CITY OF LA VERNE
City Engineer
DATE: February 7,2022
Honorable Mayor and City Council
FROM: Cody A. Howing, City Engineer
SUBJECT Vacation of City of La Verne Water and Sewer Easements Located at 1520 and 1530 N. White Avenue and Setting Date and Time for a Public Hearing
TO
AGENDA MARY:

The property owner of 1520 and 1530 N. White Avenue has requested that the City vacate two water and sewer easements located on his properties. The water and sewer easements are no longer required for service for the properties. Future development of the properties has been proposed with water and sewer service by other means outside of the existing easements. Setting a public hearing and providing noticing will initiate the easement vacation process.

RECOMM DATION:

Staff recommends that the City Council approve Resolution No. 22-08, initiating procedures for vacating two water and sewer easements located on 1520 and 1530 N. White Avenue and setting a public hearing for the vacation on Monday, March 21, 2022, Council Meeting and direct the Assistant City Clerk to notice the meeting.

BACKGROUND:

The property located at 1510, 1520 and 1530 N. White Avenue has been proposed for redevelopment. The total area of the three parcels is approximately 3.95 acres and was previously the location of multiple commercial buildings that have since been demolished.

The proposed project includes merger of three parcels to form one. The improvements proposed include constructing four commercial units totaling approximately 83,000 square feet of mixed warehouse and office space with suirounding parking lot and landscape areas. At the October 27, 2021 meeting of the La Verne Planning Commission, conditional approval of the Precise Plan, Parcel Merger and a Variance for building height was granted.

Aftachments: City Council Resolution No. 22-08
Waier and Sewer Easement Location Exhibit
The two subject easements being considered for vacation can be generally described as both having a width of 10 feet and being situated on the westerlyand south easterly limits of the property at 1520 and 1530 N White Avenue. An exhibit depicting the limits of the easement is attached to this report for reference. currenfly, there is no longer a need for the public water main as located in the easeme;t. The future condition of the proposed project will obtain water service connections from the frontage along N. White Avenue. An existing sewer easement located on 1510 N. White-Avenue will be preserved. Given alternative service connection options and the conflicting location of the subject easements with the proposed improvements, the property owner has requested that the city vacate the easement.

Public Works has reviewed the existing utility easement and determined that the pioposeu vacation will not impact any-existing or Juture service for the area. lt snouU atso be noted that while the rights granted to the City for this easement in.trai ."*"r use, there is no indication based on available records that any public sewer main is located within this subject easement.

Honorable Mayor and City Council
Eric Scherer, AICP, Community Development Director
Community Development Block Grant Program tor 2022-2023 This is the 48th funding year for the community Development Block Grant Program. According to the Los Angeles Co-unty COSG Bulletin, the City of La Verne will be allocated approximately $15O,OOO in Cbmmunity Development Block Grant (CDBG) funds.

The Community Development Department recommends the following allocation of lhe 2022- 2023 Communiiy Development Block Grant (CDBG) funds as follows:
2022-2023 GDBG Allocation $150,000
Senior Hot Lunch

$ 30.000
$ 58.000
Unallocated: $ 62,000
This recommendation is made after consideration of the federal allocation requirements and the desire to continue the existing public service program. The Community Development Department further recommends lnai ttre City Council qpprove Resolution No. 22-09, approving p"rti.ip"ti"n in lhe 2022-23 Community Development Block Grant Program with the County of Los Angeles.

for the full 20o/o, by funding the full amount of $30,000 to the Senior Lunch Program, it allows staff time ($7,000) to be billed to the projecf to successfully operate of the program.

As identified in previous years, due to expanding regulatory criteria, it is difficult for La Verne to find programs that will be deemed eligible, e.g. meeting the national objective of assisting loMmoderate income persons.

One main challenge is the fact that there are no longer Census blocks within the city that qualify as 517o low/mod. This finding prohibits creating any programs that would qualify as having an area wide benefit within the community such as park improvements, street or alley improvements and public facility improvements. To qualify, programs would have to be restricted to "limited clientele" (elderly, abused, handicapped, low income) and of these programs the City can only designate 20% of their allocation for public service programs. The bity is required to fund programs with a minimum of 70% of the total City allocation benefiting low/moderate income persons.

Additionally, the City can no longer do public improvement projec{s due to the new HUD regulation that requires the re-certification of slum/ blight areas. HUD has determined that reievelopment areas designated more than ten years prior must be re-designated before any funds can be expended.

The following are proposed for City Council consideratSon:

This year, staff recommends that the Senior Hot Lunch Program, which has beei funded for the past ieveral years, be continued and funded a total of $23,000 with an additional $7.,000 to cover the administrative costs. Staff cannot recommend funding or the creation of any additional new public service programs due to the limited funds available. Based on the current year allocation, the maximum amount that can be used for public service programs is $30'000.

SIDEWALK REPAIRS
ln previous years, with the exception of the last year, due to the funding being r^e_1llocated to the Business Gjrant Assistance Piogram, the City Council typically allocates $58,000,. for the sidewalk repair program that would provide for removal of architectural barriers on damaged sidewalks fbr appr&imately 30 locitions throughout the City. Staff is asking that the City Council approve ihese funds with $8,000 allocated towards the administrative costs associated with the project.

F
Staff is continuing to work with the Community Development Commission to allocate the remaining portion ($62,000) of the grant to benefit the City of La Verne' Respectfully submifted by: Candice Bowcock. Principal Planner Attachments: Resolution No. 22-09

Dear Mrs. Carder,
I came across an article about the CIIAIR OF HONOR, remembering over 82,000 service members who have not retumed home and are listed as POW or MIA. This chair serves as a reminder of all the sacrifices made for our country by these American servicemen, who have for too long been forgotten by all but their families and friends. In Pennsylvania at professional sports stadiums and City Hall they have been dedicating these chairs of Honor for remembrance for all to see who enter those places.

I feel this would be an Honor for City Hall of La Verne to place such a Chair of Honor in their building. I would love for you to present this to the Council Members for consideration.
