services.

At the meeting of April 22, 2025, the City Council held a public hearing and received public input on the proposed rate increases from VVS and ultimately approved Resolution No. 25-5928. During the public input, several residents’ voiced concerns about the rate increase. Additionally, Dave Perez, VVS Vice President spoke regarding additional justification as to the reasons for the proposed increase. After the meeting and considering some of the public comments and concerns, City staff received communication from VVS proposing an increase to the senior discount percentages, which is currently set at 25% for a 70-gallon cart or 10% for a 96-gallon cart, as well as the low-income rates, which is currently at 50% on the trash component only.

The proposed percentage increase on the senior discount would go from 25% to 30% on the 70-gallon cart and from 10% to 15% on the 96-gallon cart. Similarly, the low-income discount would go from 50% to 55% on the trash component only.

City staff are recommending the City Council approve Amendment No. 2 to the Solid Wate Collection and Street Sweeping Services with VVS to update the percentage discounts available to senior citizens and low-income families.
