Robert Russi, City Manager
SUBJECT: Reconsideration of ULV/SBDC and Chamber of Commerce Business Grant Proposal
After the Council's February 22 action it was determined that based on the structure of how the Small Business Development Center is operated out of University of La Verne (ULV) and Council Member Lau,s position on the ULV Board of Trustees, that out of an abundance of caution that the proposal for the SBDC and Chamber to administer the grant program be brought back for approval with Council Member Lau recusing herself from the vote.

It is recommended that the City Council reapprove the proposal as submitted.

After the action was taken by the Council for administration of the Business grant program staff was made aware that the SBDC representative is actually an employee of ULV. Although the Small Business Development Center has operated out of the University of La Verne since 2014 the structure for this is the University receives annual grants from the Small Business Administration and the Governor's ffice of Business & Economic Development which funds the position and associated expenses. Although the funds generated through the business grant proposal will be earmarked for further activities of the SBDC, given the structure of this relationship it was recommended by the City Attorney that out of an abundance of caution the action be reconsidered, with Council Member Lau recusing herself due to her position on the University's Board of Trustees' C:\Users\lestrella\Desktop\Scanned Documentswarch 7, 2022\cC Rpt-SBDc Proposal (2) doc 30 March 7, 2022, City Council Meeting

CITY OF LA VERNE
City Managels Olfice
DATE: March7,2022
TO: MaYor & CitY Council
FROM: JR Ranells, Assistant to the City Manager
Marla Pendleton, Director of Finance
suBJECT: American Recovery Plan Act - Essential worker Premium Pay Stipends Sum n
At their December meeting the city council was presented with an outline of the city's allocation of American Rescue Plan Act (ARPA) funds and a preliminary plan for their use' ln addition to giving concurrence to the proposed uses, the city council directed staff to bring back an outline of a stipend for employees for their consideration. After researching the provisions of the Act and what other agencies are providing, staff has prepared a set of criteria that was reviewed by the city council at their January 18 meeting. That plan was shared with the affected employees and their associations' ln order to implement the stipends, final approval by City Council is necessary' Recommendation
It is recommended that the City Council:

1. Approve the ARPA Premium Stipend program;

2. Authorize staff to execute side letters with represented employee groups;

3. Appropriate $520,000 from the City's ARPA allocation; and

4.AuthorizetheFinanceDepartmenttoissuestipendsasprovidedundertheoutlined criteria.

Backoround
Through the Federal covernment's American Rescue Plan Act (ARPA) the city will receive $7'6 million in funding. As outlined during the December 6, 2021 study session, based on the preliminary rules, there were a variety of areas identified of how the funds could be spent, including: business grants, housing rehabilitation, homeless engagement, and funding for previously approved capital improvementprojects.oneareaofpermittedUsethatwasnotproposedduringthatpresentationwas a premium pay for essential workers'
After some discussion, the council expressed a desire to recognize the organization's workforce for their individual efforts in ensuring that the myriad of municipal services provided to our residents were 40 March 7, 2022, City Council Meeting

continued with minimal disruption during the pandemic. As such, it was requested that a set of criteria be developed that would allow employees to receive a onetime stipend as provided under the Act. Based on that direction, staff has reviewed the ARPA language, surveyed neighboring cities on stipends provided, developed criteria for eligibility, and calculated an estimate of potential cost' on January ,18, and February 22,lhe city council met in closed session to give direction to staff on the stipend criteria and amount to be provided. During those discussions, the following criteria and amount was the direction of Council. Additionally, staff met with all employees and respective associations to explain the criteria, and process for implementation. Per state law, in order to provide added benefits to represented groups the city must execute an amendment to their Memorandums of understanding (MOUS), which is being done by way of side letters' As such, associated to this action' staff is requesting authority to execute letters with each of the respective represented employee groups in order to provide the stipends to all represented and unrepresented classifications' Proposed criteria - lt was decided that two tiers of stipend should be provided A full stipend ($3,OOO) that will be provided based on the criteria outlined below, and a partial amount ($1 '500) for those employees that do not meet the higher standard but still played an integral role in the city's response during the pandemic. ln either case, the stipends will be reported as special compensation and will be subject to the taxes but not reported as compensation within the retirement system' Full ioend-Amountoffullstipend$3,000,willbeprovidedtothosewhomeetthefollowing:

Partial stipend - Recognizing there were individuals outside of the above criteria that still had an instrumental role in the city's ability to manage through challenges that we faced during the pandemic, it is believed they should also be provided some amount of stipend Therefore' individuals that meet the following will receive a stipend in the amount of $1'500' -lndividualmustbeemployedwiththecityattimeofStipenddisbursement' 41 March 7, 2022, City Council Meeting

- Full-time employees that worked less than the required hours during the 1s-month period. - part-time employees that worked an average ol 15 lo 24 hours per month during the 15- month Period.
public Safety Employees - ln consideration of the contributions other agencies with public safety operations have provided their employees, in addition to the above amounts, sworn personnel will be provided an additional $1,000 or $500. The amount provided will be dependent on the individual's eligibility above.

Fiscal lmpacts - Based on the outlined criteria and the number of employees that meet the requirements according to payroll records, the estimated cost to fund all stipends is valued at $520,000.

To accommodate the added expense, it is suggested that ARPA funds be redirected as follows: 'l) reduce funds for water lnfrastructure projects by $35O,OOO (cost of meter automation is less than originally reported); 2) reduce $75,OOO from administration of Business Assistance Program (chamber/SBDC proposal is less than originally reported); any remaining amount needed will be taken equally from upgrade to outdoor facilities, housing rehab, and homeless engagement activities' 42 March 7, 2022, City Council Meeting
