7. PUBLIC HEARINGS

Weed Abatement Protest Hearing - On February 7, 2022, the City Council adopted Resolution No. 22-07, accepting the Declaration List of Properties which has been found by inspections to have growing upon them weeds or brush and/or rubbish. Pursuant to the County of Los Angeles, Department of Agricultural Commissioner and Weights and Measures, these conditions constitute a public nuisance and must be abated. Notices to destroy weeds were mailed to property owners notifying them of a hazard or public nuisance upon their property and that it must be abated.

That notice set Tuesday, February 22, 2022 at 6:30 pm, as the date and time for protests to be heard from affected property owners. The Annual Weed Abatement notice further required that owners of the declared properties must maintain their parcels in a fire-safe condition throughout the year. (Council Member Carder will declare a conflict of interest because she is a member of the Board of Directors for a homeowners’ association that oversees property appearing on the weed abatement list.)

STAFF RECOMMENATION: Following the protest hearing, the City Council should direct the Los Angeles County Agricultural Commissioner/Director of Weights & Measures to abate the nuisance by having
weeds, rubbish, and refuse removed.

She had three older sisters and one brother. She married Har old Devine on February 2, 1940 and t hey had four children: They started their family in Kansas City but then moved to California. They lived and raised their children in El Monte where they had horses and chickens, and ultimately built apartments that they owned and managed. In 1992, after 52 wonderful years of marriage, Harold passed away. At this time, Frances spent much of her time volunteering at the La Verne Community Center and City Hall. She loved working for the City and treated it as a job. She was devoted and dedicated; this is where she felt a sense of purpose, and she felt loved by everyone she worked with. Frances began volunteering daily with the Senior Nutrition Program, serving lunch and registering participants. From there she helped at the Community Center and City Hall with answering p hones, filing, and making copies. She also volunteered on special events that include: Senior Dances, 4th of July Country Fair, Winter Wonderland (serving as Mrs.

Claus), Flu Shot Clinic, and the most rewarding to her, Inclusion Dances. If the City needed help, Frances or “Saint Frances” as we commonly referred to her as, was there without hesitation. Over the past two years, Frances missed being at the Center but loved to tell stories about all of her experiences. She had many fond memories, but two of th e most important were when she was named Volunteer of the Year and honored with being the Grand Marshall of the 4th of July Parade. She lived a very full and happy life. She is known for saying what was on her mind, for being strong, and for her entertaini ng sense of humor. She was loved and will be missed’.

This project is also one component of a long-term effort by both cities to make Arrow Highway a multimodal street with more pedestrian and bicycle activity. By changing the overall aesthetic of these neighborhoods, which contain residential, commercial, and recreation land uses, _ residentsivill be more willing to walk to their destinations and not rely on their vehicles. The improvement of air quality and a reduced urban heat island will encourage those who were unwilling, or unable (dueio asthmatic or heat sensitive medical conditions) to walk or bicycle from thjii neighborh;od to local resources. Additionally, the project will enhance the connection to tne L Une [formally the Gold Line) light rail stations and higher density development planned along the roadway.

Weed Abatement Protest Hearing
TO:

SUMMARY:

On February 7,2022, the City Council adopted Resolution No.22-07, accepting the Declaration List of Properties which has been found by inspections to have growing upon them weeds or brush and/or rubbish. Pursuant to the County of Los Angeles, Department of Agricultura! Commissioner and Weights and Measures, these conditions constitute a public nuisance and must be abated. Notices to destroy weeds were mailed to property owners notifying them of ahazard or public nuisance upon their property and that it must be abated. That notice set Tuesday, February 22,2022 at 6:30 pm, as the date and time for protests to be heard from affected property owners.

The Annual Weed Abatement notice further required that owners of the declared properties must maintain their parcels in a fire-safe condition throughout the year. (Mayor Pro Tem Carder wilt dectare a conflict of interest because she ts a member of the Board of Directors for a homeowners' assoctation that oversees property appearing on the weed abatement list.)
Following the protest hearing, the City Council should direct the Los Angeles County Agricultuial Commissioner/Director of Weights & Measures to abate the nuisance by having weeds, rubbish, and refuse removed.

SUBJEGT: American Recovery Plan Act - Business Assistance Program At their December 6, 202'l meeting the City Council was provided with an outline on the City's allocation of American Rescue Plan Act (ARPA) funds and preliminary plan for their use. One of the proposed uses supported by Council was creation of a Business Assistance Program. As a result of that action, staff has been working with the Chamber of Commerce and the Small Business Development Center at ULV to develop a program.
'it
It is recommended that the City Council:

1. Approve the Business Assistance Program as outlined in the attached; and

2. Authorize staff to execute the agreements for administration of the program to be coordinated jointly by the La Verne Chamber of Commerce and SBDC; and

3. Authorize the use of $1,070,000 of the City's ARPA allocation to fund the grants and costs for administration of the program; and

4. Authorize the Finance Director to issue grants to businesses as approved under the criteria.

Through the Federal Government's American Rescue Plan Act (ARPA) the City is expected to receive $7.6 million in funding. As outlined during the December 6th study session, based on preliminary rules, there were a variety of areas identmed for the City's use of these funds. One such use was to support a business assistance and recovery program. ln staff's preliminary proposal, gl million was identified for this effort. lt is believed that providing economic assistance to businesses that suffered financial losses as a result of the pandemic was a priority in helping them begin the process of returning to normal operations. While the specifics of the 44 February 22, 2022, City Council Meeting
Page No. 37
program were not identified during the study session, Council supported the concept and directed staff to come back with greater details for their review and approval.

Additionally, during that presentation staff reported preliminary conversations had been held with area community banks about administering the program with the Chamber and the SBDC providing advertising and other general applicant support. Afrer further review, it was determined that through a collaborative effort, the Chamber and SBDC had the ability to handle the complete administration of the program including advertising, processing of applications, assistance with application submission, record keeping, and monitoring businesses for compliance. This arrangement would ultimately lessen the administrative cost of the program resulting in more funds being available for local businesses. ln 2020 a business assistance grant program was provided through the City's local allocation of Community Development Block Grant (CDBG) funds. That program yielded the issuance of 38 grants at a maximum of $5,000. The key difference between the 2020 program and this proposal is centered on the reporting requirements of the funds. Under CDBG it was necessary for the distribution of funds to be justified by the business owner providing record proof of having/retaining a low/mod waged employee on staff, which created extensive reporting requirements for businesses and created baniers for some to apply. Since the ARPA funds provide much more discretion, the City has more flexibility on what is needed to justify a business's eligibility. Based on conversation with SBDC, the Chamber and local businesses, it is the collective opinion this program will be much more attractive and will yield higher disbursement of funds than the prior grant program.

The administration of this program has been designed with the Chamber of Commerce and SBDC with the focus on streamlining the application and reporting process, a robust outreach effort, and maximizing the amount of funds that will be issued to the businesses. To achieve that, SBDC and the Chamber submitted a joint proposal to handle administration of the program (Attachment A). The only responsibility of the City will be to confirm a business's eligibility, issue the checks, and future reporting to the Department of Treasury.

Outline of Program
Attachment B contains the comprehensive details of the Busindss Assistance Program as well as a draft application. Following are the major conditions of the program. o Must be a for-profit business and physically tocated in a commercial or industrial space in the City. . Chamber membership is not required.
o Residential or real estate projecls, short-term rental operators, landlords or home occupation businesses are not eligible.
o Must have a business license since March 2019; or bring existing current. 45 February 22, 2022, City Council Meeting
Page No. 38
. Must have 1 to 25, full-time equivalent employees (two part-time employees equal one full-time). . Be in good standing with the City (currently no violations, and in compliance with Municipal Code.) . Experienced mandatory shutdown or substantial change in business operations. o Be able to document financial hardship due to COVID-19 (i.e. total revenue from the 2020 calendar year was down in comparison to revenue from the 2019 calendar year') . lf an application was submitted under the City's 2020 assistance program, that application and documentation requirements must be in completed status. . lf grant funds are used for revenue replacement, amount cannot exceed the amount of lost revenue.
. Expenses are considered necessary economic support in connection with the COVID-19 emergency, were incurred after April 1, 2020, and were not recovered through any other progrims ii.e. CARES Act, State unemployment funds, CDBG.) Example of eligible expenses are, but- not iimited to: RenUMortgage Expenses, Utilities, Payroll, Hiring Bonus, Fagade lmprovements, Personal Proteciiva Equipment (PPE), enhanced outdoor operations, and Employee Handbook UPdates.
. Funds must be expended by June 2023. Any portion of the grant funds not expended on eligible expenses shall be returned to the City by no later than December 30, 2023.

Timeline/Process - Once Council has approved the program, staff will work with the Chamber to finalize the application and program guidelines, with the intent of opening the application window on May 1,2022. Once SBDC has begun promotion of the program, the Chamber will review applications on a first-come-first-serve basis. As the Chamber confirms an applicant meets the eligibility criteria and all required documentation has been provided, the business will be notified of their "preliminary approval" and provided a Grant Agreement acknowledging they are subject to repayment of the grant should they not comply, with approved use of funds. Upon receipt of that executed agreement, the Chamber will submit the completed application to the City for confirmation of eligibility and issuance of a check in conjunction with Finance's normal check warrant schedule. Provided all information is submitted in a timely manner, estimated timeframe from application submission to check issuance would be 4s-days or less.

Fiscal lmpacts - The City designated $1,0OO,OOO of its ARPA allocation for this program. With a maximum grant amount of $'t O,OOO per business, at lea-st 100 businesses will able to receive assistance. Additionally, the proposal by the SBDC and the Chamber to administer the program will total $70,000. considering this, the total approprlation required from the ARPA funds is $1,070,000 to support these anticipated expenses of the program which will be incorporated as part of the mid-year adjustments. ln the event there are funds remaining at the end of the application period (June 30, 2023) the unused portion will be returned to the City's ARPA fund for reallocation to other programs. 46 February 22, 2022, City Council Meeting

The application will be submitted to the La Verne Chamber of Commerce who will conduct an initial review to ensure completeness of the application and documentation and to verify a negative financial impact has been experienced. Upon pre-approval by the Chamber, the application packet will be forwarded to the City's Community Development Department for concurrence with Chamber's recommendation.

The City of La Verne is expecting the Small Business Rescue Grant Program to have an overwhelming number of applications. lf the number of applications exceeds the amount of funding that is available for disbursement, the Chamberwill stop receiving applications until the first submitted applications have been reviewed and decided upon. lf funds still remain available, they may open a phase 2 period to accept additional applications.

Approval and Grant Disbursement
As each business recipient submits a complete set of required documentation, it will be reviewed and verified. Business will be required to sign a Grant Agreement acknowledging and agreeing to comply with the grant terms; funds will then be disbursed to the approved individual business. The City will award grant funds in a single disbursement. All grant funds shall be expended on eligible expenses within 12 months of the effective date of Grant Agreement or by June 30,2023, whichever occurs first. Any portion of the grant funds not expended on eligible expenses shall be returned to the City by no later than December 31, 2023.

Grant Report
Eligible expenses are considered necessary expenditures that provide economic support in connection with the COVID-19 public health emergency, and they were incurred during the period that begins on April 1,2020, and ends twelve months after the effective date of the Grant Agreement or by June 30, 2023 whichever is sooner. ln the event a business does not expend the entire grant amount, the business will be required to return the remaining balance by the thirteenth month after the effective date of the Grant Agreement or by December 31, 2023, whichever is sooner.

The business recipient will provide a Grant Report to the City once all funds are expended, providing documentation that funds were spent in compliance with the Spending Plan. The City will evaluate the business's compliance with the Grant program. lf it is determined the business did not expend the funds consistent with the Spending Plan/Eligible Activities, it may constitute an Event of Default under the Grant Agreement.

Post Grant Follow Up
ln the twelve months following execution of the Grant Agreement, information may be requested from each grantee. If contacted by the City or La Verne Chamber of Commerce, all 5lPage

awardees will be required to provide an update on their business and if additional employees have been hired or employees retained. The City of La Verne will create a twelve-month report to document the success of the program.

d. Staff recommends approval and passage of the following Resolutions:

Resolution No. 22-10 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

LA VERNE, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING AN

AGREEMENT WITH THE CITY OF POMONA FOR ARROW HIGHWAY MEDIAN IMPROVEMENTS - Approval of an agreement with the City of Pomona (Attachment No. 1) which will result in median landscape/irrigation improvements in the existing medians along Arrow Highway, from White Avenue in La Verne to Garey Avenue in Pomona, to be funded by the California Natural Resources Agency (CRNA) Urban Greening Program grant funds.

Public Works Director Igoe recommends that the City Council adopt Resolution No. 22- 10, approving an agreement with the City of Pomona for median landscape/irrigation improvements and project management on Arrow Highway from White Avenue in La Verne to Garey Avenue in Pomona; and authorize the City Manager, or designee, to approve the agreement and any extensions/amendments on behalf of the City.

American Recovery Plan Act - Business Assistance Program - At their December 6, 2021, meeting the City Council was provided with an outline on the City’s allocation of American Rescue Plan Act (ARPA) funds and preliminary plan for their use. 12. Adjournment in memory of Frances (“Saint Frances”) Louise Divine who passed away on February 4, 2022, at the age of 101. Frances was born in Kansas City, Kansas. She had three older sisters and one brother. She married Harold Devine on February 2, 1940 and they had four children: They started their family in Kansas City but then moved to California. They lived and raised their children in El Monte where they had horses and chickens, and ultimately built apartments that they owned and managed. In 1992, after 52 wonderful years of marriage, Harold passed away. At that time, Frances spent much of her time volunteering at the La Verne Community Center and City Hall. She loved working for the City and treated it as a job. She was devoted and dedicated; this is where she felt a sense of purpose, and she felt loved by everyone she worked with. Frances began volunteering daily with the Senior Nutrition Program, serving lunch and registering participants. From there she helped at the Community Center and City Hall with answering phones, filing, and making copies.

She had many fond memories, but two of the most important were when she was named Volunteer of the Year and honored with being the Grand Marshall of the 4th of July Parade. She lived a very full and happy life. She is known for saying what was on her mind, for being strong, and for her entertaining sense of humor. She was loved and will be missed’.
