Wilderness Plan Public Hearing Principal Planner Bowcock reported on the Wilderness Plan along with a power point presentation. She stated that in 2006, the City acquired 208 acres in north La Verne through State grant funds obtained in cooperation with the County of Los Angeles, the Trust for Public Land, and the La Verne Land Conservancy. This land was combined with 150 acres already owned by the City to create an open space preserve of 358 acres, collectively referred to as the Wilderness Area. The Wilderness Area Management and Public Access Plan includes selective habitat enhancement actions, the resolution of public safety hazards, and opportunities for limited controlled public access as part of the City’s stewardship responsibilities for the Wilderness Area. The Management Plan includes goals for specific physical improvements or management policies that would implement the vision for the Wilderness Area.

She stated that there are two phases being proposed. Phase 1 consists of maintenance, security, fuel modification, planting, and protecting the wilderness area. Phase 2 includes the development of the loop trails and the increase of public access to the area. Conditions were also added that if there is ever a desire for Phase 2 to move forward, an update to the Environmental Impact Report (as necessary), a public workshop, and City Council approval would be required prior to implementation. This will ensure that Phase 2 will only move forward with proper notification to the residents and ultimately a vote of the City Council. Staff and the Planning Commission recommend City Council adopt Resolution Number 22-72, approving the Wilderness Area Management and Public Access Plan and certifying the Final Environmental Impact Report.

Mayor Hepburn opened the public hearing and called for public comment on this matter.

Several residents expressed their concerns and objections to the proposed loop trail and increased public access, fire hazard, homeless living in the area, and public safety. (To hear what was said during public comment, please visit the City’s website to view the archived Council meeting.)

Special Counsel Barbara Leibold stated that the Wilderness Conservation grant terms requires that the wilderness area be managed for the purpose of wildlife habitat preservation and other conditions

It was moved by Crosby and seconded by Kashifalghita, and unanimously carried to adopt Resolution Number 22-72, approving the Wilderness Area Management and Public Access Plan and certifying the Final Environmental Impact Report.

Assistant City Manager Ranells reported on the Agreement for temporary employment with Anthony Ciotti. ATTACHMENT A

CONSULTANTS

Commission Regulation 18700 defines “consultant” as an individual who, pursuant to a contract with a state or local government agency:

(A) Makes a governmental decision whether to:

(i) Approve a rate, rule, or regulation;
(ii) Adopt or enforce a law;
(iii) Issue, deny, suspend, or revoke any permit, license, application, certificate, approval, order or similar authorization or entitlement; (iv) Authorize the agency to enter into, modify, or renew a contract provided it is the type of contract which requires agency approval;
(v) Grant agency approval to a contract which requires agency approval and in which the agency is a party or to the specifications for such a contract; (vi) Grant agency approval to a plan, design, report, study, or similar item; (vii) Adopt or grant agency approval of, policies, standards, or guidelines for the agency, or for any subdivision thereof; or

(B) Serves in a staff capacity with the agency and in that capacity performs the same or substantially all the same duties for the agency what would otherwise be performed by an individual holding a position specified in the agency’s Conflict of Interest Code.

The Commission realizes that not all consultants participate in the making of decisions on behalf of public agencies and rather than amend your code each time you retain a consultant that is in a decision-making capacity, you may use a specialized disclosure category which provides that the disclosure required of consultant shall be determined on a case-by-case basis by the City Manager. The City Manager may make a determination as to what disclosure, if any, is required or any particular consultant.

This consultant disclosure category should be part of the code. You should add the position “consultant” as a designated position in the appendix of the code with a footnote as shown in the following example:

*Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in the code subject to the following limitation:

The City Manager may determine in writing that a particular consultant, although a “ designated position”, is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with the disclosure requirements descr ibed in this section. Such written determination shall include a description of the consul tant’s duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager or executive officer’s determination is a pu blic record and shall be retained for public inspection in the same manner and location as t his Conflict of Interest Code.

A
t the City Council meeting, held on February 22, 2022, staff presented the Small Business Rescue Program using a portion of the City's allocation of the American Rescue Plan Act (ARPA) funds. The program has been operating successfully since March of 2022 and has assisted over 61 businesses . Staff has been working with the Chamber of Commerce and the Small Business Development Center (SBDC) at University of La Verne (ULV) to develop an update to the program. There is also a need to redirect the remaining funds to Fire Station 1 Gender Compliance Project Recommendation
S
taff recommends that the City Council approve the update to the Small Business Rescue Program including:
 T
he business must have been mandated to shut down during the COVID -19 pandemic.
 The business has a minimum of at least one employee and does not exceed a maximum of fifty (50) full or full -time equivalent employees (two part -time employees equal one full-time employee).
 The number of additional grant participants will be limited to the amount of funding (up to $100,000) allocated to the program.
 The business must submit the application, and all required supporting documentation on or before December 1, 2022.

S
taff is also recommending that the City Council approve the reallocation of the remaining unused Small Business Rescue Program ARPA funds (about $300,000), after the close of the program on December 1, 2002, to the Fire Station 1 Gender Compliance project.

Small Business Rescue Program Update
October 3, 2022

Page 2 ends

Background

At the meeting, on February 22, 2022, the City Council approved the allocation of one million dollars to the Small Business Rescue Program , using a portion of the City's allocation of the American Rescue Plan Act (ARPA) funds. The Small Business Rescue Program has been operating successfully since March of 2022 and has assisted over 61 businesses. A total amount of $ 599,339.51 has been spent to date. This leaves a balance of $400,660.49 left unspent. The number of applications being submitted has drastically diminished, due to most of the businesses , that suffered a loss in the City of La Verne, having been assisted with grant funds. Staff has been working with the Chamber of Commerce and SBDC at ULV to develop an update to the program. The Chamber has advertised on multiple platforms to businesses and have even reaching out to businesses personally to be sure everyone who may need help, has been notified.

Therefore, staff and the La Verne Chamber of Commerce are asking the City Council to approve changes to the guidelines to spend up to another $100,000 on an expanded program. The changes that are being proposed require that the business applying for the grant would have to have been mandated to shut down during t he COVID-19 pandemic, have a minimum of at least one employee, does not exceed a maximum of fifty (50) full or full -time equivalent employees (two part -time employees equal one full -time employee), and submit the application on or before December 1, 2022. Staff is requesting to cap the total grants for the program at $100,000, at a maximum of $10,000 grants for each qualifying business. The revised (red line) version of the guidelines can be reviewed in more detail in Attachment A.

Due to the slowing of the Small Business Rescue Program , staff is asking that the City Council consider redirect ing the remaining funding (about $300,000) to fund another, very urgent and important project, to ensure the ARPA money is spent before the deadline of December 31, 2024.

Fire Chief Chris Nigg became aware of a lack of gender compliance at Fire Station 1 immediately after his appointment and has sought to rectify the deficiency as soon as possible. As the fire service continues to expand its diversity, equity, and incl usion, it remains a top priority for the La Verne Fire Department to ensure that they are prepared for anyone seeking to join the ranks. Further, OSHA gender compliance requires gender separated bathrooms. Currently, Fire Station 1, which also serves as the City’s Emergency Operations Center (EOC), does not provide restroom equality for Fire Department personnel, anyone utilizing the EOC for training, or during exigent times need. Having just hired the department’s first full time female, this is an urgent matter that needs to be addressed immediately.

The Community Development Department originally contacted the Los Angeles County Development Authority (LACDA) about using Community Development Block Grant (CDBG) funds to fund the Fire Station 1 Gender Compliance Project, however after months of work, the LACDA ultimately denied the project. This left staff urgently look ing for funding elsewhere, considering the lack of OSHA gender complaint bathrooms and dorm area privacy , leaves the City vulnerable to liability and lack of equality for all who use the facility.

As part of the project, this will also open up the opportuning to construct a much needed workspace for the new Deputy Fire Chief. The Deputy Fire Chie f will be heavily administrative and tasked with the daily operational oversight of the department. Fire administration is unable to accommodate the Deputy Chief and does not have an office for this new member of the team. While incorporating gender compliance and dorm privacy, opportunity has also been identified to add a Captain’s workspace among the upstairs crew quarters. Doing so would provide an office for the Deputy Chief and create a true administrative environment encompassing only management staff.

If the City Council approves this projected transfer of funds (about $300,000) to the Fire Station 1 Gender Compliance Project, that project will return to the City Council at a later date for review, as well as the potential need for any additional supplemental funding.

Program Overview
About the Program
The City of La Verne has created a Small Business Rescue Grant Program, which will provide funding to small businesses needing financial assistance in overcoming the temporary loss of revenue due to the COVID-19 pandemic. All eligible businesses are invited to apply.

Businesses which have previously received alternative sources of funding such as the Economic Injury Disaster Loan (EIDL) or Paycheck Protection Program (PPP) Loan are eligible to apply. The program is based on the availability of funds, program guidelines and submission of all required information and supporting documentation. Small businesses, that were mandated to shut down during the COVID-19 pandemic, with a minimum of one (1) employee and a maximum of twenty-fivefifty (5025) employees (full or full-time equivalent combination) may be eligible to receive a working capital grant in an amount of five thousand dollars ($5,000) up to ten thousand dollars ($10,000). The grant is intended to mitigate financial hardships resulting from the COVID-19 public health emergency; eligible uses include working capital to cover the day-to-day business operating expenses such as rent/lease payments, mortgage payments, payroll and benefit costs, utility expenses, or expenses related to COVID- 19 such as Personal Protection Equipment (PPE) or expenses incurred to adopt safer operating procedures.

In May 2021, the U.S. Department of Treasury allocated funds from the American Rescue Plan Act of 2021 (ARPA) to the City of La Verne for COVID-19 response, relief, and reinvestment.

The City is allocating $100,000 up to one million dollars ($1,000,000) for the La Verne Small Business Rescue Grant Program. These funds are to be used to mitigate financial hardship caused by declines in revenues due to the COVID-19 public health emergency.

The City’s Economic Development Division will be responsible for oversight of the La Verne Small Business Rescue Grant Program and disbursement of funds will take place through the City’s Finance Department. The City’s Program Partner, the La Verne Chamber of Commerce (the Chamber) will be responsible for program marketing, initial review to ensure application is completed correctly with all appropriate documentation received. The City Manager will complete the underwriting and be responsible for review of financial and business documentation for grant approval. City staff is obligated to fulfill the terms and conditions of the funds as established by the City Council, these program guidelines, and Federal, State, and local rules and regulations. Business will be required to sign a Grant Agreement acknowledging and agreeing to comply with the grant terms; funds will then be disbursed to the approved individual business. The City will award grant funds in a single disbursement. All grant funds shall be expended on eligible expenses within 12 months of the effective date of Grant Agreement or by June 30, 2023, whichever occurs first.
